I went thru the Embassy in Manila, Philippines. there, if the child is accompaning the mother to the USA, the child must also be at the interview. the child would also have to have a medical. you did the right thing by preparing separate DS forms for the child. you mentioned the daughter's name was included in the original I-129f, that's good. you might want to call the Embassy to verify they have the daughter in their system.

For the I-129f petition, emails and phone records are not important. you'll use those when it comes time for the interview to show ongoing relationship. for the petition you need to show you met in the previous two years. I submitted 8 photos with my petition. also include evidence like airline tickets, boarding passes, hotel receipts, passport stamps , etc... with your petition.

yuor timeline says it left NVC Jan 10th. It could be at the Embassy already. if you know your case number MNL2007XXXXXX, you can call the Embassy at 011-63-2-528-6300 ext 5184 to check if they have it. it takes about 4 months from date petition is received at the Embassy till the interview date. you wont receive the packet till after you are scheduled an interview. I'd say you are looking at a May interview date. it probably wont be till middle of March to know your interview date. I suggest you check out the Manila Embassy Thread in the Embassy forum.

To enter on the K-1, she has to be free to marry. She's not free to marry if she's already married, even if that marriage is to you. So, no legal wedding; even a non-binding ceremony can be problematic when it comes time to adjust status, or to enter (if the officer thinks she's married, he won't let her in.)

I'm also guessing that this dilemma hasn't arisen because her family wants to throw a party, but because her family is uncomfortable with sending off their good Catholic daughter to America to live with a man she's not married to.

A couple of options that might help:
1) File for the K-1, have an engagement party with a priest doing a blessing.
2) File for the K-1, find someone to do a non-binding religious ceremony (probably not going to be Catholic.)
3) Go and have a Catholic wedding with her family, file for the K-3. It will take a bit longer, but if you haven't filed for anything yet and it would make her family happy, it might be something to consider.


good advise. :thumbs: be careful with the non-binding regilous ceromony. how would Embassy know?one might ask.
I've heard of instances of it being jealous family member or friend.

I believe you will need the parental consent for CFO. she will need the CFO stamp in her passport to be able to get on board the plane.

the procedures for the medical for Bangkok are different from Manila. I suggest you check the website for the Embassy in Bangkok.

to be here for the wedding, she would need to apply for visitor visa. if you are considering as an immigrant, your fiancee would first have to become a US Citizen. only a US Citizen can petition a parent for an immigrant visa.

Ok maybe I have been mislead. I thought i understood that someone marrying you who does not file taxes in the usa. ( my fiance being a unemployed student at the moment but is a usa citizen) would have to have an alternate sponsor for you to get down there (someone such as her mother). Being an I- 134 form.


the petitioner would then need a co-sponsor. that will be needed when submitted for the interview.

I'd try calling the Embassy and asking if her name could be included. remember, a K-2 has to be issued within one year of the date the K-1 was issued. you know how long it can take for an interview in Manila, so plan in advance. After one year, you would have to start from scratch by filing a I-130.

We received our interview date which is April 16th. I have read so many different things here and on the embassy web site that I am asking for clarification of the interview process. The medical exam and the interview-are they done at the same time over a two day period? I just read a post where ones physical was about a week prior to the interview. Packet 4-I was told that my fiance does it online-yet I read just now where someone said you have to have two copies, etc... If its online is she going to print copies of what she filled out online and then bring them with her? I read the embassy's packet four information and it does not address these issues. Again and as always thank you so much for your responses and support. We are almost there and I have to tell you it feels so good right now.


The medical is scheduled one week prior to the interview. some take the medical earlier in case any problems are found, so that they can be taken care of. the medical itself is done in one day. most of the time you need to go back the next day for the vaccinations. the DS-156 is the form you will do online. print out two copies. a third page will be printed containing a barcode. make sure to save it. the DS forms will be submited the day you have the interview. why don't you check the the Manila Embassy Interview thread in the Embassy forum. another option is for you to petition the children as a stepchild. a US Citizen can petition a stepchild as long as the marriage took place before the child reach their 18th birthday. you would have to file a separate petition, I-130, for each child.
