The K-1 has a deadline to interview. USCIS only approves for 4 months. Also, there is no packet 3 to complete or do. For a K-1 you go straight from NVC to medical to interview. You print and bring the forms with you. This is different from the I-130 forms with the packet 3 needing completed. However, on the I-130 you ARE an immigrant. Your two years starts as soon as you enter the USA. On a K-1, you are NOT an immigrant, and are not an immigrant until the AOS is filed. On a K-1, if you fail to marry, you go back home. You cannot stay. If you marry someone other then the petitioner, this is also a violation of the K-1.


I haven't heard of a situation where the Embassy will not revalidate the petition, if an interview has been scheduled. our NOA2 was 7/31/06. we were scheduled an interview in Nov 06. the interview was on 12/13/06, over 4 months. the Embassy automatically revalidated the peition. If for some reason the interview cannot be scheduled before the end of 4 months, I'd contact the Embassy to make sure the petition is revalidated.

Best of luck to you. this is only a one day process. However, this can be one of the worst things your fiancee will endure. She will need to know many facts about you, and your secret name. Plus a copy of your BC, passport Bio page, plus either your last income tax return or something to show that your are single and where you live. She will also need photos of you. And if under 21 a parent must attend with her. If under 24, a parent must sned a notice of counseling. There are locations in Cebu as well as manila.

If you are 18 or younger, you MUST have a parent present at the US Embassy. PERIOD. Marasol is about 3 to 4 months younger then Gretchen.


a couple of questions to members, can a person under 18 be issued a K-1 Visa? if so, I can see that a parent would need to be present at the interview. where does it state that an 18 year has to have a parent present at a visa interview? also curious why a CO would ask for a copy of petitioner's birth certificate when one is included in the original 129F petition.

Actually I am not joking about that part. It may seem overly dramatic. But if she changes after getting her 10 year green card, then she was just after getting to the states and not in love with me. I do not want to be guilty of visa fraud. And her divorcing me 30 days right after her 10 year green card would send up MAJOR MAJOR MAJOR flags with USCIS. From now on, when a girl tells me, she does not love me, she is gone. No questions asked. I ain't going to play those games any more. I went through a really really really bad first marriage to an american woman. the marriage was verbally abusive, and horrible. If I was the OP, I would be taking her back to the village already. I spent 8 years sleeping alone in a 10 year marriage. There is no way I WILL spend just ONE day in another marriage going what the OP is going through. Taking her back to her village, and leaving her there is supreme ostracize for her. She will be disowned by the family for treating her husband the way she has. Filipino culture does not tolerate her behavior in any shape or form whatsoever. trust me, just going to the village, and going back to the hotel without her, will MAJORLY affect her. Sleeping one night in her parents house will do more to change her then anything he could do. If she is from a village like my fiancee is from, she would not EVEN be doing what she is doing.



you are jumping to a conclusion that having received the 10 year green card has anything to do with the OP's situation. also, you can not force someone to go back to their home country.

Yes..Really we have been trying to get her passport since Feb. of 2011. the DFA took so long. She received her passport Aug.20.
and that is why we have been rushing to get her here.


the K-2 Visa needs to be isssued one year from the date the K-1 was issued. the date to enter the USA would be the expiration of the K-2 Visa.
if you haven't yet received the visa, perhaps you can call the Embassy to see what the expiration is of the K-2 visa. maybe you have more time to get everything done for the child to enter the USA. best of luck. :thumbs:

Leave it to the gov't to be both legalistic and unclear at the same time. Now, what does "other" mean? Other countries than the only country (Philippines) that she has ever lived in? Or, do they mean countries other than the USA (in which case would include where she lives)? Is she expected to get this for the Philippines, or is this only a requirement for beneficiaries who happen to have traveled abroad from their home countries? Plus, this certificate seems redundant to me if there's already an NBI clearance (why would she be cleared if there's an issue to report on a police certificate), but what do I know.

This is good news then. It gives us another few months of time.

From what I see, we would have about a year of time remaining after her mother gets here in which to #1: get her mother a GREEN CARD and #2: petition the younger sister.

AS I UNDERSTAND IT... once the petition for the younger sister is filed and accepted, the clock stops ticking for the younger sister. She could turn 21 and it would not matter. If she were to get married of course, she is no longer going to be able to come here under her mothers petition.

Am I correct that the clock stops for the sister??-Phil

I'm sitting here reading about vaccinations in another thread, and it got me thinking of medical insurance for my fiance. (She is not here yet) She wont have a social security card and wont have a green card or drivers license, so how will you put your fiance on your insurance policy? In my case its my fiance and step daughter. Would I have to wait till the AOS when she would be able to get a social security card or divers license. Just worried that they may need some sort of medical attention before and they will not be on my insurance. Just a thought but I'm sure others have questioned it also.


check with your insurance provider to see if it's required have have an SSN. also you don't have to wait until after AOS and she receives her EAD or green card for an SSN. she can apply for an SSN with her I-94. just don't wait until there are only couple of weeks until the I-94 expires.

Congrats! The Visa is valid for 5 months but she is allowed to stay in the US for another 90 days after she entered. So make her enter the US, maybe in December and then she will have 90 days more to stay legally but you have to be sure to marry within that 90 days. When she enters the US, the Visa automatically expires and the Immigration Officer at the POE will stamp her passport with another "expiration" date.

Bear in mind that her k1 visa will no longer be valid when she enters the US, and what will matter is the 90 days stamped on her i94 :) You will have to marry within those 90 days

Congrats on the approval. you don't want her to go to the USA now if you will not be there until at least Jan 21st. the expiration of the visa is the date by which she must enter the USA. after entering the USA, you must marry within 90 days, the expiration of the I-94.

She is taking driving lesson in a car with manual transmission. According to her, she finds it easy. Maybe that has to do with the fact that she drives the motorcycle of her pop often to go to the grocery.The more she learns there the quicker will be for her to get her license here. Few driving lessons to take when she arrives.

an SSN is not enough. she will need a proof of legal presence document ( EAD or Green Card ). probably makes more sense to wait for green card since driver's license will expire when the legal presence document expires. one thing to remember, if she applies for SSN before you get married, she will need to go back to SSN to change card to married name when she obtains the green card, otherwise when you go to DMV, there will be a no name match.

I had my Mom enroll in a driving school in our town so that she already has some basic skills when she gets here. If she will have her Non Professional license in time then she can also use it temporarily to be able to drive around for one year. I will eventually have her go to the DMV and get a license once she gets her Green Card.

Correct me if I am wrong but you don't need to have an "International Driver's License" from the Philippines to drive in California in particular.
