congrats on the upcoming baby. :thumbs: on your mom being able to get a tourist visa, depends on what ties she has to the Philippines. I've noticed sometimes it's easier for someone older to obtain a tourist visa.
you mentioned you plan on going to the Philippines. are you planning to schedule your son's K-2 interview so it will be possible for him to come back with you?

In Inyong's situation, it will probably be difficult for her elder child to obtain a tourist visa to accompany her K-2 child to the USA.

Once she naturalizes the Philippines would acknowledge her earlier divorce and single status

BUT...

Her Philippine husband would still need an annulment before he could get married to her in the Philippines. If they tried to get around that using a K-1 (The US Embassy would recognize him as single and free to marry) he wouldn't be able to get the CFO Sticker (departure clearance) for the same reasons.

If she's playing this type of long game on the OP then she's taking a big risk,


or would he be able to obtain a judicial recognition of foreign divorce? this is all based on a hint being given to the OP of this thread.

Well i can see that getting a divorce over there is not as easy as going down the street here and getting the 250 dollar divorce. From what i read, it seems that if she became a USC then it wouldn't apply with her, but who knows.


there is no divorce in the Philippines. the Filipino husband would need to try to get an annulment.

If she eventually becomes a USC and divorces the Kano, she would be free to marry in the eyes of the United States, but a bigamist in the eyes of the Philipines government, yet her ex in the Philippines would be free to marry in either country. I wonder what the US Embassy in Manila would make of that. :unsure:

I know she has to get an Adjustment of Status and then her Green Card, but will she have to get her K-1 visa before all of that, or since she's already here inthe US can she go straight to the Adjustment of Status procedure and then on to getting her Green Card?

If she remains in USA and divorce's her husband here. you would not file a fiance petition, once you marry, you would file an I-130 petition and an I-485 (AOS).

And finally, should we get an attorney to help us do all of this, or can we do it on our own?

depends on how sure you are you can do it yourself. if any doubts, get an attorney.

back in 2006, calling that number is how I found out the petition arrived at the Embassy. it tends to be busy. my best luck getting through was about 8am Manila tome.
as Tahoma has suggested, go ahead and pay the Visa fee and try to schedule online.

My fiancee will be attending her CFO seminar at PRISM and I'm so confused with the documents she will need to bring...

I keep reading about having a original and photocopy of her K1 visa and Immigrant Data Summary, but when her K1 visa packet arrived at her home the only thing in the package were her passport and the yellow envelope saying not to open that contains her visa. She got her passport, but she said there was no other document stating "Immigrant Data Summary"

So how are we suppose to have an original and photocopy of her visa?! If it's in the yellow envelope that states DO NOT OPEN?!


So far what we have to bring to the CFO are:

Original Birth Certificate

We started our k1 visa process when I was 17. Just submit a minor's marriage consent form (from the state where you're going to marry)along with other i-129f requirements. We got the NOA2 (approval notice) 4 months after we got the NOA1 (Receipt Notice). My embassy interview was 24 days after I turned 18, and we were approved! And we just filed our AOS. I met another VJ member who also has the same experience and she just received her conditional greencard. No worries! You won't even need a lawyer. Good luck!

the USCIS does not regulate marriages, but they do set requirements for filing a petition. when filing the petition you both must be free to marry.
in the Philippines the age of consent is 18.

Yes. According to Philippine law, she is still married in the Pilippines. But right now, she is in the US and she is married to me, under US law. But when she goes back to the Philippines, will she be married in the Philippines to Husband #1 or married in the US to Husband #3? How can she be legally married to two people at one time, no matter where you are? The US is supposed to recognize other countries marriages.


who's she legally married to depends on where she is residing. in the Philippines, she is still legally married to husband #1,. the subsequent marriages woud not be recognized. the US does recognize other countries marriages. she obtained a divorce, so in the US, your marriage is the one that would be considered valid.

Forget about what happens to her. Focus on what you need to do to move on. You have a marriage certificate. No one is going to look to see if your wife was not able to marry to see that you have a marriage certificate. People will presume that you are married based on the marriage certificate - this can complicate your life. Complete the divorce. With the final decree, you can prove that you divorced her - you can prove a definite end to whatever legal relationship you may have had. If you don't finish the divorce, there will always be the ambiguity of whether you are married or not.

Sorry, correct me if I'm wrong but were you there at the interview?



They didn't even look at the income, I stated that is my concern yes, but they didn't even look at it - the particular CO we had DID NOT ACCEPT THE TAX TRANSCRIPT OR MY W2. I provided 2007 to 2010 W2s and Tax Transcripts. Did I make a mistake? Yes, I should have included the Form 1040's, but actually I think my case was a special blessing in disguise.

IF they denied based on income, then my 221g WOULD HAVE SAID SO. PERIOD. But it doesn't, it says 2010 W2 (which she had with her) and 2010 Income Tax Return needed. Why would they ask for the stuff if they know it wasn't sufficient?

Point of the story:

TAKE W2, FORM 1040, and IF you have them, IRS Tax Transcripts as backup, because maybe the CO doesn't pay taxes and therefore has no idea what a Tax Transcript really is!


You gotta ask yourself the Dirty Harry:

But being as this is the Manila Embassy, the most stringent Embassy in the world, and would blow your case clean off, you've got to ask yourself one question: Do I feel lucky? Well, do ya, punk?


And learn from the mistakes (or hidden blessings) of others so you don't have to go through what we did.

AND ABOVE ALL - GIVE GLORY TO GOD no matter what the outcome!

=) Because He sure does know best, and I praise Him for this process because it truly is, a blessing to not have to get a sponsor and go through Administrative Review. Submitting extra documents is much better.


just a question, did the annual income you reported on the I-134 reflect the gross income of your 2010 tax return or your higher current annual income?

also, was it the pre-screener or CO who would not accept the tax transcipt or W-2?

After sending the petition all you have to do is to wait. The consular section at the embassy or consulate where you, the fiancé(e) of an American citizen, will apply for a visa, will tell you about any additional specific requirements that you need to fulfill to complete your visa application.

How Long Does It Take?

The length of time varies from case to case according to its circumstances. The time it takes each USCIS office and each consular office to process the case varies.
