K-1 Fiance(e) Visa Process & ProceduresK2 follow-to-join process for US embassy in manila,philippines???

thank you so much for your reply sunandmoon.. yes i still have a copy of the I-129f petition and it does have my son's name on it (2nd page, that part where it says, INFORMATION ABOUT YOUR FIANCE... LIST ALL CHILDREN OF YOUR FIANCE, IF ANY)...

i called this number 1-214-571-1600... got it here: http://manila.usemba...ov/contact.html

should i call the manila office?

yes, I'd call the direct line to the Embassy. you have to be persistant to get thru. I had the most luck when calling about 8am Manila time. One of the first things I did was call that number to verify that my daughter's name was on file. they should be able to verify you son's name is on file. I'd also email the Embassy.

your son's name would not be on the NOA2. do you have a copy of the I-129F petition to verify that your child was listed? are you calling the Immigrant Visa Inquiry line 632 301-2000 ext 5184 or 5185 at the Embassy?

K-1 Fiance(e) Visa Process & Proceduresk-2 for unborn child
you cannot list an unborn child on the 129f. if child is born before interview, the child can be added at the embassy level and be eligible for a K-2.

K-1 Fiance(e) Visa Process & Proceduresjust want to ask my KI visa
your I-129f would have been filed with a Service Center, not NVC. you should be receiving a NOA1. that's the first step. You can check the bank to see if the check has been cashed. If so, you'll know the Service Center has received your petition.

same thing happened to me when calling NVC, operator saying have no record of it. then when called one day and it was there, case number assigned and on it's way to Manila. don't worry, it should be at NVC, just takes time to be entered into the system. keep calling, one day you'll receive the answer your waiting for.

K-1 Fiance(e) Visa Process & ProceduresSome silly questions about the I-129F

Hi everyone!

I just have a couple of questions about the I-129F application form. I know some of these are silly, but I just don't want to make a mistake and have the whole thing sent back to me!

Firstly, what is a 'certificate of citizenship'? My citizenship was acquired through birth in the US, so I shouldn't need a certificate, right? (dumb questions, remember!) CORRECT

Second, my fiance and I have met several times over the course of two years. The form says to "describe the circumstances under which you met." I plan on sending original copies of plane tickets as evidence, but should I start from the beginning and how we FIRST met? Or should I just start with the most recent time?
I'D LIST DETAILS ABOUT THE FIRST AND MOST RECENT. ALSO WOULD LIST THE OTHER DATES YOU WERE TOGETHER.
I honestly don't know what I would do without this site. Thanks in advance for bearing with me!

best of luck,
Roy

K-1 Fiance(e) Visa Process & Proceduresnon-binding religious wedding allowed?
In the Philippines, a Marriage License is required before a civil or regilious marriage ceromony. th OP would
probably be correct the are not legally married. However, if the Embassy has an indication there was a marrige ceromony, you could be put on AR.The Embassy will not accept a Cenomar or Affidavit form Local Registar from you, they will do a marriage check of their own. that could cause a long delay before a visa is issued.
there is also the risk at the POE, as has been well pointed out.
It is not the cultural norm that you would be shunned by family if a regilous ceromony is not performed. I, like others with fiancee's from the Philippines, had an engagement party. her family was very happy with that, they felt part of our marriage experience.

K-1 Fiance(e) Visa Process & Proceduresnon-binding religious wedding allowed?
your twist of words, place of prayer not a church., seems to incidate your looking for validation of your decision. it's not paranoia to point out possible risks, as one member seemed to imply. I admit I haven't provided a link that says a non-binding regilious ceromony is prohibited by the Manila Embassy. I also haven't seen one that says it's allowed.
best of luck to you with whatever you choose to do.

K-1 Fiance(e) Visa Process & Proceduresnon-binding religious wedding allowed?
The Philippines is different than Thailand. according to Philippine Family Code, a marriage license is required
even for a church wedding. If someone can provide a link to otherwise, I'd be happy to be proved wrong.
I suppose you might be able to get a priest to perform some kind of ceromony. as have been stated the Embassy know the local laws. If the Embassy is aware you had a ceromony at a church, you could have problems.

K-1 Fiance(e) Visa Process & Proceduresnon-binding religious wedding allowed?
not all Embassy's are the same. at Manila there is the high fraud factor to consider. if you proceed with a regilous ceromony, make no mention of it at the interview. wedding photos, referring to you as her husband, etc...

K-1 Fiance(e) Visa Process & ProceduresNot seeing each other's effect on interview decision?
I'm going thru Manila where high fraud is a factor. I've seen many approved with the timeframe you mentioned. in such a situation, you just need to prove it is a genuine, ongoing relationship. you can provide evidence like an updated letter of intent, snail smails, emails phone records etc...

K-1 Fiance(e) Visa Process & ProceduresHow should I submit pictures??

adamkun

Don't over do the submission of many photos (which are secondary evidence), at the expense of any primary evidence.

What would be good examples of primary evidence be?

other evidence could be copies of plane tickets, boarding passes. passport stamps. hotel receipts, money exchange receipts, engagement ring receipt ( if there is one, not necessary) etc...

I submitted mine in clear plastic photo sleeves, so the picture could be seen front and back. I just wrote the names of the family members on the back of photos they were in. I didn't remember the names of all my fiancee's friends.

your info is a little too vague to provide any estimate. some fees are I-129f $170, Visa application $100,
I-485 (AOS) $325, Biometrics $70, I-765 (EAD) $180.
other costs vary from individual to individual. everyone's situation is not the same.

K-1 Fiance(e) Visa Process & ProceduresCSC Sending applicatoins direct to embassies?

Well i have talked to a person directly from CSC and she said all k-1 petitions go to NVC before being forwarded to the embassy.
After calling 3 times today and talking to 2 differant people i got the same information and my petition has been sitting there in the mail room since 9/6 and was finally sent to the NVC on 10/2.
I was told to wait about 2 weeks for the NVC to get it in the system and then call and get my embassy case number.
The only petitions that i know of that go to the embass's straight from the uscis are expedited and i-129 worker visa's.
Perhaps the person's that you are talking to at the USCIS misinformation line is giving you info about another type of visa.
And if you try to tell them you know someone that was sent faster than you they, tell you they cant comment on any other case because each case is differant from the next.
If you will look at all the other people that have been sent to the embassy al;ready you will see that noone has been sent straight to the embassy ,they all have been to the NVC and have gotten there embassy case number.

i agree with gobdogman. the NVC assigns the case number to a I-129f, not the Service Center. operators at NVC won't have any information about the petition until a case number has been assigned to it. people who were told otherwise must have been misinformed.

K-1 Fiance(e) Visa Process & ProceduresCSC Sending applicatoins direct to embassies?

Background:

http://www.visajourn...showtopic=36573

Some people have been told that some I-129F applications are going out from CSC straight to the foreign embassy. I would like to know how many people have actually had this happen. Another person says they called the CSC (misinformation line) and this info was confirmed. Is this something new? Any ideas?

Again, I'd like to know who has actually had this happen.

Bill

are they being given their case number?

I believe a K-2 has to be issued within one year of the date the K-1 was issued. be sure to allow enough time before the one year has lapsed to set up an interview.

I'd list the child's name on the I-129f. a k-2 visa can be issued up to one year after the K-1 has been issued.

K-1 Fiance(e) Visa Process & ProceduresK1 with a Child
I went thru the Embassy in Manila, Philippines. there, if the child is accompaning the mother to the USA, the child must also be at the interview. the child would also have to have a medical. you did the right thing by preparing separate DS forms for the child. you mentioned the daughter's name was included in the original I-129f, that's good. you might want to call the Embassy to verify they have the daughter in their system.
