The ROC process is a safeguard against marriages that were entered solely or primarily in order to get a Green Card. What the immigration people want to see is documentation you that you and your spouse are happily married, live together, and share your life together.

You send anything that will HELP make your case. If the utilities are not in both of your names, you do not send them. If there's something missing that you think they expect you to enclose, you explain your situation in your cover letter. In case of utilities that should not be necessary.


Two different utility company bills in two different names for the same time period and for the same address proves the same point as one utility bill with both names and one address. At least to most normal human beings it does. A cover letter saying "my utility companies only allow one name on an account, so we shared them out and are sending in a copy of each" should help build the case, unless you're being reviewed by robocop.

There are no hard and fast rules about proving your case to these people, you send in what your gut and your brain tell you, and you hope for the best.

Logically I would say: do whatever you can to help her remove conditions (WITHOUT lying to USCIS), and try to get her to settle locally, so that you both have access to your son, so he can be raised properly with both parents. If you really want a relationship with your son you're both going to have to act like adults and compromise.

And personally, I wouldn't go posting stuff like this on the internet. Quite apart from the danger of your wife's lawyer getting hold of the comments and tearing you a new one in the custody court, if you really want help (which you do, by the way), you need to find the right forum.

Are you 100% sure about this? I'd hate for you to be giving out intuitive guesswork as verified information. I can't find any mention in any documents or guidelines that state anything of the sort. Please clarify.

As a contrast, I sent them the first 2 pages of the single most recent statement for our joint checking account and joint credit card account. It shows all the pertinent information, no need to overwhelm them.

it came with a little protective envelope, which is fair enough. But the envelope is lined in some kind of metal foil, and it says on the front:

"We recommend use of this envelope to protect your new card and to prevent wireless communication with it"

Thinking further through this...

The only way there could be a common set of variables affecting the speed of approval is if:

One IO reviews all files every morning as they come in, and decides amongst them a priority based on the variables. This would have to be a documented process (since government people have to have a process to follow), and I very strongly doubt that "country of origin" or "race" would be a factor that anyone would dare write down in a process. (except, maybe, for the "rogue" states, like Scotland for instance (joke!)), same goes for gender, income etc.

The only variables that would be constant in any discussion of possible variables, in my mind, would be "Time Remaining Until Out Of Status" (which would include the 1 year extension), Time Of Arrival (to give some kind of FIFO workflow) and most probably "Likelihood of this file helping this processing center to hit its targets and therefore get the extra federal funding for a commemorative George W Bush water fountain in the lobby"

But unless History Channel runs its next realo-docu-drama about the inner workings of a USCIS processing center, we're very unlikely to ever know.

Many (many, many) years ago, in the age before widespread computers, I worked in an office filing paperwork. There were stacks and stacks of boxes and files, and the order of working through them was thoroughly random. Some, deep at the back, never got touched, yet still held entirely valid invoices to be paid. That was a government agency in the UK, not some pikey contractor.

I imagine USCIS is more buttoned-down than that, and the age of computerization would have made the whole process way more automatic, but you still have a huge element of coincidence.

I got an e-mail from USCIS saying (On August 19, 2010, we ordered production of your new card.) :) !! I'm happy for everybody who got approved so far , and i'm sure that for the rest of you guys who are still waiting will be getting some good news soon :yes: , as you never know when you'll get the surprise of approval .

There's a small, barely-recognized, rarely-expressed, primeval part of my brain which takes a huge pleasure in organizing paperwork and getting it just-so. That little part of me knew instantly that it was dealing with professionals when it saw that packet. It was a work of art. Even the staple holding my check to the form was exactly in the right place. There's some serious paper-skills in that office. There's some serious OCD in there, as well, I reckon.

Yes, like they say here '' my bad''. Did you see that type of staples, they use to staple the papers with ? i decided to just leave everything like the way they sent them, and send the original I-175 form, i think there s no need to make a new package all over.


yep, they had some cool government issue cardboard clip-board type affair with big metal prongs holding everything together. Everything was dutifully stapled, arranged, annotated with secret markings - I didn't dare alter it. I just wrote a cover-sheet apologizing for being a retard and added that, and the original form into a new envelope with the entire packet, and sent it back.

well, i got my package back, i didnt send the original I-751 (the signatures issue ), somehow i sent the copy. Also, they said i filed early, my green card will expire on 15/10, and they received my package on 7/16, i thought 90 days may be counted as 3 months( although some months are 31 days), anyway i will send it again next week and i will update. :bonk:

I noticed on past months that a few people didn't receive their NOA 1 for some reason....so who & when do you decide to call somebody to find out if they atleast accepted the package? Or do you have to just wait and hope you get the biometrics letter?


i think getting an NAO1 is pretty much mandatory, since that is the official extension letter. Don't go to Arizona without it...

and when they cash your check you can be pretty sure the ball is rolling.

This is very true Tom. There's a reason they recommend sending it in sooner rather than later....mistakes can be made that cost time, but at the end of the day USCIS will blame the applicant if the deadline is missed.


In my defense... we had a 10 day family vacation / wedding to attend in the other side of the country. A lot of different family members pitched in to help pay for flights and lodging etc, because they wanted to meet our new baby, so I tried to time the I-751 filing such that potential interviews/biometrics appointments/correspondence from USCIS would not cause us to have to cancel our trip.

In hindsight, though, the amount of stress its caused leaving it till last minute was probably greater than the stress of dealing with any issue that might have come up, so in future I'd file early and be damned.

If the packet had got lost in the post, or returned to the wrong address, then I'd be royally screwed right now. So overall, lesson learned :)

ok, i'm home, looked through the packet, and I did indeed include a photocopy of the i751.

the packet has been nicely bound at the top, and there are a few remarks in the borders of the form
the explanation letter is stapled to the i-751

i think the best way to go is to just return the exact packet, with a cover letter apologizing for being a retard, and with the original i-751 that was actually signed. it should get there tomorrow by USPS express, which is still within the 90 days. just.

wife just told me that we got the package returned to us (i'm at work)

it says: "you have to resubmit form 1-751 with the signature of the petitioner"

I might have put the photocopy of the i751 form in there instead of the original.

now i have 2 days before the GC expires, so if i post it off ASAP, I might get there.

Hey Tom_G. Do you know when they received it (delivery confirmation)? Usually after that receive it it takes a couple days for them to cash the check. Your check might already be put in but take some days to clear. Hopefully you'll see something soon.


I sent it USPS priority with online, it was delivered the next day. Without that reassurance I'd be chewing paint off the walls by now.

All my visa stuff seems to be delayed, my k1 sat around for over a month before I got the NOA1. Maybe i have a suspicious name or something.

I mailed mine on the 7th. They haven't cashed my check yet, I know because I obsessively check my account online every other minute.

My greencard expires on the 17th, so I'm getting a bit twitchy right now.

A lot of people have been reporting that when they went for their biometrics nobody was in the office. I'm starting to think that instead of USCIS putting people in the unused slots taken up by "doubled" appointments they are just letting those times stay blank and scheduling everybody in the cue behind them as if nothing happened, thus these horrible delays in appointment times. :blink:


They almost certainly would have left them blank. Their distributed appointment-generating system probably doesn't even have a "delete appointment" function, let alone one that can be used to bulk-delete appointments based on a previous error. That functionality would cost an extra 100k, take an extra year, and would cause far more problems than it would solve. A small delay for the end-user is almost irrelevant compared to that cost.

well its been almost 37 days since we filed and still nothing. all we know is TSC got it. no case number, dont know if money order was cashed.. i know there is a delay. but has anyone that filed around my time recieved a NOA1?

we have the same timeline as you, we filed on the 27th april and have heard nothing whatsoever since. And we paid by money order so we don't know wether they've cashed it yet

Hello there, not been on here for a while (new job). We posted our petition on april 25th, and we've heard nothing at all since. it's nearly two months :(

I know there were delays caused by the huge amount of h1bs this year, but has there been any new development? i've done a few searches but can't find anything

is anyone else in the same boat as us? We used a money order so we can't get our wac number

feels awful not knowing anything. and worse is that this two month delay in sending out the noa1 isn't going to mean the noa2 comes quicker, because they've not even registered our petition - it'll be put on the same set of racks as everyone elses :(

sorry, but this is killing me now. We are actually seriously considering applying for Malia to come to the UK, then trying the reverse process in a few years, when its been sorted out

I got my approved NOA 2, 3 days ago dated March 10, 2009 and the status has not yet changed on the website nor did I get any email notification... So I guess we can't trust the Goverment to stay on top of the details... But we sure had better... good.gif
