People will confuse the different "clocks". The visa has 6 mos. validity "clock" from date of issuance to US entry... upon entry a new 90 day "clock" begins before marriage must occur.


Yes, two separate clocks but the first clock dies at US entry. Once you're in the US, the six months validity is a moot point. Only the 90 day clock is meaningful after entry. One time entry is authorized by the visa. Staying is authorized by the I-94.

Once your gonna send the packet 3 back...few days later or weeks depends on the embassy youll get the packet 4 to schedule your interview and medical.

The NOA2 isnt your visa so theres no limit time to be in US at that time...Its only once you get your visa k-1 in hands which gonna be issue by your embassy and not USCIS then you got 6 months to go back in US and once you are in US you got 3months ( 90 days) to get marry.

I understood that I will need a police certificate from the places I have lived in since I am 16. But by places, do they mean city or country?? I sound like here in France, it is a national thing, so I should get only on paper, even if I have lived in a bunch of different cities in France... So I am kind of confused.

1) If you are in the USA when your petition is approved you are under no obligation to leave immediately. You must leave on or before the expiratio of you I-94

2) Could be a couple weeks to a month plus... each petition seems to act a little differently

3) You still have not applied for a visa. The consulate will send you an application packet that you must prepare and return.

4) 90 day marriage requirement occurs upon day of entry on K-1 visa

Hi everyone,
I am an October filer and I have seen that the first October filer had been approved by CSV. Pretty good news!!!
However, I have a question about that:
I am going to visit my boyfriend in Alaska, from March 12th to beginning of May. I am very very excited about that, but I realize now that (hopefully) our case should be approved by the time I come back to France and I wonder if it could be an issue or not. I mean, once the case has been approved, will I have to come back to my country right after?? Am I allowed to be in the US once the case is approved?
You see, the timeline says that it should get approved arounf mid-April... And I will still be in the US at this time.
Do you think it could be a problem??

A couple more questions...
I don't really know what will happen once we are approved. I understand that the USICS will send our case to NVC and then to the Embassy in France. Am I right? How long does it usually take? A coulpe weeks or months???
I will then receive papers from the US Embassy in Paris, explaining all what I need to provide the day of the interview. Still right? Is it I who will have to call the Embassy to get a interview or are they going to call me to tell me when to come?
Last question: Once they grant me the visa, does the 3 month validity start the day of the approval or the day I come in the US under the K1 visa??

As far as we are concerned, my fiance had to use his PO box.
He moved right after we applied for K1. At that time, we worried because we still didn't receive any NOA1 after almost 3 months. We called USICS, telling them we didn't have any NOA1, and they told us it was sent 2 months earlier at my boyfriend's former address. They asked for a new address, but my boyfriend didn't have any appartment. They told us that a PO box was ok, and now we are expecting our NOA2 at the PO box.
If you have any doubt, the best is to call them and explain your situation, and they will tell you what is the best!!

HELLO MY FRIENDS!!!
I am currently in Alaska with my boyfriend, and we just got the I-797 Notice of Action, saying that the petition has been approved!!! I am so so so so happy!!! And you know what, it is also my birthday today!!! This couldn't be a better day... blush.gif
Anyway, apparently, the notice date was february 29th. The mail was sent on march 3rd and we just got the letter. It is also said that approval notice is valid from 02/29/08 to 06/27/08. USCIS also said they sent the original visa petition to the Department of State National Visa in Portsmouth. So, am I right to think this is really my approved NOA2??? star_smile.gif
The thing is that on the USCIS website, last touched was on february 29th, but it still indicates that our case is received and pending, instead of approved. Is it an issue??? I guess the paper we received is more important, but I cannot help worrying. Please any idea about that?

Well, I still cannot believe it!! Being approved after 137 days! I still have many things to figure out! I don't really exactly know what I should be doing next...

I am just wondering why later filers are approved before I am. I read USCIS was supposed to process each case chronologically, right?

OK!! I am lost. All this is SOOOOOOO confusing!
On the one hand, SSA states that K1 visa is work authorization without any DHS documents needed, so without EAD.
One the other hand, DHS states that K1 visa is work authorisation but that a EAD is needed to proove that.

I was subject to this two years home requirement, because in summer 2005, I worked two months for USDA under a J1 visa. The two years are now over (september 2007), but during this time, I didn't stay in my residence country all the time. I visited my boyfriend in the US a couple times, but I didn't need any visa to do so..
Do you think this could be an issue for the K1? I thought that leaving my country for vacation under no visa wouldn't matter for the two years, but no I am worried that this could be an issue for my K1 application... I am an october filer and we are expecting our NOA2 pretty soon..

Hi everybody!

I am in the process of sending the I-129F petition, and would like to come and stay (under a touristic visa) with my fiancé in the US.
I've seen on this forum, that a bunch of people have been denied at the immigration! and it does scares me a lot.
Because, at the time I will go through immigration, we may be would not receive the NOA, should I say I am on vacation, visiting my boyfriend, or that I am in the process of the K-1 visa.
It seems when you say you're engaged, immigration thinks you have too much ties to the States!
I am not working right now, and I am just afraid to spend $600, and to have to go back in France(and pay another ticket)! I love him, and we want to stay together to make the wait less longer.but I can't afford to loose so much money for nothing(but it would worth it if we could be together)

I-134 for the US embassy in Paris/ I-864 for AOS.
In the packet 3, it is asked for the I-864, but in my case, someone crossed out that, and wrote "I-134". I guess it is why it is wrote I-864 on the embassy info in VJ.
I know many other french persons who went with the I-134, and none of them had any problems.

My fiancee came for 2 weeks in France in june to see me, and then we took the plane together back to US, I stayed 3 months and we filled while I was there for the K1 (september fillers). I so wish we would have start the process as soon as I arrived in US in june...but we can't change it.
It is going to be 4 months that we didn't see eachothers, and I plan staying in France during the whole K1 process to be able to answer asap if I receive something.

My fiance phoned USCIS, and they confirmed they didn't receive anything.
We are going to send it all again, along with a note explaining our situation. We will use the mailed over night option this time.
so if he send it monday they should receive it tuesday.
But now the problem is, that my fiance don't recall the due date since it was written on the page he sent in the first package :bonk:
he just know it is next week, so the question is : what if it is late of like a day or two? I've read in a post of that forum that they give you an extra 3 days to the due date. is it true?

Since we still didn't get the text message from USCIS saying they received our documents for the RFE since 1st march, we are thinking about sending all the documentation again and this time in priority mail so that it could reach them before the due date still(24th march).
The problem is that we sent the RFE page that USCIS sent us in the first package we sent them, would it be ok to send documentations again but this time without the RFE page? We could add a letter explaining that our first package didn't reach them and all maybe?
That completely freaks me out that we might have to start over the whole 5 months wait just because of USPS.

USCIS is supposed to sent us a text/email when they receive it right? we still didn't get that.
Is it normal to wait that long? My fiance sent it from Michigan to California at the normal mail class (no express or first class).
What if they don't receive it in time? our application gets denied?

I had no problem to copy the ID page of my passport (my US fiance either). I just used my scanner, and printed in color.
I was worried how they would know my stamps pages and ID page come from the same passport, but there is the passport number indicated on the ID page peirced through the stamp pages.
I pointed out the stamp dates, and tried to include the plane tickets matching with those dates.

I thought I would share my RFE experience here even if I already said it in the september filers topic.
So they want more evidence that we met in person...

Since I started to read on this website only some months after I sent our application, I did some mistakes.
-I sent them copies of my passport stamps BUT without the first page of my passport (which shows my name, picture, ...)
-I sent them only one picture of me and my fiancé together, without the dates on it.
-I did already sent plane tickets at least

So I guess that from correcting those mistakes, we will get our NOA2 soon *cross fingers*

I have explained in my 1st post. And yes, our case in complicated cuz of my bf being bounded to military rules too. I'm not in the US yet, I will come visit in May but I am able to stay only 3 weeks cuz then work and exams waiting for me for summer.

( a ) : K1 way
- apply for K1 asap
- come visit but wont have a place to stay cuz if my bf is not under married statues = not allowed to move off base, and aswell I'm not allowed to stay there.
- come back to France and deal with work and exams + wait for K1 to be approved
- prob visit 1 more time (same pb for place)
- finally have K1 approved but then bf may be deployed shortly after marriage, which means I'd have to stay in the US alone and without a job, waiting for my green card or AP.

( b ) : K3 / CR1 way
- visit and get married with a place to stay
- come back to France and apply for K3 / CR1 asap
- take care of my stuff in France and may visit 1 more time, waiting on K3 approval
- getting in the US or not depending on deployment orders and the I130 processing (being allowed to work or not)

Is it clearer ? I know I'm a special and complicated case here... sowwy. blush.gif

Hm, s/o else here, but nvm. I have been reading a few times that K3 was made for ppl who marry abroad the US, as well as I have read a few times abt ppl getting married in the US... As I said, this is confusing. I have checked the guides, but they dont say anything abt where the marriage has to take place for a K3 or a CR1, or I never read the right lines.
And unless my bf gets the right to move off base if I'm just a fiancée (which I doubt since they have their own rules) then K1 is no longer an option. Otherwise I'd have followed that way. Considering our situation, prob gonna be the K3 / CR1 though that we still need to discuss.

Yeah I've been wondering abt the CR1 too ofc, I guess I'll discuss that with my hunny. He tried to call the Immigration Services to ask for infos on petitions bu omg the woman was just not helpful at all and not very nice, bleh.

I'm just like everyone and hoping it won't take ages to get everything completed. From what I have seen the K3 as well as the K1 process takes like 6 months and I really would like to be able to be back in the US under K3 for the end of the year without having to worry abt it. smile.gif

As you have noticed, I am new here and like most of us, I am seeking for answers.
Here is my situation :

I met my fiancé online a lil bit more than 2 years ago (yes me too, hehe), till we fall in love in March last year. We didnt know at the time if we would ever have a chance, and things going as they were, my boyfriend joined the military and is now in the Air Force since July 2008. After 9 long months of waiting, he finally managed to visit me in Dec.-Jan. and we had a wonderful time. Though now, we cannot bear to be apart anymore.
Now it is my turn to go visit and I have planned to go in May for 3 weeks. What we intended to do was to make a civil union within that time period so that he is granted the permission to live off the base (he is in McGuire AFB, NJ), which is not possible before a year if he is not married (I know, lalala this is so complicated). However, I do NOT intend to stay in the US after this union, I have university exams awaiting for me after my stay in the US, and also my summer job. Both which I cant avoid.
Unfortunatelly, I have found only recently about how much complicated are the conditions to marry a US citizen and be able to stay in the US and now I dont know what to do anymore. Basically I have 2 options :

( a )
- come visit on my VWP time in May, marry him and come back to France as scheduled so that I can deal with all that I have to do here.
- ask for a K3 spouse visa asap (and hope it takes less than 6 months) so that I can come back later to the US with it and then actually ask to stay.

=> But then I do not know if it will be possible or easy to come for short visit while I'm waiting on the K3, how long the process would take (and if we can ask for a military expedit) and all that.

( b )
- ask for a K1 fiancée visa asap and pray for it to be delivered quickly
- come visit in May and do not make any union
- come back and marry him after I obtain my K1 visa.

So here is my dilemna,
- if I take the option of the K1 visa I know my bf wont be able to move out of base so we wont have a place to stay the times I come visit, and both of us are really broke so idk how we could afford to pay the hotel and stuff (cuz I'm not allowed to stay at the dorm but for like a week-end ofc). The other thing is that I dont know when my bf will be deployed and unfortunatelly that may happen when I finally obtain my K1 visa or shortly after. That would be a problem considering after i get married on a K1 visa I need to stay in the US and ask for an AOS and would probably not have it before he gets deployed. sad.gif
- if I take the option of the K3 visa, he will be able to move out the base (and just as I am writting he received an email saying he got approval for an apartment) and save some money, thought that -same as if K1 option- I would not be able to stay : 1. I dont wanna do visa fraud 2. I need to return in France cuz I'm not done with my stuff before a few months. However, this option seems to be a bit more risky so I dont know what to do.

I know my fiancé would prefer to go the K3 visa way, and tbh he is really much more confident than I am. As for myself, I am really lost and idk what choice to take (cuz in both cases i gotta come back in France anyways) and I dont wanna disappoint him or ruin our projects. I really cant stand being apart anymore and you all know what I mean, and all of that would not be any problem if it wasnt a matter of money (then paying the plane tickets and hotel would be np to do a few times more), but as usual, it is.

So I hope that anyone of you here can provide me interesting info or help cuz I'm really really lost and I need to make a decision quite soon.

That may be paradoxical but the visa can actually wait longer than the marriage, as I said earlier, is that in the meantime my fiancé may be deployed. We really dont know when this can happen, and if it does just when I got my K1 approval, we're kinda screwed ...

Now if I can travel between US and France while I'm waiting for K3 or CR1 approval then np. Leaves me some time to deal with my stuff in France, may work a bit longer and prepare better for when I move. It's really all abt that, and ofc, saving money since we're both broke atm. I'd change my mind if I won the lottery, haha.

I checked the premium process criteria on the USCIS website but we dont really fit them, it's quite specifical -.- so ofc we will check the military expedite, which is the same for both K1 and K3 (and prob for CR1 too). So well, need to check all that stuff and make a few phone calls.

What we intended to do was to make a civil union within that time period so that he is granted the permission to live off the base (he is in McGuire AFB, NJ), which is not possible before a year if he is not married (I know, lalala this is so complicated). However, I do NOT intend to stay in the US after this union, I have university exams awaiting for me after my stay in the US, and also my summer job. Both which I cant avoid.
Unfortunatelly, I have found only recently about how much complicated are the conditions to marry a US citizen and be able to stay in the US and now I dont know what to do anymore. Basically I have 2 options :

( a )
- come visit on my VWP time in May, marry him and come back to France as scheduled so that I can deal with all that I have to do here.
- ask for a K3 spouse visa asap (and hope it takes less than 6 months) so that I can come back later to the US with it and then actually ask to stay.

=> But then I do not know if it will be possible or easy to come for short visit while I'm waiting on the K3, how long the process would take (and if we can ask for a military expedit) and all that.

( b )
- ask for a K1 fiancée visa asap and pray for it to be delivered quickly
- come visit in May and do not make any union
- come back and marry him after I obtain my K1 visa.

So here is my dilemna,
- if I take the option of the K1 visa I know my bf wont be able to move out of base so we wont have a place to stay the times I come visit, and both of us are really broke so idk how we could afford to pay the hotel and stuff (cuz I'm not allowed to stay at the dorm but for like a week-end ofc). The other thing is that I dont know when my bf will be deployed and unfortunatelly that may happen when I finally obtain my K1 visa or shortly after. That would be a problem considering after i get married on a K1 visa I need to stay in the US and ask for an AOS and would probably not have it before he gets deployed. sad.gif
- if I take the option of the K3 visa, he will be able to move out the base (and just as I am writting he received an email saying he got approval for an apartment) and save some money, thought that -same as if K1 option- I would not be able to stay : 1. I dont wanna do visa fraud 2. I need to return in France cuz I'm not done with my stuff before a few months. However, this option seems to be a bit more risky so I dont know what to do.

I know my fiancé would prefer to go the K3 visa way, and tbh he is really much more confident than I am. As for myself, I am really lost and idk what choice to take (cuz in both cases i gotta come back in France anyways) and I dont wanna disappoint him or ruin our projects. I really cant stand being apart anymore and you all know what I mean, and all of that would not be any problem if it wasnt a matter of money (then paying the plane tickets and hotel would be np to do a few times more), but as usual, it is.

So I hope that anyone of you here can provide me interesting info or help cuz I'm really really lost and I need to make a decision quite soon.

Hi everybody

so my lover and I decided to start K1 and about proof of relation ship I want to be sure of something, I read the forum carefully but didn't find answers to my question... We both do have a lot of letters one from each other and postcards, do we have to send originals of them or just copies?

Is is a plus? I mean I have one year of phone bills (5 pages each), photos of him and I in America and also in France, stamps on passports that he came to visit and I did too, skype logs, what else can I add? I didn't kept my flight tickets or boarding pass (coz i didn't know at this time we will need them one day, but I got bills from travel agency)
I'm pretty nervous about forgetting something and got our file send back any support is welcome :)

I know i've read that too and got me really confused because I got the letter from the embassy 4 days ago and it clearly says ds260 with the link to the website....

 

that it really confusing

 

I just call NVC again today right when they do open I talked to a lady she gave me Invoice Id Number, i got online it match my case number so i'm filling ds260 gonna send it back to the embassy and see what they'll say

i can access the ds160 online because no need of password unlike the ds260 it's free access i'm just worried that it's not the correct one and if i send the wrong form they'll delay my interview

Hi everyone,

 

i got my letter from the embassy in Paris, before i can have my interview date, they are asking me to fill in the form ds260 online and send it back to them so they can schedule my appointment.

 

However, i never success in login in with the NVC website they say that my case number and Identification does not match. (i used my date of birth as identification number as said in the us embassy website in paris) I tried to call NVC several times but i got busy signal all day yesterday and finally when it hang up i waited twice 30 minutes without anyone answering..

 

I did some research online and i read that ds 160 has replaced ds 260, why would the embassy send me to fill in ds260 if it's not the right form. When i go to the french embassy website it clearly said ds160 for k1 visa and that's also what my fiancé got on the letter from NVC...

 

anyone got the same problem with that?

what should i do, i really want to get the right form mailed asap so i can get my interview scheduled
