hey guys..
just wanted leave update.. i recieved my RFE on friday june 15. 2007. i been so just stressed and thinking about stuff .that didnt get time to update. besically they want my foreign language marrriage certifacate that corresponds to the English translated that i submitted only problem with that is that - thats is my orginal document.so i am going to try to get one in my language and send it . i am hoping it wont be problem atleast it shouldnt be and ill get approved.

should start preparing for next time.
what document do i need ?
i hope i get apporved soon???

Good news! and you are welcome.
So now you take care of this RFE. You should get NOA2/your cases forwarded to NVC within a month after you mail your response to RFE. May be as short as 2 weeks. Then your case will spend 1-3 months at NVC. I hear there are also security checks at NVC and occasionally paperwork gets stuck there too.
After that your case gets forwarded to your embassy and they set up an interview date with you. Depending on how busy your embassy is, you may have to wait 2-12 months for your interview date. I hope it's rather 2. Look at timelines of people from your country, that should give you an idea.

hey guys ..finallyl some news.. i got touched and its RFE. and please dont say it that what is before. i dont care i ll take anythin right now. i am so happy and exicted finally something changed..little settled down and tthinking what can it be. i know i had all my papers in order.
so got touched on 06/12/2007 and its change to RFE ..and then touched again today on 6/13/2007 is that good or bad?
damn when is this rfe going get here. i am so nervous and freakin out now.

I will try to summarize for you the best I can.
If you file I-129F now (i.e. start working on K3), you have these possible outcomes:

1. While your I-129-F is being processed, your I-130 gets approved. You lose (what is it currently) $170 that you paid for I-129F filing.

2. Your I-129-F gets approved at the same time or very shortly after your I-130. They will choose to process K3, not IR1/CR1. You move to the states and have to go through Adjustment of Status, which will cost $1010 (with the new fees). You lose in quality of your visa (you have to wait until you get EAD for work and AP for travel) and you cause extra pay for Adjustment of Status (as noted above). If you got CR1 you would only have to pay $545+$80 for Removal of conditions and that is almost 2 years after arrival to US.
You would have the option to terminate K3 processing and go for CR1/IR1, but that would cost you extra (~$200 and ~2 months, I think).

3. Your I-129-F gets approved quicker, much quicker than I-130. Normally that would not be the case, but your I130 already got stuck somewhere. If you read up on this website, someone got stuck in USCIS and is still waiting for their NOA2 after 10 months. Yes K3 would cost more than CR1/IR1. But if that ends up being the case for you and money is not an issue, you would be glad you filed for K3.

Bottom line - people who tell you not to file for K3 are trying to save you money and advise you to wait out for a better visa. They believe your application problems will sort themselves out and you will get your NOA2 very soon. Will that be the case? I don't know. You are the best judge of that.

I am not sure why you think your last touch was not an RFE issued. I am not sure they specify that they sent you an RFE. RFE may look just like a touch on their website - I do not know. But I think you should try to read RFE threads and see for yourself what people say.
Now, if it turns out that RFE is on the way or you just have missed it, then TRUE, once you submit your response to RFE, your NOA2 will come shortly (likely within a month?).

Have you checked the case on-line, register at USCIS, and maybe you can findout what has been sent to you, you can also register for e-mail updates here, they usually come before the snail mail copies. There have been many cases of people not receiving the NOA's, so maybe you have been approved and sent to the NVC already, you could call them also! They are friendly and helpful, I am not sure but I think they can look up your case if it has been sent to them. IMO I-129F won't help you, save your money! i highly doudt i have missed RFE ..other wise it would show up online and in email and mostly importantly wouldnt i have received in mail. unless the mail was lost and it didnt show up online. i did asked the lady at office to make sure my address was correct and she even did.i do have online account and ichecked it everyday two to three times . only thing i show difference was i got touched 5/8/2007 so i dont think it was rfe..
about the 129f do you really think i shouldnt file it now.. money is not issue with me .well not that much. even w/o that don't you think that this process(130) with not knowing anything is going to take long time.... do ou think i should just file it in case.. i know i shouldnt have filed it long time ago but better late then never .

is it possible she told you that you should have received an RFE?
If so, you do need to find out and to respond to this RFE. Then you should get your NOA2 within weeks.
I would not discard the idea of filing I-129F just yet. But you need to find what is going on with your case.

Actually, from what I have seen, people who file both I-129F and I-130 get approved faster.
Or at least they did, in case of January - March filers.
May be it is that if you submit both forms, then I-129F determines the speed of double approval and now I-129Fs slowed down?...

It does appear to me that I-130 is approved quicker if it is the only form that is filed. The people who file both I129F and I130 seem to wait longer to get their petition approved.


What I'm most trying to find out is....is it quicker to get an NOA2 for an I-130 if you never submit an I-129F and just go for the CR-1 visa? Does filing the I-129F afterwards like you are pursuing a K3 have any effect on the I-130 approval time? Originally when I filed both of these I was hoping that the I-130 might actually be approved faster once I filed the I-129F...reason being, if they started processing my I-129F first, they would see that I had previously filed the I-130 and thus, go get it and process them both together.

As an interesting side note, I'm trying to bypass that whole holding up of the I-130 form once my forms are approved. I wrote in several places on my I-130 that I didn't want them to hold it because we planned to pursue the consular option. It was in their own instructions to do that to avoid having the I-130 held once approved along with an I-129F. So I'm hoping that sidesteps the nasty extra filing, $200, and wait (the wait which is so long it makes the I-130 completely worthless...what the hell are they thinking!). I can't wait to report back whether this works or not, but I gotta get approved first!

Reason I ask this, I saw someone post recently that an Immigration Officer actually told them that going for a K3 made it take longer to get the I-130 approved. That's a little disappointing to me if true! And I'm just talking about the NOA2 approval step at the USCIS here...not all the good stuff that comes afterwards! This part of the process is by far the worst due to the lack of feedback for many months (aka the black hole effect) and the apparent complete randomness of approval times (wish they would just sort them by NOA1 date to be fair and post the REAL date for most of the forms they are currently working on)!

Anyway, I hope someone can provide some insight on this before I've completely chewed off all my fingernails!

If you prepared the formon behalf of your spouse then you should indicate that you prepared the form, regardless of how "it looks".

I 864 asks for both current income and the last three year's reported income. Put the appropriate information in the appropriate place.

I had one affidavit, four wedding pics and an itinerary showing my spouse visited me in France since the wedding. And a copy of marriage license of course.
If you don't have the wedding pics, may be you have some other (honeymoon/vacation/home?) pics of you together?
Affidavits are the easiest proof to obtain.
I would not sweat the wedding pics even for the CO. When we got married, we were the only couple out of a dozen to be "properly" dressed and taking pics. That's a norm for court weddings :)

You have 6 months to enter the US after CR-1/IR-1 issued, you will then get a visa stamp in your passport at the Point Of Entry. This visa is as good as a greencard for work and travel, but the actual GC will arrive at least a month later. Then you can leave US (after establishing domicile in the US - at least get to use friend's address as your mailing and "permanent" address and get a bank account). Best to apply for SSN too, I believe SSN card will come in the mail.
You can stay outside of US for a maximum of 1 year, but it is best not to cut it close.
All that gives you ~18 months after embassy issues a visa. If it is YOU, not the NVC who schedules your appointment at the embassy, you can delay scheduling by saying your paperwork is not ready yet. Worst come to worst you can show up to the embassy lacking one vital document - like a police record that you ordered too late... or may be you did not fulfill immunizations yet... They will hold visa issuance until you provide all required documentation.
When there is an administrative process, there is always a way to delay it :devil:
But, take this advise at your own risk :whistle: who knows, may be if you miss too many documents at the interview, they will put you on AR and you will be delayed another few months :rolleyes:

All in all, this process is so lengthy and delays are possible for numerous reasons. Just follow the process at your own pace and you should be OK (just don't miss the 1 year anniversary of I-130 approval).

I just got my NOA1 from VSC for my husband. I've already had to call them to correct the spelling of his name. (I guess they did not look at his passport:)
While I wa slooking online for the processing times, I noticed that for I130 filers they are sooooo behind. They are only processing ones that are from Jan. 2006!!! That's over a year and a half. The woman on the phone told me that all those people have to wait for visa numbers. She told me that I did not have to wait for a visa number though because I am a US citizen. As usual she could not quote me any time frame of when they will be caught up and able to look at my husband's papers. But the fact that he doe snot need a visa number, does anyone know if he will be able to go ahead of anyone else or is he really stuck at the bottom of the pile...ignored until they get caught up from a year and a half ago? If taht is the case, then our I130 will take eons!!:(



PS There is no June 31 :lol:
May be you meant July 1 as your NOA1 date?

It means to send a copy of the biographic data page of the applicant. That's all you need to send since she's the only one you're applying for. But if you had applied for her children (if she had any) then she would have to send copies for them as well.

Of course even with DCF it is that short only if your spouse has all the required vaccinations, orders police reports right away and has all their passport/birth certificate/marriage certificate/divorce certificate and other papers on hand and in order.

Just so you know - your choice is either K3 visa or GC (greencard). I-130 is the form to file for GC. I-129F is the form to file for K3 and it requires that you first file I-130 and provide a receipt from USCIS from filing it (so called NOA1) as a part of I-129F package. In reality this means that you will only be able to file I-129F about 3-4 weeks after you file for I-130. Sometimes, USCIS is really slow with sending you NOA1 or just loses it somewhere and then you can not file I-129F for months!..
Lately people report that spousal I-129Fs take longer to get approved than I-130. Up until March, K3 visa route was faster than GC. Now it seems that GC is faster. This can change again, so sometime when your I-130 is filed and you can relax a little bit, you can check VJ timelines and decide whether it is worth to you to file the I-129F.
Another way to send your prepared I-130 package, is the famous "Russian express". It is an informal post service provided by travelling Russians :lol:
Ask you husband, if he has any friends who go to the US soon, scientists are a good bet, or people with relatives in the US. They would likely agree to take your prepared package and mail it for you from the US.
If not, those are also the people who can likely suggest a more reliable and fast postal service than regular Russian mail. It will cost you an arm and a leg, but it is still surely less than losing all your wedding investments.
Three stages of the process you will go through with I-130 (GC) if you have to file in the US:
USCIS - about 3.5 - 4 months average
NVC - 2-3 months average
Russian embassy - I am guessing 3-4 months.
That is if there are no complications.
So, as you see you are really cutting it close. If you can talk US embassy in Moscow into allowing you to file I-130 with them directly, the whole process should be less than 6 months. Tell them about wedding arrangements, cry in the office of the chief official - whatever it takes.

Here is a link for you, to the VJ guide on I-130. Filing the I-130 is what you need to do ASAP. It will get your man in line for receiving either greencard or K3. I believe both GC and K3 should allow your husband to travel for your wedding ceremony and then out of the US.

The I-130 is the first thing you need to do and it can be done from Moscow. In order to prepare I-130 package you need to translate your marriage certificate into English (easy to do in Moscow, your husband will help to find this service).
Call the embassy - see if they allow you to file I-130 with them directly, this would be a faster route. If not, you will have to mail I-130 to USCIS office in the USA. Considering that you are going back to US in August, you may find it cheaper and faster to prepare the whole package and then mail it from the US the day when you arrive to the US. Because Russian mail is either expensive or sucks.

You can worry about taxes, your parents signing on his financial support and I-129F (application for K3 visa) after you mailed your I-130 out.

CR-1 also only needs to provide proof of one (last year) tax return, BUT we have to give AGI information from 3 years of tax returns.

I have read up on the different petitions K-1, K-3, CR-1 why is it that there are different requirements as far as number of years required of tax records? I had thought that if you were employed you only needed the last years records and if you were self employed you needed three years.

Now just reading again I see that a CR-1 needs the last three years tax records While a K-1, K-3 only needs one years records. Am I just stupid or is there a type somewhere?

some ppl doe follow both K3 and I130, in case I130 gets held up K3 goes ahead. in case I130 goes fast they try to transform K3 interview in IR interview
