At least you know he left you because he has no spine and because of his family pressure. Many don't have even that knowledge.

As far as your financial responsibilities - as LPR he is not eligible for any means tested benefits within the first 5 years in the US. Yes there were cases when sponsors got sued to provide support anyway, but they are very rare. Just get a divorce, take him off all your accounts and forget about him. It takes two to dance... you alone can not change anything.

If you are adamant about marriage and bringing him to the US, then yes, getting married in Egypt will show the embassy that you are serious and most red flags can be overcome. Especially if you are willing to live with him in Egypt for some time.
What scares me is your willingness to marry a man who you have not yet met in person.
I hope you are not desperate. To me, strict religious upbringing does not bode well for a "nontraditional" couple.

My fiance' is 22 years old and lives in Upper Egypt. He has a strict Muslim family and strict Muslim upbringing. I am a 38 year old female from the US and am a non-Muslim. we have been in an online relationship for 3 years and I am going to visit him in February and we plan to get married and start the embassy process in July when I go back to visit him again. I have been reading many different responses here on this site. Some are comforting while others are scary....Can someone tell me if it is better to marry him there and start the process...will it make a difference? Most importantly how long could this process take especially if the consulate asks the family if they approve and they do not? Will it be an automatic denial?

I don't know how this works when you are self employed... do you "pay a salary" to yourself? If yes, you multiply your monthly salary by 12 and that is your current income.

Q25 deals with your past income in 2004, 2005 and 2006.

I feel your pain. This whole pushing you up into a higher income tax bracket is totally bogus.
IRS calls it "paying at the same rate" as if the foreign income was not excluded, but this kind of calculation actually makes it a higher rate.
This is much like credit card companies choosing to apply your payments to the lower interest debts first.

We're really living high on the hog. Is there any deduction for having to buy 5 plane tickets to Europe last year while USCIS processes our case?

I ran your numbers manually (60K + 60K income) and indeed in your case married filing separately is better by about $3000 (assuming foreign income exclusion).
What happens is that your SO's foreign income pushes you into a higher income bracket. With lower income, it would be offset by standard deduction, exemption, making work pay credit and lower tax rate for married folks. But you guys made too much money :P

I'm using that form. My question was concerning the calculation of taxes when using this form.

when I sent an apositlled copy of a passport to the IRS asking for ITIN, I got back a letter... requesting an apostilled copy of the passport. I then sent them a notarized copy of the apostilled copy, with explanation that I already sent them the original and they should have it... I got back a letter saying ITIN denied due to lack of passport :bonk:

I gave up. All that to say, get TWO apostilles if you are going to go through the expense!


I tried it when going through the immigration process.
To get the Apostille in India is long process, first local stuff, then stamp from Delhi Ministry.
You can do this, file now as single, when she comes here, file a amended return (married filling jointly).
I think (check with accountant), you can go back 3 years to file amended return.

Err... are you saying that you are legally married to two people at the moment? Or that you were legally married to someone else when you met your new husband?

My husband had his interview yesterday in Mumbai and it did not go well at all. When he was finally called for the interview the woman officer was basically stuck on the fact that I was still legally married to my first husband(who I had not been with 6 yrs when I first met my husband now but was legally seperated).

Even if he is currently on B2 visa, they still will need to find a co-sponsor for adjustment of status. And no, he can't just take a job while he is in the US. He has to either find a job, leave and get a work visa (not really feasible after marriage to a USC) or he has to wait for EAD card to be sent to him (once they apply for AOS) or he has to leave and come back with CR-1 and be eligible for work almost immediately (he has to get SSN).

However, it is not illegal for him to look for a job. If he is looking for an offer letter from a company, then he is not trying to get a cash/ under table kind of job. So he is not trying to break the law, he's just not well informed about how it works.

As far as intent goes, it is, just like separation date, a grey area. As she was married at the time when he entered the US, he can argue that he could not possibly plan on marrying and staying.

If they find a co-sponsor for I864, they just might pull it off.

They just assume if they get married, he gets to stay.

I would not get hung up on separation date, really... it is not the same date as when she moved out from her husband's house. If she was honest with her husband, separation date was probably in October 2010 when she met the Romanian. Could be earlier, but only your friend and her husband know for sure.
USCIS is not going to investigate whether separation date was true or not.

She can get divorced and she can marry the Romanian immediately, if her state laws allow it (many have a cooling off period required after divorce). She also can file I-130 for him, which will take 5-6 months to get approved. Meanwhile, he will have to return to his ship/work/country (because he can't adjust from crew visa and can't work in the US for now).

Her problems will be (1) finding a co-sponsor, and (2) him convincing US embassy in Romania that their relationship and marriage are real.

Love conquers all, so they may be able to make this relationship work... but if he is a fraudster, he'll give up... theirs is not an easy case.

On the bright side, if it's true that she can live on a cruise ship for $7/day as his family member - it's cheaper than any rent and they could be together. Not sure where it leaves her daughter though.



On those documents, she does indeed have listed a different separation date than is true. She moved out of her husband's home as of July 23, 2011 (update from my initial post) and she is staying at the home of a friend. WITH the Romanian citizen.

She probably needs to spend a lot of time lying down, and for that a cruise is perfect - get to see new places, but can travel to them in your bed.

If you are able enough to go on a cruise, you're probably able enough to find some sort of job. Nursing admin? - not on the feet all day...not sure of the situation, but going on 7-8 cruises makes it seem like you can find some sort of owrk

Money changes hands between husband and wife all the time. This could not be used as evidence of fraud. As alternative, he could rent his property (if he has one) and use this income as rent money would continue to come even after he moves to US.

And as if the case didn't look like immigration fraud before, that would clinch it beyond a reasonable shadow of a doubt.

His asset in Romania could not be used.
Co-Sponor has to be a perm resident or USC, after whom the govt can go to recover the expense incase he become a public charge.

US govt cannot go after asset in Romania or a foregin national to recover this dept.

I agree, ex's address would be a problem.
So, first divorce, then file I-129 or I-130, then some 6-9 months later comes interview date in Romania (for K-1 or CR-1 visa). Ideally, she should be out of ex's house from the date of divorce, at least.

They must find someone to co-sponsor, or his visa will be rejected. Or, if they pursue CR-1 after marriage he could use his assets in Romania to meet the poverty line requirement, that is if he has any assets.

Yes but i've also seen ppl on here that did just that and when interview time came it clearly showed the wife was still at the residence of the ex spouse and it came up on the background check as her address until such time...

I'm just saying its not a big deal to me personally but ive seen it happen that the background checks show her address as beign with the ex and it created really big issues at time of interview..

It is a common practice, I've been offered such a lie by a lawyer... I refused.
But apparently "separation" is a soft definition and so only the couple involved can determine when it really happened. So, if both husband and wife want out of the marriage, there is pretty much no way to prevent them from deciding when separation date occurred.

the fact that she would lie in court to obtain a divorce without following the state's requirements is a huge deal!!! It's lying to the judge, the court system and giving false information regarding her divorce.

You can actually ask the embassy what are the criteria that make US citizen spouse eligible to file I-130 with them. It's probably just having the right kind of visa/status. As long as the embassy accepts your documents, you are fine.
If they refuse to take your file, it will have no bearing on processing of your paperwork stateside. Never lie to them though!

You worry too much.
It is possible to be resident of two countries - I know because I was. Your wife is legally a UK resident. Do you still live in the same house? Then there must be bills or something in her name. Do you have a joint bank/ credit card accounts in UK, may be health insurance? Voila, not only she is a resident, but you can also prove it. She did not file any "exit" documents, did she?
That she spent last 3 months in the US living with her parents - will only help you two to prove that you have the intention of moving to the US. One catch with DCF is that the US citizen has to establish domicile and that can be tough for someone who did not live in the US for a while (requires job offer, apartment lease, kids school enrollment etc). She just went ahead of you to establish domicile ;)

And yes, by all means call/e-mail the embassy to find out about the procedure and expect a positive outcome :yes:

Thank you for all the replies. I don't think I'm totally comfortable applying for the DCF without checking. I will ring them just in case.. but I think if it was realised that my wife was already in the states it could end up getting messy, and the last thing I want to do is get barred from the states because of a technicality. This is kinda heart breaking obviously..as it doubles the time away from my wife and little girl (And yes I miss her so much, it's incredibly hard. Not only that it's hard for my wife), but the risk possibly isn't worth it. (even though it's a small risk, and basically a completely pointless thing to stop someone from doing a DCF).

Why don't you contact the embassy and ask them if she can file for you with them and what needs to be done?
As for the dogs, perhaps dog sitter is a possibility?
DCF used to take 2-3 months (country dependent), but I am not sure what it is for the UK these days. Check the DCF section posts for fresh info and stats.

Your info about marriage place was wrong - it does not matter, you could have married in Maldives, so what.

ETA: either way you need to start collecting paperwork for I-130 filing.

But if there is a problem with your case, you may never find out unless you call - sometimes their correspondence gets lost and the website does not get updated.

They gave me a Reference number and told me to call back if I receive nothing in the next 45 days.

im not sure if you actually can tell me if or if not im ready to leave. i was when we send the petition... it took forever and we still have no approval. what is so wrong about looking in other directions now?

it is not that germany is a third world country that i just try to get out anyhow. believe me there are certain things that are better here (the whole social system for example). but i also love the US and i want to live there because we have lots more opportunities once my hubby is done with school. why should i risk now to end up in a trailer park and not knowing how the next week will be?

I am not a very experienced VJer, but it seems to me:
you don't have I-130 approved yet. Once it is, it is good for 1 year - I would guess it means you should have your interview within 1 year from I-130 issuance? You CAN reschedule embassy interview appointments. Once the CR1/IR1 is issued, you have 6 months to enter US.
Sooo, if your I-130 is approved tomorrow, you already have 18 months. AND there is nothing to stop you from going to US for a week to "activate" your greencard and go back to Germany for another 6 months to finish your work's obligations.
So if you ask me, I think you are doing just fine! :devil: :devil:
On the other hand, you WILL need cosponsors if your spouse does not have income, or will not have US source income. Which however would also be the case if you withdrew your petition and applied later.
Also consider that if you withdrew and re-applied, DCF may be available to you. And that is much faster.

Do we need to submit anything or somehow update CSC on the fact the petitioner has a new workplace? If they look at G325a, his work history will be reflecting his old place of employment (the one he had more than 2 months ago when I-130 was submited). If they call to verify - they will be told he does not work there anymore...

Any advice appreciated! :thumbs:

It may be "free" after July but in reality they get you when you file for AOS since that fee went up as well... so it's not free at all.

I am hoping for the best and preparing for the worst. If we don't have I-130 approved by the end of July, we will submit I-129f (hopefully for free), and still hope that I-130 comes through before I-129F. I-129F is only a backup. If it comes to using a backup, yeah, they get me for AOS fees... but better that then never be able to move in with my SO :unsure:

I-129F maybe free but if you follow that route, your AOS fee will be $1010.00 (too way expensive) plus EAD that is $340.00...

it still would be more expensive to do K3 and then adjustment of status, than it would be to do CR1 and then removal of conditions ($1010 vs $545). So the "Free" filing of I129F is not going to save anyone money in the end. But, if my I130 ends up hanging at CSC forever, I just may have to go for a more expensive K3 track. At which point free filing of I129F is NICE...

My I-130 was filed almost 3 months ago (still no NOA2 damn it!), hence it was $190.
Starting July, I129F is free, but I130 becomes far more expensive.
So the question is: does it mean I can wait until July and then have I129F filed for FREE? :devil:
(That is if NOA2 for I130 does not arrive yet, of course).

What is your opinion? Is it a loophole or what?

Don't panick!

True, the clock is ticking, but I think you have to accrue over 6 months of illegal stay before you earn the 10 year ban. You have to read more to find what exactly the rules are. I also read somewhere that if you marry to a US citizen, your illegal stay can/will be forgiven. I don't know for sure, I am only suggesting the topics for you to research.
You need to do Adjustment of Status. You will have to address two problems: 1. Income 2. Proving you did not intend to marry and stay in the US when you entered on a tourist visa.
I don't know what you can do about #2, but for income - if you belong to any religion and go to church, you may ask a priest of that church to vouch for you. Otherwise your man might have to quit school for a year and get a job instead. It is rough, but better than failing at AoS and being sent out of the country.
Yet otherwise, you can ask your relatives to lend you a large sum of money, put it in the bank and use it as the asset to prove that you will not become public liability.

But!!!!! We just dont know anybody here... He does know some people from his own school, but most of them are international students anyways.. and the other students are full time students, so they don't work neither..

Is there a way out for us? Is there any idea ? Something helpful you might be able to share with us?

In my French experience post usually takes 7 days versus 3 days in the States. It is not too bad.

Why could not your SO just write a check and mail it to you and then you mail it to the embassy? I will have to go through somewhat similar situation as you do now.

From what I understood, when you fill the Choice of Agent thing, unless you have a lawyer or you live in the desert like a nomad, the beneficiary is the Agent. When I got the papers from NVC, there was a scheme with the papers sent to the petitionner and the papers sent to the Agent.

So, I, the French citizen, got the IV fee papers and guess what? You can only pay if you have a bank account in the US. I had to send the papers to my husband in the US because he is the only one who can pay.

Such a loss of time. We already lost a month with this BS.

Well, there is a chance that filing I129F would be free for you after July, 30.
K3 would definitely cause higher fees later in the process (they say $1010 for AOS), but those fees would be pushed into the future for when your SO is ready to adjust from K3. If I understand correctly, K3 would allow her to work, hence your SO may be able to help you with the cost of the K3 route.
I would do it in your situation, pending that I would worry that this may cause "doubling and mutual interfering" of security checks.

It supposed to help if your NOA2 takes forever...
I hope it would not create a problem with some cross-security checks.
But then may be they just ignore your case and filing I-129F would make CSC look at it again?

I think they want a COPY of your marriage certificate. You will need your ORIGINAL later, don't mail it to anyone.

hey guys..
just wanted leave update.. i recieved my RFE on friday june 15. 2007. i been so just stressed and thinking about stuff .that didnt get time to update. besically they want my foreign language marrriage certifacate that corresponds to the English translated that i submitted only problem with that is that - thats is my orginal document.so i am going to try to get one in my language and send it . i am hoping it wont be problem atleast it shouldnt be and ill get approved.

should start preparing for next time.
what document do i need ?
