Your US citizen spouse has to fill out form I130 and submit it either to USCIS (mail it to the appropriate office, depending on the state your spouse resides). Or, if your spouse lives with you in Pakistan, you can go to the US embassy together (or call the US embassy) and ask if you can submit I-130 directly to them.

You have to submit I-130 either way. You will or will not file I-129F also (depending on wether you later decide to go for K-3 or not), that is once you receive a receipt for your submitted I-130.
So, DO make sure that your I-130 is completed correctly and that all required documentation and evidence is included. But you have to start right now, the waiting times are outrageous.

Hi Severinep,
at some point the US petitioner will receive a letter from NVC stating that case was complete and forwarded to the US embassy in Paris.
It should take about 7-10 days after case complete for the auto message to change to "case forwarded to the embassy".
The US embassy in Paris will send you an appointment letter. Mine came long time ago, so may be you should
(1) Call Department of State (search VJ posts for the number, I do not remember it) and ask them about the status of your case - they should be able to tell you your interview date already.
(2) E-mail/fax US embassy in Paris and tell them you did not receive your appointment letter yet. You have to have that letter, otherwise they will not let you inside and you will not be able to have a medical!
Most likely you will have a January interview.

I was searching topics about travel after application submission... so that was my impression after reading more than a dozen of threads. I could have missed something. I saw people saying they were turned away at the US border and that caused no problems at the interview. I saw nothing about problems. So at least for me, problems as such are major news!..
All right, so according to you, POE officer makes incorrect statements about consequences of entry denial (while stamping/signing travelers passport/visa with codes/legal sections of INA), all the while he/she does not care about consequences of his/her actions to the traveler. POE officer is happy he/she prevented a suspicious person from entry to the US. Suspicions are not necessarily correct.
This is just great.

The OP wasn't traveling after filing. He was merely traveling. That point though is really moot to the third one.

Which is - where did you come to the conclusion the general concensus is a turnback is no problem? It ALWAYS depends on what (if anything) is entered into the passport.

And finally - I don't believe the POE officers give one damn what the results are of making a notation into a passport or into any log of passenger entry. The question of "is it possible/safe to travel after filing I-130/I-129F" comes up on VJ very often. So far, general opinion was that even if you are denied, it does not cause any major problems. Now we see two cases that demonstrate serious consequences.
So do you think those POE officers are not aware of consequences they cause by putting all those codes on one's visa? Is that it? They think "Oh, that's nothing, just a code"?

Ha! So apparently POE officers DO lie to denied travelers, and probably do so to encourage the unsuspecting victim to withdraw and return at own expense.
Eeeenteresting. I am so glad I did not try to enter the US on my then current B1/B2 visa after marriage. Decision on whether someone is just visiting or may have intention to stay is purely up to the POE officer, hence attempt to enter the US after applying for immigration is like playing Russian roulette, more or less.

So here is my review (while memory is fresh):

IV appointments start at 1 pm, but the guards will let you in if you are a little early - so no need to que in the cold (or rain). If you brought food/drink/any electronic equipment with you - it will be checked in and you can have it back on your way out.
I got inside a waiting room and took a ticket (my place in virtual line, I was first). I was called to the windows three times:
1 - turn in my ticket number and appointment letter.
2 - hand in one by one all the documents listed in packet four. I was also asked to show my French residency card - Titre de Sejour. The lady was French and very nice and thorough. She seemed to be surprised that I had everything right. laughing.gif I was also asked if I or my husband have children and if we had previous marriages.
3 - interview with consul. I was asked 5 questions: How long have you been married? How long have you known each other? How did you meet? What is you profession? Why do you want to live in the US?
My answers were found satisfactory wink.gif
I was not asked to show ANY evidence of ongoing relationship, although I brought in like 6 pounds of it. I am sure the consul saw my many folders... and made a wise choice not to get too close to it laughing.gif
She said "we have everything we need to approve your visa, you will receive it in 7-10 days and do you have any questions?"
With that we happily parted our ways...

Hi there,
It may be worth asking your US embassy if they could put your visa "on hold" for you.
If not, I still think you can get away with your plan. Your spouse can help you by putting your name on the apartment lease, and open a joint bank account; you can put your name on energy bill once you have a SSN. That way should you run into a problem re-entering the US, you will have some paperwork to defend yourself.
You can also bring a letter from your former job to prove that you quit your job outside of US and if you sell a house you can document that too.
Basically, you have to establish that you are in transition, I doubt that you will be denied entry 9 months after 1st entry, if you show plenty of evidence that there is no ties to your home country anymore and there are ties to the US.

I called the police station of my town and they were a little bit surprised about my request. I was not suprised as in France, you can ask for your criminal record at the Department of Justice. It's an official document showing (or not) everything.

Do they really need something from the police in my town? It does not make any sense because if I committed a crime in the town 2 miles away, it won't show on the records of the police in my town.

Then, you'll see the baggage claim/connecting flights and you can wait quietly.

On your flight from JFK to Detroit, as it is a domestic flight, the plane will park at a "domestic flight parking space" so that when you leave the plane, you won't see the immigration as no one will need it because it's a domestic flight.

I want to add my 2 cents here. What the NVC says was pretty confusing to me. I called my local police station telling them I needed a certificate and they told me they don't do such a thing. They told me to use the regular criminal record (the one you're asked to give for certain jobs...)

I then checked my US embassy website and that's the document they want: a copy of my criminal record from the national database. It has nothing to do with my address and how long I lived there. Everyone in France has one and you ask it to the department of justice.

I suggest that you double check on the US embassy website of your country. The NVC will tell general information. On the other and, the US embassy knows how your country works and will tell you exactly what document they need and how to obtain them.

Be extremely careful: what they mean by "certified copy" is NOT a xerox copy with a stamp. It is an official document signed by a registrar saying it's a certified copy from the original certificate (that is kept by the city hall or whatever government place). They want originals of everything.

Call to the city hall of the place where you were born or where you got married and they should be able to tell you how to get these documents. I know that for France, I could ask for my birth certificate online and it was sent to me within 48 hours and I wrote the the city hall where we got married asking for a copy.

Both documents were printed on official papers with a stamp and the signature of the registrar who took care of it.

I don't think you can divorce over this or that means they had other problems in their relationship that you are not aware of.

Once your case is approved, I highly recommend that you call the NVC because with the new system, you might get your interview package less than 1 week before the interview!

At least you know he left you because he has no spine and because of his family pressure. Many don't have even that knowledge.

As far as your financial responsibilities - as LPR he is not eligible for any means tested benefits within the first 5 years in the US. Yes there were cases when sponsors got sued to provide support anyway, but they are very rare. Just get a divorce, take him off all your accounts and forget about him. It takes two to dance... you alone can not change anything.
