IR-1 / CR-1 Spouse Visa Process & Procedures	To DCF or not to DCF...that is the question...	May be your fiance has friends in Moscow who would not mind you staying with them for a couple of nights? Russians do it all the time, nobody is keen on paying those high hotel rates. It is not like US, where you think twice before barging in on your close relative As for travel, I am sure you can travel relatively cheaply by train. And Russian "long distance" trains are not all that bad So, considering that with DCF you will have your future wife following you in about 3-4 months, and filing from the US it will take more than 9 months to get a visa... Definitely, a vote for DCF!!! It only delays you by ~ 2 weeks if you responded promptly. - Vermont filers probably see "average" processing times now, because the workload was re-distributed between USCIS offices. That is a good thing, in general. - the complaint about work visas being through faster than family visas is just silly. I am not sure that sending a bunch of letters will change anything, but if you intend to do so - good luck! I would work on the wording of this letter a bit more tho. Please someone update me, I am too excited to do anything right myself Okay, we did not get the snail mail yet (obviously), I did not receive an e-mail either. But I went to USCIS website, and it was there - APPROVED! For those interested how important it is not to make mistakes onthe paperwork: We did not put None or N/A for the A number. IR-1 / CR-1 Spouse Visa Process & Procedures	Timeline on I 130 Approvals	Suggestions: AnnaF filed both I129F and I130, both forms got approved on the same day. No offense meant (happy for you!), but this list was made to reflect "pure" I130 filers. This is because "double filers" get approvals much sooner. Which is great for them, but screws up statistics - you can't compare the two groups (I-130 only and double filers). Suggestion - to remove? Trailmix was originally a VSC filer, according to his signature. Suggestion - to correct CSC to VSC on this line. IR-1 / CR-1 Spouse Visa Process & Procedures	Timeline on I 130 Approvals	There seems to be a seeming speed difference in NOA2s for the I-130 forms, for both VSC and CSC, which benefit K3 receivers. What I'm personally wondering is why has CSC approved 20 persons on this thread while leaving 3 serious laggers (defined as filed last year but still hasn’t been approved), when the same numbers for VSC are 7 approved and 8 seriously lagging. The available statistics just don't add up with the picture represented on this thread. It might be that the sample is too small or biased or equal, but it has to be pretty badly so in order to produce such varying results. Hi Stabu, I've read somewhere in this thread that indeed K-3 filers get their NOA-2s faster, mostly on the same day as their NOA2 for I129F in fact. The drawback - I-130 is then retained and I-129F is sent to the corresponding embassy, meaning you will need to pay additionally and file more paperwork and lose another month or two, if you want your I-130 to proceed instead of I-129F. Soooo, then this is why people removed K-3 filers from this list, to avoid screwing up the statistics As for the laggers I suppose sometimes paperwork DOES get lost and then sometimes people do not update their profiles... However in the top part of the appointment letter it is written "Paid" in black ink. Does it mean that since the IV bill was paid to the NVC, there will be no payment required?... They should have, it's been more than 2 months since "case complete". If your case was forwarded, you can call DOS and inquire about the status of your case. IR-1 / CR-1 Spouse Visa Process & Procedures	Embasy Application	Here is Fiji's US embassy website: http://suva.usembass...nformation.html They say nothing about direct consular filing availability, but you can call them and ask if they allow it (ask if it is possible to submit I-130 petition directly to the embassy). However, even if they allow it AND you can comply with all their criteria, then you will need to cancel your currently processed I-130/I129-F before filing I-130 directly. You can not have two I-130 processed at the same time. So, if I were you, I'd get copies of all work done by your lawyer and then fire him From your timeline, he waited 2 months between NOA1 for I-130 and filing I-129F. Unless I missed something, he is lazy and will cost you time, not just money. As is, you can simply wait out and see which petition (I-129F or I-130) gets approved first (hopefully within 1-3 months), then you will need to do paperwork for NVC and then you will have your interview. If you are not comfortable doing the paperwork yourself - get another lawyer, hopefully a better one... Consider that a lawyer will not collect the needed paperwork for you - YOU will likely have to order IRS transcripts, police records, get translations of all kinds of documents yourself! YOU will have to prepare evidence of bona fide relationship - e-mails, phone records, letters etc. or if you live together in Fiji - evidence of co-habitation. But, one of the questions on the medical questionnaire was - have you ever been admitted to a hospital or had a surgery? I ticked "Yes". I had, twice. Then at the bottom of the questionnaire there was a note, saying "if you answered yes to any of the questions, be ready to provide records at the time of the interview"... Well, one of my surgeries was 20 years ago, when I was a child, in Russia, during the still communist times and at a first commercial clinic. No records kept there and my family did not keep whatever doctors gave us. Records would be available for the second hospitalization if I went to Russia to pick it up personally, but I did not plan to, and my interview is in 5 weeks. I am sure I can not be the only person going through immigration who was ever admitted to a hospital. What was your experience? Did they ask for your medical records related to hospitalizations? If yes, did you provide notarized certified translation of your medical documents? (I don't know about other countries, but Russian doctors tend to make records in handwriting that even Russian patients can't understand, that will be tough to translate!) But, you could download an I-864 form from NVC website and read their instructions - there may be a clue. My feeling is that whether you can use this payment as income would depend on the reasons why you receive this SS check and for how long in the future you will be receiving it. But that is something you will have to deal with in several months. Also, once your I130 is approved and your case is transferred to NVC, you can call NVC operator and ask about what can be used as income. Yes, you can ask your mother to be a co-sponsor (it is OK that she lives at another address). You should really read I864, it explains several ways of meeting income requirements. Yeah, 5 months is a bit of a long wait for approval, but not unheard of. Did you receive NOA1? If not, you should call CSC and request a duplicate. Do you know your case number? Then you can check your status online on the USCIS website. 6 months after NOA1 date you can bother USCIS and ask them why there is no decision on your case. Are there any "touches" on your case (you can see that online, the date of the last action will change)? If there are touches, do not worry, USCIS is working on it. If you are not approved yet (you are talking I130 approval?) then why are you contacting you congressman? How long was your I130 pending? 2 months to get NOA2 for I130 is nowhere close to normal. Your phone situation is not a problem. You and your daughter live at the same address and you (hopefully) put this number as your contact number on every document you sent to USCIS or NVC. You can prove your address (lease?) and you can show a bill for this phone number with your address on it. Your bad credit history is not a problem. Your income may be a problem. I believe that you have to make about 26,000 for a family of four (please check the poverty guidelines). You need to find out if your social security check can be treated as income or it actually creates a problem. You may have to find a co-sponsor, or to show that you have assets in the triple the amount you need for 3 years, or to get a notarized job offer from the US... at least this is all I can think about right now I mean I know all this should not apply to you, as you should have been able to DCF , but now this is where beaurocracy leaves you... Seems to me that your AoS bill go lost and you should call NVC and ask them to send you another one. If AoS bill is not paid, they will not accept/review your I-864. AOS does take a long time, but if you can stay within the US border then it should not be a problem. If you choose to marry and stay - think of possible proofs you could offer to prove you did not have intention to marry when entered the US. You may get lucky and question of intent will never rise. You may get unlucky... what do you have to prove that you did not have intent to marry? I would say, with 6 month stay it is very reasonable that your intent to marry arose within those 6 months in the US. It is a long time. But it would be nice if you had something else - something that normally would require your fiance to return to Russia. Does she own property there? Is enrolled to a university?
