Personally just got through activation of my green card.My husband had already left France when he filed ( we had a weird situation )
and he filed at Vermont center. They took their time, we took ours.

I have been able to go through multiple times under Visa waiver program
At first for business purpose, then as visitor
sometimes officer would not ask / not notice
once I had to show my ties to France to demonstrate I was not going to stay

Hi all

I processed my IR1 visa on Jan 9
so I have my passport with the visa stamped now
no more worries to go through immigration I guess

I am currently back to France
(visa is not the onlyy hurdle, wrapping up in your country is another....before starting well over there)

Husband tells me I received a welcome letter and a tracking number
Has not scan it to me yet (he does not like paper....)

can I do anything with that tracking number?

Have not received SSN yet!

Why not K1 instead of CR1?
K1 is faster to be together
But I am not sure you can work after K1 until Adjustment of status done
and basically the bunch you do during CR1 you have to do it after being together.
So CR1 might be simpler maybe.

I was with my son, US citizen
I had been told previously at previous entrances under Visa Waiver I could go through the citizen line when with him.

Showing my visa to be processed I was sent to the visitor line
went down up till the end of the citizen queues and the beginning of the visitors and saw a citizen line a little hidden with only a person in the queue
went there
was quick

at secondary inspection it was also quite quick
about 5 people before me
done in 20 minutes

I was happy because I had only 2 hours to connect

Good advice from Vanessa and Tony.

you need to think about all the steps to go through. To go through NVC, or direct filing in Australia your fiance will to do demonstrate she can sustain you in the US I864 or Affidavit of Support. Don t forget that. Either with revenue or asset or she will have to get a cosponsor (her parents) ready to sustain you.
Will she be able to do it? Or convince her parents or somebody else?

Also why don t you go K1?

I would read again very carefully the instructions
knowing that you have to comply with them either with documents you bring or documents nvc got


I remember Part of the instructions you receive are very specific (like A O checklist)
Then other part of the instructions Paris embassy sends is not specific to IR/CR1 through US Service Centers but more or less like the DCF instructions listing all documents from A to Z petition process. that can be confusing

Each case can be slightly diffferent
personally I think the specific instructions were more or less a summary and no new documents were required but my memory can be wrong

what I remember well is that
I brought copies of documents previously sent
also the originals when copies had been provided
also more recent employment letters / irs returns as time had passed since documents sent to NVC
and passport pictures
and chronopost enveloppe
were the most recent documents necessary not sure, but the lady took them saying very well

if I remember well I also brought more recent police document or mariage certificate
but they were not needed per embassy instructions. It was just in case and because they cost little to have.

conclusion
read it carefully but with a flexible mind

I would correct that it is true in general
there are some exceptions I have seen where only the K3 received NOA2 while I130 never received it.

By submitting I129F you are on the K3 path and you dropped CR1 and lost your i130 line.
Generally you can later restart CR1 but after going through the K3 line up to NOA2 and if Service center gives NOA2 at the same time for K3 and I130 (2 simultaneous NOA2s) . You do so by dropping K3 at embassy level. (i did it) Except sometimes only the K3 NOA2 comes out (no luck). When restarting CR1 it will be at NVC level that is what is fast for K3s but less fast for CR1.

Voilà, our journey is over. My IR-1 visa (immigrant visa) was granted yesterday.

My appointment was at 1pm at the US embassy in Paris. We showed up at 12:15 pm and they didn't want to let us in so we came back at 1pm, time of the appointment.
After 10 mins, I had to give my letter of appointment to someone. I was called again and this time, she shecked my documents and asked for my medical. Asked a few questions like "When are you coming to the USA?". I answered I didn't know exactly. I was caught off guard as I can't go to the US if I don't have the visa. She told me I had 6 month to enter the US and to go sit down, the officer would call me for my interview.

By the time I was called, it was 4pm already and she just asked where I was going to live in the US (whate State) and where was my husband and that was it, she said congratulations, you'll get your visa in 7 days, don't open the sealed enveloppe we will give you bla bla bla bla...

It took less than 20 mins for everything. The wait lasted for 3 hours though.

Some tips: it wasn't mentioned anywhere that I had to bring en enveloppe (Fedex, DHL...) so I had to go to the post office and send it to the US embassy.
My husband had to scan the appointment letter he received or I was unable to do my medical on time. I received my appointment letter 1 week exactly before the interview and during that week, you had Christmas day and New Year's day. With doctors on vacation, I would have never had the time to do all this on time.

I also would like to visit my husband while our CR1 is being processed (we should be able to send next week), most likelly this summer. I just want to make sure everything is gonna be fine, but some posts here are threatening !
I guess it is like you said, a matter of mood of the day but still, if you just come to visit with no intent to remain in the USA but just spend time and money here it should be fine... Anyways, I'd like to visit middle of July to middle of August, I am renting an apartment, and I have holydays planned in France with my parents for end of August. Could proofs such as apartment rent or return to university for september would work ?
We really would like to spend some time together to make the wait more bearable but my husband is in the military and he cannot have any leave days before a few months so me visiting a few weeks is the only solution.

Yes I have seen the edition on the website, but I still wasnt sure cuz this date on top right is confusing. Tbh, I had not paid attention to it, had taken for granted that the form was good since I downloaded it last week from the USCIS website, but my husband just spotted it and said straight away "expiration date", and that freaked me out, haha ! Yes I know this is quite stupid but it put some doubt on the form and so I prefered to check everything was good before going any further.
Now I know, but you are right, they should do something about it.

my husband I are currently filling the forms we need for our CR1 but the G-325A seems to be a problem. We filled the infos and everything, what is bugging me is that on top right of the form it says Exp. 05/31/09. The problem is I already sent my forms signed to my husband, and there is anyways NO NEW VERSION of the form on the USCIS website. I don't know what to do and if we can send those so I hope that if we send the ones we have we won't get screwed :S.

You can, there is a specifical part on the I-130 for that. Part C-14, "If your relative is currently in the U.S." then you will have to complete what they asked, i.e. the stuff abt your I-94W (you get that on the plane).

I got in the USA the 1st of May, we married the 9th and I left to go back to France on the 24th. We have sent our I-130 package last wednesday (17th of June) and are now waiting for NOA1.
Ask me if you need anything, I will help as I can, as I am myself kinda a "noob" on the process hehe.

PS : In any way, when you get at the POE after you get off the plane, never, never say you are here to get married. You also may want to bring proofs that you are gonna come back to Sweden (round-trip plane ticket, rent for apartment, etc.) as you may feel safer then.

And yes I come from a VWP country aswell (i'm French), so actually what I fear is to get to an agent who is in a bad mood and tries to make problems out of nothing when I wanna come visit.

I was wondering about one other thing too, some people say if you join photos in your package (and we have a few) it is better that you got them printed with the date on the back, but I dont know where my husband could do that in the US, or if it really has to show the date or that it just is an option. Actually we have "so much proofs" to send with the photos that it seems the package is gonna be huge blush.gif copies of letters, phone bills, pics, plane tickets, train tickets when husband was in France and a few debit card receipt and stuff (not inven including chat logs cuz it is TOO BIG), so well, it is kinda a mess.

my hubby and I got recently married and are going to apply for a CR1 (prob will send package end of next week). What I have read on this topic was really interesting (Thanks to the person who posted it) so I was wondering I we could apply. My husband is in the Air Force and currently finishing his formation which is gonna lead him to his first deployement, and we would really like that everything is set before this deployment. Furthermore, we are currently renting 2 appartments : his in the US, and mine in France, and this is seriously a lot of money. That's why I am wondering if it couldn't be taken in consideration.
Now the question is, when do you apply for an expedite, can you do it when you send your package ? Or a while after ?


Other question out of topic : does anyone have experienced travelling to the US for visit while their CR1 was being processed ?
Like all of you, I can't live without my loved one so much anymore and I really would like to visit for summer, I am just quite afraid not being let in, even if I don't have any intention to stay till the visa is not approved.

I called the NVC and they say they forwarded everything to the embassy so we dont need to bring the documents, WHILE the embassy specifications say we NEED to bring all of the I-864 related documents (see post above).

I have been away from VJ for a few months, but here I come back with my interview date, which I got this morning.
This is the good news. However, I am a little panicked regarding some documents to bring the day of the interview, especially the affidavit of support.

The documents for the I-864 and stuff have been given to the NVC in the "AOS Package" and I do not know if I have to bring them again for the interview or not. The different places where you find the info are very contradictory !

IF a sponsor filed an I-864 (Affidavit of Support) AND provided the NVC with
proof of an IRS Federal Income Tax Extension in lieu of a Federal Income Tax
Return, the applicant must bring the sponsor's most recent Federal Income Tax
Return to the visa interview.


For me it means that you have to bring the Tax Return IF you gave a Federal Tax Income Extension to the NCV instead.
= have to bring nothing

Evidence of financial support (e.g. Affidavit of Support, a notarized offer of employment, or evidence of assets)


Here for me it means you need a copy of the I-864, and/or of your own assets. Different version. :unsure:
= have to bring the I-864 only and/or your own assets.

The following items are required for all visa types, except employment-based visas:

And here for me it means that you have to bring in EVERYTHING again, even if it has been submitted to the NVC already. :wacko:


Please if anyone can help me on this it would be so welcome. my husband who is in the Air Force is currently deployed. I have the copy of the I-864 and all the pay stubs for 2009 here but not the one of the tax returns, so if they are needed we're in deep s***.
This is so totally confusing...

I have the very same case. My husband is being deployed since last thursday.
We have been wondering exactly the same as you, so we called the NVC and we asked them if we had to change the adress, etc. They said we do not need to, because anything they are going to send to us will be by e-mail.
However, do not do the same mistake that we did : have your husband take a copy (and the orginal of the documents too if he can, or if he can give them to you) of everything with him.
The reason why ? After sending the AOS package and the IV package, I thought we just needed to wait for the interview. Well, I just got my interview date, and now I am very confused cuz the embassy specifications says to bring all the documents related to the I-864 to the interview while the NVC says I do not need. As I have not managed to get any info yet (seems that no one has been interested in my topic except like 2 ppl so far), the only piece of advice I can give to you is to be more prepared than us.

From the processing time statistics, I will get the k1 visa before end of october.
My daughter is declared on the k1 visa as k2 and is living now in France with me. She needs to attend highschool in August in the US. My question is : could she use the "visit visa" for the school term while waiting the k1 visa obtention ? is it an acceptable and legal way regarding to the law ?

Has anybody ever have the same issue to face with ?

10 months pending did happen to some people, but I would not call this normal. May be you are on administrative review? Or may be you waited a long time before replying to RFE that USCIS sent you (request for more evidence)?
I assume here that your are already married and filed only I-130 from outside of the US?... Then it is not normal for your case to be sent to a local office. But if you filed for adjustment of status, then I just don't know.
Either way - if you provide more info, somebody may be able to help you here.
Otherwise why not call USCIS and ask them?

Chances are, NVC will "complete" your case in about 2 weeks after you send them the last required document.
