I do confirm that giving emails is good. I called twice and the second time the person asked and took our mail and today we received a note about the fee. (in fact a forward of letter to lawyer).

we got our NVC number by calling AVR +1-603 334 0700
on the AVR it says to allow 6 days since case created in NVC

we have not received mail yet (for IR)
Our NVC number was created May 18th and AVR did mention our lawyer (while we did not expect it)
maybe mail will be delayed by fact we removed lawyer via mail on May 22 / will go to lawyer first

have your NVC number or get it through the automatic voice system by giving your USCIS number

ask for operator, given him your email names
(so you will have a copy of what the lawyer receives)

to get your nvc number you must first do the AVR instead of going through operator immediately

option 1 for english
option 1 for family visa
option 1 for uscis number (as opposed to 2 for nvc number)
there you enter your uscis number and you hear
-your nvc number
-your status
eventually at the end you can do 0 to get to operator

or call back and do
option 1 for english
option 5 for operator

You may find that the lawyer is going to receive the fee notices.
we had a lawyer ourselves and he received the fee notices
that was not a problem because we received them via email also and did pay ourselves
then for following steps my husband was my agent

0) tell your lawyer / send him a letter telling him you no longer use him
1) you need to call NVC and give them your email addresse
2) you tell operator and then an email or a mail telling you are no longer using the lawyer
3) the petitioner can send choice of agent maybe at the same time (I did wait but not sure it was needed)

if you are sure you sent original/certified and they are mistaken, you can ask like us to have it checked by supervisor,
will take about 7-10 days
but is not a waste (at least wasn't for us)

operator can see problems in the records before checklist is sent
operator does not eventually read all to you he eventually stops after first or second problem

I would call operator to reaffirm you have sent all ok
just ask the operator to have it checked by supervisor
or just be a pain and sure about what you sent and she/he will do it automatically

in our case, they told us that marriage certficate not original / certified
we heard about it as checklist on AVR but did not wait for checklist email
I call operator to understand the problem
she told us only one problem and not the other about tax retruns
I told operator I was sure that certificate was good, she said that the only thing she could do is send to supervisor) and so she did

we also sent email with comments scans to nvc without waiting for checklist
"this email is to confirm that we did send certified marriage certificate" blabla..

Later came the checklist mentioning the problem, but operator confirmed then that problem closed and we did not need to resend
just answer about another pending point

did lawyer receive checklist email? he could forward if so.
or is checklist still not sent by NVC like in our case when we first heard about it on AVR

Hi Guys

it was tough but I got in with Visa Waiver
Thanks God Supervisor at secondary inspection was clear and said no problem
but initially I got put aside with red enveloppe by the first officer
and the officer who stamped at the secondary inspection said it was first time he saw that.

I know it seems odd to you all
but it is perfectly ok
although pretty rare I admit.

I am still working in France and will not cut my ties until end of the year
it is too early for me to activate my GC now
I can activate it until March.
I plan to do so ealry next year

I also plan to come back for thanks giving weekend under VWP
hope it will be ok again!

I think about it a little like the trips while waiting for the visa
need to prove ties
and subject to good will / judgment of officer

certainly Canada is in a better position to try this
as there is no flight back issue if passing the border by road

but if it makes sense for Canada
should make sense for Europe too, shouldn't it?

As an aside..... we asked the Consulate Officer about this at my interview and he told us there was no policy which stated it must be used once it is in your passport. However, he did emphasize that it was always up to the CBP Officer at the POE whether they will let you through or not. He did offer me the option to delay issuance of the visa until I was ready, so you can certainly ask about that.

I don't see why you wouldn't activate the visa immediately. Having the GC or I-551 stamp makes easy exit and entry to the US. You will still be a French citizen and as far as anyone in France is concerned the GC means nothing. Just don't stay outside of the US for more than 6 months without a proper reentry permit.

No "schemes" there, just rights and sense.

if I plan to go under VWP it is just that I feel it makes sense.
On one side I am afraid of non sense
On the other side I feel that if I am clear with myself and not burdening the officer will
not see any harm (like it has been the case for my previous visits)

I waited so long for this visa
If early / in the middle of the year I would certainly not delay things
but going immediately as GC now is complex versus waiting some few days

why couldn't avoid to activate GC if I am again going back and forth one more time
still having my job or having to receive settlement from leaving job
still having not moved my furniture
still having my French taxes to settle
etc..

Also my mother has a donation in progress at the notary
and she will complete it by november (I told her to hurry up but I doubt she will manage)
she has been preparing it for months with the notary and has deadline of november because of her birthday
being a US resident at that time might wreck the work of the notary, wreck my mother spirit ,
and make it awfully complicated

I want to be for holidays with my husband
making it more bereable to wait
for me to come really and settle end of the year / beginning of 2010
I will not work and have no revenue


when you activate GC you become immediately US resident
I would like it to be not too soon now to simplify handling

why would I make things complex
mixing in 2009 revenues from France with residency in the US

I have been travelling under VWP while waiting for visa
I feel I can travel still waiting for appropriate time to become resident

I have to study more about taxes
see if manageable to come end of the year

Probably in the states for Christmas I will probably come back early January to see my family
for Epiphany , then go back and activate GC and bring furniture over

I don't care about getting GC early
I need to wrap up fiscal and work things
and having the GC makes me Us resident
and I think it makes it very complex

Hi all

I have interview at embassy next week for the IR.
but I worry that I might be in trouble going to the US next time.

I went for K3 then but dropped it while pursuying IR at NVC.
Pratically maybe I should have pursued K3 first in order to wrap up
all in France and also delay the GC until after Jan 2010 but now it is too late.

I want to be with my husband and stable in the US asap
but might be only in January 2010 that I will be willing to activate GC

in the meantime I want to see my husband and would travel in October
what if I have the visa for GC but choose not to activate this time
and travel again under Visa Waiver.

Hi
I plan to get in and activate green card on Jan 9
then I will be flying back to France end of Jan
and will come back Feb 8th

question 1a)
any issue that maybe I will not have received green card before I fly to France end of Jan?

question 1b)
should I delay activation to february (visa is valid till March)
though I may need to fly again who knows

also husband still has his old address (of parents) on nvc file
I have the same on my visa papers
should we notify of change of address or keep old address
it may be weird to keep the old one as it is not the same state and will not match address
I give when flying
it may be trouble also to change because it is not the one on my visa papers

supposing your kids are us citizen they don t need visa

your husband has to file I130 for you
the sooner the better
eventually the so called Direct filing of I130 in Canada while he still is in canada is the fastest track
if he leaves Canada then he has to file either at Vermont or California Center.
Maybe he should contact the US embassy in Canada
I recommend you look at Direct filing and Canada info on this site.

Personally just got through activation of my green card.My husband had already left France when he filed ( we had a weird situation )
and he filed at Vermont center. They took their time, we took ours.
it was 18 months ago

I have been able to go through multiple times under Visa waiver program
At first for business purpose, then as visitor
sometimes officer would not ask / not notice
once I had to show my ties to France to demonstrate I was not going to stay
