Hi there, a lot of what you are speaking of is not considered primary evidence. Primary evidence so to speak is things like ticket stubs from airline flights there, hotel receipts with both of your names, and items of the like. If you have phone records, keep those and use those. In your skype account, there is a way to saver your history, start saving that. Pictures any any visits you've had together, any receipts you have from whe you were together also help. Another thing you might want to try, if you do not have a lot of e-mails and things of that nature, written statements from both sides of the family and friends confirming the relationship may help. Snail mail is regular mail sent through the post office. I would suggest you starting using this form if you are not already, then keep the envelopes when they are delivered to you. Because the countries "stamp' the mail it is good evidence that you are corresponding. You stated you just filed your K-1 most of this type of evidence will be needed at interview which is some months off. Yes, you may not have a lot of these items now but begin gathering it now as you move forward.

Hello again Vj'ers,

I have a question about the G-325A. my fiancee filled the form out on my last trip to manila and printed her name on the bottom but did not sign or date the form in the signature section. can i send in a scanned copy that has her signature. (think i just got my answer by reading further down the step by step page. :( anyone ever send in scanned docs and got approved before?



I would suggest sending to her all documents that need her original signatures via e-mail requesting that she print and sign several of them, just in case one gets lost or something then have her mail them through Fed Ex or DHL direct back to you. I used DHL to ship from CA to Turkey and my husband received the documents within 3 days. But you do need original signatures. Also, just a suggestion, some of these documents have expiration dates, so make sure that you download the most current templates/documents. I would determine what documents will require her signature for all phases of the process going forward and have her fill them out and sign them. She may, if you provide her the links be able to just fill them out online then print several copies and sign. Hope this helps.

I looked for the answer here but could not find the answer. Does anyone know how long it takes a petion to be returned to the United States from the Embassy. I called UCIS and they do not have it. They told me I had to wait 120 days. Does that mean it takes 120 days for the file to be returned or do they have 120 days to review it?



Hi yes. It can take anywhere from 1 month to 12 I have seen in some curcumstances for the file to be returned to USCIS, then it has to undergo the review and the approval/denial. The 120 days that you were quoted is an approximate time frame for review once it has actually been returned and received by USCIS from the consulate. Although I understand you have valid points as to why you had limited time together etc, the truth of the matter is that they want to see above and beyond evidence of a bona fide relationship. As someone else mentioned above, one option to consider would be to marry there and move there temporarily if that is feasible for you then re-apply for an IR1-CR1. If not, another option would be to wait out the final decision of the review once it has been returned to USCIS. It is really more a decision of what works better in your particular situation.


As for contacting a representative, typically from what I have seen from others who have posted on this site is that they can assist with obtaining more clarity from the consulate as for the reason for the file being returned to USCIS but as far as assisting with getting the case approved, unless there was an administrative error or something along those lines, their reach for aiding you in obtaining the approval you are seeking can be rather limited.

K-1 Fiance(e) Visa Process & ProceduresFile Returned to USCIS

I contacted one of my senator's office last week and today I found out that our file is being sent back to USCIS.The Consular officer says that the relationship was entered soley for immigration. I have only seen him once in 3 years. We are trying to save our money for our future. He had his interview last month and was given a 221G form requesting proof of relationship. He brought hotel receipts, engagment ring receipt,emails, my phone log from my calling card and pictures to the interview. I thought that was enough. In response to the 221G we sent pictures, emails (about 65) , engagment ring receipt (again), envelopes from the mail I sent him.
The only possible red flag I can think of is that I am a lot older than him (about 17 1/2 years) We get along great and the age has never bothered us.

I plan to call USCIS tomorrow or Monday. I also plan on calling my representative in congress. I am doing the right thing by contacting USCIS? I am unsure what to do at this point. I am also considering hiring a lawyer but I thought I would contact USCIS first.

Has anyone else gone through this? What is my best course of action.

Hi So sorry to hear about this. Unfortunately my fiance and I experienced something similar and I had actually gone and visited him about 5 times from when we first met to when he had his interview which was about a year and 1/2 total. At the time of our petition the requirement was a minimum of 1 personal meet in a 2 year period. I am not sure if that has changed or not. No, we were not out-right told that the reason he was not granted or issued a visa was because they thought he was in it only for immigration, however they state that they needed more evidence of the relationship. While you can contact your congress person for aid etc, the unfortunate fact is that they are really looking for concrete evidence of you both trying and wanting to spend time together, planning for a long term future together and wanting to be married to each other. Although you state that for financial reasons you decided not to see each other more over those three years, in their eyes, they may question how you plan for a long future together and have a solid enough foundation on which to build that future if you have only been together 1 time in those three years.

My suggestion to you is that before you spend the money for the attorney, that you do a few "free" consultations with several attorneys.That way you can get the professional opinion of several individuals to see if they concur that the primary issue is the lack of personal meet or something else. In addition, as the file is being returned to USCIS, do not be surprised if it takes 6-8 months for them to actually receive the file. You may want to consider exploring other options, going for visits, if you have not already done so, get letters from family members attesting to your relationship etc. Unfortunately however, if USCIS comes to the same or similar conclusion as the consulate, you may want to consider working on building your relationship more so from the stand-point of spending quality time together, in person, then re-petitioning. I will tell you that we provided much of the same documentation as you described, proof of phone conversations, video chats, letters mailed snail mail to each other, and other such pieces of what we felt were concerete pieces of proof or our relationship and still found ourselves in the same boat as you.

Anyway, just wanted you to know that you were no alone. If I can be of any help to you, please send me a private message. I know this can be dis-heartening, but do not give up. Just re-group, utilize as many resources as you can at your disposal and consider your options and alternatives and go from there. I wish you the best.

Can someone tell me what the purpose is to mail the copies of I-129F package, supporting evidence of an ongoing relationship, original documents used for the I-129F, a copy of the NOA2, letter affirming your desire to marry your fiance, etc...??

Will the interviewer ask to see these documents and proofs during her interview? I like to do things by the book and I think mailing unnecessary documents and proofs will only cause confusion and clutter if they are not needed for the interview. Can someone tell me if my fiance will need these documents and proofs at some point during the interview? Thanks.



OH and make sure the photos of both of you show the "ears"...this is something I completely missed and will hang your fiance up at the embassy. Luckily mine caught this and made sure hers was correct...I have short hair, so I am in the clear ;)

I just sent my packet yesterday. The "step by step" instructions on this site for the K-1 are very helpful. Also, you should visit the "Embassy Reviews" section...there are recent experiences involving the embasssy in RJ(if this is where your fiance will go) After reading, I feel like I know exactly what mine/we will have to deal with when she gets to this stage.

I was wondering if anyone could help me with this problem:
My fiance will have his interview soon and we are still working on proving our ongoing relationship. I have called him many times on calling cards. When I called the calling card company, they told me I could subpoena the calling card company to get calls from a card or cards, but then the lady from the legal subpoena office of the calling card company told me that since those cards are prepaid and throw-away, (the kind I bought form a grocery store,) that they would not have any record of my calls -- even with a subpoena.
I heard that there was a woman who posted on visa journey at one time who obtained proof of prepaid calling card calls, and she bought her cards from a gas station. I have no way of accessing her posts. Does anyone have any ideas about if I can access the calls I made to my fiance with pre-pay grocery store calling cards?? Also, does anyone remember seeing her post and know how to access it?



My fiance' wanted me to save the old cards(I guess for sentimental reasons) so I have stacks of them. I checked my cel phone records and found the access number I had been using for the cards and highlighted the number on the copies of the records, and made copies of 4-5 of the old cards highlighting the access number on these as well and sent in with the 129F. Luckily, I had been using the same access card and number for several months. It remains to be seen whether this works or not. My fiance also sent me several months of her cel phone records showing all the times she had called me. I guess my advice is dont throw the old cards away!

My fiance and I were wondering if we are required to pay a separate $131 (Visa application fee) for her daughter. The child will join us later in the US after we get my fiance here and settled. The interview is scheduled for Feb 19 and my fiance will have to fly to Rio from her hometown which will be about $300US roundtrip. We want to be sure she has enough money to cover any extra costs so we dont have to pay for another flight, delay the visa, etc. We are also wondering if her daughter needs to go to the interview because she has an Italian passport (my fiance holds a Brazilian one) and I am fairly sure she will need a separate stamp to get through the POE when she joins us. Sorry if this question has been answered in another post, but I dont have the time to do a search today!

OK EVERYONE READ THIS AND TELL ME WHAT YOU THINK. USCIS INTEROFFICE MEMO dated 2/4/08 REVISION to the 180 day FBI CHECK. 180 day limit still applies on your end- however once the 180 days is reached you can address them on this policy and they are to approve you until FBI gives them information to start a removal process. They are supposed to issue your card right away.

Have you been to the Ankara Consulate website??? Let me warn you - they are horrible at following procedure! We never got an interview letter. I had emailed the consulate and asked them if they could take into consideration that my father was dying and we would like to all be together for his last Christmas. I was asking only for an interview BEFORE Xmas. They responded and said- CONSIDER THIS YOUR NOTICE- January 8, 10 am appt. That was it- they never sent him anything. WHEN THEY ASK if he wants his interview in English or Turkish - TELL THEM ENGLISH- you are going to get it in English anyway. My husband said Turkish and boy was he sorry. Hope you don't get a Chinese American woman- She is a total B*TCH! We are still waiting for his visa they say another 4 to 6 months! Anyway, this woman is MEAN- She asked Zeki why he doesn't have a Turkish girlfriend and WHY did he HAVE to have an American.... Insinuated that his mother hated me and that he hated his country. Its really crazy. He said he could not wait to get back to Istanbul. He just wanted to cry. WE are going thru security clearances now.


We applied in early June- 2007 It may be a full year before he steps on US soil. I'm leaving for Turkey in a few days- ( every 3 months! )

First let me say you need to make absolutely certain this is not a language barrier, and it is not just because of the different languages that you are misinterpreting things. I wouldn't care if the person were white, black, yellow, or green, it is not ok in any culture to be deceitful with statements one is making.

If this is an infrequent occurance, it could be that it is simply a misunderstanding between the languages. She may be getting frustrated because she did not understand what you said to begin with.

the dilemma..

she was married in Peru and the husband divorced her in the usa. i got her copies of the divorce and got the documents stamped from the Peruvian embassy in Houston validating the documents. she began the process to get the divorce recognized in Peru last November; at the same time we began the process for the fiancee visa. the problem is her visa interview is Monday and her appointment with the judge to get the divorce recognized is not until august.

will this be a problem in getting the fiancee visa?

not sure about other countries, but my fiancee is from peru and was given shots at birth but there were no records. my fiancee went to her medical appointment without records and she only had to get 3 of the vaccinations listed. i guess the doctors knew which shots she had received at birth. maybe your fiance received some shots at birth too but does not have records. good luck.

Agreed. Regardless of whether or not you are working with an attorney that should not prevent you from calling USCIS and following up on your own case. You are entitled to know you one personal information. And they will speak with you if you are the petitioner or beneficiary. Additionally, I just called USCIS about another subject concerning my case and found them to be very helpful. The woman took the time I needed to answer all my questions and she was quite informative. It was a positive experience so I would encourage you to call.

Today, I got the text and checked my email. I think I stared at the USCIS "Post Decision" dot for 30 minutes in a trance. Wow what a feeling this is.... Now very nervous and anxious too. I have to Thank everyone of the VJ Family because without you while Kadir is working abroad without internet and limited fone signals, I think I would have gone crazy. Honestly. I really appreicate this Journey with you!

I know it sucks, but at least someone looked at your file. I have seen here people getting approval after RFE in a week or two. Hopefully the turnaround is quick! Best of luck to you.



Agreed, I have seen the same thing. The good thing to remember like this member posted is that someone did look at your file and i have seen in many cases where approval has come within a week or two after you submit to them the required information in association with the RFE. Agreed, totally sucks to get an RFE when you just want to see APPROVED but in any case this is better than waiting around not knowing anything. I'm Very Happy for You. This page has a very positive look at this subject. I have a good feeling when I read this post, but if you will go to the Egypt Portal Page you will find in Egypt Hot Topics ( on the right side of the page) A Topic entitled "Family Acceptance" Where you will see how a woman can be bashed and condemned by many for loving a younger man. It isn't seen as love in so many ppl's eyes only seen as the man being too young. He's 22 she's 38. I found myself writing on this post as I am older than my fiancé. On that post ppl had become so cruel that additional posting was stopped. To me it was the saddest display I had ever seen. Giving advice was one thing but being cruel was just not what that lady deserved. Where I come from at age 18 you're old enough to make your own decisions. I realize not everyone will agree with age difference, but please don't place judgement on others. Many Thanks to everyone posting here who knows what the meaning of LOVE is :)




I am very happy you made this comment. I read a post yesterday and it seems the couple may have been denied the visa because of the age difference. I have been very worried about this. There is not a dramatic age difference between my fiance and I but still I was concerned. But it is great to see people stating that they have received visas even with their age differences and I think it is great that people are making positive posts here concerning that issue. My personal stance is that age is a number, the maturity of a person, what they feel in their heart and the way the two people interact with each other is what is really important. AGE means nothing. Thanks for your post!

Nick's visa was approved this morning in London, even with his two small crimes on his record. We were extremely nervous but it was a very smooth process.
