Removing Conditions on Residency General DiscussionLawyers & Application
With the AOS, we paid an attorney $2000 to help us, because we didn't have a clue how to go about dealing with immigration. Now for the removal of conditions, we are going solo without an attorney becaue we are now more familiar with immigration. If you hire an attorney, you still have to gather all the info to give to the attorney to photocopy. Its definitely not worth it to pay an attorney to do something thats easy to do at home in my opinion.

Is it better to have sworn affidavits from US citizens rather than from a non-US citizen? I want to get an affidavit from my parents in N.Ireland in addition to affidavits from here in the U.S.

Can anyone advise please?

Thanks, Kat

Hi everyone,

What documents from the closing documents package for our house should we copy to send to USCIS?

There are a ton of documents and I am not quite sure what they want to see?

Thanks,

Removing Conditions on Residency General DiscussionBank account numbers
I am really not comfortable with sending bank account statements with account numbers visible. My husband is even less happy with the idea. There are regular people that work at USCIS afterall and I don't fancy having my identity stolen... I really don't see why USCIS needs the account numbers, so I was going to write in the cover letter explaining why they were blacked out.

How many of you guys blacked the account numbers out?

Thanks, Kat

Removing Conditions on Residency General DiscussionEvidence list
Finally I'm getting closer to finishing the packet and plan to send it by next week. Thank goodness I started this thing back in January or I would be screwed right now. I think I have nearly killed my scanner and printer by putting the packet together! laughing.gif . It totals 112 pages in all.

This is my list of evidence. can you guys see any gaps where I need additional info. Thanks in advance.

I'm sending a variety of statements from each of our 3 bank accounts and sending all the pages to show the activity in each account and to show that both of our pay checks get deposited in the same account. I am however blacking out the account numbers for safety.

Removing Conditions on Residency General DiscussionNotarized affidavits?
Its better to have them notarized, but it is not a requirement. All of ours are notarized because I think it looks better and shows that the affidavits are true and are not just made up by joe bloggs! It saves USCIS time as they don't have to call the person to testify and lets face it...USCIS needs all the help they can get to approve our petitions faster! laughing.gif

Removing Conditions on Residency General DiscussionEnough evidance for remove of condition??
You said that you married last year therefore you can't even begin to remove your conditions until 2009. You have to have had your green card for 2 years before conditions can be removed. Your case doesn't really look promising to be honest. if you are thinking about divorce at this point, then you need to call it quits and move on, and apply for the waiver when the time comes for you to remove conditions.

Removing Conditions on Residency General DiscussionWhat do you think?
The passport is good if you have changed it to your married name. I included a copy of my passport to show this for additional evidence. The mailer specifically said that you should include it when you are applying for a new card, and therefore I also included it with my package.

Also how about including a few photographs?

It looks good! Good luck! good.gif

Removing Conditions on Residency General Discussionjust got Extension letter and Biometrics from TSC
Today I received my 1 year extension letter and my biometrics notice which is next week. Nice of USCIS to give notice! huh.gif

I sent my package on May 16th to the TSC and my letters both say TSC on them. I guess that eventually it might be transferred to VSC.

I have a wee question though. As I got the extension letter, does this mean they accepted my evidence and we won't get an RFE for more evidence or does the RFE come after the NOA extension letter and biometrics?

Thanks everyone,

Kat

There should be no problems but they cannot apply for passports until they are actual US Citizens. They should take their own passport from their own country of origin (China? judging from your info).

Removing Conditions on Residency General DiscussionAbout Lawyer
I used Mr Eugene Flynn from Dallas to file the AOS as we didnt have a clue what to do at that time. For the I-751 I think he charges around $1500. Maybe less but hes very good.

Removing Conditions on Residency General DiscussionAfadavit from Friend
Its always better to have your affidavits notarized. The basic layout should be short and concise with the person stating their name, address, how they know you and a wee paragraph about a recent event that involves y'all (e.g went on vacation together, had dinner at their home, went to movies etc). The samples on VJ can be adjusted to suit your requirements, but they do serve as a good guideline.

Good Luck!

Removing Conditions on Residency General DiscussionMissed my biometrics appt
I was supposed to do my biometrics on friday, but woke up and felt horrible. I called the USCIS number on the letter and the agent I spoke to was SO nice. I told her that I had tried to make it but just couldn't and she let me know that you can go any wednesday to the biometrics location during business hours and told me to feel better. What a lovely person! good.gif

Removing Conditions on Residency General Discussionwarning on biometrics walk-ins
I am thoroughly pi$$ed off. I was sick for my biometrics last friday and called to notify USCIS. I tried several times to get ready to go and I was too nauseus with a killer migraine. I spoke to a lovely agent who told me that I could go in on a wed between business hours to do it. I went on Wed and was told I could not do it. I told her that I was told by the agent that I could and the woman at the biometrics center said that it was incorrect and I had to write to USCIS and get a new date.

I went back and forth with her arguing and was appalled at the way that I was treated by her. I asked for her agent number and she laughed and said that I had no power to ask that with other nasty retorts implying that as an immigrant that I was lower in status than her... I went outside of the center (the security guard stood beside me at that point...like I look like I could kick the big fatso womans ### at my weight of 115 lbs... huh.gif ) and called USCIS. I was told that I could do it but that they had no jurisdiction or over-ruling power over the biometrics office.. What the heck? Aren't they the same government entity? I am sooooo annoyed at the situation. Just a warning to everyone. Don't assume that you can just walk into the Fort Worth office and do your biometrics on a wednesday.

Just to follow up on this. I just called USCIS and they are sending a service request to the service center in Ft Worth. It doesn't look like it was received at the ASC. Another month to wait to see if I get a new notice before having to call again.

I did attempt the walk-in and was turned away by a horrible woman sitting at the desk (read my previous post for details..I get mad thinking about it..). She told me that I had to write to USCIS and include the original biometrics letter too, which I did. Now I guess all that I can do is to wait... headbonk.gif

Removing Conditions on Residency General DiscussionBiometrics query
I missed my biometrics appt as I was sick approx. 1 mth ago. I wrote to USCIS requesting another date and haven't heard anything. Now I'm getting concerned. To anyone who has had to reschedule a biometrics appt, how long after the original appt was it until you got your 2nd appt?

Thanks!
