IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsApril 2013 I-130 Filers

Collie, the girl in Knightsbridge doctors told me that in some cases people book the medical just the day before the interview, stay over and go for the medical and the visa will be issued pending the results of the medical which they receive 3 or 4 days later. Might work for cr1 as the NVC issue the date for the interview and then I guess you could book the medical for the day before. In my case, for the k3, I had to send off a notification of readiness to the embassy which required the date of the medical. It would be soooooo much easier to have medical and interview in Dublin. Dreading going to London, not at all sure about using the underground to get around. Only thing is, my flight is at 7 45 am and the medical appointment isn't until 3 so will have plenty of time. Flight home at 19 45pm, gonna be a long day. They don't make anything easy for us, do they? In fact, I think, they do their best to make life difficult!!!! Have your parents had their medical yet, are they emigrating to the US?

Anne, I was under the impression that the interview would not be scheduled unless the medical was completed from what it says on the embassy website?

"The medical examination must take place before the visa interview. The Embassy will not schedule the interview until they have received the results of the medical examination".

My parents are indeed immigrating to the US. They haven't done their medical just yet as they don't want their 6 month count down to start until April. They have 2 cats they are bringing with them and they will need to wait until the end of summer/start of fall before they can bring them, otherwise the airline won't let them fly with the heat.

I hate the tube system in London. It is so busy and people are just so rude, pushing and shoving to get places. They truly don't make anything easy. My parents were given Dublin case numbers by accident and we all thought oh great they would be saving a fortune, but we found out that it was a mistake and so they were given new London case numbers. Such a pain!

Hopefully you will have a painless experience in London. At least you have plenty of time to get places with your flights being spaced out :)

Just some info. Even though I have an Irish passport, I live in Co.Down, N Ireland, so that means I have to have my medical in London and then back again for my interview, my flight for next week cost £185. A bit of a pain in the ####### as the US embassy in Dublin is only a 50 minute drive from my house! Aren't they all the same US embassy?? By the time I go to london twice, pay medical fee, have to stay over for interview as I'll probably have to be there for 7 30am, it will have cost me the tidy sum of £800. Rant over!! Lol

Hey Anne, its a small world... I'm originally from Lisburn :) What part of Co. Down are you from? My parents too have to make double trips for medical/interview. It would be so much easier if the Northern Irish residents could just go through Dublin.

Oh its great to see movement! At least they are looking at your case now and have blown the USCIS dust off it ;) I would be calling them for an update rather than waiting for the computer to reflect an approval. I believe that the update on the case status site is behind what they actually can see.

I can't do a lawsuit. I don't have the money for that. Plus I have an attorney.... I sent him an email yesterday asking for status and asked what is going on... his response 12 hours later..

Sorry Jen, PENDING

3 friggin words. ranting33va.gif  I'd fire him but he already has the waiver done.. and the waiver is the reason I even got a lawyer in the first place

####### that! You have an attorney?! HE needs to be filing the writ for you or you need to be looking for another attorney asap.

I also suggest reading this: http://www.visalaw.c...b3/2feb305.html (I found this on a thread where gogo was talking about his situation. He wound up filing a Writ of Mandamus.)  Personally, I would start getting all your information together that shows that you've been trying to resolve the issues, and start working on a Writ. That way, if it goes past 1 year, you can file immediately. I would also mention to your senator (or congress person)'s liaison that you plan on filing a Writ as soon as it goes beyond 1 year. If nothing else, perhaps a lawsuit or threat of lawsuit will make them move on your petition.

I think if the people who are still waiting once they hit a year start threatening Lawsuits en masse, they will change their tactics rather quickly.

Just read up about this and I agree that everyone who has been waiting more than a year or is outside of the processing time, needs to file this. It may just make them sit up and take notice when they have lawsuits around every corner.

Just a random thought but maybe see if there are any of these people on Linked In, where you might find an email through a backdoor page link or something? Just a wild stab in the dark perhaps but I know you will try anything. Also maybe Glassdoor? look at reviews from ex/current employees and see if there is any mention of an email.

I'm sorry you are having to go through this BS. I'm sorry for anyone who is still being suspended right now with no movement on their case.

I think that I would be making strides at this point for face to face contact with a representative from my congress and not taking a BS answer of 60 days.

I think if I was in your position, I would be contacting news stations as well to try and get them to take notice. Pester the ####### out of your Senators and Ombudsman. Emails, faxes, you name it! Do it every day until they know you by name. There are even still March 2013 filers that have been left behind. Utter BS.

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsApril 2013 I-130 Filers

It looks like you filed in April, so your time should be coming up soon as it looks like they are just about finishing up the people who filed before you in March. Yes its a sucky process but there are a few unluckier individuals who filed before you even back in Feb 2013 that has yet to be processed and whose file is possibly lost in the NRC. Those are the people that I feel truly sorry for.

I know it doesn't help when you see people that filed months later getting approved. I think its BS that July filers are getting approved now but its yet another little number fudging ploy of USCIS just to make their numbers looks good in their monthly reports.

The Dude is right - get involved with writing emails/letters/faxes. Calls to NVC, I have found really don't have an impact, but emails tend to get noticed from my own experiences.

Subject: Urgent: Case Status update

Dear Sir/Madam,

I have 2 pending petitions (I-130) for my parents (*****and *****) that I am requesting a status update on. The receipt numbers are MSC*****XXXX8 and MSC*****XXXXX9.

The priority date is 3/28/13 and the petitions were transferred to Nebraska on 11/14/13. The NOA of transfer letter stated that if I had not heard anything in 60 days of the case being transferred that I should contact the service center, thus the reason for my email.

Please provide me with any information that you have on this case. As I am sure you are aware, the separation is very difficult from my family, but I am saddened as my 4 year old daughter desperately misses her grandparents and cries herself to sleep at nights. My parents are additionally missing out on seeing my little newborn daughter growing up.

Thank you kindly in advance,

KXXXXXXX NXXXXXXX

Ah thankyou carey!

was that letter vaild for any particular period?

No problems :) there's no date validity on the letter as it is purely confirming that you are immune to the childhood diseases that you were vaccinated against :)

When I went to have the medical I was told the only shot that I needed for my age bracket was a booster and he administered that one only on the day.

Hey Chloe :) I'm kiwi but living in Australia and had the exact same problem - my vaccination records were long lost. So I went to my local GP - she arranged a simple blood test and then gave me a letter which advised what I had immunity to. I gave this letter to the physcian at the medical and problem solved :)

Hey Gypsy - congrats on the wedding :) I had heard a rumour it was difficult to get after marriage. I wanted to get mine before but the wedding was 2 weeks after I landed. Tried to get it on the Friday before the wedding (day 13 after landing) but there was about a 3 hour wait in the queue and I had family here from Oz that I wanted to spend time with so I didnt. So like you I know have to wait for the EAD or AOS.

However the bank and Ted's medical insurance both allowed me to be added without a SSN. It was simply a case of asking and they said yes.

Will be filing the AOS at the end of the month as we're going away next week for 10 days to Arizona, will deal with it on return. Cannot wait however to get EAD, so disgustingly bored at home!!!

Hope you and the others are faring well.

No worries that's why we share - really easy to get, Ted just went to the county courthouse where it was filed and asked for a fully certified copy. He was able to get it then and there - only unexpected was that he had to pay $46 - $1 per page that was certified and the decree was 46 pages long. He was able to leave the courthouse and put it straight in the mail that day so if I dont have it by the end of this week I will have early the week after so am confident it will arrive before my interview :)

Sorry to hear they are delaying you Heidi - not great news!!

Ang when Kathy and Heidi mentioned that it happend to them both on the same day it was the first time I'd ever heard of it and I've spent hours pouring VJ making sure we had everything.

It appears to be the USC's divorce petition (if there is one) that they appear to be interested in. When filed in the US County Court the original is held by them and each party given a copy only. The consulate asked for an orignal (certified) copy on the day of the interview to compare with the photocopy the USC lodged with the original petition.

Myself personally had a freak attack when I found out why Kathy's visa issuance had been delayed and sent Ted down to the county courthouse the next day. He's obtained a fully every page certified copy of the decree and its in the mail to me as we speak so I'll have it at the interview if they ask for it.

In Kathy's case (apologies for speaking for you) her visa was approved but they wouldnt put it in her passport and return it to her until such time as she got it from her partner and posted it in.

Not sure if they are going to ask for it on the day, as said first I've heard of it, but want to have it just in case.

Hope that helps
Cheers Carey

Hi Caren - great news about Matt's interview, that's the same day as empyre84 - and mine is the Tuesday after on the 31st.

When I sent in Ted's affidavit of support I included 2009, 2008 and 2007 tax returns, a letter from his employer and his last 6 payslips (he gets paid fortnightly) but I'm not sure if this was overkill or not lol

If they're asking for a copy of it its best that he supplies it with the explanation re school. Have you got current payslips from the now period that you can also send over? These can be scanned and emailed to Matt to save the will it get to Oz in time by mail problem.

Good luck with Matt's big day :)

Hello everyone  just discovered this sub-forum and thought I'd say hi :)

Am an april filer and sent my packet 3 back to Sydney on 4 August so currently waiting for the packet 4 email - thanks for the heads up that it may be sent direct to Ted.

And thanks for the info Kathy re the original divorce decree. I had no idea that they would hold you up for that :( Have asked Ted this morning where his is and he said he and his ex wife were only ever given a copy and he thinks the original has been retained at the courthouse so he is following that up tomorrow his time just in case. Hopefully he can get it and post it down - at least if it doesnt arrive before the interview I can always submit it a day or 2 later. Is there ever an end to this silly red tape?

Hope everyone is having a great day and thanks again for the additional info.
