Removing Conditions on Residency General DiscussionGC Expired, have not recieved NOA1 AND we moved
For many reasons, we did not send off the packet until about 15 days before my husband's conditional GC expired, because we were planning to move, and everything did not come through until the beginning of September (he expired Sep 26). We moved from Florida back to Texas last week, and at the time we sent the packet we still did not have a new address, so for the mailing address we used my Father's address in Texas, along with proof that I received a job transfer etc. I did not want to trust that the mail would be correctly forwarded. The check was cashed on September 16.

Well, now we have no NOA1, my husband's GC is expired and I'm assuming he will not be able to get a job with out a NOA1 or passport stamp. We also have a trip planned to the Dominican Republic in 2 weeks ( I won a free vacation!) and I'm stressing out!!

If we make an infopass do you think they'd give the stamp, given the circumstances?

Our NOA was dated for the end of September, here it is December and we have not received a Biometrics notice yet, should we be worried? I'm thinking maybe we can just walk in to the biometrics office on a Wednesday when it's not so busy. Any advice? It seems people are getting their Biometrics appt very quickly but I don't want to think the letter did not come and we are "abandonded"

On our petition sent back in September we listed my father's address as the mailing address because we were in the middle of a move. We recieved the NOA of reciept there because we didn't have a permanent address for about a month. In November we changed the address and recieve the Biometric stuff at our house as well as the letter of transfer from VSC to CSC..

BUT...the notice of approval was sent to my father's address again..saying we will get the GC in 30-60 days..WOW I thought it was usually within 30 days...has it gotten longer?? so I guess I need to call and do another address change or what?? My dad will keep his eyes open for the GC in the meantime..

But..SO HAPPY smile.gif The letter was dated 5/22....

Well forget what I just wrote about not having problems with address change, as soon as I posted it, my dad called and said they'd recived something from Homeland Security. I told him to open it and it was my husband's approval letter...weird. Everything else we got at the house except for the initial NOA....

I agree! That's a great idea.

I think the OP could also send in the change of address form before moving, once the new address is known. If the move is 100% definite (lease signed or whatever), send the I-751 packet a few days or so before the move - just put the new address on all of the paperwork. Gets things processing a little sooner, plus eliminates the possibility of losing the paperwork during the move. If the copies are misplaced, not as much of a problem - they can be unpacked later.

If you have family or someone where you are moving, you can also have things sent there, just fill it out that way on the paperwork. We had the same dilemma, and we moved around the end of the 90 day window so we had everything sent to my Dad's house which was in the same area that we were moving. After we were settled we did the change of address and have not had any problems.

Should we go down there and ask for a new one? He's got the I-551 stamp in his passport and 10 year GC should be on the way.. I was thinking just to be on the safe side..

Got our approval! 5/22 was the postmark in the envelope..ironically the day I made the post! ha! It went to our address that we had in the 751 paperwork though, even though we'd called and changed it....and recieved everything else but the initial NOA at the new address... Anyone have any idea why? Kinda scared about the GC...

Hello to all of my VJ friends and family. Today was one of the most trying times of my life. Today at 7:00am my fiance went to the Lagos Embassy to sit before his interviewer and tell his story of our relationship. He did not get to see an interviewer until 11:30am today. He went in and sat before an American woman who asked him many questions about me and our life. We were approved today for our Visa. He will go pick it up on July 5, 2007. Thank you all for your supposrt. I will be posting more about his interview in the Embassy Review section later when my fiance comes home to me. He will arrive in NYC on Saturday morning very early and by 10pm the same day we will begin our home as one. I thank God for giving me the Desire of My Heart and I thank you all for your support and may the GRACE of God be with us all because no amount of studying and no amount of documents will get us through that embassy. Only God's favor can give this to us. Peace and mercy be to you my sisters and brothers.

If you are asking why the total timeline of a K1 is on average, shorter than the total timeline, on a K3, the answer is that historically, I-129F petitions for spouses were filed only after receiving an NOA1 for an I-130. This generally added a month or so to the total timeline at the onset. I've seen K3, I-129F's sail through CSC in 30 days, only to fine another hang-up later in the process. Frankly, I'm not convinced you actually will find more than a few days difference in the timelines if you count from the I-129F filing to interview.

If you're asking what your subject line indicates, which is about the difference in actual interview scheduling, done only after packet 3's are returned, again, I doubt you'll find much difference either but any differences would be due to individual Consulate IV unit policies. I don't know why they would vary and in my China experience they didn't.

Does either of the above address the question you actually had in mind?


well my concern is that a friend of mine did the k3 ok she turned in her ds230 way before me and i got an interview, thru same embassy i have oct and she still has no date they say shes eligible but no date so im wondering what is the differnce in k1 getting the interview faster im seeing others get the k1 interview also faster at the same embassy im just hoping she will get a date soon sad.gif


Compare the dates your respective cases were deemed "eligible for interview". How far apart? Your interview was only assigned a short time ago.

You have concluded that the cause of one interview being scheduled sooner than the other is the one thing you know that is different about the cases. This may not be the cause. You may be falling into the logical trap of coincidental correlation. "Post hoc, ergo propter hoc" literally means "after, therefore because of" or as I like to say, B folled A, therefore A caused B. Such conclusions can be correct but are arrived at using false logic.

Here's an example. A couple my wife and I met when he and I were both visiting our (my wife, his fiance) in China got their P3 and returned it a few days before we did. A month later, we had an interview date and they didn't. The cause had nothing to do with them filing K1 and us K3. (the reverse of your situation) The reason for the delay (two months) had to do with something specific about their case.

When I was calling DOS nearly every day to see if we had an interview date, one operator told me she answered a question earlier that morning for a China K1 petitioner who's fiance was assigned an interview date of August 30. The next day, I called and found out that my wife's interview would be August 8. For that Consulate, it seems that all P4's approved on a given date have interviews assigned on random days of the same month. Go figure.

Exactly Jomo they tend to do what they want when they want... but based on others k3s it seems they wait long time before they get interview after their stuff is complete and they are eligible....but with us K1s its fast soon as ur ds230 is in u get that date right away, re:jamaica

Hi Everyone,
My K-1 VISA has been approved and sent to the Juarez Consulate but my fiancee in Guadalajara, Mexico still hasn't heard or received and appointment letter. Any Suggestions on how to contact the consulate. The number on their website no longer works.. 900-476-1212 or 800-919-1754.
Does anyone know how to see status on their case from the Juarez Consulate?

Thanks to everyone who's been keeping us informed. My Fiance and I are STILL waiting for our letter from Juarez. I emailed the Juarez consulate three weeks ago and they emailed me back that they had received our paperwork from the VISA Processing center. Just havent seen anything from Juarez.

I must have because I received my approval letter already from USCIS and it stated that they forwarded my information to NVC on Jan 5....I recently emailed the Juarez Consulate and emailed me back stating they have our paperwork in Juarez... BLamb, I'm confused by what you wrote and your timeline...
Your timeline says your NOA1 is Jan 5th, you have to wait like 5 months for USCIS to process it, then a couple weeks for NVC, then it gets forwarded to the Consulate. Did you put 1/5 under NOA1 instead of NOA2?

They send the letter to both. I just discovered that my letter was sent this last Friday, so i think i will show up at the consulate next week. As far as I know, if you are ready before receiving your appointment letter, you can go ahead and show up at the consulate and get a copy of your letter printed in the consulate, it helps to save some time


Sweet. How did you find out that your appointment letter was sent to you? I tried calling the Juarez consulate but their numbers don't work.

Our case was sent to Juarez on Jan 4, 1 day behind you guys. I am pretty sure that they will send packet 3 this week so that means we can show up at the consulate next week, hopefully.

wow thanks for the update. Do you know if they will send it to our Fiancee in Mexico or to us in the USA or to both of us? I have sent my fiancee letters before to Mexico and she never gets um. I don't want to miss the appointment. :crying:

The consulate in Juarez is about to receive our K-1 Visa app. How long does it usually take to receive the open appointment letter?
How did you all plan the Juarez trip? Buy refundable tickets for a 2 day stay? 3 day? one way tickets?

Dude I'm almost in the same boat.. Our approval letter has been sent to Juarez Consulate on Jan 5 but neither me nor my Fiancee in Mexico have heard anything. Wish there was a number we could call to check status of appointments... :(

Congratulations to 'loveacanuck' and thanks for the feedback... My fiancee is also headed to Juarez this Friday for K-1 VISA interview... We scheduled her ASC appointment in her own city in Guadalajara for this Tuesday. Then Wednesday she flies to Juarez to do her Medical and Friday morning is the Interview... I hope after this Friday all of this will be behind us. :)

No Kidding! Have you made the appointment yet for the ASC? Just wondering if those appointments take a long time. We are planning to use the ASC in Juarez as there isn't one close to us here. Those on the Juarez forums are sure that they ASC doesn't even begin until April 1st. Also, what is your take on the DS-260? I can't even figure out how to access the form. Its grayed out when I go to the website. Maybe we will all hit Juarez at the same time. I don't know about you, I just want to make it back in time for my own wedding. :lol:



Actually my Fiance in Mexico called the consulate nearest her house and was told by them that they are not actually starting the ASC Interviews at her consulate until March 14. Soooo, next Monday she will call and schedule a appointment.
I'm not sure which website you are trying to access to fill out the DS-260 but try this link. This should help. :)

I think I have lost my mind. I just called the consulate (703#) and they were of no use. They said my case was still pending and they haven't sent my letter out yet, although I am HOLDING my letter. All he kept saying was "then follow the instructions on your letter". I asked if the DS-260 form applied to K1 visas as they website lumps them all together, I asked if it was an open appointment as it says in one paragraph it is, and in the next one to schedule and appointment, I asked if new procedures were for March people or only people after April 1st, his answer to everything was literally, " follow the instructions on your letter." The letter of coarse, they don't even have proof they sent me. I told him the letter was confusing and contradicting, he said, "all I can do is recommend you follow the instructions in your letter." So, no better off than I was at 2am during my meltdown. BLamb, your letter at the top says he has an "open appointment with this office any working day...: but further down it says "...schedule and appointment with ASC and a Consular Interview. Which is it? Were you able to clarify? Sorry guys, I am just so confused. We cannot afford to go sit in a hotel in Juarez to find out our open appointment doesn't exist and wait for a scheduled one. Also, does anyone know, the payment for a K-1 visa is $350.00. We have a minor child on ours, do we pay an additional $350.00 for him? The website says $350 per applicant, just not sure if he is considered an applicant. Arghh! :help:



sounds to me like everyone who works at the consulate is confused as we all are.. :) I think all of us will be ok. The only appointment I am making is for the ASC. After that, it's high tailing it to Juarez. :) I figure as long as my Fiance in Mexico has her ASC done and all the appropriate paperwork filled out and Medical Exam and payments taken care of we should be ok.
I am not sure about your additional payment for children. It's just my Fiance and me. Hopefully someone with children could shed some light on that one for ya. :)

Now that makes it seem that the interview must be scheduled and is not an open interview.



If your unsure I would call them and provide your Case number and name. They can tell you exactly what your case requires.

Where did you find this out? Will this still be so after April 1, 2011?



I am not sure what will happen after April. I only know what the Consulate told me when I called a couple days ago.
Also, if you go to http://mexico.usvisa-info.com/ and log in you can read all the current information. :)

General Visa Information

Based on your selection, it appears that the applicant has been asked by the Consular Section to schedule an appointment for the immigrant visa consular interview at the U.S. Consulate General in Ciudad Juarez.

Each applicant is required to appear in person at the Applicant Service Center (ASC) prior to the consular interview. Please continue below and complete the process to schedule an appointment at an Applicant Service Center (ASC), and at the Consular Section. Please note that the applicant does not have to go to the ASC in the city where the immigrant visa interview will take place; the applicant can visit the ASC closest to home prior to traveling to the interview with the Consular Section.

If action is not taken on the application within one year, it will be assumed that it was abandoned and will be terminated.

OK, I am freaking out a bit. At the top of your letter it says he has an open appointment date, but in the letter it says to schedule an appointment at ASC AND an appointment at the consulate. Am I missing something? Which is it? Also, can I ask if your case number started with CDJ or MEP? Mine starts with CDJ, but they say we need the DS260 anyway. When I go to the website, I cannot even click the DS-260 form. Help! :help:



Yes my Case Number begins with CDJ too. There is still an Open Appointment at the Juarez Consulate for Interviews for K-1 Fiance VISA's.
The ASC appointment is for fingerprinting and taking your picture. This must be scheduled thru the website listed in this forum.

I think you can schedule appt at ANY ASC office, not just Juarez one, so you can do it nearby, then later go to Juarez for medical & interview.
