Your cosponsor will have to prove that they meet the requirements for their family(let's say a family of 3) PLUS your fiance. So that would mean they must meet 125% of the poverty guidelines for a family of 4.

And yes, if you have a cosponsor that meets the eligibility requirements your income doesn't matter. There have been some couples here in which the petitioner was in school and didn't have a job. As long as they've had a cosponsor that met the requirements, they were approved.

I did, and it didn't really do much good.

Mathew had his interview a month ago today and was approved. HOWEVER, we only received his visa 2 days ago. The Montreal Consulate wouldn't respond to the emails we had sent, each time I called DOS I got a different story, and we didn't have the tracking number for our package. The guidelines on Montreals website say 5-7 business days between the interview and visa in hand so we waited until 14 business days had gone by. Unfortunately, the congressmans aide didn't know what to do and didn't really help us out at all. Montreal responded to her initial inquiry, saying that our visa was mailed on the 24th of March but when she contacted after that she never heard anything back.

But thanks to some members here giving us advice on how to contact the embassy by phone(even if the page says they don't take phone calls), and the very nice woman Mathew spoke with, he was able to pick up his visa the very next day after calling the Consulate.

As of yesterday the Congressmans Aide STILL hasn't heard back from Montreal.

This process is easy for no one. There is no speedy lane. There were couples from my month who were married and together long before Mathew and I knew his interview date. There were only two Montreal couples in September for VSC and we were the last two to interview. Of course we were a lucky group, no denials but there were a few from hard consulates as well in there. I don't think anyone has an easy time. We all have to wait. Sure, there's more scrutiny for other countries but we all wait the same, and we all miss our SOs.

I wrote the captions on the back of mine and put then in a plastic sandwich bag. I then paper-clipped the bag to the section of my petition labeled "Proof of having met & of ongoing relationship".

As for assembly, I paper-clipped each section together and then bound them with an ACCO clip. I put a cover page on the front as well as a table of contents and then I made an additional cover page for my evidence. After the clipping and binding was done I just put it in a USPS flat rate envelope and sent it on it's way. Took 3 days to get there and a little over a month for my NOA2. Those were fast times for VSC, very fast times. :P

There have been a few threads about this since I started my journey, so maybe if you searched you could find what others have said about it.

I'm pretty positive(without knowing exactly which form you're using) that you should fill in her name exactly as it appears on her passport. Most of the USCIS forms are like that.

Yep I've read the posts. Everyone has been helpful and giving you the correct information. It is up to you to decide how you're going to read it and/or take it and you must be always on the defense or something because most of the time you are calling people rude. Stating facts is not rude and it is not discriminatory. Say what you want. Everything we say is falling on deaf ears anyway.

I sincerely wish you good luck at your interview. If you continue to act the way that you are acting right now then you're going to need every bit of good luck you can find. You need to have patience and the ability to be calm, cool, and collected in situations where most people would not. From what I've seen, you don't have it.

Oh my gosh, no one here is discriminating against you! All we are doing is trying to help you.

My husband is from Rouyn-Noranda but he lived in Montreal for 6 years. His English is awesome. No one here thinks that because you're from Montreal that your English sucks. No one is being rude. You're the one being rude most of the time. Keep it up and pretty soon NO ONE will want to help you. Keep this attitude at your interview and I guarantee that you'll be denied. They are going to ask you some questions that will test your ability to handle stress and they're going to ask if you've ever been denied at the border. If you go in there and start screaming discrimination when they ask you that question it's not going to be an easy road for you.

No one discriminates here. This website is full of people from ALL countries, and some of them can barely speak any English. Is that a problem? Heck no it's not. As long as we can decipher what they are trying to say it's all good.

I am curious, though. If you can't stand Americans so much why are you moving here? In both of your threads you've spoken about how awful Americans are and how we take things for granted. If you don't like us so much, why doesn't he move to you???


And always, ALWAYS remember that your attitude can have A LOT to do with getting through at the border. If you act towards them the way you act on these boards sometimes that may be part of the reason why they've been reluctant to let you through. That may not be the case, and I'm sure that you're going to say that no one understands what you've been through but I assure you others have been through the same exact thing as you. Many people have not been let through to other countries. Many people have been treated worse. And not just at the American borders. Many Americans have been treated like ####### at other country borders, just as many other citizens of different countries have been treated badly. There is no fair in this fight. CBP officers have all of the power and we have NONE. All we can do is hope that they're having a nice day, that our evidence of return is sufficient, and that we get let through. There is never a guarantee.

It depends on many variables, so looking at the quickest case isn't really going to help you out that much.

But if you aren't living in the US now, you need to start thinking about what you're going to do if the question of domicile comes up. Not being able to prove domicile wouldn't be a good thing.

yes a touch is the last updted box that indicates if there has been a touch. so since you have a last update date of today then yes you have been "touched" It will never show what has been done to the case on the "touch" The advantage of signing up is that you at least know your case is being worked on and not just sitting there to some it is like a pot of Gold I know I was so excited when my case got "touched" You wont know if you receive an RFE through the updates sorry.....but once a decision is made you can possibley get a txt or email that a decison has been made which is another advantage of signing up with USCIS and electing to be notified via txt and email but keeping in mind there have been some people who signed up and didnt receive either but did receive a letter of approval in the mail.....GOOD LUCK!!!

Sorry, but this is wrong. They let you know that you're getting an RFE, they just don't tell you what it's for. I got an RFE on August 6th, and got the following message via email, text, and could click on my case number in my portfolio and have the same message:

Application Type: I485 , APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

Your Case Status: Request for Evidence

On August 5, 2010, we mailed a notice requesting initial evidence in this case. Please follow the instructions on the notice to submit the evidence requested. Meanwhile, processing of this case is on hold until we either receive the evidence or the opportunity to submit it expires. Once you submit the evidence requested and a decision is made, you will be notified by mail. Affidavit of Support that they need is not from any attorney from there !! this Form I-864 will fill up & signed by your so called husband, then he must send the original to you using USPS/any delivering company,he can get/ download this form ,from wwww.uscis.gov, you must have it during your Interview to get the Visa Approved.about employer it depends to an employer employee status,.

AOS is , if you were here already, Just wait for the USA General Consulate Hongkong letter to process & Where to go, they will send it to you,about Police Clearance , they are also the one will send you a letter to do it , once you received, just go to the police Station near you, bring your Hongkong ID & the Letter from USA Consulate,the results , you don't need to wait , the police , are the one will send the results of your record to USA Consul,same as in Medical, the USA Consul ,also will send you a letter Where to go, the difference in police Clearance, you have to pick Up you Own Medical Results , and bring it to the USA Consul, on your next appointment date.

First of all I'd like to give thanks to this site and to all members. All the information on Visa Journey has made the filing process much easier.

Hopefully some of the members here can help me with my question. I send my I-129 Fiancee visa out on 05-05-10 and the receipt of delivery was 05-07-10. As of today I have not received any other information or has my check been cashed. I've noticed similar petitions during my time frame and it has only taken two or three days to get notification. Is this normal or perhaps something has happened to my application?

I think the First thing you have to do is , Check your Bank Information if The Amount you made to it, has been Cashed Out, there you can see the Date when it been Cashed, then You will recieve A Notice Of Action , telling that they Recieve the Amount. I f you don't have Notice of Action Yet, so it could be on the way to your Mail. Hope this make it helpful to you, Sometimes Its Depend where you live and the way the mail Man Do thier job as quick as we Expected.

My question is, I have a 3 year old son included on the petition and he was left in the Philippines. We can't get him yet then because we decided it would be better for me to get adjusted here before my son comes. We planned on getting him by December though, because my visa was approved last February and we were told that it is better to get him within one year from the approval date of my visa. I'm sending in my I-129F package tomorrow. I'm going to use a personal check for the $455 fee so I can track it, but do I "Pay to the order of" USCIS? I'm almost positive this correct but I cannot find a confirmation on this site. Much thanks to anyone you can calm my thoughts.

OK...I called the NVC today and the NVC Representative today asked me to read my approval notice to him, when I did he said "If the Notice says it was forwarded to the listed Consulate, then it was forwarded to the consulate." I said are you sure? Are there really cases where this happens? He said "Yes, the USCIS and U.S. Consulate decide where the case will go and if the consulate wants the case they get it, the USCIS and Consulate trumps the NVC." Has anyone else ever experienced this??? Why would they want it to bi-pass the NVC? Please Advise if you can! Thank you!

Ok! first, i let you know that I experience the same with You, You call NVC and the NVC answer you right, Yes if your F-129 Petition been Approved By USCIS it Doesn't mean they Passby the NVC, Because NVC Has a record of it ,the representative you talked with, is Listening to what the reason you call them, and to read the letter Approval you are pertaining to;It means you Gave the USCIS all the Required requirements they need to Approved F-129, You should be Happy to it, And If YOur Fiancee Is In the Philippines, Or Wherever ? She will be Recieving soon the Notice Letter, Saying , We are Happy to Inform you that you may begin to Process the Application and All Instruction is INcluded in that Letter, they will send too your Fiancee all Requirement Instruction and you will recieved also SAme Notice,Of Informing to Start the Application Process,but the Rquirement Instruction is Only Included to your fiancee Notice letter, My Advice Is This,: You Ensure that, your Fiancee know ,and Follow all the Instruction Carefully, Submit all the required Documents in the Notice letter, then Only later ,after Doing that , she will recieved Another Notice for her to Interview in Person, for Visa Approval, It Doesn't mean F129 was Approved by Uscis all things are ok Already Only If you give All required Documents and If She passed the interview then Only the time you can Totally Say that She Has an Approved Visa if Already Stamp on her Passport. Im here again for another set of questions. And i would like to thank you all in advance for your upcoming replies. hehehe.

1st question: Do i need to get police clearance from every country i have lived in after age 16? i have lived in the US for a short while and I am now currently working in Jeddah, KSA. Do i need to go to US Embassy/office to get my US Police Clearance? While im here in Jeddah, should i get my police clearance now? or can i get them in my country when i go home by going to these countries embassies? Pardon my ignorance but i really have no idea what to do re his thing.

2nd question: I have an ongoing Immigrant Visa (EB3) petition but due to visa retrogression, I still have no idea when my visa no. will be issued. Honestly, i am losing hope already as i have been waiting for my I-140 petition (immigrant visa) for over 3 years now. My fiance and I are now preparing for my K1 Petition and im worried if my ongoing EB3 will have any effect on my upcoming K1 petition. Is it allowed by the USCIS to have more than 1 visa application (but different types) at the same time?

The Point is this....... First, if you are now working Jeddah & Applying at the Same time you have to get your Police Clearance there, but to do that, if you Applied for K-1 at this time , you have to wait to the Formal Letter given by US Consulate Jedddah Instructing you to get the Police Clearance, if you don't have that kind of Notise , you won't be able to get it Because it's Govt by Govt rules about the Law in Connection with the your Visa Application, Secondly if you are planning to go back home , you Must get Our NBI Clearance , that to US Embassy will Honor As Police Clearance it valids for 1 year After the Date of Issue,About your EB3 Petition you must Closed that Case / rather Checked if still on Progress , other wise it will affect to your Application, about live before in US, no need to get ploice Clearance from here , they will find out that during your processing of your Visa. You can try to apply for B visa this time however it will be very different from last time when you applied. Like you are married to a USC and you are a housewife. That makes your application success rate kinda weaker unless you can show very strong ties to China. Since you are already planning to apply for CR-1, then earlier get it started will benefit you better.


Do you know how long it might take if I started the process in Shanghai?

I think I can file a form maybe the I-131 so I will be able to travel to the US while the application is being processed. I heard in the US that takes about 90 days, but not sure how long that would take in China. Just would be great to start the process but be able to visit while I waiting.

Since you are only visiting, apply for another tourist visa.

Do not start the spousal visa process until you are actually ready to move to the US.


We will eventually move to the US once my husband has finished work in China. So I didn't know if it was worth starting that process now since it takes some time.

Also I wasn't sure how easy it is to get another B1 visa. Considering last time we were not married yet and this year I had already spent lots of time in the US visiting last Christmas and over the summer. Also last year I was employed, this year I am a housewife. So I know for my B1 I had to prove my intentions were to return home, but this time it might be more difficult, although we really do intend to just visit on this trip.

I'm just getting started on the visa process. Sorry to start a new thread, I know the info is already here. I'm just a little overwhelmed with how to start.

My husband is a US citizen, I'm a Chinese citizen. We live in Shanghai. We have been married for one year, last year I had a B1 visa to the US and went twice to visit family.

My B1 has expired. We are planning to go back to the US in the spring to visit family again. Depending on his job we may move to the US later next year, but right now just planning to visit the US and return to China.

Should I get a new B1 visa or just begin the IR-1 visa process? We eventually plan to live in the US, but for now its most important to get the new visa so I can go back with him to see family.

I would start the IR-1 visa process, but afraid it may take to long to finish before the spring.

Any suggestions would be greatly appreciated!

Our evidence was a mix of both kinds. But we didn't have proof of how we first met because we met each other on an online game and had known each other for almost 7 years at that point.

In presenting what we had, I divided our evidence into 6 categories:

  • co-mingling of finances (copies of a couple of credit cards in both our names, insurance paperwork etc..)
  • affidavits from people
  • wedding related stuff (photos, receipts etc..)
  • 3 pages of photos
  • travel related stuff (boarding passes, entry stamps, trip itinerary etc..)
  • evidence of continued communication spanning the years we'd known each other as well as after the marriage(chat logs, phone logs, emails etc..)

We had to prove that we were communicating regularly since we weren't living together at the time. This is probably not as important in your case though!


My husband and I are working on getting Skype call logs but they only go back a year - how did you evidence for the chat logs the whole time? We also use blackberry messenger but I'm not sure that we can get evidence... we don't want to overdo it of course, but I don't want to provide too little evidence either - we have not been able to live together except when visiting the others' country, etc... thoughts?

Time will tell if I should have loaded my I130 with amazing amounts of evidence right off the bat, but I hadn't spent much time on Visa Journey then. I sent in 2 letters/affidavits and I think one 8x10 print out collage of 6 photos from our Nikkah (wedding), a couple with family, and a couple with my children. We were approved 3 months later.

For the interview I have put together a portfolio for my husband with collections of ticket stubs, more photos, a random selection of facebook, email, skype, and phone records excerpts, flight itineraries from our visits here and there...

I'm sending in my NVC packet this coming week, and I will throw a couple pictures and recent flight stub in with that packet, even though I'm not sure it will do any good. Its been 6 months since our NOA2 came so I'm hoping they'll glance at it and notice the ongoing relationship. It will be 10 months since we filed the I130 with the initial evidence.

I hope we are that lucky! :) I hope they approve stuff and I figure I don't want to overwhelm them, but I am also a detail oriented person, so it's hard not to give too much sometimes because I prefer a little too much over too little. * We both wrote affidavits outlining our relationship (how we met, how it progressed, how we decided to get married)
* Affidavits from 2 friends who spent time with us, 3 of our parents, my sister, & my coworker
* A long summary of our daily skype calls
* A printout of our email list
* A printout of our chat logs
* Copies of cards we have sent each other (mostly that I have sent to him)
* Screen shots of facebook posts about my husband and with friends and pictures of us together
* I added him as an authorized user on my credit card and sent that info
* I made him the beneficiary of a life-insurance policy I have and sent that info
* I sent copies of emails between me and other people regarding plans with my husband's visits
* Screen shots of a message board we frequented together where we mention each other and interact a bit with each other (beginning 2 years ago)
* Many pages of photos with friends and family with us
* Print outs of emails - airline reservation/confirmation for flights to visit each other
* Copies of passport pages with entry/exit stamps
* Print outs of an email between my husband and my sister discussing ideas for my birthday present

I just got my NOA1 12/21 so I am just hoping this evidence is enough to prove the validity of our marriage!

Lily, how were you able to do a printout of daily Skype calls? As far as we can tell, you can only go back a year, and that includes chat messages, etc. I don't really want to include all of our chat messages but just the calls and I don't know that Skype will keep your call logs for two and a half years haha...

I am also going to change him as my beneficiary on my life insurance for work and make copies of this change, we did a printoff of our "Facebook friendship" which includes our relationship, photos of each time we visited, statuses where we mention each other, etc. We also are picking out a photo or two of each time we visited each other to document the different places we went and all that too... but if you could help with the Skype thing, that would be awesome! Thanks for your help!

Did you both fly each time you visited each other? Do you have your ticket stubs, flight itineraries, receipts, do you have emails, chats, phone records? All those things mean more than affidavits because anyone can write a letter. Also, both your passports would have stamps as evidence. Correct me anyone if I'm wrong or missing something. It seems you have a good long history together, you just need to show the proof.


We did fly and I probably have some of the ticket stubs, etc. but he is not the type to save these things! Haha! I have tickets of places we've gone, concerts, etc. as well so that may be a good thing to submit copies of... We do have e-mails, chats, BBMessenger use, Skype use, etc. But I also have heard that giving them far too much can be dangerous and delay one's application so I am including in the cover letter that we are happy to provide evidence of Skype/data usage on phones, etc. if requested but I do not want to overwhelm the officer who receives our application either... We are submitting the entry/exit stamps on passport pages as additional proof of visits to each other....

My husband and I were recently married. We waited until he left the U.S. to file the I-130 and so we will be filing within the next week or two. Many of you on the forums have lived with your spouse and have evidence of your bona fide marriage in bank statements, joint ownership of property, etc. However, as two young students or recently graduated students, we have never had the ability to jointly own property.

Our thoughts were to apply with some photos documenting our relationship from the beginning to the present (2.5 years with 7 visits to/from etc) as well as a number of affidavits from individuals who know us both in a number of ways in each country. We are thinking of submitting the following affidavits and the reasoning for each person is provided. Please give me thoughts as some feel that providing numerous affidavits lends a marriage to be doubted. We just want to be together as soon as we are able and finally begin our lives together. Thank you in advance for your thoughts and advice!

-Both of my parents - my husband as lived with me at my parents during my winter and summer breaks from school when he has been able to visit and so they have been witnesses to the growth and strength of our relationship over time. They were both also present at a very intimate wedding ceremony that we held.
-A very close family friend who was present at the ceremony (and her husband who was unable to be present due to the death of a friend) who have met my husband a number of times and spent time with both of us when they have visited from out of state...
-My best friend who knew of our relationship from the beginning and is one of the few people outside of my immediate family who knew of the marriage before it took place
-A work connection of mine who is also a member of the congregation of the pastor who married us - she announced our marriage on that Sunday to her congregation - she is also a friend of my mom and myself
-My husband's mother - I spent extended time with his family on my two visits to Argentina (when I lived with him there) and was invited to family celebrations (new year's, father's day, etc.) while I was there
- Two of my husband's friends who have both met me and spent time with me and who have heard him talk about our relationship and know of our marriage

We have not made our marriage super public as we are not super traditional folks. However, we love each other very much, and I want to make sure things work in order to reduce both our stress at not being together for 5-6 months at a time for the past two and a half years...

Dear VJs,

 

My wife dosent qualifies as a sponsor so she has a Joint sponsor. My wife employer is not ready to write a EMPLOYEE VERIFICATION LETTER or any KIND OF LETTER but she has got all the pay stub.

Is it OK if she dosent get a letter from employer & just provide the pay stub? as the joint sponsor is furnishing all the documents required as a JOINT SPONSOR.

Thank you very much to go through my post on this forum and i really appreciate very much for this. Please provide me your advise on this.

 

My Wife & co sponsor are about to file I864 for me and i have this following queries,

1/ My wife being dosent fullfulls the poverty lines so she would be sponsor or co sponsor?

2/ I864 is the only form should be used by both sponsor or different forms has to be used?

3/ Please provide me the checklist of documents need to be furnished along with I864?

And seriously, if my computer doesn't print this employment verification thing soon I'm going to toss it into traffic.

On the upside of that, it's showing I make double what I've been making (due to pay increases, thank you AT&T), but my w-2s and paystubs aren't going to show it. So much frustration is getting ready to be put on one little laptop!!!! grrrrrr!!!!

Your NOA2's will come soon. I've got a feeling about it. And even if they don't come today or tomorrow, they ARE coming because they HAVE to.

I just wish it was sooner rather than later. I really want all of us VSC people to be on the same page again that way we can freak out about the next thing as a group. It's better that way. smile.gif

The California Service Center is still moving at the same pace. Vermont is up to 2 weeks ahead of California. If you go to the thread for September filers at CSC you'll see that many people are in the same boat as you. I hate to say it, but I wouldn't expect you to have any touches or a NOA2 for at least another month. Heaven knows we here shouldn't have had our NOA2's for another month, maybe 2.

I've said it a thousand times, but I don't think it's fair that VSC is going so fast and leaving CSC in the dust, but it is what it is and we can't change it. sad.gif
