K-1 Fiance(e) Visa Case Filing and Progress Reportsaugust VSC approve

like to say i got approve after a long wait 1noa 8-29-12 got hit with a RFE: Intent to mary on 2-4-12 approve today. SO SO Happy that part is over. Now i want to know whats next.

hi carlos and ellin~ Congratulation~~~
and i got the same RFE as yours~ we got NOA1 8-20-2012~~ RFE 2-28-2013. recived the hard copy of the RFE 3-11-2013, and then they got our letter back at 3-19-2013.
so i just wanna ask~ did you give them the original intent to marry letter? cuz we wanna save time when we got RFE~ so i scanned the letter with my signature, and then sent email to my fiance. (actually we gave them both of our original intent to marry letters with 129F at begining~ but now they asked it again~~ so we guess if they lost our letters~ )
i am worried if the scan copy of the intent to marry letter is ok~~ someone said that would be ok~ but someone said no~~ we have to give them the original~~
(they worte "you may submit either the original documents or legible photocopies of the originals." on the hard copy of the RFE~~ )

thanks~~~~~

K-1 Fiance(e) Visa Case Filing and Progress ReportsHow long did it take to get NO2 after RFE?

We responded to an RFE on March 12th- still waiting too. However, we're outside of normal processing times, so I've put in a service request. Hoping that will help speed things along. Best of luck to you!

hi how did you ask for the service request? just call the "800" number? we called, but i guess it does not work, they just told us that keep waiting~~ they got our intent to marry letters on march 19th, we are still waiting~~~
thanks~~ hope all of us could get NO2 soon~~~

What happens if you apply for ROC, gets denied for whatever reason, and then you GC expires before you refile? What are the options at that point?

So I was looking at the official USCIS timelines and it shows ROC takes 6 months, so does that mean there will be a period of time when our gc will expire and we can't travel or work? Or does EAD and AP apply here as well?

So, I figure there's a few Canadian-American newbies going through filing for the first time as married, with income in both countries, and I can't be the only one that finds the IRS more confusing than immigration.

So here's an open thread where we can collect experiences. I'll start off with a couple questions:

U.S. Taxes:
1) C. has to file U.S. taxes, obviously. He has income earned in Canada before he moved down here, and income earned in the U.S. since he moved down here. Do we count his income earned in Canada as part of his adjusted gross income? If so, what do we do about the exchange rate?

Canadian Taxes:
2) This is sort of dumb, but now that we will file as married, will my income earned here count as income for him on the Canadian tax forms?

Any suggestions on software or forms or a link to a walkthrough would be much appreciated. I've read through the threads here, and am desperately in need of the process being explained in simple English.

As per my conversation with a very knowledgeable CRA employee, you file with the CRA for Can. Income earned, and with the IRS for US income earned, they cannot be on the same tax return, simple as that. Now, if you made Canadian income while living in the US (such as working for a Can. company, getting paid in Can. funds) then you would still have to file with the CRA. She told me that one currency earned is only applicable to THAT specific country. I would call the CRA & ask to speak to someone that is knowledgeable in this area just so that you know for sure. Good luck.

jen

As a point of clarification, if you are filing as a US resident (Form 1040), you are taxed on your WORLDWIDE income (US plus Canadian wages). However, you do receive a tax credit for any foreign taxes (i.e. Canadian taxes) you paid on your Canadian wages. This is just how the IRS treats your foreign sourced income. I do not claim any knowledge of how they do things in Canada.

Removing Conditions on Residency General DiscussionROC - How long do you wait before contacting USCIS?
I called up USCIS since we are outside the 6 month processing time for ROC at the VSC. Some sort of notification is supposed to be sent to the office and we should hear from them within 30 days. Fingers crossed this will be over soon.

Removing Conditions on Residency General DiscussionROC - How long do you wait before contacting USCIS?
It has been 8 months since submitting our I-751 to remove conditions on my husband's green card. The NOA and biometics occurred relatively quickly (4-6 weeks after submission), but there has been no news from USCIS. How much longer should we wait before contacting USCIS about our case status? The VSC is handling our application, which I know processes applications much slower.

We called USCIS a month ago because we were outside normal processing times and received a notification in the mail that we should receive a response/action on our application within 60 days. 30 days down, 30 more to go. I hope the VSC gets their act together and we don't have to call back and/or get our congressman involved. We are now past 9 months since our application was sent in and the delay is irritating.

OK...after 4 days of no mail delivery, the postman finally made an appearance (I was about to send my husband to the post office today if they did not appear). Apparantly our wasp nest was cleared out Friday but for some reason the mailman did not return until today. Of course we received our biometrics appointment notice for February 8th at 10 a.m. I would greatly appreciate if someone can update. Thanks!

Hi all January filers :-)

We filed our I-751 january 4th. An the other day we received the NOA. Now I am curious if this is the same NOA that everyone else got?
It says my conditional resident status is extended for a period of one year.......and so on.
Is this the same letter the rest of you received?

Thanks :-)

Yep...same thing we got.

K-1 Fiance(e) Visa Case Filing and Progress Reportsjanuary filers!
Hello everyone! It sounds like things have been pretty ho-hum the past week. Dawn & Susie - so glad to hear you were able to see your SOs! Irie - I'm with you girl, I see Aidan for a week at the end of this month and we are both counting down the days.

Work has been killing me with the April 15th deadline (tax accountant) and I am counting down the days (literally) until next Tuesday...make that hours! It has been hard to check in on you guys but I promise to be back in action come next week. A few updates on my end...we finally sent Packet 3 back to the Dublin embassy. I had been working in London when Aidan received it and wanted to fill the forms out online instead of by hand since he does not have very neat handwriting, which held us up until I got back to the states. He has scheduled his medical for next Monday so now we just wait for our interview.

I am secretly hoping they will schedule his interview for when I am but we will see how it goes. I have no idea how fast the Dublin embassy works. I get the impression there aren't too many Irish looking to leave the homeland so maybe I will get lucky!

I have mom and the bridesmaids coming down to Fort Lauderdale this weekend (including my BFF from England) to do our dress shopping for the wedding. I think this is when it's really going to feel real. Hope you all have a great day and I hope our CSC filers starting hearing good news soon!

How is everyone doing today? Tax season has really whipped my butt and I have only been able to catch up on many of your posts on the weekends. But I have to say you all have had quite a bit of fun conversations in my absense. I love the April Fools ideas. All day yesterday I was trying to think of something funny to get my boss. He is a Starbucks addict and I came so close to running into his office with a lie that the Starbucks down the street from our office (he stops in there at least 3-4 times a day) was on fire.

But...I am a horrible liar and I would have busted out laughing before I could such a joke out. So I sat quiet yesterday and on guard for people who might have tried to pull one over on me.

Hope you all have a great day.

Hey Dawn,

Aidan and I have packet 3 and are gathering the info. Since I can't see what is in the packet Aidan received we are unsure if the DS-230 goes back to the embassy by itself or if we send in the police certificate with it (or bring it to the interview). Do you know if we are just supposed to return the form now and bring everything else to the interview?

We just sent the forms back...I think you're supposed to take the police certificate to the interview with you...that's the way it is in London...not sure about Dublin though...we only had to send the checklist, DS-230, 156, 156K, and 157...everything else goes to the interview...

At least that's my take on it...we haven't gotten packet 4, so who knows if we were right?

Oh geez..I better get in touch with Aidan. He only mentioned the DS-230 and the checklist. He's not the most organized person in the world so I fear him not having me there to review things before they are sent off might result in a mistake. Maybe I'll just fill the forms in for him and send them over for him to sign.

Did you answer the question on the DS-230 re: did anyone assist you with preparation of this form? Curious if I do the forms for him and answer this question "yes" if that will cause any red flags. Can you see my obsessive nature coming out? Ha ha.

I am surprised at how fast things are going. We are not moving forward at the breakneck pace we were at earlier in the process. Aidan does not have his immunization records for the medical so we are waiting on that before we schedule that part. Not to mention I still need to gather all the financial info to send to him....

Happy Easter everyone. Hopefully this time next year we will be with our SOs for good!

Thank you very much smashrox rose.gif

I wish I am indeed a CSC january filer who got approved, at least it would have meant all the other january CSC filers are in line already.... but as it is, I am a VSC filer, it's probably not very obvious because I didn't get a superfast record breaking approval smile.gif but I still feel very very lucky to get approved in less than two months..... but it still breaks my heart to see fellow January VSC filers and those who filed months before me still waiting to be approved and all the CSC filers still waiting a few more weeks to a few months longer. sad.gif

OH #######!!! How did I miss that? I must have been blinded by that which is obvious. OK...let's try this again...CSC filers I am still pulling for you.

Wow this board has been active the past 24 hours. I have enjoyed reading all of the posts. DBEARS...congrats! You deserve it, especially after all the cheerleading you have done for the rest of us. Surely an October wedding is in sight now! After we received NOA2 I breathed a deep sigh of relief because I took the risk of planning our wedding and making arrangements without approval in hand. While we aren't quite completely done with the immigration process yet, at least the end is in sight and we still have over 7 months till the wedding.

Aidan and I are still waiting on packet 3, but I imagine we will be one of the "early bird" interviews as we will have all info ready very soon (except I need to get around to filing my 2007 return...I owe this year so I'm waiting and borrowing against the government this time). I suppose I could make a copy of my return for his interview and just wait and file on the 15th. I have requested my IRS transcripts for the other years since that to me is easier.

I hope DBEARS is the first of many CSC approvals for this group!

I checked a few other timelines...they vary...

Ours was sent to the NVC on 2/26 and Darren got Packet 3 on 3/10...

I called NVC yesterday on their automated line and got the message that my case could not be found helpsmilie.gif

I was approved on 3/5 so surely NVC should have received it by now, right? Do I need to skip the automation and see if I can get ahold of a real person?

APPROVED TODAY!! I am so excited and I get to see Aidan this weekend to celebrate. I could not be happier.

Although I feel like I kinda "cut the line" a bit seeing as we were #107 on Igor's list yesterday. I would have been fine waiting another couple of months so those who are far overdue could get their approvals.
Here's some approval dust *******************88

I know exactly what you mean!!! Congratulations!!!!

Dawn - I'm sure it is somewhere on this website. I looked at the K1 flowchart but can't figure out (besides calling the phone # after two weeks) how you find out when your application arrives at NVC and then on to the Embassy. Where did you find this info? I'm already overwhelmed at the next phase of the process...I'm not ready yet! hee hee.

I'll let you know what I did....

I waited about a week and then called NVC (their # is at www.state.gov)...got a busy signal for about 15 minutes, but eventually got through...you'll need your receipt #; they will tell you if your case has arrived and when they will send/have sent it to your embassy (I'm assuming it's Dublin)...then your beneficiary will wait for packet 3...

Hope this helps!!!

THANKS! I will call NVC sometime next week then and see what I can find out!

But I did send my congressman an email last night and ask for some help. I also ask if he would check into why this system is done GRAB BAG style and not in order by dates as we file them. I don't see any use in calling VSC to hear a lie.
