Don't panic... they're not going to try to make arcane links between visits to the US and getting a K1 visa. In fact the two of you HAVE to have met in person at least once before you can apply for it so somebody's going to be travelling somewhere! If you so choose you could apply for the K1 visa while she is here visiting - there's no law against it and it's what some people choose to do. But she'd still have to make sure she went home in good time for her interview...

K1 visas tend to be the fastest to process... but you can't leave the country again after you use the visa unless you have an Advance Parole document to let you back in. K3s don't need AP but it takes longer for the visa to be processed so you're apart for longer while you're waiting.
The Advance Parole does NOT take 'years' to grant - it takes about three months after you apply for it and you can put the paperwork in at the same time as you apply to adjust status. So really it's about four to six months that you can't travel, not years...

Definitely NOT! The Embassy advises everyone NOT to buy their plane ticket until after the interview in case of delays... if you really want to book first make sure you leave plenty of time between the interview date and the flight, otherwise you might have to cancel and lose your money!

Is it worth it? To us, yes it was... it was worth waiting five years! Waking up in the morning to see my husband lying next to me is worth it... knowing we can go wherever we want to go together without worry is worth it... our home and our three beloved kitties say it's worth it... yes it's a stressful process and it can take a long time, but in the end if you really love someone and want to spend the rest of your life with them, it's worth it... a year or two is a very small fraction of an entire life.

Eric, the question is, since you have been with this woman for three years and spent so much time and money visiting her etc, and you are seriously committed to spending your life with her, why are you not ready to get married to her? If you want to bring her to the US to live that's what you're going to have to do... and if you don't actually want to marry her, what are you getting out of the relationship?

If you do go for the fiance visa and bring her over, you have to marry her within 90 days. It doesn't have to be a church wedding that costs a million bucks - you can get married at the courthouse for less than a hundred. It's still a valid marriage. Two months ought to be plenty of time for your fiance to decide whether she's happy to live here... and that leaves you another month for the marriage.

It doesn't have any effect on it at all. Your part of the processing is done. The only thing that matters is that you fill out the affidavit of support correctly, with your current address etc. It's if you move after you're married that it matters and you need to inform USCIS.

Of course it's possible. There's nothing about the K1 visa that says you have to stay in the US long-term... you could do one and live here for a few years and then move overseas to study. But there might be hassles coming back and you might need to get a new visa and start over again.

Take all your proof that you have to be back in Canada for the operation. when they ask why you're visiting be honest - you want to visit your fiance before you have your operation. They might let you through or they might not, but the only way to find out is to try! At least you have the advantage of geographical closeness - you can drive to the border and you don't need to buy a two thousand dollar plane ticket to get there! I never tried to visit because the risk was too great to be worth it...

BTW they wouldn't ban you just for trying to visit... but they have a high likelihood of saying 'no you can't come back until you have your visa in hand.

As a Canadian you're allowed to go to the US for up to six months out of the year... so if you just want to go and visit for awhile it's quite permissable. You have an advantage because you get twice as long in the US as people from overseas countries... if I was you I'd use that time wisely.

Short trips are looked upon with much less suspicion than long ones... if you can pack up and leave your home country for two or three months at a time more than once a year the customs people are going to look at you and ask why you want to be in the US for so long... if I was you I wouldn't try to go back for at LEAST six months and preferably longer, because you might very well find yourself denied entry and told you can't come back again.

Firstly, they usually do the interview and process the case in the country where the person is currently a legal resident. He doesn't have to be a PERMANENT resident to qualify. He's there on a student visa and has no plans to go home in the immediate future, so it's perfectly allowable for him to interview in Italy. They're not going to be biased against him because he's not Italian.

And secondly, you do NOT have to have the vaccines before they will give you a K1 visa. If you don't have them all they'll just mark the form 'incomplete' and then give you the visa. He will have to have the varicella shot once he gets to the US, and before he applies for AOS. But it's not a black mark against him now...

So relax!

Sending an RFE isn't instant... it can take a week or two to get to you, so try to wait patiently for another week before you start worrying if it got lost.

The date on the case status change is the date they decided that they needed to send you the RFE, not the date it went into the mail... or even the date it was printed off!

My SO is an american citizen and was over on a visitor visa. We tried to get married over here and then apply for a spouses visa for america. However we found that we could not get married in the UK because the UK goverment brough in a rule banning anyone not a resident from marrying. You have to enter the country on a fiancee visa or a special wedding visa or get married in a Church of England church.

What an incredibly short-sighted and discriminatory law! You'll have to have letters from her doctor/s showing that her condition is well-controlled by medication and that they think she'll be able to cope with the move... you'll probably have to show arrangements for her continuing care in the US (like medical insurance or plenty of money to pay for her meds) and they'll probably ask her about how she's going to get her meds and see a psychiatrist etc.

Adults just need tetanus and the MMR shot... they don't do varicella/chickenpox vaccinations in the UK so you don't have to get that one till you're in the US. But if you've had chicken pox before you can have a blood test for antibodies and you won't have to have it at all - get the test done by your GP and KEEP THE TEST RESULT SHEET. Then you can just show it to the civil surgeon and they'll tick you off.
