K-1 Fiance(e) Visa Process & ProceduresQuestion on behalf of a friend
I don't think the fingerprints are STORED at all - they use them to check on them once and then discard them - that's why you have to have your prints taken again and again and again... the chopf@cks don't actually have any facility to store the fingerprint files longterm.

As for the visa, a denied tourist visa is irrelevant to a K visa... she just has to tell them that it happened because otherwise they might think she was trying to conceal it.

K-1 Fiance(e) Visa Process & ProceduresDescribe how we met
You don't have to write a thesis for them :) Remember that what they're really interested in is how you came to meet in person and how that satisfies the legal requirements for the visa.

You could say something like 'we first met on the internet in X chatroom in X month and we became very close and decided to meet in person on X day (blah blah blah) and go on to tell them what they really need to know...

K-1 Fiance(e) Visa Process & ProceduresEvidences for K-1

is it necessary lets say if my fiance only includes 3-5pics as proof of evidence then my interview comes i showed another pics aside fr those on the packet would that be okay? wud there be any questions asking why showed only now those pictures ? also the instructions on passport days at least 6months valid fr the time the visa was issued , what if i already have a passport since 2003 and expiration is 2008 can i use this or what should i do next? help me please thanks am just quite nervous my interview would be on May 22, 2006 thanks :help:

No need to worry about your passport! It's got at least 18 months left on it and that's a lot more than six :) But if you are really worried, then renew your passport now and take the new one for your interview - that way you won't have to worry about it expiring once you move to the US.
As for pictures, my interviewer never asked to see ANY. They don't really need to see a thousand photos as evidence - they're just a part of the picture.

K-1 Fiance(e) Visa Process & ProceduresProof of future marraige
You don't need to PROVE that you're going to get married by showing them receipts etc. They need proof of your relationship, not how much money you can afford to throw away on a fancy wedding!

K-1 Fiance(e) Visa Process & ProceduresMedical Info, especially for UK
My doctor told me there was NO DANGER in having the MMR vaccine when I only really 'needed' part of it. When I was a kid they didn't have a mumps vaccine yet so I was missing that third. They don't do mumps seperately any more so I just got the shot and had no problems... I know that nobody likes having extra vaccinations but sometimes you just have to bite the bullet and let them do it.

K-1 Fiance(e) Visa Process & ProceduresK-1 Visa after being Deported is it Possible
I would strongly suggest you talk to a good lawyer about your case... you could file the waivers for it yourself but it's something that's much more difficult than just filling out some paperwork...

K-1 Fiance(e) Visa Process & Proceduresevidence of relationship
What everyone else said. The evidence of an ongoing relationship is for the interview... For the application you have to prove that you have met in person, which means boarding passes, passport stamps, photos etc. Emails don't prove that you were actually together...

K-1 Fiance(e) Visa Process & ProceduresI-129F Packet
You only need to keep a copy of the APPLICATION for your own records so you can remember what you wrote, and in case there is any problem with your application (like it gets lost in the mail). I never got a copy of the application my fiance filled out and I don't even know what he wrote on it, and the issue never came up... You need a copy of the NOAs for the interview, not the entire original application packet.

btw, Scorpio, is there a reason you are typing in all-caps? It makes it a lot harder to read your messages.

K-1 Fiance(e) Visa Process & ProceduresDNA Testing
It's fairly standard for some countries - your fiance has a child and they want proof that it is really yours before they'll declare it an American... they're a bunch of suspicious SOBs but that's what they're paid for, and there have been cases where someone is paid to bring a 'family' of entirely unrelated individuals to the US, or where the fiance hasn't been exactly true to them etc etc. I'm sorry it means more beurocratic delay for you!

It's way too soon to panic! It's not as if it went to a different state... I'm sure your application is perfectly safe and in the hands of the USCIS.

K-1 Fiance(e) Visa Process & ProceduresChanging jobs
It doesn't matter where you are working or how long you have been there as long as you have the required paperwork - for a new job your letter of employment or employment contract should show everything that you need, plus as many pay stubs as you've acquired in the new job to show that they're actually paying you what they said they would.

K-1 Fiance(e) Visa Process & ProceduresLanguage of Visa Interview
Your fiance should get a choice of whether to be interviewed in English or in their own language... but some people have been given a hard time for that or been forced to interview in their second language despite their preference... if your fiance doesn't speak English then they need to be ready for the inevitable questions about how the two of you will communicate.

No you're not screwed. There's no law that says you have to be living in the US before you file for a K visa... you just have to be intending to live there after the visa is obtained

K-1 Fiance(e) Visa Process & ProceduresPermanent Resident wants her Fiance here with here...
It's bad isn't it... I know a couple who were up the creek without a paddle because she was a LPR who had filed for citizenship but was caught in the huge backlog of a waiting list, and he was here on a work visa that his employers let lapse (but kept him on in the same job for a couple more years!) They wanted to marry but they couldn't do a thing the legal way... in the end he decided to leave the country voluntarily and stay under the radar and she was going to go to England to marry him and then try to get him back in when she could... I have no idea where they are now because we lost contact, but I hope they're going to get a happy ever after...

K-1 Fiance(e) Visa Process & ProceduresInterview Done PLease help !
No you have NOT been denied. You just have to give them what they ask for and wait patiently... they didn't have enough information to approve you at the interview so now they're waiting for it before they can make a final decision (but the decision is most likely going to be yes...) Try to relax :)

K-1 Fiance(e) Visa Process & ProceduresQuestion
The best advice anyone can give you is just be honest! I'm sure it helps that when she was denied entry to the US it was because she was trying to come and visit you... had she ever been refused entry before, or was this the first time? Lots of people are refused visitors visas and it has no bearing on a K-visa later, because they're meant for different things. If they deny you a visitors visa because you don't have enough ties to your home country it means they're afraid you're going to try to stay in the US illegally instead of going home... but that's no reason to deny a K visa.
KajikitFemaleAustralia2006-03-29 19:34:00
K-1 Fiance(e) Visa Process & ProceduresWhat happens if I get deported?
There's a difference between being deported and being denied entry... it may be a technicality but 'deported' implies that you were in the country illegally for a period of time, and it could make for big trouble. Being denied entry is quite common to people who try to come to visit while a visa is in the application stages...

K-1 Fiance(e) Visa Process & ProceduresTravelling within the US
This isn't a dictatorship... you are allowed to travel wherever you like within the US! They aren't going to say 'papers please' and lock you up because you don't have an EAD yet. If you're travelling by road you shouldn't need any official ID at all and if you're flying then your passport or your Drivers Licence will be just fine and nobody will try to look at the visa page to check on your status...

Canadians are allowed to stay in the US for six months out of the year afaik...

And yes, you can file for the visa while he is still here. But his interview will be held in Canada and he has to leave the country before his legal stay is up...

K-1 Fiance(e) Visa Process & ProceduresAge Difference
It depends on how old you are... when you're a kid or a teenager, three years makes a world of difference, but it ceases to matter once you're out of the education stage and you're all out in the big wide world with the rest of us :) eg. 15 - 18 is such a huge diff. that I'd question the motives of the older party, and 18-21 seems pretty big to me, but 21-24 is nothing :)

I very much doubt that USCIS will pay any attention to a 3-year age difference!

K-1 Fiance(e) Visa Process & Procedures2 years before starting the I-129F???
You'll just have to wait patiently... and if things take too long then you'll have to make another visit to Cambodia, and make sure you keep your itinerary, boarding passes etc - anything that proves you went there. Some people take a photo together with their fiance holding up a newspaper, or in front of a sign or bulletinboard etc because that provides a way of dating the picture.
I hope you won't have to wait two years for your citizenship though!

sounds like you're going to have to work hard to prove to them that you have a real relationship and he's not just hunting for a greencard... but there's no law that says you can't fall in love with more than one American.

K-1 Fiance(e) Visa Process & ProceduresTechnical question
All you could do is to show them his EAD and his AP and his NOA1 for the AOS... (boy, that's a lot of acronyms for one sentence!)

Also, you may not have to wait two years for his greencard... a lot of applications have been (and are still being) transferred to California for rapid processing, and once you're transferred it only takes about three months to get approved. My service center has a two year+ backlog but I was transferred and ended up with my greencard in hand 10 months after we applied for it.

K-1 Fiance(e) Visa Process & Procedureshelp, i'm a newbie
Don't panic about the application... if your fiance is a legal resident in Italy they won't make him go back to Albania for the interview etc... he can do it right there in Italy.

As for working in the US I'm afraid that your husband will have at least a few months to improve his english before he's legally allowed to work - after you're married he'll have to apply for an EAD work permit and it takes about 90 days to get it approved. Best advice is apply for the permit asap and then enroll your husband in ESL classes to give him something to do for those three months!

And good luck with your visa...

K-1 Fiance(e) Visa Process & ProceduresGetting Out
Before you give up on the marriage I'd really suggest you try counselling together. It might be easier to talk out some of the issues with a third person to mediate... but if your marriage really doesn't work out your spouse doesn't necessarily have to leave the US - if she hadn't got her green card yet she wouldn't have any options, but you can lift conditions as a divorced person if you can prove that your marriage was entered into in good faith and not just as a way to get to the US...

K-1 Fiance(e) Visa Process & ProceduresI want to marry a US citizen
Since you're in the US legally and you didn't go there just to get married, you don't NEED to apply for a marriage visa unless you have some deep-seated need to go back to England before you tie the knot. If you want to stay in the US and not leave you can just get married and apply to adjust status - you're not an illegal alien and there's no law against falling in love while you're going about your legal studies or legal employment... good luck!

K-1 Fiance(e) Visa Process & ProceduresWill this hurt us?
If they were going to deny a visa to anyone who had ever suffered a situational depression, nobody would ever get one at all! It's only a problem if the person has ever been so suicidally depressed that they had to be hospitalised, and if they've ever attempted suicide. And even then you can still get a visa if you can prove to them that it was all in the past and you've been appropriately treated and you're not going to be a risk of being a public charge in the US.

It means bringing a letter from your treating doctor (psychiatrist or GP or whoever has looked after you) explaining your treatment plan (or prefereably how you don't need one any more and you're a perfectly sane human being)...

I was terrified that I wouldn't get my K1 visa because I was seeing a shrink for five years and suffer from anxiety etc, but in the end it wasn't a big deal - I just thought it was! The worst thing that happened was that in my interview they asked if we had any plans for me to see a therapist in the US (no we didn't...) and they gave me a conditional approval and I had to have a repeat medical exam within 12 months of arriving in the US. The first I knew about that was when they sent me a RFE for it... but it was even less of a big deal than the original exam! So try not to worry - sometimes we're our own worst enemies...

K-1 Fiance(e) Visa Process & ProceduresApplying for K1 with a Tourist Visa
Don't panic... they're not going to try to make arcane links between visits to the US and getting a K1 visa. In fact the two of you HAVE to have met in person at least once before you can apply for it so somebody's going to be travelling somewhere! If you so choose you could apply for the K1 visa while she is here visiting - there's no law against it and it's what some people choose to do. But she'd still have to make sure she went home in good time for her interview...
