You have until January to file your paperwork. There is no need to rush to send it in - it's just going to sit there in the queue once it gets there anyway. Always make sure that you've got all your ducks in a row first and send everything in at once. They don't really have the ability to add stuff to your file later on unless THEY'VE asked for it via a RFE.

Nope, you're not the only one... I was fine while they were still a few months ahead of me, but now they're processing applications from the month as me and I'm still waiting to see something! We just went away for a week and I had the fond hope that I'd find an approval in my mail when we got home but nope... since my case status says it was 'received at TSC on Jan 3rd' does that mean that it puts me behind the other December people in the queue? My greencard expires on something like Jan 5th and I'm going nuts waiting for the new one...

I was very worried about our documentation because we live a very quiet life and we didn't send any affidavits... but I needn't have been concerned - the website says I was approved on December 11th. So I can quit worrying about it now. Good thing too - much longer and I'd have run out of fingernails entirely. tongue.gif

Here's hoping that all the rest of the December crowd can get approved in time too - they seem to be TRYING to get it done in the 12 months, but at this rate they're going to need to hire more staff! Approvals were flying thick and fast until they got to all the TSC transfers and it slowed down to a crawl...

I've been watching the Vermont approvals like a hawk... at first I was happy to see the approvals creeping closer to my application date, but then I was overtaken and now I'm the oldest unapproved December application on the list! I check my online status every day but it hasn't budged from 'your case was received on Jan 3rd'... and now somebody who applied on January 31st has already been approved?! When do I start to worry about it? (of course I'm worried about it already, but I'm not sure whether it's justified or just my over-anxiety...)

That's how long it took VSC to approve my application to remove conditions. I was starting to get really worried about it because my green card expires early in January and I hadn't heard anything yet... but the USCIS website says that I was appoved on December 11th 2008! Hooray! Now I just have to wait for the letter, and then the actual card itself.

If you looked on the old forum there were several polls about who used a lawyer for their visa... and about 75% of people who responded did it all themselves. And most of them were successful. It's not like a court case where you need a professional legal representative or somebody who knows the law book backwards - you just fill out the forms carefully and in the right order and send them in and wait around a lot. Anybody of average intelligence and with the ability to read English should be able to do it for themselves just as well as a laywer.

After you submit for the I-751 they will give you a biometrics appointment [another one] for removing condtions.
If it's been 21 months since GC approval you can submit now.
You'll beat the fee increase if you mail petition to remove before July 30 [next Monday] if that's the case!



Ah ha! Thanks for clearing that up for me. However, I thought we could only send in our paper work 90 days prior to the expiration date. No sooner and no later. 90 days will be August 16th for us.

Hi Guys,

Well, 2 years are almost up since my wife received her provisional permanent resident card and we are beginning the "Lifting of Conditions" process to receive her 10 year card.

As I was reviewing all the information I need to provide along with the increased fees, it mentioned the fee includes biometrics. Do we need to do this again before we submit our I-751 or is this performed after our I-751 is approved? I'm very confused because she has already done this once. Can someone please point me in the right direction or provide an explanation? What am I missing here?

I'm preparing to send my wife's I-751 documents off tomorrow morning and I was just hoping for a quick review from my friends here at Visa Journey. =)

We live in Florida and I'm pretty sure we need to send the documents to the Service Center in Texas. Is this correct?

11. Copy of my wife's Domincan Republic Passport showing her original VISA to enter the United States

14. Over 10 photographs of the two of us shot in the past 2-3 years in different geographical locations.

Yes, Thank you. I see the barcode on the new form but, my fear is now that they are asking for either a Revision Date of 02/05/07 or 07/30/07. and the only form you can download from the USCIS site has a revision date of 07/31/07! God forbid I do all of this again and it still not accepted because of one day difference on the Revision date.

Where can I find a from with the other dates? Either 02/05/07 or 07/30/07?

The only form they have for the download has: "Form I-751 (Rev. 07/31/07"

I have now gone to the U.S. Citizenship and Immigration Services web site to find the form. I am even more confused now. It appears to be the exact same form. In the upper right hand corner it states: OMB No. 1615-0038; Expires 09/30/08. This is the same as the form I downloaded from this web site. Can someone direct me to which form I am supposed to be using?

He everyone. I received my wife's I-751 form back from immigration today and they stated, I quote: "The Form I-751 you submitted has been revised. You must submit the Form I-751 with a Revision Date of 2/05/07."

I don't understand. The form I used states it is the I-751, Petition to Remove Conditions on Residence and it doesn't expire until 09/30/08. I downloaded the form from the download section of this web site. If the form on this site is not accurate, I highly recommend that it be removed from the site or updated with the appropriate form.

Since the form states that it doesn't expire until 09/30/08 I felt confident that it was the correct form. Now I'm panicking that we will not meet the necessary deadline and my wife will face deportation procedures if I do not get this corrected immediately.

Can anyone provide a little advice? Thank you so much!

We will re-submit, for a third time, all of the original documents + new Utility bills with both of of our names and her past two driver's licenses and mine. If I can find 2 years worth of pay stubs we'll include those as well but, wouldn't you think tax returns and insurance records for the past 2 years would be sufficient evidence that we have indeed been living together for the past 2 years. Finding 2 years worth of anything is difficult on its own. I have plenty of paper work with both our names and address on them. Just not two years worth of the same document! I called the electric company this morning and had my wife's name added to the account but, I don't have 2 years worth of bills with her name and mine on the same bill. This is what is scaring us. I would imagine the most concrete evidence we will have will be her past two driver's licenses. They date back to 2005 and mine dates back to 2003. What do you think? unsure.gif

Personally, for the identification section I would send in the photocopies of your driver's licenses (front and back), as well as a copy (front and back) of your wife's green card.

They are definitely looking for evidence of shared domicile (see bolded sentence above). Whatever you sent in beforehand did not convince them that you live at the same residence, so you now have to convince them that you do. Since she is not listed on the mortgage (or deed, I assume) or utility bills, you do have time to add her to these things and get a copy indicating such.

Other things to include:
--definitely highlight the address on your driver's licenses to show you live at the same address, and include any other things that do the same -- library cards are good for this as well.

--joint tax returns are helpful

-- notarized statements from people that can attest that you live together, you have been living at such and such address since she came to the US, etc.

--anything addressed to both of you showing the shared address -- any recent Christmas cards? insurance statements? medical bills? etc etc.

Take a good look at other evidence threads in this forum -- there are lots of great suggestions in those that may help you overcome this burden of proof. This can be done! smile.gif



This is what is so perplexing to me. We already submitted these items.

1. Copies of the passports and green cards (same address) of my wife, Carmen Fragoso.
2. Three original letters written and notrarized by U.S. citizen friends and family, attesting to our relationship and marriage.
3. Copy of tax returns from 2005 and 2006 (same address)
4. Letter from my company of designation of my life insureance to Carmen Fragoso.
5. Copy of car insurance identification card. (same address)
6. Copy of the loan agreement t our car, showing joint ownership (same address)
7. Copy of our joint checking account (same address)
8. A copy of different photographs taken in the past 3 years of us together in and around the house.

So, it looks like the only thing I didn't include was:

1. Each of our driver's licenses. Front and back.
2. Copy of Pay stubs. Front and back.
3. Credit card statements
4. My wife's medical bills.
5. Copy of MY passport.

Unfortunately, our county library card does not include a printed address or name. Only a digital bar code with the members information included.

And believe me... I've gone through these forums for hours on end searching for different kinds of evidence to provide. I felt confident that I had covered all the bases fairly well the first time I did this. Man, was I fool to think that!

I'll contact all of our utility companies tomorrow morning and try and add my wife to accounts. I hope that isn't going to be a big deal and the utility companies don't give me a hard time about it. I'll keep you posted.

Now if the letter you received is a Request for Evidence... well, then you need to send in additional evidence along with the RFE notice.

As Cassie says, your whole application has been Forwarded to the California Service Center and there is no reason to resubmit the application or payment.



Okay guys, I will try and calm down but, I'm sure you can understand my extreme frustration with the current situation.

The first letter is blue and in the upper right hand corner is titled: I-797E, Notice of Action. Below my wife's name and our home address it states:

RETURN THIS NOTICE ON TOP OF THE REQUESTED INFORMATION LISTED ON THE ATTACHED SHEET.
Note: You are given until MARCH 4TH, 2008 in which to submit the requested information to the address at the bottom of this notice.

Pursuant to 8 C.F.R. 103.2 b (11) failure to submit (ALL) evidence requested AT ONE TIME may result in the DENIAL of your application.

On the Attached letter which is white and states:

REQUEST FOR EVIDENCE - I-751

IDENTITY DOCUMENT: Please submit a photocopy of the Department of Motor Vehicle issued driver's license and/or identity card for each party to the qualifying marriage.

AND

RESIDENCE: In order to establish eligibility for removal of your conditional status, you must submit evidence of your communal residence for the past two years. Such evidence may include but is not limited to the following:

Copies of rental lease(s) or rental agreement(s) showing joint tenancy at a common residence signed by you, your spouse and the owner(s) of the property (or the property manager).

Copies of utility bills such as telephone, gas, electric, water, cable etc. or other statements issued in both your name indicating your residential address.

If applicable, submit copies of military Basis Allowance for Quarters (BAQ) form for housing and/or DD Form 1172 for dependent military dependent cards.

Any other documentation which show that the marriage was not entered into in order to evade the Immigration Laws of the United States.


Now I submitted all of this information and then some back in August of 07' We already submitted both our driver's licenses. It was a stack of evidence and inch thick!

Do you guys think there is a problem because my wife's name is not on the mortgage to the house or our utility bills? I bought our home over 10 years before I met my wife.

And it appears to me that they are indeed asking for ANOTHER I-751 form. (steam coming out of both ears). helpsmilie.gif

Even though the up to date, 2007 form clearly stated that if I live in Florida I was to send the form and the $400. + dollars to Texas? Well, I start this new year with yet another letter from Immigration. I sent my wife's I-751 form with over 10 different forms of evidence that we are indeed married and have been for the past 2 years to the Texas address on the form. It was received and everything seemed to be going as planned. Well, around the last week of December 2007 I have received a new letter from the California office requesting the exact same information. This will be the third time I have gathered, prepared and sent evidence to immigration that we are indeed married and requesting lifting of conditions. What is going on?! mad.gif

My wife finally received her 10 year card this past weekend! After nearly a 4 year long journey, it's finally over. Only after we had to submit evidence 3 different times! I supplied everything I could find and it worked. I was getting concerned. I would simply like to thank everyone here on the Visa Journey forums for answering my questions and keeping me focused and calm during the most stressful times through this process. It has truly been an educational and eye opening experience. Thank you all! And now we simply wait to apply for Citizenship. kicking.gif

I am sure I will return often to this wonderful resource on the web and offer my help and experience where I can to others going through the same strenuous process of immigration. Thank you once again everybody. You're the best!
