If his card expires in January, that's your deadline for having the paperwork SUBMITTED... Mine expires Jan 11th and I'm going to send my package in today just to make sure there's a few weeks leeway in case we screwed anything important up. It'll take them months to actually process it but that's their problem, not yours.

I decided we probably had enough without them... I dredged up EVERYTHING I could think of to show that we did stuff together (like church), and there's 65 pages of stuff in the package! If that's not enough to show that we're really married, I don't know what is... I just finished tidying the packet up and added in some 'real' junkmail and envelopes just so not everything is a photocopy, and in about half an hour it's off to the bank to get the cashier's cheque. And then it's in the mail. Whew!

Nobody else has any advice for me? Should I be panicking because we don't have any letters... well, if they want them now they'll have to RFE me for them. Since nobody pointed out any glaring omissions, the package is going in the mail this afternoon.

It had to get postponed a couple of times because things came up (like a vacation and my husband getting sick)... but it was a good thing because a few more bits of evidence came in during the last month. So this is what I've got to send in. (everything is a copy of course, except the actual application...)

- cover letter
- application to remove conditions
- permanent resident card
- my social security card with the address attached
- 2004, 2005, 2006 tax returns from H&R Block
- matching driver's licenses showing same address.
- DH's Insurance benefits summary for 2007 showing me as spouse/dependant.
- dental insurance statement for me from Oct showing DH's name as inusrance holder.
- matching eyeglass statements (I broke my glasses so we got DH reading glasses at the same time)
- joint lease for our apartment ending in April 2008
- bank statements from our three accounts (one statement for each account per year we've had it open)
- letter from the bank re our account balance in November.
- Best Buy letter approving our joint credit card
- Pet Insurance paperwork for our two cats
- Vet reminders for our cats from 2005
- Receipt letter for donations to our church this year
- his-and-hers donation checks from our old church.
- Friends of the Library newsletter from the local library with a 'thankyou for volunteering' to me in it.
- Broward Folk Club newsletter addressed to both of us
- Junk mail from the christian bookshop, addressed to both of us
- a couple of envelopes/christmas cards.
- memorabilia, hotel invoice and photos from our trip to a sci-fi convention in 2006
- Ditto for a different convention in 2007
- Half a dozen random pages from our scrapbook from our wedding onwards.

And I certainly hope that's enough to satisfy them! We can't send in bills because they're all in DH's name... ditto the car and insurance (I don't even drive). And we don't have any kids so there are no birth certificates etc. DH's sisters offered to write letters for us, but they're both out of state visiting family until the end of the year, so it's too late for that. We have photos of us and them together in the package. I've included EVERYTHING I could think of to put in! Does it look okay?

Well, our evidence was so many pages that I went through it and stapled each seperate individual piece of evidence together (like each tax return) so that the pages would stay together... then I fastened the whole packet with a binder clip that was JUST big enough. If they don't like it, tough! I doubt they'll deny my application just because I used a few garden-variety staples...

No you don't. Your photo will be taken when they do your fingerprints again... you only need to send in passport photos if you are outside the USA (ie. military) because they can't get your photo themselves if you're not in the service area...

Just file as soon as you possibly can and don't worry too much about it... you could tie yourself in knots panicking over it and what's the worst that happens? They could possibly deny (but I don't see why they would if you give them a reasonable explanation for not filing when you were supposed to) and you have to start over and file for AOS again. There is absolutely no reason to need a lawyer if you didn't before.

I know it's a nasty shock... but it sounds like none of the stuff they want should be too hard for you to get hold of, just a hassle... everyone has medical bills at some time, utility bills come every month, you can get your tax transcript from the IRS just by calling them etc. It sounds like you gave them evidence, but not in quite the form they wanted to rubber-stamp your paperwork...

I just hope we don't get RFE'd for the same sort of stuff! (I sent in some medical bills, but all the utilities are in DH's name, and I sent in the H&R Block tax info... etc.) Did you send in any of this information at all before?

PS. Don't blank out ANYTHING this time - why take the chance that they won't like it? And since you don't have a joint mortgage, send a letter explaining why you can't provide one... and a letter from your neighbours wouldn't be a bad idea either to say that yes, you are BOTH living there...

You're the one who has to deal with immigration, not your wife. Lifting conditions doesn't require a new affidavit of support, so your wife's financial status is irrelevant at this point - what matters is your continuing relationship, not how much money you have.

I WILL be becoming a US citizen - it doesn't invalidate my Australian citizenship, and it provides a lot more security which could be needed if anti-immigration sentiment gets much stronger... besides, I'm quite happy here and have no particular desire to go 'home' again. (besides, I don't want to have what happened to my mother happen to me... she was an Australian citizen by virtue of her family, and then they decided that wasn't good enough and she had to do the actual ceremony etc and she refused to, so even though she's lived there for 50 years, she's 'not Australian'.) There's no valid reason NOT to do citizenship, and plenty of reasons to do it.

They don't actually care what's ON the tax return as long as one was filed correctly and they get to see it... they're not going to say 'hey, there's not enough money on this thing'. That's not relevant at this point. It shows that you have joint financial stuff and that's all they really care about.

Sadly, it's entirely normal... it seems that if you're very lucky you'll be approved before the 12-month extension expires, but don't expect to hear anything before that. Judging by the approval dates we're seeing here, VSC is up to September '07.

My fingerprints were illegible the first time round... so they sent me a letter to go and do them again. I don't know what was going on the first day (when three people tried to do my prints and NONE of them worked out!) but when I went back it was 'zip, it's over with'... and I didn't have any problems getting them for my greencard either. So just because it doesn't work one day that doesn't mean it won't work EVER... you might not need to worry. The human body replaces skin cells all the time so it might have been a once-off problem.
