K-1 Fiance(e) Visa Process & Proceduresround trip ticket?
is my fiancee required to have a return ticket when she arrives? I have asked my travel agent, and I can not purchase a ticket that departs from her country. I can only get one that departs from here, and only use the return ticket.

thank you in advance

Now for the cold and snow and ice to go away for good so I can get him his drivers permit and start teaching him my poor driving skills heh heh! Poor guy must feel trapped but at least we have a nice pub in walking distance wink.gif

It's the paradise to have a pub closeby!
Nevertheless, don't make him drive after going to the pub! lol

What's up everyone?! Haven't posted for awhile, but we've been keeping tabs on all of our fellow January '08 CSC Filers. Valerie received her EAD on Friday, January 23rd. It took 84 days to receive, and we also had an RFE. It's crazy how timelines can differ so drastically depending on where you live. I thought that maybe ours would be among the last ones to go through since we live in San Diego, but she has it. Exciting! We also have our AOS interview on February 24th! Won't be long! Good luck to everyone still waiting to hear something. Things always have a tendency to happen when you least expect it.

Congrats!
It's good to hear that everything's going smoothly for you guys! Good luck on your interview! good.gif

That's so funny! biggrin.gif
Complaining does work! Congrats Pam and Cecile. I hope you'll have your GC soon!!!

Me I don't even try to complain. I know it will take forever for my GC. I called USCIS 2 weeks ago to check on my status for AOS. And the lady told me it just had been transfered to Denver, but when I went to my infopass last week, the lady told me my case was still in Chicago, and that it will takes about 8 months to get the interview...

Jeroen, did you get any touch on your AOS since your complaint?

About driver's license... I've had my temporary driver license at least three weeks ago (well, Dec 23rd I think) and I still haven't received the normal one. For people who have already received it, how long did it take?

Nevermind I just received it today! It took a month!

Congrats Cecile!

And on our end, still NOTHING regarding the EAD or AP or AOS. mad.gif mad.gif mad.gif Last Friday I called and filed a Service Request since we are beyond the three months. They said we should hear within two weeks. Tomorrow will be one week and no sign of anything happening... not even a touch.

Sheesh...
crying.gif

I'm so sorry! I totally understand you! I was in the same case! I had to wait 112 days before getting my EAD!
What happened when I put a service request, is that a week later I received a letter saying that someone is processing my case, it should arrive soon at your home!...I've been approved about 20days after my service request. And the next day after my infopass. I think you should think about getting an infopass too. wink.gif Things seem to go faster after that!

on a different note... anyone knows how things are with taxes over 2008??

I mean, I always thought we had to file 2008 in either the US or our home country (that is if there is an agreement, I know there is one for most European countries). But now I also read different things and that we apparently do not need to file tax yet since we haven't been here long enough or something? I don't know but it confuses me a bit so now I am kind of wondering what you guys think we need to do.

On that same note... the USC's claim differently now that we're married. I'm not sure how all this impacts taxes this year. Anyone with knowledge in this area?

I'm not an expert but I understood that in 2008 we pay the taxes in our home country. Since we were all working during the long K1 wait! héhé. But not in the US, since we're all not working during this long EAD,AOS' wait! We'll pay taxes for 2009 here.

I read that the discovery health national challenge (or whatever it is called) gives free memberships at a gym for a month. So I went on the website to sign up because it would definitely be good to do some kind of exercise... and apparently you can only subscribe if you are a US Citizen!!! mad.gif
I can understand that some jobs are only for US citizens, national security and all that, but seriously, why shouldn't we be able to get that free membership?!

I said that to Bryan and he told me: "maybe you can lie and say you're a citizen if they ask, they won't find out". Which I am definitely NOT going to do! But I'm curious, would that be a federal offense to say I'm a US citizen just to get a free membership?

It's so unfair! I don't see what the point to have the citizenship for a gym!
I think it's an offense! You can't do that. I bet if you suscribe they'll ask your american passeport number or sth like that...

Second, where is this California service center thread? Or January filers thread? And how do I find iggors list and what is it??? Sorry, but I'm new and I dont know a thing yet! PLZ reply!!!!

Hey!
Welcome on VJ!
The thing between Vermont and California is different from time to time. This the January thread of last year! happy.gif
Last year in Vermont people got approved in 60 days whereas in California in 6months. But things change...
You can find Igor's list under "immigration Timelines" right above "K1 visa holders"! Hope you'll find it!

Yes, winters are quite cold here, we're only 45 mns from the Canadian frontier.
It is not like it is my 1rst winter (3rd one), and I really enjoy having snow too, but this week, it is going until -25°C, so yes, especially if it is windy, you don't feel like going snowshoesing on your time off!! whistling.gif
Fort Collins sounds nice to me right now!! It must be nice to be in a sunny place, it is good for your mood!! smile.gif I read not long ago that Colorado is one of the best states to live in (average on income, education, hospitals, etc.)
About going to work, we're ok because we live on the work place! tongue.gif We're both working in the same resort, and luckily, they provide "employee housing"! It is just a studio, but it is cozy and cheap, so we just walk to work!!

About my DL, yes, I have a yellow paper with my info, and a side where the examinator is writting that you passed, with your fee paid, etc.
The test was easy for me. What made it easier was that I passed in a very small town, so, no surprises I knew the town.
He is first checking your signals (lights, horn, warning lights....), and then you drive. He made me drive around, and made me do the parking tests.I was a little worried on the parallel parking ("créneau"), but there were plenty of room for me!
My only mistake was when you park in a hill, you need to use your parking brake, and turn your wheel a certain way so your car don't end up in the middle of the street (in case your brake don't work), and I couldn't remenber, and turn my wheels in the wrong way! whistling.gif but still he said I did ok!! biggrin.gif

Oh my god! You're so lucky to live where you work ; )
You gave me an idea. When I'll have my EAD I'll ask the renting office of my residence if they have a job for me. The office is right in front of my building and maybe we'll get a cheaper rent! hehe!
Your exam seems pretty smooth! And the guy seemed nice!
I read some horrible stories here on VJ about people who kept failing their exam in the US because they had stupid examinator! Plus it was people who'd been driving for many years in their country. One guy failed right at the beginning of the test because he had a tiny crack on the front windshield, he didn't even noticed! huh.gif

Minnesota is supposed to get a -47 windchill today (yikes) I agree with the comments about Colorado. I lived in Boulder (actually sunnier than Ft. Collins yes.gif ) for almost 20 years and the sun is so warm it can be below freezing and you feel comfortable in a t-shirt. Also, the snow doesn't really melt there as much as evaporate. I'm in Chicago now and it's below zero...... perhaps a move back to Colorado is called for.

-47 windchill?! I wouldn't like to be there right now! ohmy.gif

By the way, it is getting freaking cold here in Minnesota!! wacko.gif

Oh Lucie! I am so sorry to see that you didn't receive you EAD card!! It is not fair seeing you filed before me, and still you are waiting for the most important paper!! mad.gif
I am hoping that your info pass is going to move things along!!
They sais it should take 2 to 3 weeks to receive my DL! kicking.gif

Thanks for the good wishes Pam!

Indeed I heard that Minnesota winters were quite harsh! How do you go to work since you don't like driving in the winter? Do you carpool?
I'm lucky I'm in Colorado but it's always sunny and dry here in Fort Collins. We have the montains on the west side that blocks everything. Fort COllins is the most sunniest city in the US! even in front of Phoenix, Arizona! Yeah ayy! (but not the hottest place though, hehe)

While your waiting for your DL? Do you have a temporary paper that says that you passed the test? Was the test hard?

Thank you so much, all of you guys. This has been very confusing and very difficult. I don't know what has happened and can only really speculate at this point. There is not much I can do but wait for some answer some day. Olga is not "flighty" or capricious, nor have I ever seen any action at all on her part that would lead me to think she is in any way manipulative. So a disapearance is bizarre and not like her. The fact is that she lives with her father and he is not at the apartment either, and hasn't been for weeks now.

I have more questions than answers, I do not understand anything. The children start school tomorrow in the Ukraine and if no one is at the apartment then I cannot help to think that she is gone and not coming back. But I don't know anything, like I said.

We all started this journey a year ago, and at no step of the way was this easy. I am so happy that everyone has been successful in at least getting together. My journey still has a ways to go, I'm thinking, and although I'm not sure how it is going to end, I know I'll keep moving. You give your spouses an extra hug tonight, cherish each of your moments. Love you all.

Blake

Blake, it's so nice to hear from you! I'm so sorry about what happened to you guys! I hope Olga is fine and she'll find a way to contact you soon! rose.gif

I just saw something which kind of might interest you guys...

Someone on a Dutch forum (diff site) just posted two pictures which were taken of a USCIS service center and were inside an ombudsman rapport of 2008 (it was not said which USCIS service center it was).

The guy who posted this on the Dutch forum also added a nice calculation... They get about 6 million applications per year, each file is approximately 3 mm high and they work about 200 days per year... that makes 6000000/200*0.003 = 90 meters of files each day :S

Oh well, here's both the pictures:

A loading/unloading dock at the USCIS service center:
Attached File  uscis.jpg   24.37KB   13 downloads

And here is where your files get stored:
Attached File  uscis2.jpg   35.57KB   12 downloads

Seeing these pictures, it really makes me look like blink.gif ... it is amazing they can still track down our applications and that there are still so little mistakes then.

I know! That's crazy!

That's why it was easy to be back at work so quickly, my manager already knows how I work, and don't need to train me.
I am part time right now because they isn't enough work (the resort gets busy at summer time more than winter), so I just need to be patient and wait for spring to come! wink.gif

B. K-3 spouse of a U.S. citizen or a K-4 child of a K-3 spouse of a U.S. citizen, and

Thanks Jeroen for all the infos! You worked on this very well! wink.gif
That's what I thought too...That they will ask it at the interview.
My doctor here in Colorado, he asks for 150 dollars, just to write the vaccination on the I693. Dr Arnold is cheap, but I don't see how I can do that, because I still need to do the Tb skin test, which we didn't do at our home country. So, I'll need to go to a doctor here in CO anyway, and pay an extra hundred bucks...great! dry.gif
My doctor in France doesn't have my DS2035. He just had the original that he gave me for the embassy and then the POE. It(s not fair, apparently in the other countries they give the DS3025 to their patient...So all I have is my very old french Health Book. Ihope the Dr will accept this, and transcribe, and not telling me that he wants me to do them all over again!!!!!

I sent out my AOS/EAD/AP today.. Not the I-693 though...I don't know where all the sudden fuzz about the I-693 comes from but we don't have to submit that one as we are in the US through the K1 process and we had our medical done back in our own countries within the last year...

Yes, it's only the vaccination thing to give for AOS. And that's a big fuzz! at least for me..because they ask for TB skin test in addition (which means additional lots of money) . and for women under 26 and 26 included, HPV, which my doctor in France advised me not to do. He says it's crazy to make me do this vaccine for a women my age and with my medical past... But the USCIS civil surgeon, whereas it's Dr Arnold or my local one, don't care about that. and they will do this HPV thing anyway, because that's what it says on the document. So, if they ask me to complete the I 693, I'll just wait to be 27! tongue.gif

We did the I-693, but I'm worried about the TB skin test that is a new requirement...we were JUST after they implemented the rule and no one seems to know anything about it. I'm scared they'll RFE for it. We had it done, but none of the CSs will transcribe the results unless they do a full physical...hmm...let's see, an additional $300-ish that might be unnecessary? No thanks.

That's weird that they don't want to transcribe the results... I feel like in the US medicine is more about money then health! huh.gif especially USCIS medecine...

Congrats Steph! smile.gif It sounds like you two are having a lovely time.

Has anyone/everyone sent out their AOS/EAD/AP paperwork? We're going to send ours out hopefully tomorrow.

Yep, We already sent our AOS! at the end of September ; ) Do you have any questions or doubts?

I'm a little bit worried about mine though... I was expecting a RFE and I didn't get one yet, whereas everybody has their RFE within the first month they sent it. Basically, I didn't send the I 693 and I only gave 2 pictures instead of 6....So it means, that maybe I'm lucky and they won't ask for it, or that they will ask me to do my medical thing when I'll be at the green card interview... who knows... blink.gif

@Lucie, I think they either made a terrible mistake or that the person who helped you just didn't know any better but it is for almost every airline 23kg per bag, not the total. It is at least for all the major airlines like this.

Well I gues it was my fault. I didn't read well enough the company website... sad.gif
But it was weird 32kg seemed fine to me. Because when I was living in China, with their main airline co, airchina, it was 30kg max total! and in one bag! So I thought it was the same for the US...
Now I know it's 23kg. I learned my lesson! wink.gif

It's a matter of weight more than volume - one bag is dangerously close to the 23 kg limit, I may need to re-pack it.

I've checked in online. Quick, is there anything else I need to do? I have my passport, boarding pass and brown envelope...is there anything I am desperately missing?!

Did you look up prices for when you get overweight? When I flew here I had 2 bags with overweight (approx 30 kg each), it cost me 50 euros per bag on the airport.

As for the things in your carryon, I think passport, boarding pass and brown envelope should cover it.

Maybe you want to take some additional proof with you just in case they ask for it (for example, I took everything with me that the consulate didn't ask for at the interview, they adviced me to keep it with me in my carry-on tho (I ended up keeping a copy of the whole case (including the stuff they did take at the consulate) with me during my trip), you never know what they are going to ask (probably not much but yah, you never know, what if the consulate forgot to put something in).

When I came to the US. I read on the flight company website, that 32kg were allowed. So I packed 32kg in one suitcase. But at the aiport they told me it was 32kg total, but not in the same bag. 23 kg max in one bag was allowed! dry.gif I had to open my suitcase in front of everybody and give the heavy stuffs back to my parents! they mailed my things back later to me....

I did the same thing as you Jeroen! I had all my K1 file, with copies of everything just in case... wink.gif

Well, someone on VJ said that the international licenses are only for visitors. Someone else said that it can be used only for 3 months.
I asked to the Highway patrol and they said that basically, there's no real rule about it and it depends who arrests me. if the officer feels like telling me I can't drive with it because I'm a resident, then he can do it.

Well, I guess if ever this situation happen to you, you can tell the officer that the DMV doesn't consider you as a resident, and cannot give you a DL. Which means that you are somehow still a tourist... wink.gif

The Department of Revenue website says that while adjusting my status I can get a DL, so I went to a first DMV office where they told me that it was wrong, I can't get one until I am approved for the AOS (or for the EAD). I went to a second office and the woman went to ask her supervisor (I assume that's what she did, she disappeared with all my paperwork for 5 minutes), and told me that when I have a proof that I am adjusting my status I can apply for a DL. So, just to make sure, when I received my NOA1, I came back to their office to ask them if the NOA1 is really what I need, and this time they told me that no, it had to be approved. which didn't make sense. So once outside the office, Bryan called the Department of Revenue for Missouri, and they told us that yes, I can have a DL even without being approved for the AOS. They told us that if the DMV office says something else, they should call the "Fraud and Immigration" department (yeah they put immigration with fraud, isn't that funny?). So we came back inside the office, told us what they had told us on the phone, and the woman said "Ok, then you go pass your driving exam and then you come back here and we'll call them to make sure, and there shouldn't be any problem"
So after all I should be able to have a DL soon.
And the DMV of Hawaii may be nice, but the ones in Missouri ARE the gates of Hell!!! tongue.gif

A little update on the driver license.
Friday I passed my driving and writing exams. The people at the Missouri Highway Patrol didn't have any problem with me adjusting my status. So after I passed the tests, we went to the DMV. There the woman said that i was her first K1, she started doing whatever she had to do, and when she realized that there isn't an expiration date on the NOA of AOS, she asked someone else in the office and they said "No! no expiration date, no Driver license". So we had them call the Department of Revenue in Jefferson City, they stayed on the phone very long, and while they were trying to deal with that, Bryan also called the Department of Revenue, just to make sure that what they had told him last time was good. After waiting 20 minutes, we finally got an official response, which is that as long as I don't have an EAD or a form that says I am approved for AOS, I can't have a DL. Why didn't they tell us that last time? I keep thinking that it doesn't make sense, as when I receive such form I will not be on AOS anymore, I'll be a permanent resident, so they shouldn't even have a "AOS" category in their paperwork!
Anyway, we left the DMV and even though it made me really angry and sad, now I just have to wait until I receive my EAD or GC. I just hope that the paper they gave me that proves that I passed the test doesn't expire before I get one of them... I don't want to redo the test (I almost failed because of how stressed I was... another thing that made me really angry, depressed and sad)
So, time to move on. I am not going to think about this until I have the right paperwork. It sucks, I can't do anything about it, but I have no choice. So here it goes out of my mind.

sad.gif I'm sorry to hear that! You passed all these tests for nothing! They really don't know what they're saying and doing at the DMVs. Hopefully they will keep them valid until you got yr EAD! Now you just need to be a lil more patient. wink.gif
and you still have your french DL, so you can still drive....right?

Removing Conditions on Residency General DiscussionWrong fee
QUOTE (sjoefl01 @ Jul 31 2008, 08:22 PM) <{POST_SNAPBACK}>
Today I got the whole package back with a letter saying that they can't accept it without the right fee.
There was all kind of red pen writing on it. The check was stapled on it and had the numbers written on it that were on the NOA's that they sent. It was also stamped for deposit only on the back.
The letter said the fee was $465 plus $80 for each bio included with the application. The check was clearly written for $625. That was to cover Lucero, and Angelica. Unless have checked the math on every calculator in the house and the computer, as well as with Excel and my fingers and toes.
They obviously realized that Angelica was included on the application because they had corrected a typo in her A number. We had gotten 2 NOAs for this application. One had the amount at $625. We got another at the same time that had an amount of $545.

What did I do wrong?

I sent it all together in one check, and had no problem. Someone is obviously confused though. Not you!

In our case, the first NOA came back from Nebraska showing the entire amount. This was followed later by the NOA's for each child showing $80 each from California. While that doesn't exactly add up, it makes more sense that what they sent you. It's no wonder they can't get it right!

I'd contact them and raise H$%%. Good Luck.

In regards to the question in your wifes signature:

My wife and children just returned from the Philippines. I never thought to have the name changed in the passport. After about a half hour of Ticket Agents debating the issue, and asking for a copy of the Marriage Certificate, (which I never thought to bring) they said it was OK to travel to the Philippines. After that there weren't any questions. Be assured if the passport name doesn't match the green card, they will question it.

But hey, I guess they are just doing their job!

Cheers

PhilippinesThe cheapest international call
Wow, So many ideas and so little time to try all of them!

I have broadband there in the Phils and use both Yahoo Messenger Computer to Computer (Gotta have the Web Cam), and a Magic Jack. It's free! The beauty of the Magic Jack is it costs ~$50US for 1 year, or ~$100 for 5 years, no monthly service charges. Gives you a local US phone number where ever you are, and you plug a real phone into it. You just need a computer with a USB port and Broadband. Gives you voicemail and all that too. Works great for me, and they can call free anywhere in the US or Canada, from the Phils. (The neighbors love it!)

http://www.magicjack.com/

The drawback is that I can only call the Magic Jack phone at the Families house, but it's a free local call. With a little planning... You can also add prepaid International Long Distance (Carrier is ATT, but we aren't supposed to know that!).

I'm not associated in any way with Magic Jack by the way, other than using them for phone service! I use one here too as a landline, beats the monthly charges for any other service I know of, even broadband based.

I've used several LD services in the past, and hated them. Either it's Ten minutes for a call that didn't complete or sucked, or you hit a credit limit. Either way it's better than Phone cards, but not much!

We still use Yahoo Messenger prepaid to call the other relatives, works good, but from what I read here there are cheaper ways to make these calls...

I'll have to try Rebtel, sounds good.
