She can always apply for a tourist visa. But under the scenario you've suggested, as the spouse of a US Citizen, she'd most likely be denied for immigrant intent.

The Port Of Entry (so in this case JFK or IAD) is where he will go through immigration and surrender his envelope.

Once he has gone through immigration and customs at the POE, his next flight (to Raleigh) will be internal.

Even if he wanted to, after arriving at Raleigh on an internal flight, there will be no opportunity to pass through immigration. Once he's off the plane at Raleigh, it's a straight shot to baggage claim and the airport exit. No immigration desk in sight.

London is pretty efficient. If your interview is on Feb 13th, you SHOULD have the passport and visa back in plenty of time to depart on the 29th (from memory, I had my interview on a Tuesday and got my passport back at the end of that week).

But however tiny the risk, it's always a gamble.

So here's the thing. I have a (UK model) BOSE Soundwave CD player/ radio. Anyone whose owned one of these will know that they are beautiful machines - the sound they generate is something else, but aren't exactly cheap. I really don't want to have to replace it with an American model if at all possible.

So being a UK model, it operates on: 220/240 volts, 50-60 hz, 60 w max.

I lugged it over here 3 years ago, and bought a transformer. The radio plays beautifully but I've never been able to get the CD player to work properly. It works for a few seconds, but then the music stops, skips, or slows - I'm guessing the motor that turns the CD isn't getting the right amount of power?

Any ideas on how to rectify this? Are some transformers better/ more suitable than others?

I'm ex-British Customs and still have friends working as front line Immigration officers.

The general rule of thumb is that British Immigration doesn't view overstaying by Americans as a huge risk. So unlike U.S. Immigration Officers, (who perceive every visitor as a potential overstayer), showing ties to America shouldn't be the main issue for you. I can't guarantee that you'll be ok, but you are unlikely to be pressed on ties to America.

British immigration IS however very, very concerned about people working without authorization. 2 months is a long time to spend in Britain, and you may be asked to demonstrate how you can afford to live for 2 months in a very expensive country without working. So bring credit cards, debit cards, a wad of cash, even bank statements if you have a healthy balance. You can also explain (if true) that you'll be staying with Robin for the whole period and therefore won't need to spend money on hotels.

Yeah - the admin at the London embassy is awful. I too sent my package by recorded delivery (April 2009). When I didn't get a response, I contacted the embassy and was told they hadn't received it.

So I sent it again - better news this time - I got my K1 interview date. But when I went for my interview.... they'd lost the paperwork I'd submitted! Fortunately I had copies with me.

I raised this with the U.S. immigration officer who I finally saw at the end of my 4 hours at the embassy. He apologised and confirmed that all the admin work is outsourced and done by British staff. I'm guessing VERY poorly paid agency workers on short term contracts. They certainly don't seem to care that much about doing a good job.

The Dr. who performed my medical in London (2009) told me that the main blood tests were for HIV (no longer performed) and Syphallis. But she also said that the blood samples are also tested for narcotics. Whether or not that's true, I don't know. Just reporting what she said.

Yes, some states and cities do have a citizenship requirements for police officers, but there are further notable exceptions missing from his list including Chicago, and San Francisco, who allow LPRs. Additionally Portland, OR will employ GC holders if they will become citizens within 12 month of hiring. And LA will accept applications from anyone who has applied for citizenship.

Not many public sector jobs outside the Federal Govt are reserved for citizens. You may see a few that are - but don't be put off. Most aren't (including many law enforcement jobs).

I'm only a LPR, but had no problems (for example) becoming a Financial Investigator with the Colorado Attorney General. I also know of a (British born) Police Chief here in Colorado who was a deputy long before he became a U.S. citizen.

Like you say, you don't want to waste time applying if citizenship is a requirement, so just check that at the outset.

In almost all cases, if you leave the United States for 1 year or more, you have disrupted your continuous residence. This is true even if you have a Re-entry Permit.

If you leave the country for 1 year or longer, you may be eligible to re-enter as a Permanent Resident if you have a Re-entry Permit. But none of the time you were in the United States before you left the country counts toward your time in continuous residence.

If you return within 2 years, some of your time out of the country does count. In fact, the last 364 days of your time out of the country (1 year minus 1 day) counts toward meeting your continuous residence requirement.

and not quite satisfied just to show them you still have a drivers' license. In practically all states, if you don't pay those fines, they take that away. But then you are dealing with idiots.

Unless you are subsequently stopped by a cop and have it confiscated, how exactly are they going to take it away? Send a swat team round your house, and seize it? There's a very good reason why USCIS won't be satisfied, just because you can show them a license.

As always be ABSOLUTELY honest with USCIS, but I'd also advise that you choose your words very, very carefully when responding to them - verbally, or in writing.

You may not have meant it, but there's a potential discrepancy in what you are saying (or at least an ambiguity) which USCIS could use against you. If USCIS thinks you are shifting your position, or changing your answers, that won't be good.

Post 1: "one of the required documents was a selective service paper I honestly had no idea what the heck that was so i googled it".

You then clarify in post 6 that: "I swear to god.. that i never heard I had to sign up for the selective services". You then confirm that you knew exactly what SS was, as you talked about it with your (military) father and took his advice that it didn't apply to LPRs.

There's a big difference between having never heard of selective service; and having heard of selective service - but believing that it was not required of you. Whatever the truth is, tell it exactly. Don't give ambiguous/ contradictory answers that will lead to more questions.

You are not eligible to apply under the 3 year rule, due to your divorce. Getting married again will make no difference.

So the 5 year rule applies.

The earliest you can apply for citizenship is 90 days before the 5th anniversary of the date your permanent residency was granted (if you came on an i-130, that would likely be the day you arrived in the U.S.).

As sn530 says, you can only apply for a U.S. Passport AFTER you obtain citizenship.

Indeed, even if she does accompany me, will she likely be called into the actual interview room, or will she spend the entire time in the waiting area?

Wait till you get back. What's the hurry. I have a feeling that they look more closely at application sent in the day of or within a couple of days from the eligibility date. Before people start jumping on my back, that is my personal opinion, I have no proof. I just put myself in their shoes. If I were an IO, I would be curious why somebody wants citizenship so badly that they would send the form in so it arrives exactly on the day they become eligible. It's either suspicious or just #######-retentive.

People who need Citizenship to progress their careers won't dawdle with their applications - is that suspicious, or #######-retentive, or just common sense? My money is on the latter.

My wife filed for her N400 yesterday. Our immigration attorney told her there was some kind of an amnesty program and there has been a surge in N400 applications since Sep 28th. 84,000 people have filed since Sep 28th.

He sounds like an idiot. Do you really need an attorney? - If so, try finding one who knows what he's talking about.

There is no amnesty - and even if there was, it wouldn't allow people to apply for citizenship straight away. They'd need to become lawful permanent residents first.

He is probably referring to Obama's memorandum on Deferred Action for Childhood Arrivals. This allows some migrants who arrived illegally as children, to receive a deferral on any removal action, and (I think) the right to obtain a work permit.

In the first month that applications were accepted (Aug 15 - Sept 15), 82,361 applications were received. These are not applications for citizenship, but are being processed by USCIS staff, at USCIS locations. So resources will have to have been re-allocated from somewhere else. It's therefore possible that the number of staff processing N400 applications has fallen since August.

I've spent 15 years of my career as a government investigator (both in the UK and the U.S.) - trying to establish who is telling the truth, and who isn't, and what the facts of any given situation are. I've interviewed hundreds of people in that time and never once has someone's choice of clothing been a factor in my decision making process. This may surprise people, but we are focused on the facts and evidence before us. Not what someone is wearing. It's utterly irrelevant to anyone but the most incompetent government official.

Someone else likened the citizenship interview to a job interview. Not it isn't! At a job interview, you are competing against others for one position. Where is the competition here? You either have something against you that will preclude you from citizenship or you don't.

It does happen, but depends on numerous factors including:

a) The Jurisdiction. In some Federal Court districts, the Federal Court retains exclusivity on Oath ceremonies. In some districts, it doesn't.
b) Name changes. Even if your district allows same day oaths at USCIS offices, if you elect to change your name this automatically stops you getting a same day oath. You have to do that at a judicial hearing.
c) Timing. There has to be enough time between the interview and the oath (to prepare your certificate etc). The later in the day your interview is scheduled for, the less chance you have of getting a same day oath.

my lawyer also says that i can re-enter with the expired greencard - he suggested getting a re-entry letter in order to be able to board the airplane bound to the states. but i believe i can board also just with my european passport, under the visa waiver program. will be checking with the local embassy about a re-entry letter first thing tomorrow morning.


Unfortunately you can't just show up at the airport with an EU passport and expect to board the plane using the Visa Waiver Program. You first have to apply for (and be granted) ESTA authorization. Given that you already have a Green Card (albeit expired), it is possible that the ESTA authorization might not be granted.

You don't have a test scheduled - you have an interview. You could ace the 6 questions and the language component and still not be approved.

As for the same day oath, that's impossible to say. But your chances are higher at certain offices - so where will your interview be held?

Not really true.

Depending on the nature of the crime, they'll happily revoke your U.S. citizenship first, and then deport you.

It's not particularly common - but does happen. Examples are: Lauchlin Currie (Canadian born spy); Bidemi Bello (Nigerian born sex trafficker); Rasmi Almallah (Jordanian born terrorist - linked to 9/11 attacks).

Those who applied in July had the longest average wait (go figure).

So - it was an 8.15 interview. Normally wouldn't be a problem - except it snowed today - first snow in about 7 weeks (damn this drought), and the traffic was awful.

But I got there just before 8, and was almost immediately called.

Officer Winfield was great. Very professional and polite, but with a friendly persona that would put anybody at ease. We went through the application (line by line). I'd brought a ton of documents (my application was at 3 years, so based on marriage), but all he wanted to see was the original copy of our daughter's birth certificate.

I'd noted on the form that I had a traffic citation - I'd brought all the paperwork, and evidence that I'd paid the fine, but when I confirmed that drugs/ alcohol weren't involved, he said he didn't need to see a thing.

We then moved on to the test:

  • Name one promise you make when you take the Oath
  • Who is the Governor of your state
  • Where is the Statue of Liberty located
  • Name 2 U.S. public holidays
  • Can't remember!!!
  • Who was the first President
He then asked me to read aloud: "Who lives in the White House?"

And write down "The President lives in the White House".

We talked briefly about eastern England (he was once stationed in Suffolk), and that was it. He asked if I was free to take the oath that afternoon - I didn't need asking twice!

The oath was scheduled for 1.30pm. There was a slight delay due to some technical difficulties, but it soon started. About 50 of us from all over the world. LOADS from Mexico! By 2.30 it was over and we were brand new U.S. citizens. Many had friends and family there, but quite a few (me included) didn't. Annette and I can barely get our toddler round a supermarket - never mind a long day out at an immigration office. I wish they could have been there, but that's reality. We had a lovely celebration this evening though.

Oh - dress code. The oath letter clearly says no jeans - but jeans were in ABUNDANCE. Ditto t-shirts, sportswear, sweats, lycra, and a whole host of other informal attire. Obviously every office is different - and Colorado is possibly more relaxed than some parts of America - but certainly here today, nobody was turned away based on what they were wearing.
