Then figure another $150-ish for your passport book and card, depending on your expidation options, if any.

And that is it! No more immigration shakedown after that! :D


I've heard people say on VJ that if your ROC biometrics was within a certain time period before applying for citizenship, then you don't need to do biometrics for the N-400.

So my questions are:

a) Is that true?
b) If so, what is the time period?
c) If you are exempt from the biometrics, do you still need to pay the $85 fee at the time you file the N-400?

Some people told me that the USCIS will always send applicants a letter asking for more evidences before they decide to either interview the applicants or just send them the cards. Is this true? Because I haven't gotten that letter yet. From the time that I went to take my biometrics back in 11/29/11 until now, I haven't heard anything from them. Is this normal?


Aside from the 4 of us who have been approved, EVERYONE is in the same position as you. It's perfectly normal not to hear anything for months and months. Basically there's a backlog of applications at both offices (though Vermont's backlog is far worse).

Believe me, if anyone had received an RFE (a letter requesting further information), they'd have posted all the details on here. And RFE's are certainly not sent out to every applicant.

Some people will get an RFE, some people will get an interview, but most will just get their approval. There's no rhyme, or reason, to the time it takes - and sadly it's certainly not first come, first served. Hopefully you'll have some good news soon.

Even down to the folding, and the BD initials on the back!!

I seem to have thrown the envelope away, but I THINK it was postmarked Omaha, NE rather than Denver, CO or Laguna Niguel, CA.

Card received today. Totally different style these days - front is very green and has various pictures, including the Statue of Liberty.

Full of fancy new security details too.

On Wednesday I received the hard copy of my approval letter. Shows the date of approval was 3/16/12 - not 3/19/12 as the e-mail indicated.

Hopefully all November filers will have their fancy new cards very, very soon!

The e-mail arrived and the website status was updated on the same day (yesterday). I'm guessing I'll receive the hard copy letter by USPS either today or tomorrow.

We have not heard anything since the Biometrics letter. We did get the letter to use until the GC arrives. My hubby's GC expired last week and we are going to Scotland to visit my stepson and in laws next month. Since it seems very unlikely the GC will arrive before the trip we will be taking the expired card, passport and the letter. Has anyone else had any trouble at all travelling while you wait?


As long as he travels with the expired GC and the NOA1, he should be absolutely fine.

Make sure it is the ORIGINAL NOA1 though - not a photocopy.

The only problem I've read about on here, involved an LPR spouse who traveled back to Brazil - but on the return trip, the airline refused to carry her back as she only had a photocopy of the NOA1. Her USC husband (who stayed in the States during her trip) insisted that she leave the original at home for "safekeeping", so she only had a photocopy with her.

Basically she was able to make the first return leg from Brazil to Peru - but was denied boarding for the connecting flight to the U.S. - and sent back to Brazil.

He then had to FEDEX her the original NOA1, and she had to pay for a brand new flight.

I noticed that the October Filers have their first completed 10year GC issued via the CSC. The September CSC group is about half completed. However Vermont is still way behind with no approvals even in September.


That first "October" filer, might actually be a September case (they've only just joined the October thread and can't remember when they filed), but yep - maybe we November CA filers will start to hear soon(ish)...

Just how far behind is VT? My husband had his biometrics appt on Tuesday. I came on to see about how long people are waiting for approval and it looks like no one who filed in November has been approved. Does anyone know how many months behind they are now? When we filed for the original CR1 we were moved from VT to CA due to how far behind the VT office was at the time and it still took 5 months. The waiting is a lot easier this time since we are together.


Looking at the threads from September filers (and earlier) should answer your question much better than this thread will. But certainly the average VT applicant is waiting much longer than the average CA applicant.

If your husband filed in November, add your details to the list in this thread and join the fun!

Bear in mind though, that the lists here are very much the tip of the iceberg. Each Service Center receives well over 1,000 ROC applications every month.

I paid for the Biometric for my 13 year old step-daughter. She will be 14 just 12 days after the current card expires. We did not get a letter for her for a biometric. We were told that they haven't made their minds up yet as to her. As it costs over $100 in gas and a day's traveling for the biometric, I was unhappy that we could not do it with my wife. They are not refunding the money.


That sucks. Are they sending you to Aurora, CO, or Salt Lake City, these days? What happened to Casper? Has it closed?

Its been 35 days since they sent mi NOA 1 and yet i havent receive my Biometrics, I schedule an appointmet at my local immigration office cuz 1. I'm worry that my letter got lost in the mail or they sent it to my previous address. 2. I'll be going to Okinawa with my husband under military order and i need to ask them what do i need to do since i'm not going to be in the states for the next 3 years. It seems like everybody got their biometrics within three weeks and thats what concerns me.


It may seem that way, but it's really not. Some get their appointment letter within 3 weeks of the NOA1, some don't.

But the good news for you, is that it is more that 30 days since they issued the NOA1. Therefore you are allowed to call USCIS and see what's going on with your appointment.

It amazes me that USCIS doesn't mail everything certified.

We already pay a hefty fee, but I'm sure people wouldn't begrudge paying say $10 more for the certainty that their NOA1, biometrics letter, any RFE's and ultimately their GC will actually reach them.

I'm thoroughly expecting the Denver biometrics office to have moved too. Back in 2009 it was an empty store in a run down Aurora strip mall. I'm guessing they go from cheap location, to cheap location, as premises become available.

hey guys, i need your help. i sent my i-751 documents on November 7th and VSC received it on the 10th. after i sent the documents i just realized that i sent it too early because the start of the 90 days before my GC expire is November 24th. i called USCIS and the agent told me that they are going to send everything back to me... so i started paying some bills because i thought that they are not gonna cash the check since i sent the documents too early.. but then on December 1st they cashed the check and the check bounced.

now my question is... are they still gonna send me back everything or they are just gonna send a letter and all i need to send them is another check? how much is the charge for the bounce check?


Looks like they might try and debit your account two more times. If that doesn't work, they'll ask for a new check and an (unspecified) admin charge.

Insufficient Funds ? Please note that the electronic fund transfer from your account can occur faster than normal processing of a paper check. If we cannot complete the electronic fund transfer because your account has insufficient funds, we will try to make the transfer up to two more times. If your account still lacks sufficient funds, you will be billed the original check amount and a one-time administrative fee by USCIS.


Of course, your bank may also charge an NSF fee - but you'll need to talk to them about that.

But speaking from my experience arriving on a K1 (long lines at Houston), I'd recommend a minimum of three hours for the connection:

20 minutes to get to Immigration.
40 minutes to stand in line.
An hour in the back room waiting for the official "ok".
Then an hour to go through security, get to the gate, and grab some refreshments!

Toronto is the POE.

It'll be where you go through US Customs and immigration control (aka preclearance). America has had a border presence in Toronto for decades - and has similar arrangements at other Canadian airports and in Bermuda, Eire and The Bahamas.

After going through preclearance in Toronto, your flight to LAX is to all intent and purpose, an internal flight - and just as if you were flying from say, Denver to LA, you won't go through any customs or immigration at LAX.

Beware though - the lines at Toronto can be LENGTHY. Hope you don't have too short a connection.

Angelina's rape did not occur on the first day or second, it was after a week of arriving to the States. You can imagine the shame, embarrassment, hurt and confusion she must have felt, especially after putting her trust in a man who was supposed to love and protect her.

What's more evident by reading the comments here on vj, are the cultural and social mores surrounding sex, love and marriage. Some members believe that Angelina and Bob had sex before because after all, that's OBVIOUSLY what couples do when they are in a pre-marital relationship. And there are others who have the belief that sex happens once a relationship is consummated (i.e., marriage). Wherever your views/beliefs may lie on this issue, I think one thing we can all agree on is the importance of understanding and respect for the different beliefs that individuals have on this issue. To inject your personal beliefs and make biased statements doesn't help to address the issue.

Now I've got a question for all of you vj forum members who successfully petitioned for a K-1 visa and are now happily married (presumably): were the consequences of not getting married under a K-1 visa explained to you and your foreign spouse during the process? How important were these ramifications stressed (or not stressed) during the entire process?


Firstly, I just want to say I'm ashamed by some of the comments in this thread. It's a reminder why I sometimes drift away from VJ. Your second paragraph here is spot on.

Now, to answer your question....

YES. At the Embassy In London I was told specifically that if my K1 visa was granted, I would have 180 days to enter the U.S. and then 90 days after entering to marry Annette. If we didn't marry within those 90 days I'd have to come home to London.

Then at my POE (Houston), I was sent to a back room when I arrived at the immigration desk. In the back room I was told repeatedly that if I didn't marry Annette within 90 days I had to leave the U.S. And when I say repeatedly, I mean repeatedly. The officer must have told me that a dozen times - and every time he did, he asked whether I understood. I was actually taken aback by this - it was a simple concept to understand, but he labored it so much, it made me wonder if he thought I was a bit simple.

When he let me go, he even shouted "YOU'VE GOT 90 DAYS. YOU MUST MARRY ANNETTE WITHIN 90 DAYS" as I exited the room!

I echo this. I came over a few times during the K1 application process and never had any problems. I always had my HMRC identification and badge with me in case they wanted proof that I still had a job in the UK, but they never asked.

Morality applied to this circumstance seems to disregard that both she and I have arrived at this decision through careful consideration and a long time spent deciding on future compatibility. It's easy to say that she's acting irrationally, or that I'm acting irresponsibly, but in either case, are you judging our ages, or our experiences? Is it really so hard to believe that a 16 year old can make the decision to marry? Law makers in various states still see it fit to deem that an appropriate age, and a person's age is least of all determinate of if that person can fall in love. If we're all bound to marry off eventually, why do we have to be alone for so long before society lets us do it without staring down their noses at us?

Most of you have a love you've had to overcome obstacles for; consider yourselves lucky that your happiness isn't the subject of moral outrage and please bear in mind that I didn't come to this forum to be reminded that my fiancée's age makes her subject to a 16 year-old's lack of maturity. It's the lowest hanging fruit of this subject and not something helpful to my cause.

We hope to be together by late fall of next year. She finishes school before then in the UK, and we'll deal with the US high school equivalence details as soon as we've settled the matter of her residence.

Hello all,

My fiance is worried about working and possibly traveling back home. She currently has a visa that allows her to travel back and forth to the U.S. She told me today that there might be a 6 month to 1 year process where she will not be allowed to leave the U.S. after she enters on her k-1; is that true?

Another question she had was in reference to a job. She is worried about not being able to work right away. Is there is a 3 month application process that she may have to go through before she can work? Does anybody on this board have experience with either of these issues? Also, is there any way to get this process rolling sooner rather than later?

Once she enters on a K1, you must marry within 90 days of entry. Following the wedding, she should apply for Adjustment of Status (from K1 to permanent resident), Employment Authorization and Advance Parole.

Once Employment Authorization is granted, she can work (I got my authorization within 2 months of applying). Once Advance Parole is received, she can leave the country (again, I got mine within 2 months of applying).

When the Adjustment of Status is approved, she'll get a 2 year conditional green card. Mine was approved just over 3 months after applying.

The K1 visa does not allow her to work in the U.S. If she does work before receiving her Employment Authorization, she could find herself in serious trouble.

Agree with Delani. Length of the relationship shouldn't prove a barrier to you.

Annette and I first met in Nov 2006 - but given the 5,000 mile distance there didn't seem much point to a relationship.

So it was March 2008 when we started "dating". We hadn't been able to get each other out of our heads, so we decided to give a relationship a try. Within 6 months I had proposed, and we had no absolutely no problems with her petition, or the K1.

Keep a log (and as much evidence as possible) of all contact - and certainly, travel documentation is superb evidence.

No SSN required to get married in Colorado.

I didn't even apply for my SSN until after our honeymoon.

We got our marriage license a few days before the wedding. All we needed to show was photo ID.

That license was then signed and dated by our pastor and witnesses at our wedding, then we sent it off immediately to be formalized into a marriage certificate.

I've read that LA County offers such programs and I seem to recall lawyers there saying that if you complete the diversion program, you are legally entitled to deny ever being arrested, let alone convicted. I think under the terms of the LA program, the only time you'd have to admit to the arrest would be if you applied for a law enforcement job.

That said, applications for visas are subject to detailed scrutiny and cross checks with law enforcement databases. If your arrest flags up, and you haven't declared it, that could cause major alarm bells. As such you might want to consider declaring the arrest, but clearly state you took a diversion program and were not convicted.

My wife (then fiancee) applied for B1/B2 after we met but before we got engaged. She did disclose that she will be staying with me (her boyfriend) and was outright denied which is understandable. She got K1 without a single problem or delay. And please, stop making statements about things that you have no idea about.

Yes, as long as you marry within 90 days of his arrival, filing for AOS allows him to stay. That's the very point of AOS - adjusting status to permanent residency.

Indeed, if he was to leave before AP is granted, he wouldn't be allowed back in to the U.S. for many, many months. You'd have to start from scratch and petition again, this time to bring him to the U.S. as your husband.

The costs listed in the OP pale into insignificance compared with the lost income that K1 migrants suffer. I didn't earn a penny for 6 months after arriving on a K1.

Hmmm ok the only reason we thought about this was because we heard from this lawyer that the best option is if I go to Colombia and marry there, and then she can actually file for a visa that would get her here in 2 weeks. She actually said tourist visa.

She can always apply for a tourist visa. But under the scenario you've suggested, as the spouse of a US Citizen, she'd most likely be denied for immigrant intent.
