Seems very complicatedPosted Image.My fiance stationed in Guam for military duty. He asked me to choose which states I would love to go for our wedding and honeymoon. I have checked many beautiful scenery, places, old buildings, etc..etc..etc. For honeymoon we probably go to cruise ship - which I think can do that by apply Advance of Parole (AP)- but I guess we would have hard way if we choose to wed in US mainland based to info you put on this post. Posted Image. My clear explanation, I would use Guam as my POE by K-1 Visa. And the problem comes up because if I wanted to fly to US mainland to wed my fiance, I have to make a stop in Japan. I assumed, I would be out of US at that time.Posted Image

My information about Guam comes from a professional visa / immigration service that specializes in the Philippines. They have had clients that did not check with them on their travel plans and got stuck in Guam because it became there POE. Even if you have a direct flight from Guam to Hawaii and have plane problems and have to divert to another country you can have the same problem. The recommendation they gave me was just avoid Guam unless there was absolutely no way else. Or you are prepared to spend a LOT of time in Guam.
The risk of getting in to a legal mess was just to high.

My point is that I don't want when we stopped in another country would consider I'm out from US after enter by K-1 visa.

My understanding is that if you have a "1 time entry visa" like a K1, you can NOT fly through Guam. Because Guam is USA territory your visa will be used in Guam. If you can connect DIRECT to USA you are ok but if you connect via any other country you will be considered to have left the USA. Even if you don't leave the airport you will still be considered to be coming from a foreign country when you enter the USA the second time.

It was question A-11 on the I-129f. The PDF file has boxes you can check. I checked it the first time I printed it. Then it was saved, reviewed, file copied, email, updated, etc. Somewhere in the process the box became UNCHECKED when the final one was printed.

I was in a hurry to send that one and I printed from work and mailed on my lunch hour.
I did not even get a scan of the signed document for my records like I did for every thing else.

They sent a photo copy of the marked up I-129f with there notes.
Also on the form:
They did not like that I had "Allen Count" in stead of Allen County" for question A-9.
They noted the 18 year age difference.
They wrote in the A number at the top and on question B-9
As a general comment several question were answered N/A. There instructions were
"" Complete items(s) circled in red on the attached copy of the petition. If any item does not apply, please write "NONE". N/A is not an appropriate response.""

I had to update and resend the I-129f.

There is something like what you describe for Passports or so I have been told. My company has used it when needed. They try to identify who is needed for foreign travel far in advance and use standard processing for employees to get passports. But some times they find out to late. There is an expediting fee where every thing is sent over night mail. and for even faster there are companies who hand carry the application to a regional passport office.

When I joined the army years ago, it was standard to ask recruits if they had ever smoked weed or used drugs etc. I think they used that question to rule out the people that said yes, for having bad judgement.


I have a nephew in the Marines, He made it through basic training with high honors. Got stationed in Hawaii. His first week there he smoked a legal product you can buy in the stores there but it is banned from use by marines. He was with about 12 others. It was a year and many honors later there was an investigation and he was asked if he smoked any. He felt honor bound not to lie so he admitted it. All the others lied. The others are staying in but he is being discharged with no benefits and equivalent to a felony conviction on his record.

If you use incorrect language or look or act terroristy or try to smuggle drugs or contraband, then you might have issues.

It was my first business trip to the UK. When asked at the UK immigration why I was entering I said " For work". That was the WRONG answer. The correct answer was "For business". I got pulled off for extra screening and third degree interrogation until they were convinces that I was not going to seek employment and was being paid by a US company.

Unlike some other countries there is no central data base of marriages in the USA. If you know where a marriage took place it is relative easy to get proof of a marriage. But impossible to get proof of no marriage. About all you can do is provide related items like tax returns (filing single) and notarized sworn affidavits.

1st,,I converted them to .pdf files so they could be sent as email and printed in the Philippines.
2nd,, I printed them 2 pages on one surface of paper. Text is 1/2 size but still readable if you really want to. And last is you find a good print shop that can print front and back. you get a 4 to 1 reduction total.

My yahoo chat logs could be exported to a spread sheet program (Excel). In excel I could limit each message to just print the first line, about 30 characters, not the entire 200+. That reduced the logs to about 15% of its full size. When you read them you can't really follow a conversation but you still see all of the time stamps so you can see when and how long we chatted.


Oh.. but I forgot to mention that unless there is some other problems I think the Philippines is one of the easier interviews. They only asked a few questions, less then 10 mins and did not ask to see any logs or bank records. I think the only real question that mattered was the one the CO asked my fiancées 9 year old daughter. "Do you like your new dad?". I tried to have chats or video conversations with her daughter when ever possible. Its important to build a relationship with all the family members not just your fiancée.

Color Copy of passport cover to cover is strongly advised. go to office depot etc and make several copies cover to cover. It can also establish you were there in her country to meet. ALL PAGES , even the blank ones. :thumbs:

My passport has a few stickers security has attached over the years. I even recommend copying the outside covers too.
But I like to have these kind of things scanned to a file and burn to a CD. You can print copies any amount or any time you want then.

It is the same with your passport. My passport even has a few stickers on the covers that have benn put on by airport security over the years. When they ask for copy of passport they get ALL pages, even the blank ones and covers.
Much easier to send it all then deal with delays because they want more latter.

You will need every thing except the actual visa and passport. I don't have the full list in front of me. (birth certificate, cenomar, photos,,,,,)
You can attend the CFO seminar and they will give you a certificate that says you attended and completed the requirements. When you latter get the visa (it will be in your passport) take it and the certificate back to the CFO office and they will take the certificate and put the sticker in your passport and stamp it with a raised seal. I am told that the actual location for the sticker may not be the same as where the seminar was given

You do not have to have the visa in hand to attend the CFO seminar.
Don't plan to do the CFO seminar on the same day you plan to fly out. If you will not be back in Manila until you flight out you can still attend the CFO seminar with out the visa. They will give you a certificate that you can bring back when you have the visa and they will stamp it then.

Don't wait for "packets". Our packet came about 1 week AFTER we had the visa in hand. Once you have the MNL (Manila Case Number) you should be able to proceed with medical, pay fees, schedule interview.

I did not read all of the replies,, but to say they lied is pretty strong. Overly optimistic might be closer to the truth.


We are on track from submission to visa in hand of just under 6 months and that is with 1 RFE.


A lot of things to be factored in not to mention that Vermont has always been slower and is extremely slow compared to California right now 122 vs. 66 days. I personal do not recommend an immigration lawyer at ($1000’s) but unless you have the time to research, I do recommend the visa services at ($100’s) to speed up the process. I am using YFW visa services as they specialize in Filipino and know that process very well.

You were given bad information. You do not sent any financials or the I-134 with the I-129F package.

The I-134 and financials are sent to the beneficiary before the interview happens but after the NOA2. The beneficiary brings the papers to the US embassy for the interview and hands them over at the interview.

You will have to redo the I-134 and financials.


I did send update financials for the embassy interview. The interview never ask for them. The actual interview for (then Fiancée ) wife and step daughter was less then 10 mins.
Maybe part of the reason the service wanted me to do the financials was to be sure I would be able to follow thought later.

I used a visa service to prepare my I-129 packet. I don't see that a I-134 or any form of proof of income is required to be provide with the initial application. But my service had me fill out the I-134 with all the supporting information. The application and final visa approval went ok except for a very stupid mistake that was easily fixed with an RFE.
The service explained to me that basically during the first part (prior to NOA2) I would be investigated and had to show I was qualified to sponsor. Then after NOA2 the beneficiary would be investigated and she would have to show she was eligible to be sponsored.

My question is, Has any body else sent in the financial information (bank statements, tax returns, letter of employment, ect) with the I-129 initial packet?

OP, I've said already that you can go ahead and get your ducks lined up with the NVC number, so you are organized for when the embassy gets your paper file. I've said already that you need to be aware of some of the things that can delay you. As long as you realize it is all well and good to be proactive, be aware also that no one here can predict how your case will go.


I can't speak for other countries and don't pretend to. But you do not have to wait until the Embassy in the Manila confirms that they have file if you don't want to. If you wait for that positive confirmation that they have your file it will add as much as 2 months to your time line.

Do they have to have your file in Manila before your interview at the Embassy? Yes. I did not say they don't need the file. It is recommended that you take your own copy of everything just in case something got misplaced in your file.

How long after the file is ready in the USA does it take to get to Manila? 1 to 2 weeks.

Do you need any documents from the Manila Embassy before your interview? No. All the documents are on-line. Any body can get them. No case number or password required.

Is there a risk of something going wrong and having significant delays? Yes, But weather you wait for the Embassy letter or not delays can still happen.
Medical exam can still reveal a problem. Some people have waited 3 months for the letter before doing the medical just to find they fail the TB test and get stuck with 6 more months medical treatment that they could have stated a week after getting the MNL. Interviews can still go badly and you get additional processing delays. Typhoons can still happen and you to mis your flight.

What do I risk by scheduling the interview before the medical is done? Nothing. The best I can tell if you find a problem with your medical or you get delayed due to personal health issue you just go back on-line and reschedule the interview.

What do I risk by booking the flight early? Maybe a lot. Maybe a little. In my case I used frequent flier airline miles which basically made the ticket fully refundable. But Just getting your money back is only part of the total cost. You still have to then buy a new ticket. By booking early and TAKING A RISK, I got the ticket for 1/2 the number of required miles. If nothing went wrong but I waited until the visa was in hand I was guaranteed to 2x the cost maybe even 3x because the airline limits the number of those cheep tickets. If something had gone wrong and I had to rebook the only additional for booking early would have been the extra processing fee of about $80. I booked in September 2011 for a November 15 flight , If I had waited it would have put us right in the Christmas time. There would be no flights I could use my same airline points on until February or even March. I cant say it made a difference in the interview, ours went so quick, but they do have a place on the DS-157,#18(travel plans) ours was all filled in with flights dates and times. There must be some people who book early.

You have to decide how much risk you can afford $$$. I don't know of any reason that doing any of this early will cause your visa to be denied. It just cost you money because you waist a trip to Manila or you have to change a flight or a hotel reservation.

NO! Not only is your friend wrong what he is saying is not even possibly correct.

The "NOA2" is a letter notifying you the petition is approved. The petition then gets sent to NVC and must be approved there before being sent to the consulate. Taking an NOA2 to the consulate could not possibly serve any purpose.

I advise not getting immigration advice from this friend.

I know I am not a senior member of visa journey as many others here are. And I am sure these senior members are fluent in the process of every country. But I do have some knowledge of how it works in the Philippines.
When you get the NOA2, (And yes, it is not actually marked NOA2,It is an I-797 Notice of Action) you can email to get your Manila Case Number (refereed to as MNL). The case number is generated here in the US. I don't know why it is generated here but it is. You can get the number before the Embassy in Manila has the files. With your MNL YOU CAN start to do everything. You should put some time in your schedule for the file to get to Manila but DO NOT WAIT for the embassy to send you a notice that they have your file. It will take them 6 to 8 weeks to send you the notice. They are so slow and confused about sending the notice out that most people actually have their VISA in hand before getting the official notice from the embassy. There is nothing magical in the notice. No paper you must present later. It just tells you to go to a web site that has the instructions.

Your time line could be something like this.
Day 0 : NOA2, Email NVCInquiry@state.gov and ask for the MNL,

Hi,
Can you please send me the Manila Case Number assigned to my application?
Receipt #: (from NOA2)
Petitioner: (name)
Date of Birth:
Beneficiary: (name)
Date of Birth:
Requester: (Yes, they want to know who is asking for the information)


Day 14 : MNL
Day 15: Pay fees, Schedule Interview for + 17 days. This gives time for files and medical exam results to get top the Manila Embassy. If you are really gutsy and a RISK TACKER you can arrange airlines now. for +37 days
Day 16: Start medical exam
Day 18: Finish medical exam, confirm with St Lukes that they will have results to embassy before interview date.
Day 32: Interview
Day 42: Visa delivered to you in the Philippines.
Day 52: On flight to the USA.
Day 60: You will get the official notice from the Manila Embassy that you can now start what you actually did 45 days ago.

Just got an RFE, It was a stupid mistake and did not mark box 11 on I-129F.

With the RFE they sent page 1 of my 129 form that they had be marked on. At the top in the remarks is "18 YR Age Dof" or at least the best I can tell the last 3 letters. Our age diferance is 18 years.

My Question is : Is this a common remark?

I had a different box not marked. I have documentation of it being marked correctly on an early draft but on the final one that was printed, signed and sent it was empty.
I assumed it was something I had done but maybe there really is a problem with the form. I have been told that sometimes check boxes on the I-129f will just blank out.

Is it because he is coming on a K1 visa or is it because you told them he is not leaving?

I had no problem getting short term travel insurance. Just gave them the first day of coverage as the date of arrival and the last day as a few days after the anticipated marriage date.

Also you may want to ask your insurance provider if they cover domestic partners. This year my employer provided insurance does not actually require you to be married. Only that you not already be married to someone else and state to them that you are in a longterm relationship. This was to cove gay and lesbian couples who could not get "married".

At least here in Fort Wayne, IN. you do not get a legal binding document called a Marriage Certificate. The Marriage License you purchase form the county clerk is singed by both persons and the Minster or Judge. Then it is submitted back to the County clerk to be recorded. If you request proof of marriage from the court house what you will get is a notarized Certified Marriage License.

Lets just confirm he has or will have a K1 visa and will be using the K1 to enter the US.
Then as said earlier day 1 to 90 is ok.

If he is entering on something other then a K1 with the real intention of getting married there could be major problems.

One of the things they are looking for with chat logs is to see who much you talk not exactly what did you say.

Some of our logs were very big. For most of our logs I summited an abbreviated version. It included the date and time of each message but only the first 20 characters of each message. Basically 1 line per message. It will show how much time is devoted to the relationship which is what they really want to know. Keep the full logs only if they actually ask for them.

ALL non originals were computer scaned and then printed. And very few were Black and White.

If you need more time to arrange the wedding you have options. One is to just simply delay entry to the US. This will delay the start of the 90 days. The other is the two of you quietly go to the court house and get married by a judge to meet the legal 90 day requirement. Then have the church wedding and party with guests latter.

On your flight to the USA you will be given the I-94 form to fill out. You will present it along with your packet to the immigration officer at your arrival airport (Port Of Entry POE).
Assuming all goes well it will be stamp with your date of entry and the officer will write the expiration date on it. That will be the date you have to marry by or leave the country. You can delay the application for AOS for weeks or months, you will be forgiven for delaying the AOS. But do not miss the marry by date on the I-94!!!

In theory you can apply for your SSN any time after entry and before the I-94 expires. In practice wait at least 2 weeks after entry and no latter then 3 weeks before the I-94 expires.
