IR-1 / CR-1 Spouse Visa Process & Procedureswhat original docs are required to be brought to the interview
Great informtion because we all have the same question. I am not sure if there is a lack of consistency depending on the Consulate so I am playing safe with a few extra originals. There is so much time involved I will pay a few dollars for the extras. I have found it useful to get practical application here but also I am running a parallel checklist from the Department of state site and the local web site of the Embasey in Ukraine (for my wife). Thanks all!

IR-1 / CR-1 Spouse Visa Process & ProceduresDid anyone follow the shortcuts mentioned in VJ? please help
Yes the guide is really good. Due to logistics internet, scanning etc. I was going to have my wife sign the DS2030 when I visit her. When we get notice I can send the form much easier from the USA. Does anyone have any thoughts if cut and paste the bar code or generate a bar code from one of the available site will work as well as the original the national visa center will provide? Thanks :help:

Waiting is no fun but on the positive side. The fact that you are waiting for NOC 2 and did not get a Request for information it is encouraging. An RFI would definitely put you outside the norm. Congratulate yourself for doing a complete job on your petition submission.

K-1 Fiance(e) Visa Process & ProceduresWhat does relatively fast mean?
As for relatively fast, faster than what? A drunk turtle with arthritis and a club foot? A dead tree sloth? The evolution of monkey into man? Bad news for you if you are expecting fast: This process is ridiculously slow, taking anywhere from 8 months to 1 1/2 years and sometimes more. And most of the time is beyond your control and beyond your ability to monitor it until it actually happens. Most of us have been waiting for months, and those who got past the first step typically waited 5 to 7 months for that one step alone. The bureaucrats who run the show could not care less whether you live or die, and most of them are rude and hostile when you try to contact them to find out what is going on.
Well put

US Embassy and Consulate DiscussionI-134 Questions
Child Support - can I include this in my income, and if so, where would I report this on form I-134? Will the fact that I will only be receiving this child support for another or so make a difference in being considered as qualifying income?

This should read "I will only be receiving this child support for another year or so".

US Embassy and Consulate DiscussionI-134 Questions

Hi. If your 19yr olds income help then add him, but if not don't. It's fine about your hours cutting if your able to back your income up on your taxes. You can send them 2-3 yrs worth to knock so much focus off a check stub. I didn't send any check stubs for myself. I just sent 4yrs of income tax. Hope this helps.

Thank you for your reply. Yes, it would help to add my son IF I can combine his income with mine for the I-134, but from what I have read there is no way to do combine incomes with I-134, only with the I-864a at time of AOS. So unless someone can tell me otherwise, I see no benefit of adding him to my household size if I don't need to.

Secondly, my issue is not that my hours have been cut, but that I am working MORE hours (usually 40) than what I was hired to work (24), so I want to know if it is ok to base my current annual income on the number of hours I have been working (which will put me just above the 125% requirement, and can back up with my pay stubs for the last year) or do I need to base it on the number of hours I was hired to work (which will put me below the requirement). Previous tax returns will do nothing to help me since I have only been employed for about a year, and the two years before this was I unemployed and a full time student.

US Embassy and Consulate DiscussionI-134 Questions
I just recently filed my I-129F petition, and I am looking ahead to what is required for the Affidavit of Support for K-1 Visa, and after reading through post after post, I still have some things that I am unsure about. It would be great to get some answers to some of my questions now, so I'd have one less thing to stress about for the next 5 months or so.

Current Annual Income - I am paid hourly, and although I was hired at a .6 FTE, in the year I have had this job I have almost always worked between 32-40 hours a week. Based on the hours I have been working and my YTD income, I will just make the 125% requirement for a household of 5. Can I base my annual income for question 7 on form I-134 on the number of hours I have actually been working all year even though my FTE is only .6? If I supply a letter from my employer, how do they usually calculate annual income in a situation like this? Would they base it on the hours I have actually been working or om my FTE? Might it be best to not supply this letter from my employer if what they show for my annual income is less than the 125% requirement (since from what I understand it is not required, unless specifically asked for), and just submit 6 months or so of my pay stubs?

Child Support - can I include this in my income, and if so, where would I report this on form I-134? Will the fact that I will only be receiving this child support for another or so make a difference in being considered as qualifying income?

Household size - I had been figuring this to be 5. I have 17, 19 and 21 year old children who live with me. According to the directions for form I-864 for determining household size I know I have to count my 17 year old, because he is a minor, even though I do not claim him as my dependent, and I have to count my 21 year old because I did claim him as a dependent in 2010. It says you can exclude unmarried children under the age of 21 who have reached the age of majority (18) who you do not claim as a dependent. So if I am understanding correctly, that means I do not have to count my 19 year old in my household size. My concern is, even though I do not claim him as a dependent, I did use him as a "qualifying child" for the earned income credit in 2010. (A qualifying child does not have to be your dependent.) Will this be an issue if I don't count him in my household size? If I don't have to count him it decreases my 125% requirement by nearly $5,000.

If I do have to include my 19 year old in my household size, I understand I can include his income with mine at AOS with the I-864a, but there is no way to include his income now for the I-134? Is this correct?

I am really hoping I can work all this out so that I don't need a co-sponsor!

Thank you! I appreciate any answers/advice that can help to put my mind at ease about this.

Middle East and North AfricaAffidavit of Support at Casa Consulate

Marie, they really want to see the last year's tax statement. that is the important one. would be great idea to get employer letter of current income and years served there for backup. they may even ask fot it. Have it notarized or ceritfied. you can get certified copies of tizes straight from local IRS office at the front desk.
Hope this helps. jeanne

Thank you for your response. Yes I will provide a letter from my employer, pay stubs, and tax transcripts. But my concern is the fact that I did not earn enough in 2010. Will this be an issue if my CURRENT earnings are enough?
Housni&MarieFemaleMorocco2011-07-10 20:48:00
Middle East and North AfricaAffidavit of Support at Casa Consulate
I have a question regarding the Affidavit of Support for those who have experience in Casa. How much do they care about your past years income if your current income is above 125% of poverty level? I was laid off from my job of 17 years in 2008, after which I went back to school full time while collecting unemployment. I graduated in May 2010, and immediately started working at my current job. My 2008 taxes show sufficient income, but 2009 and 2010 fall short. I was originally a little concerned that my current income might be a little too close to the required level for my household size, but I have just accepted a new position within the same company which will put me well above for the current year. Will my lack of income for 2009 and 2010 be a problem? I was wondering if supplying proof that I held my previous job for 17 years as well as earlier tax returns would help at all by showing my stability and ability to earn above the required amount, or would they not even consider that? I really don't want to use a co-sponsor if I don't have to.

I appreciate any input on this matter.

Thanks,
Marie

Middle East and North AfricaNo Packet 3 Yet

you can get the packet 3 ,you can down load it, department of state forms, look at the casablanca morcco embassy info on top of this page scroll down to packet instractions, and documents you need , don't wait for them you send to you, you get the form ready and send it to them or fax it,

Thank you for your reply. I know we can download all the forms he needs, and we will probably do that if he does not receive packet 3 soon. But he does not send anything to the consulate in Casablanca, he takes everything with him to the interview, but we don't know his interview date yet because that information is in packet 3.

Middle East and North AfricaNo Packet 3 Yet

When my husband went through K1, it took 3 weeks to receive it. Mail is slow in Morocco. The Consulate schedules their own interview for K1s. Send an email directly to the Consulate if you have more questions. Good luck.

Thanks for your reply. I know how bad the mail is in Morocco, anything I have ever personally mailed him he has never received. That's why I'm really starting to get worried that either he will get it so close to his interview date that he won't have time for his medical, or worse yet, won't receive it at all before his scheduled interview. I'd feel better if we at least knew the interview date at this point. But we will try to email the consulate again. Thank you!

Middle East and North AfricaNo Packet 3 Yet
How long does it take to receive packet 3 from the consulate in Casablanca? Our case was forwarded from NVC on 8/16. My fiance sent an email inquiry the end of August and he received an email from the consulate on 9/7 saying they have received our case and would be forwarding the packet and appointment letter "shortly". I called DOS today to see if I could get any more information, or interview date. The woman I spoke with told me his packet was mailed on 8/24, three weeks ago. I asked if there was an interview scheduled, and was told that an interview would not be scheduled until he returned the papers from packet 3. I told her from what I understand, all the papers would be taken with him to the interview, nothing is returned beforehand, and his packet will contain an appointment letter with his interview date. If this is the case, how could they have sent out the packet on 8/24 and not have an interview scheduled? She replied again that the packet was mailed out on 8/24 and no interview is scheduled. I am really confused now. I tried to call the consulate, and was given a number to call between 3-4 pm, but when I called this number all I got was a recording in Arabic. My fiance is going to try to call this number, maybe he can get some answers. Should I be worried that he has not receive packet 3 yet? How long has it taken others to receive it?

Thank you for your response!

Middle East and North AfricaInterview scheduled on AID
I called DOS this morning and was told my fiance's interview is scheduled for November 7. He has not received his packet yet with appointment letter to confirm this. My fiance just realized November 7 is Aid al Adha Holiday. According to the consulate's website, no interviews will be conducted on American or Moroccan holidays. Does anybody have any idea how long we might have to wait for a new interview date if they need to reschedule due to their mistake of scheduling him on a holiday?

IR-1 / CR-1 Spouse Visa Process & ProceduresFedex packages to Morocco-Pros and Cons

Just sent Fai's package for the interview to Morocco via Fedex. I had been debating about how to send the package and had to weigh my pros and cons...I thought I would share it with you.

The package consists of a HUGE Binder and a photo album...so there is paperwork and pictures only. It weighed 13.5 pounds. I had it packed by the FedEx Staff member in a Fedex box. I spent the $7.95 on this packing but felt it might help speed things up at customs since their packing tape states it was packed by FEDEX staff member.

Pros:
1) they guarantee delivery by a certain date (unless there is ahold up in customs)
2) you deal with one company on both sides of the ocean (unlike the US postal service handing off something to the Moroccan postal service)
3) They will deliver it right to the door (including rural locations).
4) they have a great tracking system and easier avenues of recourse if the package is held up somewhere.

Cons:
1) It was $400.00 to send this package

Yikes, and I thought the $178 I paid was bad. But I probably didn't send as much as you did, as my fiance is taking care of a lot of it on his end, printing out chats, emails, photo album, etc. But I would have paid any amount I had to to make sure he got it. I don't trust the postal system at all in Morocco. He's never received anything I mailed to him.

K-1 Fiance(e) Visa Process & ProceduresProviding support information

Okay , by some chance, I get lucky and VSC randomly picks my Fiancee visa for approval and we move on to the interview , I know what of the standing requirements is that I can support us. OK, but what if I am moving between jobs and yes we are in a bad recession and my job status is pending but what if I have a very substantial amount of money my bank / savings which is able to support someone for 3-4 yrs, will this be accepted?

If your income does not meet the requirements of 125% above poverty level, you can use your saving/assets to make up the difference. The savings must equal 3x the difference. For example, for a household of 2, 125% poverty level is $18,387. If your income is $10,000, you need saving in the amount of $8,387 x 3 or $25,161.

K-1 Fiance(e) Visa Process & ProceduresAtty tells me to make amendment on my 2010 taxes
If I understand correctly, your lawyer is telling you that by amending your past taxes to only claim 1 child this will decrease your household size and therefore lower your income limit to be able to sponsor. Even if you did amend your past taxes to claim only one child, it won't change anything. All your children have to be counted in your household size whether you claim them as a dependent or not (even if they do not live with you).

K-1 Fiance(e) Visa Process & ProceduresK1 , HOW DOSE IT WORK ?
As the previous posted stated, there is a waiver available, but from what I understand they are very rarely granted. She would have to supply strong proof of her medical condition and inability to travel. Is there another place you could meet that would not be too far for her to travel, and that you could more easily get a visa to? If not, I guess you can try to apply for the waiver and see what happens. Good luck to you.

plzz help?? i am at the stage of I-134 for support...I am the petitioner, i know i cant sponsor cause i am disabled and my income is low..Can my mother sponsor my fiance without my father's approval?? Also can i have 2 co-sponsors? i read you can but im not sure..Im at a dead end and the interview is soon...:(:( thank you Jaime&Khalid

FYI... I believe you will need the I-864 instead of the I-134 for a K1 from what I have read here. To be safe, I sent both to my fiance.
Housni&MarieFemaleMorocco2011-10-21 22:07:00
K-1 Fiance(e) Visa Process & Proceduressponsors

No can do. Incomes are not combined. Your answer was spot on until this. The father could co-sponsor INSTEAD of the mother and then only the father's income would count, but either way, only one can sponsor and the incomes on a joint return must be delineated for each person.

Incidentally, disability counts as income and I find it hard to believe a fully disabled person would not qualify given the rather low income needed to qualify. $1600 per month will do it.

Since the Consulate in Casablanca has been requiring the I-864 rather than the I-134, I would think they could combine their incomes if needed with one parent filling out the I-864 and the other the I-864a. However, since she is asking if her mom can co-sponsor without the approval of her father, maybe the father is not willing to be a co-sponsor.

K-1 Fiance(e) Visa Process & ProceduresGetting very worried
I called DOS yesterday and now I was told his interview is November 23. I don't know if it was rescheduled (possibly because of AID?), or I am just getting mixed information from DOS. Still have had no reply from the consulate. He did schedule his medical exam for this Friday and asked if he needed his interview letter. The woman he spoke to told him that it is NOT needed and doesn't know why people think it is. I guess we will know for sure on Friday.

K-1 Fiance(e) Visa Process & ProceduresGetting very worried

You do need the interview letter for the medical exam to be completed. The visa forms are online and you can fill them out and scan them in pdf format and email them to him, I did that and they accepted the forms. I would recommend he goes to the embassy with the email trail from NVC stating they sent it to the consulate and wait in line outside and talk to someone at the window to see if he can get the letter from them he will have to insist he needs it for the medical exam. It beats waiting on them to mail it to him, mail service in Morocco is very bad. I would call now and set the appointment with the doctor just to get on the schedule atleast 5 days before the interview. Dr Alan (Alain) gives you the results the same day. He needs a copy of the interview letter and any pictures (3) of himself.

He will need his birth certificate, court report, police report (originals) and all translated into English there is a translator in Rabat that also does this is one day. Oh and two passport pics US size the photo places know the required size.

Bring conversations with any additional pictures.

I got the interview letter in April via email and the hardcopy got to my husband's house three weeks after the interview.

Good luck, i know it can be stressful.

Thank you. My fiance will download all the forms and fill them out. He has everything else ready to go. Just waiting for the interview letter. We will email them requesting that they email it to him, and I will tell him to go ahead and schedule his medical. If he does not receive the letter by email by the time of the medical, I guess he will have to go to the consulate like you suggest and try to get it from them. Thanks again!
