Hi,

I am filing a K-1 for my fiance. She has a son, 5 years old.
Do we fill out the G-325A for both people or just my fiancee?

I called USCIS and I was shocked at how little help the person
was.

I was acquiring the additional information, She decided to
cancel the process.

We are going to apply again, but she is now worried that
the embassy can refuse the application because of the prior
cancellation.

Is there any reason for us to be worried?

A simple letter on his unit letterhead will be fine. His immediate supervisor then needs to sign. I had my NCOIC (E-7) sign.



Wow.. glad to see this topic.. My fiance waited for like 2mos to get HIS from the Head Quarter in Texas.. and only to get it with NO SIGNATURE :( rrr he's so pissed off that he waited that long and get a letter with no signature.. I wonder if that's OK? a document with no signature i guess wont make it Legal.. But you are suggesting He can get one from his immediate sup and that should be FINE? That's what we tried at first but his Sup refuses and said he couldn't do it and the letter should come from the Head Quarter.. rrr.. Our NOA2 is coming so Soon and we don't want to wait another 2 months getting that employment letter :( hopefully his immediate sup will just do it for him and we will just use the other letter as back up i guess? uhmmm..

He should file a change of address on the USCIS website when he moves so they have his new address yes.

You filling out the other forms with his new address is no problem because all you do is explain at the interview that he moved during the process, pretty simple! They might not even ask you about the address change either lol.


That's so easy! Explaining this now to my fiancé will make him jump in the air saying 'I told you it would all be easy!'

First time posting on VJ!

Concerning question 14 on the I-129F petition about where your fiancé(e) intends to live in the US, we filled it out as my fiancé's current address (he's the US citizen) thinking he was just going to have to stay in the same place to make things easier. Things have occurred where my fiancé is planning on moving back into his mother's house (which makes saving money SO much easier) in July. We filed our petition very early Feb, and if the average processing time is still 5 months (we're at VSC) when it gets forwarded to the NVC and then to the Consulate, the address would have changed permanently by then. The plan we have is whenever (who knows when that will be if it's VSC :P ) I'm approved and have the visa I will stay with him at his mother's house and then move out to find our own place. But the problem I keep thinking of is when I have to fill out the Packet 3 forms (or packet 4, I'm unsure) one of those forms asks me what address I will be staying at, which has changed since filing the I-129F. Would this make things difficult with the fact that the address has changed on both parts, and would a simple change of address on the USCIS website make Q.14 change to this address?


I hope you can all understand my ramblings, I like to over think things but it's things I want the answer to. Thank you. :)

My fiancé lost his return tickets back to the US for his last trip. We just put a note in there saying the tickets were misplaced.

Do you have other tickets from other trips? I would imagine a certain amount would be fine even if you had some missing, I don't think everyone would keep boarding passes.

USCIS can go suck an egg. They increase fees and in return, to those desperately waiting to be together with their loved ones, do nothing to get the job done. Website not updated since October, for processing times and are still reporting that they are processing Aug 3rd, 2010 I-129F. I am tempted to grab my father, lawyer, and my Uncle, ex special agent of the DHS now FBI Agent, and pay them a visit. Might just do it when the 5 month mark hits for me. Down right retarded how lazy people are these days, work ethic and the genuine care for others is non-existant these days. Sorry just had to vent a bit, good luck to you.

If I am not mistaken, the income he makes there does not count because he will be leaving to come here to the US (someone please confirm or deny this statement as I hate to mislead anyone). Some consulates, such as the one in the Philippines, does not allow co-sponsors for the K1. You are doing the right thing by investigating now before you file. However, if they do allow co-sponsors, that would help with the affidavit of support.
In addition, I have read that the K3 is no longer valid and it is a different visa you apply for now. Check that out also.
I want to say again though, you are doing the right thing by getting all the facts instead of jumping the gun.

His income in Malaysia cannot be listed on either I-134 or I-864 - only your income, or the income of a sponsor (who must also be a US citizen or legal permanent resident) will be accepted. You can include assets, if you have them, to supplement low income - but they have to equal at least 3x the amount missing in your income.

I don't know the requirements of co-sponsoring in Malaysia, or Cameroon for that matter, but any co-sponsor will be required to show individual financial support, plus support for their own dependents, plus the person they are intending to sponsor. If they don't make enough to satisfy the requirement covering everyone mentioned, they will also be denied.

The K-3 is no more - IR-1/CR-1 has taken its place. If you choose to go this route you'll be looking at 6-9 months waiting. The K-1 can take nearly the same, depending on which service center your petition goes to and how your backgrounds are.

The family friend should be able to cover the financial part it is just her and her husband.Her children are grown and live on their own.As in assets do you mean by owning my home.I do own my home and half my property both valued at @least $24000 or maybe a lil more.My mother owns the other half of the property.And I own my truck...so does that all count in the assets category?If this is so i can cover the financial requirements myself.As for backgrounds we both have clean backgrounds.Would I stand a better chance by marrying him first?Im just so scared of a denial.Thank you for any advice.

My fiancée and I are trying to prepare everything to apply for visa.Even though we are a lil confused if we should apply for fiancée visa or marry then apply for the k3.My main concern is the financial support part.I don't make enough to satisfy this.But he does work full time himself in Malaysia,where he is also a student.I do have a family friend that has offered to help sponsor him.Can this be done and can anyone suggest some advice to help.I just returned from Malaysia visiting him and my heart hurts so bad from missing him so much.He had applied for a visitors visa in January to visit but was denied because they said he didn't have substantial ties outside the US but none of our documentation was reviewed and the interview was less than 10 minutes.While there i visited the embassy to inquire but was turned away the first time and i rescheduled my flight and paid a penalty charge of $200 doing so to return to the embassy on the next business day.Only to be told after i was seen that for my inquires I could only be contacted by email and no one would even talk to me.Just to write my questions and concerns by email and a response would be sent.So i did this as well but was only told that we can try to apply for the k1.This is frustrating and painful to go thru and we haven't even gotten started yet.His home country is Cameroon.Any suggestions or words of wisdom...please help.Thank you.brooks1380

Hmmm this is interesting. I would think that unless your case has gone in front of the judge, the death would overrule the divorce. I haven't ever heard of a divorce being granted to someone who has passed away. Makes you think to have your will changed before the divorce is final! :whistle:

I told my husband that I would give it exactly a month before I start contacting the DOS or embassy to see if he was in AP or not.
He got his visa exactly 1 week after his interview.

Is your fiance still in Egypt with you now? If she is, both of you go down to the embassy and go into the US side and tell them that you want to get the form neccessary for you two to get married in Egypt. Also mention how you had the visa stamped in your passport and they cancelled it. See what they have to say about it. Ask them do they recommend you two getting married just to hear what they suggest.

Have you gotten your NOA2 yet to show that the USCIS has approved your F-129?
You don't want to send any papers to the embassy without them asking for it yet. They need to receive your packet from the USCIS first, so when they do ask for the forms from you, there will be a file to attach it to.
Sort of trying to pay a bill that hasn't been generated yet. :blush:

we had our NOA2 notification approval email on the 25th June. we also had the email informing us that our case has been sent to NVC and another letter that said out paperwork is forwarded to the embassy. packet 3 has also reached the fiancee today.

however, we still have not received the NOA2 hardcopy in the mailbox yet.
should we be concerned, or is there anything we can do?

Hmm I don't think it would be any concern but you can call and make sure that they have the correct mailing address on you just in case. Did you ever get a hard copy of the NOA1?

I have been divorced, but he's never been married. I front loaded copies of my divorce decree in the I-129F packet as required. I don't have an original, I only have a copy, and my attorney wants to meet on Sunday to finalize the packet to send off on Monday so I don't really have time to drive an hour to get the copy.

Will a copy of mine work at the interview? Or will he need the original, since it's MY decree and doesn't really pertain to HIM (the embassy info site said that he'd need originals of all documents pertaining to him, and since the USCIS has already determined that we're free to marry, I was hoping that would be sufficient).

Will copies work?


I don't know so much about the embassy for the UK, but the embassy in Cairo needed my "original" divorce decree. I had to get it from the state office before his interview...

I'm in the process of a K1 visa and my case is now at the embassy. I'm sitting here tonight and just remembered that about a month or two before I applied for the K1 visa my fiance applied for a tourist visa and submitted the application online. For various reasons (mislead by lawyer), he cancelled his visa appointment and never rescheduled. On the petition I submitted and all his forms for the k1 we have stated he did not previously apply for a US visa, because technically he didn't follow thru with the application. So since his application was never approved or denied will the CO still feel he previously applied for a visa and say we lied when filing for the k1? I'm stressing out a bit about this, any news or advice would be appreciated.

I think you are just thinking of things to worry about! LOL with that being said, technically I don't believe you have anything to worry about. He cancelled the appointment so he never went to the embassy and was given permission or denied a vistior visa.

I am older than my husband and this is quite common in the middle east where there are plenty of fraudulent marriages.
We did not have any problem with his interview and age was never brought up. I believe it was because I was with him at the embassy for his interview and they really watch to see how you react and interact with each other. Be truthfull. They can tell.

Did your fiancee in the USA get his copy of the NVC letter? I am going on the assumption he has.

My fiancee did receive her NVC letter......2 1/2 weeks after her interview! LOL, Philippine post office for you.

My point is you don't need YOUR letter to get the medical or schedule the interview.
Have your fiancee in the USA call the embassy using the toll number (1-888-877-9888) and schedule your interview. Just make sure he gives you plenty of time to do the medical first. He needs only send you a GOOD scanned copy of the NVC approval letter and you should not have any problems getting your medical. Once he schedules your interview date, the embassy will send a confirmation email to him about the time/date etc. He can forward that to you as well.

Another option is for him to FEDEX/UPS/DHL his copies to you for your medical. Just takes longer.

My fiancee simply showed St Lukes our NOA2, copy of my NVC letter I emailed to her and my email from the embassy (forwarded to her), 2 forms I.D. and she had no problems getting inside. We did this in July 2009.

my fiance went to her interview. she forgot to bring my 1040 tax paper. so they sent her away and told her to bring it back with her passport.

so she returned the following week. showed the guy at the window my 1040 tax paper and check stubs and letter from my employer..

she asked the guy did i pass.. he just said ok and told her to prceed to air21. so she went to the air21 counter and they said she can pay the delivery guy upon arrival.

the guy at the widnow never said if she passed or failed. so she asked other filipino's there and they said the guy didnt tell them either if they passed or failed. he just ok to them too.

does it sound like she passed? they kept her passport and sending it air21 so does it sound like she passed?


She was not sent to the Air21 (FEDEX filipino style) desk to exchange pansit recipes! There is only 1 reason she was sent there, to get her address for delivery of her VISA package. Congrats!!!!

Hi everyone!I will be petitioning my fiance using K1 visa soon and was reading all the requirements...I have known my fiance since i was in gradeschool and he calls me by my nickname "Chaz", (L) My family and my close friends would adress me using my nickname but i have never used my nickname on legal documents.My question is, All the letters we wrote to each other was signed as Chaz.And i know letters/cards are one of the key evidences to establish our relationship. Would our case get in trouble because of my nickname? :( All response and comments will be greatly appreciated.Thanks in advance! :)


The vast majority of cards-letters I sent for b-day's, easter, Christmas etc I usually addressed "To my asawa" or "to my beautiful wife to be" etc...

The CO didn't seem to either notice or mind how they were addressed, and yes he did examine all of them. We had no issues with our K-1 petition and are in our 7th month of marriage!

If your fiancee has ever been to the USA before, when they came through customs a "A number" would have been assigned and a small card with that number would have been given to your fiancee.

If your fiancee has never been to the USA, you may leave it blank since it says "IF ANY".

I think it is best to put in NONE in blanks instead of N/A. I reviewed my I-129F from July 09 (approved) and in all the blanks that did not apply (like part A, #7) I put NONE instead of N/A.

In general, if you document your current income as 125% of the poverty level for your household size, then the bank statement isn't needed or considered. Many people have trouble getting this from their banks anyway.

If you are at or above the 125% then you might want to provide:
Three years tax returns with W-2s, 1099s OR Tax Transcripts
Current pay stubs for three to six months
And a letter stating your employment, start date, full-time/part-time, salary, company name, job title etc... can be added but is not as useful as documenting current income with pay stubs.

Yep, I agree with Audy. If you make north of 125%, no need for the bank letter. The embassy is mostly concerned with your INCOME. It is not mandatory, but I just sent a copy of my latest bank statement to show 1. I have an account and 2. regular deposits from my employer. I did all that Audy said with no problems. I recommend IRS TRANSCRIPTS (free) and the employment letter.

If your using the most recent G325a from the USCIS website (recommended), then only one is needed. That is ONE for the USC Petitioner AND ONE for the Beneficiary.

One passport style photo of the petitioner with their G325a and one with the beneficiaries.

See I129f instructions Item 6(a)(b).

Always check the USCIS website for the most recent versions of documents (although other versions may still be accepted - it will inform you of this there).


Good call bernie. Amazing how instructions can change so quickly. I was almost going to say 4 325's need to be sent in as that was the requirement just 7 months ago when I did my 129F. But the latest directions clearly say now just 1. Good example of ALWAYS verify with the latest instructions from USCIS website, not some 3rd party website. I remember needing a form (forget which) and saw a link on an immigration lawyer website for that very form. Thank goodness I read over the form........it was from 2004 and at least 4 versions out of date!

hey guys quick question..i will be sending an affidavit of support to my fiancee soon, and i am a little confused, can i just use my paystubs instead of a job verification letter..i have two jobs, part time and full time..im not sure if i can get a letter from my full time job but im certain to get a letter from my part time job..


The employment letter is important to send. Talk with your immediate supervisor or HR dept. in your FT job. The letter only need to be 4-5 sentences long.
