Sure, people do it all the time. If you use a B1B2 visa or VWP to enter the USA and give as your reason for visiting that you're teaching a training class, no problem. My first experience with this was in the direction, when I visited the UK as an exhibitor at at trade show, then later the same month to train a distributor on the use of a new product. All the VWP countries cooperate similarly in this regard. The same goes for those who need B1B2 visas to visit the USA.



Ok. I do know that my fiance ran into a lot of questioning by Customs because before visiting me, he had been in the U.S. only a week before to deliver training. He explicitly told them and showed them the dates in his calendar that he would be in the U.S. to deliver training for work and they seemed to have no problem with it after seeing the proof. They asked how he would support himself while on a long visit, he said he will be working sporadically training their U.S. clients when training is scheduled. He is on VWP. But I'm concerned about when we are married. Would he still be able to work for his company while he finds work here locally? Would be nice if he can still earn income instead of none for 3 months.

Ok so I have seen this asked sporadically around the site and no one can give any of us a legal answer. We are almost convinced this is an area where technology is beyond the law.

Can the Beneficiary / K-1 Applicant / the non-us citizen / whatever work remotely for their homeland-based-company while in the U.S.? Either on visit or during AOS process?

For example, beneficiary has clients all over the world. Beneficiary's company employs trainers that deploy and/or conduct webinars all over earth to deliver IT training. Beneficiary has clients in the US. Would Beneficiary be able to deliver training, as an employee of the uk based company while visiting the U.S. on K-1 or AOS?

Basically, can the beneficiaries work remotely during AOS whilst awaiting EAD?

I know it may be a question better suited for AOS, but it's something you should be thinking about whilst going through K1 and may come up in the interview (I guess).

The drop in fee revenues is because there has been a drop in petition submissions. Also, if you'll notice from the director's remarks, until relatively recently, almost all services by USCIS were funded by fees - not taxpayers. They changed this last year so that the taxpayers will now be paying for asylum and refugee applicants, rather than being subsidized by fee-paying USCIS customers.

I read through the entire PDF. I didn't get the impression he was explaining anything at all about backlogs. The entire statement amounted to an appeal for more money from Congress. The points about processing Haitian refugees was primarily to tug at the heartstrings of the Congressional committee to justify begging for more money. I suspect that the recent organizational changes have more to do with the slowdown than anything else. A bureaucracy this large comes to a grinding halt when you try to steer it in a different direction.



Forgive me, but I find this difficult to agree with. I, too, read through the entire PDF and watched the entire video. Afterall, I posted them for your benefit.

Whether any of you like it or not the TPS applications were real. The numbers are real. The shake up in the normal processing of petitions and applications did happen and all are effected. I do understand that we are an acute population of petitioners and beneficiaries focused on a sector of the USCIS. I get that.

But what I find myself frustrated with is the blind eye I am finding some (not all, obviously) are turning to the hundreds of thousands of other things going on at USCIS.

Drives me crazy.

Alas, nothing I can do or control other than myself, my research, education and what I do with it. But I cannot sit here and pretend through my silence that you are correct in your assumptions. Not to say you are wrong. Not to take away from your opinion. Just...are you kidding me? Pulling at heart strings? Seriously? As if it didn't happen? CMON son.

The fact is these folks DO NEED more money after a backup to fund the additions needed in order to catch back up. or at the very least start shifting petitions around so they do catch up.

On a side note, I am happy that you all are finding some use of the information I found. I had hoped it would give some insight that the USCIS is not silent, and are working to improve. But if you must use it to find some way to make yourselves more miserable, well then I guess that's okay too. Not preferred, but OK.

I think it has always been the case (and the argument) that the U.S. gets involved in matters that are not theirs...i.e. foreign affairs.

But at the same time, guys, that is what our country is made of and began as...foreign affairs, immigration, other people that are brought or come here. I think that (now this is my opinion) that we need two branches. One that controls immigration non related to us-citizens either through catastrophic events where we are for whatever reason compelled to intervene or by granting citizenship to those who have been here illegally, and the other that concentrates on legal immigration of those attached to U.S. Citizens. That might piss some people off seeing as how things seem to either be black or white, no room for gray in politics, but the problem is we have both ...needs, if you will. And the government is going to see that it is a) getting involved in catastrophic events that affect those and make us look awesome for helping and b) appeasing and encouraging immigration where it is attached to a u.s. citizen in some way.

I'm afraid there never will be a black or white, guys. We'll always be fighting this one. The best they can do is try to manage it the best they can because I can't tell you who should be expedited and who shouldn't. I can only tell you I wish this didn't take so long. The only way I see them appeasing that is creating a branch specific to my needs(how selfish of me, i know)without the interference of things that "come up" and hiring enough people to handle the volume.

Then that all boils down to money doesn't it?

We did not receive our E-notification until 4 days before the hard copy of NOA1 was mailed out. I believe you will not receive e-notification until your information is entered into their database...i.e., it is checked to make sure everything is signed and correct fee is attached. Need help with Letter of Employment. My fiancee is in the Army. He has pretty much legal docs of his employment throughout his 5 years Army duty. Is it enough or we need to get an additional letter from the Legal/HR stating that he is currently stationed at certain base and holds certain rank and yada yada?

A simple letter on his unit letterhead will be fine. His immediate supervisor then needs to sign. I had my NCOIC (E-7) sign.

i was told by another person at work that brought filipina hear 10 years ago that i will need to show a considerable amount in savings,as to prove that i can support her.i do not keep money in savings in bank.i keep in safe at home.is there any truth to this?i show all deposits and do put all moneys there to pay all bills tho.i have no collections but do not trust banking system.please give some advice if there is some out there on this.thanks


Sorry, but not true. The key "money" factor is not savings, but steady INCOME. The USCIS is concerned that you will be able to support your new wife and not become a public charge ie. welfare. So you must meet the minimum income requirements if you wish to petition. Minimum income is 125% (100% if AD military) over the current poverty guidelines. I have seen posts that Manila does not readily accept co-sponsors, I cannot confirm this. I do not know the exact minimum income figure but for two people it should be around 22K or so.

Hopefully someone else can chime in and answer a little more than I have.

Don't misunderstand here, but be careful getting advice from a friend that petitioned a wife 10 years ago without confirming the info. A lot has changed since then and the guides your friend used are nowhere near accurate today. Follow the guides here on VJ. Sign of the times I guess.

is the email confirmation letter the one that u get after scheduling for an interview?
You will get an Email after scheduling the interview. We used this for my wife to get her medical and entry to the embassy. A letter was sent to her as well but arrived 2 weeks after her interview!

what is packet 3? I received a letter referring us to the USEM website where procedures and forms are available for download and filling out. We received no "packet". Just a guess but this "packet" may refer to the older system USEM used prior to the web.

will USEM in manila send this to me? We got just a letter.

should we have our I-134 & employment letter notarized? Use the NEWEST I-134 form online and it does not require a notary. An older I-134 form is still valid and it DOES need a notary. Use the I-134 without the notary box at the bottom.

My employment letter did not require a notary (as of july 09).


do i need to have the ORIGINAL NOA2 for medical/interview or a scanned copy id fine? I sent a scanned copy to my wife who then just printed it out in an internet cafe, she had no issues at St Lukes or USEM. Just make sure you have ID. My wife used postal id and her school id.

hi vj, we have a problem we really need some help/advice... I mailed all documents to my fiance (in the Philippines) that she needs for interview through USPS express mail but they returned it to me after five days and it was all opened to my shock and some important items are missing like my iteneraries, original copies of plane tickets, hotel reciepts, boarding pass, letters and cards she sent me, receipt of engagement ring etc. what's left to me now are the only copies of these, but im still confuse what to do and how to retrieve this items, Im really hoping they haven't destroyed it or something like that... and by the way this package was not able to leave the country then it was returned to me. also can i still used or show the copy that i made for her interview?


Filing a complaint with the USPS will get you nowhere fast. Your papers are lost and the priority now is to get your backup copy to your fiancee.

My wife did have my originals but the officer never really looked at them. The inspector will want to see originals only if they want to confirm the accuracy of the copied documents.

Send her your backup copy along with a letter explaining the loss of the originals and any documents from the usps about the damage.

I received an I-129F K-1 Fiance Visa Rejection Notice for "Part B Address". I can't figure out what's missing, or incorrect. I followed the sample form exactly with the exception of leaving the Apartment Numer block blank. Should I have entered "none" in that block? For Place of birth State/Country I used Leyte/RP,is that right or should I just say Philippines. The missing or incorrect info is not identified. Is there any way to find out what the problem is?

I sent one letter from each of us , wording was just a bit different but basically said the same thing. I also addressed both to the Consulate Officer, Manila Embassy. Each letter had original signatures, black ink. Print and sign 3 or so copies for your backup. Our petition went through with no problems.

Hello again to those who've read my posts before (and to those reading for the first time) I hope I'm not being too much of a bother but I just want to have everything together for filing the I-129F.

My fiance is Filipino and she's 22 years old. I've read about getting married in the Philippines (although I'm not doing this) that one needs to have "parental advice" between the ages of 21-25, I understand this to be a signed written statement from the parents.

My first question is do I need to include this in the I-129F package?

My second question is; if so, is there an example of a form letter for parental advice that I can take a look at?
I've been unable to find anything so far.

The parental advice/approval letter is a Philippine CFO policy, not a US embassy requirement. So it is not necessary with any dealings at the embassy.

I needed that letter for my wife as she was 22 at the time of our petition (july 09).

The letter was simple, 3-4 sentences if I remember correctly. Both parents sign and simply say in the letter that they have advised and approve her engagement/marriage to you (by name). She had it notarized by an attorney, but I am unsure if a notary was really necessary.

Others mention a form is available which would simplify the process. We did not have the form and just had the typed letter. CFO accepted the letter with no problems.

Oh ok, so then I should only send a copy of it unless it for AOS. I had called NVC already and they received it, but at the time I called, they have yet to forward it to the embassy. They said to call again next week.

Scanned copies e-mailed to her are fine. When you call the embassy to make her interview apptointment, the embassy will send you a confirmation e-mail with all the details. Simply forward this to your fiancee too. She can print and use for the medical and entrance to the embassy with ID. My wife did this with no problems.

My fiancee did get her appointment letter......2 weeks after her interview! The Philippine post office is spotty at best.

This is what I did. You will get both a letter and confirmation email from the embassy. I simply forwarded her the email and scanned the letter and emailed to her as well. She just went to a internet cafe and printed these out to use at St lukes and entering USEM. She had no issues or problems with either.

My fiance and I are wondering if we really need to submit snail mail letters together with I-129F petition. We have chats on a daily basis on yahoo messenger and skype. Is this good enough for evidence?

Based on VJ K-1 Visa Guide, we need to submit 2 to 4 types of evidence? Please help us clear out our confusion... THanks a bunch! Sorry I keep posting questions, hopefully when we're done with this we can share answers and experiences..

I submitted our b-day, valentines, Christmas etc cards in our 129F, maybe 6 total. Not sure of the influence it had on our approval but it can't hurt. I mainly used these to increase the variety of support material.

There is a 23 year difference betweeen my wife and I, so age is not an issue. You have met within the last 2 years, so you have met that requirement. Make sure you document everything (i.e keep airline reservations, boarding passes, all receipts from Philippines, and lots of photos) and enjoy a long life together.

You need at least three times the shortfall of income in assets, so if your fiance is $1000 below the 125% poverty limit, he'd need at last $3000 is his savings account. Before that they usually want to see a year's worth of bank account records, so if $3000 suddenly shows up in his account, they may be suspicious about that (think you are paying him for the visa, or the money is just borrowed briefly to get the visa and will then be given back to whoever gave it to him).

Im new to this forum and site. and to be honest and straight up im so frustraded with the visa process :) me and my fiance are waiting like over 4month now to get the noa2. and its a lil bit exhausting to wait and wait and dont know if and when u get an approval.
and now my fiance found out he dont hit the fiancial support guide minimum cuz his hours got cut back like bad last year. so we are thinking bout getting a co sponsor but that aint easy to find. i heared bout the other option u have to have an specific amount of money in ur account. he aint much under the minimum mabye a grand not even. so does anyone know if it would help to put an specific amount of money in his account and how much would that be??? or if it helps that i have financial security and proof of it??

it would be great if anyone can give me some good info bout it. thank you all already for ur help.

My fiancee is not a US citizen. She is in the Philippines. I am simply taking care of her change of address for her. The OP's fiancee is also not in the US. I know what it says online about changing an address for a non US citizen. It says to notify the USCIS by calling the number and to also file AR-11 (which can be done online now). I have tried this. But how can you answer the POE questions on the AR-11 form if she's not in the US? Also, when I called the USCIS, as it states to do online, they could not give me a straight answer, but finally told me to mail a letter as I did.

I basically was trying to tell him the best way to do it from the directions I recieved on my NOA-1, and it seemed easier than everything you were saying. Yet I have not been through the situation myself, and now see you were correct the whole time.

First would be call the number but that doesn't work, then would be to fill out a change of address online, but that doesn't work becuase there is no route for the beneficiary change of address. The best thing to do is mail in a letter.


I wonder if they make it so confusing on purpose sometimes :wacko:

Note that if you submit a signed Form AR-11 online without also updating your address on pending applications and petitions, you will still need to do so either by calling 1-800-375-5283 or by going online to do so at a later time.

That came from www.uscis.gov. It says you can do everything you need to to change an address right online.

You wait until you get your NOA-1. Then you call USCIS customer service at 1-800-375-5283. You tell them who you are what your applying for and that you need to make a change in address. If need be explain the Beneficiary moved one month after you sent packet off.
