Hi, I am also new to this forum, but I am desperately hoping someone can help me. My fiance is Brazilian, but he lives in Spain now illegally. He overstayed his visa there, mainly to stay with me while I was in Spain. Anyways, now I am in the US and we have applied for the K1. Our petition just got approved after 5 months. Now my dillema is that on the US embassy site in madrid it says that non spaniards living in spain illegaly can not obtain a police certificate. He needs a police certificate from Brazil and from Spain. Is there any way he can get this? Does he have to return to Brazil? Has anyone had any similar experience with a situation like this. Now I feel like he is going to recieve packet 3 and we are not going to be able to do anything without a police certificate. thanks for your help

Which country are you petitioning him from Spain or Brazil? As a practical matter it would probably be easier to get a police certificate from spain if he was petitioning from brazil.

I am a US citizen petitioning him from Spain. But he is a brazilian living there illegally. I know you have to get certificates from every place that you have lived for than 6 months since the age of 16, and he has lived in spain for more than 6 months. as i mentioned before, the problem is that on the us embassy site of madrid, they say that if you are residing illegally in spain as a non spaniard (eg.illegal brazilian) you can not obtain a police certificate. this doesnt make any sense to me because even if he was in his home country of brazil he would still need to obtain one from spain since he had lived there more than 6 months. I just dont know how he can get one sad.gif

We only sent one phone bills, some used calling cards, a few e-mails, pictures, etc etc.....a little bit of everything. OP, it sounds like you have a lot of proof of ongoing relationship - and remember that proof of having met is most important at this time.
But it's not a bad idea to send copies of the calling cards, that's what we did. AND we sent an AMEX statement or two proving that we had bought calling cards on-line.

Make sure you have a lot of proof of your love, there are a lot of couples on here with an age gap of 20+ years and are approved no problem.

Our receipt for booking the party hall (also included in my petition) says LE DINH HON. Even included our invitations which say LE DINH HON party. Getting married in VN is not easy, you have to jump through quite a few hoops. It is not like other countries and there would be a record of it.

Do you think this will be a problem for me?

It could be a problem to speak of it or show pictures from it. The safe bet is to use other evidence. If asked about whether such a celebration took place and only if asked, tell the truth.




It's good advice not to offer any information to the CO - only answer what you are asked.
I'd avoid sending the pictures if I were afraid that your party could be misinterpreted (which it could). My now husband and I have been wearing wedding rings for years - even before we got married. However, at the time of the K1 interview he took his off. It's better to CYA.

Do your research on a lawyer if you need one, Most people don't need a lawyer for the Visa Journey.

A good lawyer is worth his weight in gold.


i did my research and i interviewed a few lawyers. This lawyer had a lot of experience with Colombia so i decided to use her base on that. it was not her fault it was her help in the office. headbonk.gif



I hope that people learn from this that if they do not have a "special" case they can do it w/out a lawyer easily.

Ths will take her her maybe 10 minutes (it took you 2 weeks to gather all the documents) Now she wil ptt back n his "in" box. He will retrun in 3 weeks from fishing and review what the secretary did, give her back the document and go off to the spa in Arizona. Severl days later she will call you to come sign the forms she typed and bring a check for $XXXX dollars PLUS $455 for the filing fee. The attorney, generous as he is, MAy offer to pay the postage to mail the package...shal I continue? Wait until you get to packet 3 (which the attroney will wait for the letter from the embassy for, but you can actually start now if you do it yourself)

You see. There is NO POSSIBLE way an attoeny can help you. If I am wrong, then tell me where, tell me what an attorney can do for this man? He can ONLY delay your case and charge you thousands in fees.

Of course this is my personal opinion, for all the attorney apologists here, and you are FREE to make your own personal decision to waste money on an attorney if you choose. Better YOU pay for the golf and fishing trips than me.


I agree with Gary, do not call a lawyer. The process is fairly simple, and lawyers just charge a lot to provide very little value in most cases.

Plenty of couples meet once in person and then apply for the K1, I don't know why your case would be any different, as long as you have proof. When did you meet for the first time (on-line)?
My hubby and I met in person and spent months together before we applied so I can't compare my case with yours.

As long as you have a co-sponsor you should be fine. For meeting only once, there are tons of couples that do that - just make sure you have a lot of proof of relationship.
And don't worry about the fact that your fiance is from Colombia. The MENA girls go through worse!

(unless you have a "special" case - like your fiance has been deported, has a criminal record, a disease, or something along those lines)

I sent my husband's BC with the initial package as proof of what I included in my I-129F. It showed who my husband was and that I wasn't just ignoring his father because he is not on the BC and I had written UNKNOWN when asked his name/DOB/address.
Also, I had had a copied translated into English while I was in Brazil so it was easy to send it. It was cheaper to do in Brazil and may be to have it translated while in Colombia.

We had a small wedding and my amazing friends did everything, so we planned quickly! The civil wedding sounds like a great idea if you want to plan the wedding together in the U.S.

It probably won't make a difference if all K1 interviews have to be held in Sydney. There are a number of consulates in Brazil, but only the one in Rio handles K1 cases, so it doesn't matter which you choose because it will inevitably be in Rio.

We got married 6 weeks after my husband arrived. We didn't have a date set because we were going to go to the courthouse - I was thinking maybe we'd take a trip to Miami and do it there.

My husband wanted to focus on the interview and his moving here before planning for the wedding...hahaha. It seems crazy now but it worked out ok since neither one of us was thinking about a formal wedding. 90 days is not enough to prepare if you don't start before the move.

I let my best friends talk me into an intimate wedding with family and friends and it was PERFECT. When my husband got here he decided he wanted to marry on his birthday - which was 6 weeks after his arrival. Everything worked out find. We IMMEDIATELY applied for AOS and the EAD since he wanted to work as soon as possible. It was also easier for him to get his DL which he wanted to.

This process is really making me want to move there. Only if my student loan payment wouldn't be almost the entire salary I could earn there.

The only thing that has to be notarized is the I-134. A friend of mine translated my e-mails/letters and I translated hers (to be safe) and we included affidavits that we are fluent in both languages.

The only thing that I had professionally translated was my husband's birth certificate, which we had done in Brasil for a cheap price. I just opened the phone book and called the first guy I saw.

I have a question that hopefully someone can help me with. I submitted a K1 petition on behalf of my fiance, who lives in Ghana, and his interview is in April. I just need to know what are the most important proof of relationship documents that are required. We have a variety of documents (a few letters, pictures, phone records, but mostly e-mails) that span from 2006, when we first met, to present. Do the officers put more weight to certain documents than others? How much should we submit? I am thinking to print every e-mail and phone record that we have, as well as copies of all our letters and pictures, but I'm just not sure of how much is enough. Any advice anyone can give would be wonderful. Thank you!



P.S. I forgot to mention that I do have evidence of my trips to Ghana, the first in 2006, when we met, and in 2007 and 2008. I have copies of all my boarding passes and iteneries (sp?). We only have about 5-6 good pictures of ourselves together because we had camera issues and we just didn't focus on taking a lot of pictures. Will this be a problem?

Any suggestions on other important proof of relationship documents would be great!




My most recent trip was from June to September 2008. We have only three pictures from that trip.
Since I came back, we have kept in contact through e-mails mostly and have called each other mostly using phone cards. We will make a point to send more real letters and cards, though.




I wouldn't send letters just for proof - that seems fake. You don't need a lot of pictures, but it'd be good to show pictures from over the years. We sent only 6 pictures with our initial package. The reason I showed my scrapbook is because the CO asked....but I made it because I wanted to.
I know a girl who took like 50+ pics to the same interviewer that I had. He didn't want to see all of them.
The CO was interested in my husband's city so I think he was curious....

I think the best proof is that I went to the interview w/ hubby. Can you do that?



I wish I could, but at that point I will be about 32 weeks pregnant, and I don't think it would be safe for me to travel. I would give anything to be there with him so that we could prepare for this together, but I just don't see that happening at this point.




Of course - that'd be hard and expensive. I'm sure it'd be nice for your fiance to tell the CO that you're expecting a baby.
