Hi guys, I have question, is it normal from uscis to touch a petition after it has been approved already? My fiancee petition was approved last September 2 2009, but nvc has not received it yet, and the weird thing is that i have checked my uscis email account, and our case has been touched everyday of this week, hmmmmmmmmm, so weird. I hope somebody can shed some light on this.

Starting out life in the US with an illegal action is hardly putting your best foot forward.

I would like to think this suggestion was made as a joke but subsequent posts simply re-enforce the fact that this poster likely has, as indicated in their post, no ethics.

Probably the worst post I have seen on VJ thus far. Download software illegally and use it to make a fraudulent submission.

You might want to check out VJ TOS before you post this type of advice in future.

I don't think USCIS is perfect AT ALL, but I don't think they're as incompetent as people paint them to be. A good eighty percent of the posts I read here about cases delayed/denied/or some other dramatic shenanigens are from people who brought it on themselves by failing to read the instructions or making bad decisions. For every story about someone who honestly encounters a problem that is wholly USCIS's fault, there are fifteen more from people who say USCIS is awful because THEY made a mistake. I've seen people on here who will say, "I didn't send the forms I needed with my packet, or read the instructions, or send the correct fee, and now I've been denied. It's just because USCIS is greedy/hates immigrants!" If you didn't do something right, you can't expect USCIS to just say, "Oh, we understand it's just a mistake, we'll make an exception in your case". It would be nice if that was how the world worked, but it's not.

I know there ARE a lot of couples who have gotten forgotten or hopelessly tripped up because of computer or government snafu, and my heart goes out to them, which is why I think the rage-flailers who have caused their own problems need to own up to their mistakes instead of pointing the finger at the government because it's easier than saying "I'm not perfect". I'm sure the people who followed directions, did everything correctly, and then had to go to court or whatever because of a clerical error (my cousin) would have very little sympathy for the ones who can't follow instructions. The system needs work, but then, so do people.

This wasn't directed at anyone specifically, just something I wanted to say.

Just to clear things up for you. Yes the NVC sends your case to the U.S interest section. The affidavit of support is submitted at the time of the interview with the other documentation that your fiancé needs to fill out. Not all the time the US interest section informs to pick up packet. I had to call to set up an appointment for Mary to go pick the forms up. And Make you call the U.S interest section to do that, and to set up an interview date. They will give you an 800 number to call for the interview appointment. Typical the visa is given the next day, but I had heard that some received it on the same day. I not sure what is the cost of the Carta Blanca as of now, but when we went through the process is was 150, and the medical exam was 400, and keep in mind you must buy the plane ticket before the Carta Blanca is received. A ticket for Cuba right now is about 300cuc. If you fiancé is permantly immigrating to the U.S, then the government will confiscate anything that bears his name. Typical they make a visit to his house and ask where he sleeps and what does he owned in the house. When they showed up at Mary's house, Mary said that she shares a room with her little sister and the house and all the belongings are owned by her mother. Nothing was confiscated. As for flying from Cuba, he needs to purchase the plane ticket in Cuba at his local havanatur office. I have seen American Airlines planes at the airport, but they are charter planes. Only charter planes can directly travel from Cuba to the U.S. As for the work permit, I had heard that you received a work permit stamp at the airport, we didn't have that luck. I also suggest he go get his social security card and his driver’s license when he arrives in the U.S. before is k-1 expires. Good Luck, Edwin&Mary

I know that I should bring some things to her and that she must do

I read the guides on this site and everything went very smooth.

What do I do now?

Do I need to mail anything else to someone?
Or just send the documents to my fiance?

I read that you can look on the Embassy web site in Moscow
and see when your interview is scheduled.

How do I find our interview date?
The numbers are different from USCIS.

We are in Ukraine on vacation.
She may have a notice in her mail when she returns to Russia.
But, we are here and impatiently waiting)).

What documentation are you looking for? If it is documentation stating the separation of powers between the states and the federal gov. then that is laid out in the constitution. If your looking for your states laws concerning marriage and the appropriate paperwork to fill out for a marriage license then google you local county courthouse they will have all of that info there.

Thank you for the quick responses.

I realize that a lot of people here have done this on their own. I keep looking at the documents and have done a lot of research and feel comfortable that I can do it. For me the service is more of an insurance policy from someone with experience to look at my documents to confirm that I have everything filled out properly and in the proper order. If the service is able to do this I do not think a small fee is unreasonable. I would just like to get feedback on a service if I elect to use one.

My case is straight forward with no problems concerning evidence of a relationship. We have seen each other 5 times since April of last year and I just returned from a 30 day stay. I have already started compiling everything that I need and will make a decision next week on if I will proceed with or without a service.

We only have about 5-6 good pictures of ourselves together because we had camera issues and we just didn't focus on taking a lot of pictures. Will this be a problem?

Any suggestions on other important proof of relationship documents would be great!




My most recent trip was from June to September 2008. We have only three pictures from that trip.
Since I came back, we have kept in contact through e-mails mostly and have called each other mostly using phone cards. We will make a point to send more real letters and cards, though.




I wouldn't send letters just for proof - that seems fake. You don't need a lot of pictures, but it'd be good to show pictures from over the years. We sent only 6 pictures with our initial package. The reason I showed my scrapbook is because the CO asked....but I made it because I wanted to.
I know a girl who took like 50+ pics to the same interviewer that I had. He didn't want to see all of them.
The CO was interested in my husband's city so I think he was curious....

I think the best proof is that I went to the interview w/ hubby. Can you do that?

I would make it a priority to show the officer more recent proof - pictures, letters, e-mails, gifts...
I like to make scrapbooks and had made one about my husband and I. The CO asked to see pictures so we showed him that book.
I had a folder of everything and showed what I was asked for. I believe that it's better not to offer anything, wait for the CO to ask, but then be ready.

You may want to go into the African forum and ask other Ghana/America couples.

Go to the interview if you can! I was in the same position as you and we decided that I would NOT travel to Brazil to spend Christmas '06 with my husband so that I could travel there for the interview - a few months later.
It's expensive and hard with work to make as many trips as we'd like to, I know. But I think it's important to be at the interview if you can, and the embassy will allow it.

We were so nervous, I can't imagine my hubby having to go alone...and that's the best proof you can have.

We bought ours in advance since I traveled to Brazil to be at the interview with my husband. We felt confident enough that we'd be approved (I know a lot of people would say it's not a good idea) and everything worked out perfectly for us. I know it's a risk but it was fine for us.
I also figured that if something went wrong at the interview we could just change the dates and pay a fee to fly another day.

With all due respect, TBoneTX, I think you're overdoing it a bit. I mean, just because you can't make it to the interview doesn't mean your SO could have a good chance of being denied (unless it's a requirement from the consulate that the UCS attend).
I think that the attorney fees, waivers, is pushing it a bit.

My hubby would have done fine w/out me, but I wanted us to go through this together, and hey, we had a romantic honeymoon in Rio de Janeiro.

Even if your consulate does not allow the U.S. partner IN the actual interview, be on the premises. You can hand your U.S. passport to your partner, who can show it to the interviewer to prove that you are present. This can only work in your favor.



But if you can't go then you can't go. I recommend it but sometimes it's too hard ($/job) and you can't make it. Many people go on the interview alone so it's kind of the norm, but it would be better IF you could go.

They don't have to be done by a professional, though we decided to do that since a BC is more complicated than say an e-mail or letter. As for our other documents (letters, e-mails, receipts), we asked a friend to translate them for us and she wrote the above statement for each translation. Then I did the same thing for us.
However, I've read about many people who translate documents themselves. I didn't want to take that chance.

Any opinions/advice/similar experiences out there?

You'll need A LOT of proof to show that you're in love with your Cuban fiancee and why the relationship didn't work out with your spouse. You can apply for the K1 but it does, as you put it, look shady.

The directions usually tell you what to do - whether to write N/A or NONE.
You may be ok or you may get an RFE. I'd redo the forms leaving no blanks so that you'll be ready to send them off just in case you do get an RFE.

I'd recommend NOT showing this as proof because of the reasons listed above. You say she has "photos, emails, phone records...", so leave it out. Good luck on the interview!
