Although I am not sure WHEN exactly the I-134 is sent: If it is asked for at the actual interview or sent back in packet 3 before the interview. We were planning if it is the former, to bring the co-sponsor and whip it out then. But if it is the latter, well then we will be forced to include both at the same time I suppose.

Anyway, I've asked a lot of questions regarding the I-134, so if the OP needs a hand and since we're in the same crappy situation, there might be specific answers in the threads I started.

You are EXACTLY in the same boat as us. Leo started in August last year as well, as such his latest tax return doesn't show his full annual income, which meets 125% poverty guidelines. We're going to be supplying at least 3 months of latest pay stubs, letter from employer and perhaps a bank statement so they can see regular income coming in and what amounts per pay check.

But we also are getting a co-sponsor just in case they are not happy with the tax return. When all is said and done, what is needed is entirely up to the consulate and it's better to be prepared then to be delayed a few months getting the paperwork needed ready. There's the tax transcripts a co-sponsor needs to get which takes minimum 2 weeks from IRS, gathering the co-sponsor's paperwork (duplicate copies of financial evidence + citizenship proof), the mailing time involved between the co-sponsor, USC and beneficiary. All in all, it will take some time. SO rather than go to the interview, they ask for a co-sponsor, go back home, gather paperwork, a month or so has passed and you wish you had come with Plan B earlier.

Our embassy is a 2 1/2 hour plane ride away, so rather than go there only to be forced to fly back with a letter saying they need a co-sponsor because they're not convinced due to tax return, we want to make sure we have everything that is needed on the spot. If they aren't happy, whip out the co-sponsor.

I don't know what the tax transcript reflects. We ordered ours a month ago and it still hasn't arrived.

You need to be married for CR-1.

You need to have met within the past two year in flesh for the K1.

Neither has any distinct advantage over the other in relation to a tourist visa. If anything, both would adversely affect it as to them it displays future immigration intent. You have to prove against this.

At the POE, you will have to show proof of social and economical ties to your country which could be things such as a lease for rented/owned house/property, bank account statements, letter from employer stating duration of employment and pay, membership card to something, return plane ticket, pictures of family.

Unfortunately the CR-1/K1 is not going to be used as proof that you will return to complete the process. From what I heard, it will be used against you as actual immigrant intent. But I would not lie about anything at the POE as some have had bans from lying about having a spouse/fiance in the US at the POE.

And yeah, the whole process is annoyingly long winded full of red tape.

Primarily for the initial filing of I-129F, they focus more on evidence of having met in person within a 2 year frame time: boarding passes, hotel receipts, bus/train tickets, ATM withdrawals, passport stamps, ticket stubs, ticket receipts, pictures of the two of you together.

Some choose to front load their petition with some evidence of relationship incase of the off chance that you will be denied a chance to present evidence at the actual interview (some instances where the CO asks for more proof of relationship but refuses to accept any when you try to give it to them). In this case, it is argued that they cannot ignore evidence in the actual petition and for that reason, some choose to front load at high fraud or hard embassies.

I would not suggest a cd sent with the petition or brought at the actual interview: the rumors I heard is they cannot access media like that. There was a case where a woman brought a cd to the interview as well and was sent back with request for more proof in paper form since they did not accept the cd.

As for your initial question, pick a short excerpt per month to send if you feel anxious about front loading. If you're anything like us, our chat logs will be pages in a short span of hours, that's why I say print an excerpt only; just to give them a feel of how you both communicate. Try not to edit it out unless you have some personal information, just blot it out with a black marker. The key is to keep it as original as possible with some leeway for privacy.

I personally sent one conversation chat log per medium we use (which was three). Also, if you use webcam, take some screenshots. If you wanna print out some emails to send, screenshot it from your inbox if possible to show it is not forged.

For identification of user names in emails and chats just put something like:

Username1: Petitioner's name
Username2: Beneficiary's name

Email1: Petitioner's name
Email2: Beneficiary's name

If you don't manage to get a record of phone bills from magic jack, I strongly suggest trying to use something else to build a paper trail in time for the interview. Some people have been asked for 6 months worth. Just to be safe. We use skype unlimited country plan and have access to that, his phone records from his mobile in US and my phone records from my mobile here. So three different type of phone records.

And just slotted everything in behind each corresponding paper. Punch two holes at the top of the package and bind it with ACCO fasteners. Don't use folders or whatever as they will take it apart and put things in their own folder system later and don't make it too hard for them to take it apart as it might piss them off.

Photos were put in a clear plastic bag with names written behind them and paper clipped to a blank sheet of paper. Some people put tabs at the bottom of the pages to make it easier for them to sort through but we didn't.

We sent 6 screenshots of webcam sessions, 6 months from 2008 and 2007 of skype telephone records, some US phone records showing my local skype number, 6 emails printed from inbox, 3 chat logs over 3 different mediums and 20 photos in the initial petition just incase. I learned not to take things for granted and hope for the best, prepare for the worst.

Chats and emails don't all have to be lovey dovey. They want to see how you converse with each other and it's not realistic to be lovey dovey 24/7. Anything that couldn't fit in the forms, we attached an extra sheet to them with full details. The boarding passes and passport stamps were scanned. The rest of the evidence was photo copied. All signatures must be original.

We were fortunate to have a member of visajourney help us and mail us a example petition so we knew the format. I can't mention their names here to respect their privacy but we were lucky. So passing on the good karma.

If you're under Vermont, a reasonable estimate would be 4-5 months for NOA2 and 2 months for the interview, so between 6-7 months if it goes fast.

If it goes slow, that's a different story. If you get put under AP that's a whole other story. If you get an RFE or they lose your stuff, that's another story. There's a lot of variables and so many things that are out of your control.

CSC seems to be 2 months ahead of VSC folks.

Things we wished we would have done before filing? Filing things faster. Kick start it off ASAP so the clock can start ticking. It's a better feeling waiting for something with a somewhat distorted deadline than not having a deadline at all.

We're gonna elope, a step up from courthouse. Maybe some place nice by the mountains or waterfall and then when we have enough money have the actual formal ceremony in a beach barefoot wedding in Hawaii. If beach weddings can be formal.

Can't imagine doing it in a courthouse.

There is the K1, CR-1 and K3. K3 is mostly obsolete now since it was used before when CR-1 took AGES. Now CR-1 takes only a few months (i've read someone had a CR-1 done here on VJ in about 5 months). If anything, the trend I've seen is about an added 2-3 months to the K1. The CR-1 is cheaper in the long run than K1 and when he gets to the US he can work immediately, have his greencard sent in the mail etc. With the K1, you have to adjust later on which is an additional 1000 or so. There's biometrics, medical, shots etc as well. Of course you have to be married for the Cr-1. Overall since you said there won't be a problem with him going there to be with you while waiting it out, in terms of cost and efficiency in starting a life together immediately, I would personally recommend the CR-1. Whats a few more months, if that, compared to saving a grand or so and having him able to immediately help with the income? Especially if he will be there with you anyway. Many people take the K1 because they want the fastest thing possible and can't afford flying back and forth and face countries that don't issue tourist visas easily. Anyway, try doing a search on CR-1 timelines here and don't quote me on the exact time frame as it varies. However I have seen a few CR-1 cases that made me go "o_O and K1 is supposed to be faster?"

I also have a few concerns about the overall process. I am slightly worried about the income support because I don't make very much money. In fact, I receive assistance from a few government programs (which is kinda silly because if he was here I wouldn't need them..)

Sounds like you need a co-sponsor. From what I have read it can be anyone that is a USC or naturalized citizen. Does not have to be a family member unless Canada consulate is specific about that. It is legally binding for a few years though (not sure on the amount) so have to make sure that is made clear to the sponsor. The sponsorship is NOT however to be mistaken as a guarantee that they will support the beneficiary financially, merely a guarantee that the beneficiary will not be a burden to the state.

Next, we were hoping for him to be able to stay with the baby and I after its birth while awaiting the visa approval. Since he is Canadian, I know that he doesn't require a vistors visa to be here, and obviously he couldn't work or anything. But would this affect the process at all? Or would he just have to return to Canada for the interview at the consulate?


He would have to fly back to attend the interview for K1 or CR-1/K3 regardless. There might be an issue at POE so he has to make sure he has the standard proof of strong ties to Canada when he crosses the border. Visiting wont affect the process and is allowed. Just don't lie about ANYTHING to the officer at POE. THAT will effect things. The only issue is managing to get past POE and convince them he won't suddenly stay there illegally and that is done with proof of social and economical ties.

There is no harm trying for a tourist visa as denial of it will not affect your fiance visa in the future or have any negative impact. They are two very different visas with two very different criteria to satisfy.

As you pointed out, a fiance visa is kinda moot and I think you have already answered your question by stating how you are not comfortable with the marital leap and the what ifs accompanying him moving to a whole new country.

My only concern is making sure you don't lie when you do apply for the tourist visa. About your involvement in it and your existence as they seem to keep records of things like that and it very often bites people back in the #### when things really matter.

A house is not good enough proof of solid ties to home country as the CO told me at my tourist visa application that 'it can be managed from overseas' when I brought up owning land here to prove I would come back. Then again, it varies wildly from person to person and embassy to embassy as its purely subjective.

The other usual things would be letter from employer stating leave of absence and date of resuming work as well as letter of offer to show how long he has been working. Pay slips to show he has substantial income. Pictures of his family. House deeds, membership cards with substantial duration, leases, financial commitments like loans, itinerary, credit card/debit card statements to show permanent address and how long he has lived there etc.

Well we updated our change of address online and within a day finally managed to see our case online after 4 months over of not being able to.

When we called USCIS to confirm the address change the person (not supervisor) refused to co-operate and said you can't confirm a change of address on the phone. Is this for real? Sounds like lots of folks have done it and got by fine. Not sure if this is typical misinformation line bullshit or if you can't confirm your address change on the phone after doing it online.

The receipt number is correct. So my question is, how can I update a change online if our case isn't even in their online database yet?

Most likely we will do it via the phone if anything, thanks cornbread. Hopefully can hear more from those that have changed their address with no adverse effects to weigh the pros and cons more.

Hi guys,

We're considering the idea of moving to a better place. Well, he is anyway. We're currently in the middle of a K1 with only the NOA1 received.

I've done some research here and it says to update the petitioner's address online with USCIS and that no form is needed (Ar-11 or something). Is it possible to update it if your case does not even show online yet? We have our receipt number starting with EAD and 10 digits but no online presence on the USCIS website.

Also, will it cause any delays? I've been hearing mixed stories from past threads I've read on it. I've also heard something about mail forwarding order from USPS incase USCIS cannot be trusted. How does one do that?

This is a big if situation. We would have a lot more privacy if we moved to start our married lives and really do like the option but it's not worth it if it adds a few more months to the process.

Any thoughts?

We changed our address online and followed up with a call to confirm the change of address. They said they could not confirm it via phone. We called again hoping for a different answer since, you know, misinformation line and all that. A day later, we received an email from them confirming the address change, in response to our calls. One day later, on Monday, we received our NOA2 approval email.

We got touched once, the day after updating our address online and touched a second time the very next day. On that same day, we got our NOA2 approval email notice.

Here is something to try.

Who is moving, the beneficiary or petitioner?

If the beneficiary is moving (which I think is inferred from the mention of consulate papers), it should be fine since it will likely take 4-6 months until the interview and correspondence from the embassy, during which they will already be settled in the new place since you mentioned 'a few months'

If its the petitioner, it's advised to have a permanent address although you can always update your address with USCIS on their website or via phone after moving. And as an added precaution, set up mail forwarding with USPS.

We had cover letters for each section, a cover letter for the entire package, a detailed time line of relationship and lots of proof of relationship to front load the petition. We even included the beneficiary's passport and birth cert copy thinking it would help name checks.

We got approved without any RFE and spent about 3 days at NVC before it got forwarded to the consulate.

We sent it via DHL and it was signed for by that guy everyone knows at Vermont, I forget his name. Did not use a box but a plastic envelope to protect it from weather. Acco fasteners on two punched holes ontop of the entire thing.

Just a note, I have read some cases on VJ where a 'religious' wedding was for all intents and purposes considered a marriage thus invalidating the K1. So please proceed with caution.

If I'm not mistaken, someone's K1 on VJ was denied because a customary act of the engaged couple's parents meeting was considered a wedding because it was based on customs. Just an example of how wide interpretation of 'marriage' can be at some consulates.

I have often called my hubby from payphones in US airports, you need four quarters and dial the number with a 1 first (ie 1-xxx-xxx-xxxx). You get about 4 minutes and they often accept incoming calls, so you can call her back to save her money. They sometimes do not work though, so if she tries one and no luck, she should try another, I'm sure there'll be one that works.

Hello everyone,

My name is Carrick. My fiance' (Thu) and I are in the process of getting all the required documentation for the I-129F ready for filing. I am still in the learning process but I want to know basically if the Letter of Intent to marry in 90 days has to be an original signed document or can it be a copy of that signed document. I want to know this for both myself and my fiance'. Any help would be much appreciated. Thanks!

I am so sorry guys. I realize I have a similar topic over at the Asia: East Pacific forum. I was basically saying that the more I read articles at VJ and the more I talk with you guys, the more I realize that Thu and I need to take more time. Now may not be the right time to file for the K-1. Right now I just want to focus on our relationship like visiting each other in each the US and Vietnam. While that is going on, Im just gonna keep adding and adding more documentation and evidence and learning more and more. Scott, you can also email me if you like. I think you are a great help to me.

I see alot of members here at VJ get placed on the AP list for the HCMC Consulate for more processing. My question is, how does one go about proving to HCMC that you do have a real, serious relationship with your SO? I mean all I can think of is repeated visits to Vietnam, multiple love letters, long phone calls (this would kill the phone bill). But I see that for many of you this is still not enough. I mean what does HCMC expect couples to do? Make babies and use them as proof?? I haven't even submitted my I-129F and I am already starting to freak out about this. How can we prove it??

Contract switch moves positions to Essex Junction



ST. ALBANS — U.S. Citizenship and Immigration Services (USCIS) has revised its estimate of how many jobs will be lost at the service center here in St. Albans from 200 jobs to 100, according to information provided to the Messenger by the office of U.S. Sen. Bernie Sanders, I-VT.

The jobs will be transferred to a “lockbox” facility operated by JP Morgan in Essex Junction.

Sanders is planning a meeting with workers in St. Albans in April to discuss the situation.

Fifteen temporary positions will be lost in St. Albans this summer, followed by 45 permanent full-time positions this fall, and another 40 positions next summer, according to James McCament, chief of the Office of Congressional Relations for USCIS.

Approximately 150 people will be employed at the Essex Junction facility, McCament said.

“We are working proactively with JP Morgan to ensure they are providing every appropriate opportunity for the approximately 100 people who will not be required at the service center over the course of the transition,” McCament said in a written statement.

The Vermont Service Center employs 1,100 people in St. Albans and Essex Junction with the bulk of the employees located in St. Albans. Of those employees, 670 are direct employees of the federal government and the rest are employed by contractor Stanley Associates and its subcontractors.

Currently, 200 of the employees at the service center are engaged in data entry.

In 2007, USCIS and the Dept. of the Treasury chose JP Morgan to be the sole provider of lockbox collection services for USCIS, according to information provided by Sen. Sanders’ office.

Sanders on March 19 confirmed for the Messenger that 200 data entry jobs were scheduled to leave the Vermont Service Center over the next two years. That number has since been reduced.

The senator at that time expressed anger about the way USCIS had handled the transfer of contract workers, saying they had learned of the change when they were shown advertisements for their jobs. Sanders called the failure to notify workers of the change "contemptuous."

Sanders sent a letter to Secretary of the Department of Homeland Security Janet Napolitano urging that the workers for government contractors be allowed to continue to work at the St. Albans center.

On Saturday, April 11, Sanders will be host for a meeting with employees from the Vermont Service Center at the St. Albans Historical Museum. USCIS acting deputy secretary Michael Aytes will be attending the meeting, which will be held at 12:30 p.m.
