I am trying to bring as little weight as possible and my relationship evidence weighs roughly 10 lbs.

1. Not sure about the embassy specific question but the process of K1 took 6 months or so from our filing to the interview date. It is dependant also on which service center you file to. CSC used to be faster by 2 months than VSC but VSC seems to have picked up pace. And it also depends on the speed of the embassy you elect to go through at filing the documentation and setting the interview date. Check the immigration time lines for the embassy you will use to see how fast on average the consulate takes from NOA2 to interview date then add roughly 4 months processing time for NOA1 to NOA2 for USCIS portion. This is of course a rough estimate as some people do fall in the black hole at USCIS and it appears to be entirely random and a matter of pure luck and assuming your case is a simple black and white case.

2. I highly recommend NOT having her come into the US with that visa and to adjust because that is immigration fraud - coming into US with the intention of getting married on the wrong visa. Also if you get denied at the adjustment stage, I am unsure if you can appeal the decision from a J1. It is very very risky and also illegal. 6 months for the K1 vs a ban from US, there's not much argument there.

PS: Also remember that since your SO moved around so much that she will need a police certificate for every place she has lived more than 6 months since the age of 16.

Well since the beneficiary will be out of status after the 90 days entry in the US utilizing the K1 visa, it stands to reason that adjustment should be done ASAP after marriage. So depending on your funds for AOS and how fast you can do the paperwork, I would say an accurate reflection of time to give to the co-sponsor starts from the day you land to the day you adjust status and send out I-1864.

In any case, the I-134 is just to make sure you are not a public charge. It is not to make sure the co-sponsor provides you with money to live. So as long as you don't become a public charge, that argument should soothe the mind of your co-sponsor in regards to their legal liability.

Only thing in terms of legal liability that I could find in the I-134 instructions were:

"Under Section 213 of the Act, if the person you are sponsoring becomes a public charge, the agency that provides assistance may be able to sue to cover the costs of the assistance'.

Then again, a lot of people are saying I-134 is not legally binding and only acts as a cover letter. One very helpful answer on the nature of the I-134 was post #14 of this thread:

Don't Travel to Washington DC, Mary and I just did that the other week. You need to send your husband passport by mail, they do nothing to his passport in person anymore. In the past you were able to go the Cuban interest section in DC to do it, but not anymore. We learn that the hard way. Here's what you guys need to do: First, every two years the Cuban passport needs to be renew (which they call prosloga at the Cuban Interest Section), no matter what the expiration date in the passport said. Second, to travel to Cuba you need permission to enter the country (not advance parole, that’s a U.S. thing). What they are going to do at the Cuban interest section is send you husband passport information to Cuba and they will do a background check. If a Cuban enters the U.S. illegal, or has a criminal record they will be denied him to enter back in Cuba. Go the U.S. Cuban section Official Website for information on where to send the passport by mail and the fees. We paid 180 dollars for the Prosloga, and 20 for them to send the passport back to us by US mail. It was paid by two separate money orders, and only paid my money orders. I hope this information helps.

Hi,

My fiance has her interview on the 20th in Moscow.
Her son is four years old. He goes to daycare and gets sick frequently.

We had to reschedule her original interview because he was sick and she
is afraid to take him on the train to Moscow.

Now he is sick again and won't be going to the interview.

What are our options if she is approved.

Would we need to file for a different visa for him?

I know that you must wait two years before filing another K-1.
Would that apply to a K-2?


P.S. His health is fine until he goes to daycare.

Hello everyone, I just have a question regarding the I-I29F form. Question 10 asked, "My citizenship was acquired through either Birth in the U.S. or Naturalization? and then underneath it it says to enter certificate number, date and place it was issued. After that it asked if I have obtained a certificate of citizenship in my name. I was born inside a navy base in Japan in 1981. I didn't become a US citizen till 1996. So I marked "naturalization" and entered the certifcate #, date and place issued. Then I also marked "yes" for obtaining a citizenship under my name and used the same certificate #, date and place issued. Is that correct? I have the same info for naturalization and obtaining a certificate of citizenship in my name. Confused?????


Was that a U.S. Navy base in Japan?

The 'application of stuff' to actually get it done seems to be sporadic, so far -
i.e. - everyone with a felony conviction has NOT been sent to an ASC for ADIT (biometrics/fingerprinting)

The information comes from reading IMBRA regs and the Adam Walsh Act.

re: 3rd quarter of last year - sorry, can't cite the source, exactly - but I did read it on ILW.com that 'that portion of the act, covering fingerprinting of convicted felons' was to be instituted starting the 3rd quarter of 2009.

If I have time this week to scour ILW.com and find it again, I'm happy to post the link. IIRC, it was a 'weekly review' from one of the attornies that post there.

FWIW, there IS another VJ member here that went through exactly the same thing.

If you feel incredulous by what I wrote - well, you should be, ya? It makes no sense to me, to make this 'extra step' for Biometrics on a US Citizen that has a felony conviction - is dead easy to match up prior fingerprint records WITH the USC's ssn.


If you mean all felony convictions that are covered under the Adam Walsh Act and/or Violent in nature then I can't comment, but if you mean ALL felony convictions then that is not true. I have a felony conviction for a white collar crime and I was approved today and never asked to give me fingerprints again to the USCIS.

When you submit your I-134, you usually are asked to show your income level via tax returns. They will use that, plus the letter from his current employer to determine if he meets the required level.

If you don't - you will either need a co-sponsor (as you pointed out), or he gets more income to meet the level.

Check with your embassy for the evidence they wish to have with the I-134 -some require tax info - some do not. (mostly do)

No. The 125 percent minimum income requirement, the most recent year's tax return and other requirements only apply when an I-864 is needed. Applicants using the I-134 will need to show that their sponsor's income is 100 percent of federal poverty guidelines as required under Section 212(a)(4) of the INA." So this is saying that to get them here on a K-1 visa you only have to make 100% of Poverty level. Once you AOS then the 125% kicks in, but this conflict with what everyone else is saying. Anyone know the story about this? My consulate requires the I-134.

My fiance is a student in UK from Nigeria. He interviewed on Oct 15, 2009. He was told to resubmit I-134 from co-sponsor (which was already delivered to Embassy) and his passport. We were told numerous times 10-15 business days and processing would be complete. However DOS told me it is administrative processing when that was not indicated on the blue form he was given at the interview. I thought all they needed was I-134 how in the heck did we get put in AP??????? wacko.gif

Hi! Thanks to all in advance who take teh time to read my question and give me any feedback. Please be considerate because as many of you know this process is very daunting and frustrating, and sometimes scary. All anxiety aside, here is my situation. My boyfriend is Brazilian and our I-129 F petition was approved in March 09. Due to problems with his family in Brazil we did not take action and now we are ready. We were dealing with the Spanish madrid consulate because he was living in spain, now he is moving back to brazil. Can we contact the Madrid consulate to see if our approved petition is still an open case? and if so would it be a problem with transferring the case to the salvador, bahia american consulate in brazil? I know that consualtes don't like any problems. The last thing I want to do is negatively affect our visa process. I know also that the petition expires in 4 months but I have read that the case will become abandoned but remain open for a year?
Would it be better to reapply for the 1-129f all over again?

More or less we are curious to see if our petition case is still open in Madrid, and if so if we could move it to Brazil. has anyone had any experience with an expired petition or with switching consulates?

No you are fine using the address you have now. When you get your NOA1 with your reciept/case number you can go on the USCIS website and change your address. Hope this helps!

Why do you want to send in a document they say not to send in? Do you want to purposefully delay your petition by incurring a RFE for sending in the wrong form?



I asked because on the I-864 form..you can use your Fiance's assets and income, but on the I-134F..you can't use your fiance's assets or income. Have you looked at the differences in the forms? There is a difference.That is why I was asking. If the I-134 is not approved. Then the whole K-1 Visa will likely be disapproved. We will probably try the K-3 Visa at that point.

P.S-You don't have to be rude. I was just asking a question. Why would I purposefully delay it..Duh?

Yes you can. The translation needs to be certified, NOT the translator. You do this by completeing the translation then add



"I, ____________________________________(name) am fluent in both the English and Spanish languages and certify that this is a true and accurate translation of _____________________________________________(document)"

And then have the signature notarized.

FWIW my wife translates documents and has done so successfully for VJ members and for other clients official government documents (she translates Russian and Ukrainian, and uses exactly the above certification) BUT she chose not to do her translations for her own visa documents, but you are not doing them for your own, either. This was her decision, no one said she could not.




Many people translate documents themselves but I decided not to. We asked a professional to translate my husband's BC and a friend did the rest - and I translated her paperwork.

You don't need a notary. For what? The only document that needs to be notarized during this process is the I-134.
