K-1 Fiance(e) Visa Process & ProceduresChecking on the status
Hello!

I just got my NOA 1 so I have my ID number now. I have gone to the USCI services website and plugged in my number. I am confused at how you know when its been "touched" or when you get a NOA 2? The only choices it has to let you know what step you are on the process are the following: Acceptance, Initial Review, Request for Evidence, Testing and Interview, Decision, Post Decision activity, Document production or oath ceremony.

So, my question is, when you are in Initial Review- that is only NAO 1? Or is it also NOA 2?

Thank you:)

K-1 Fiance(e) Visa Process & ProceduresForms that need to be translated
Hello,

I am wondering which forms does my Fiance need to get translated in English for his interview? Birth certificate? Police report? These are all in Spanish. Also are these the same forms we will need to be translated once we get married and he files for a AOS?

Thank you!

K-1 Fiance(e) Visa Process & ProceduresDisclosure of Criminal Record non IMBRA or AWA
I also have a Felony conviction for credit card fraud, I know stupid #### move. :bonk: Anyways I just recently had to go through this same process and I didn't tell them about mine. They only want to know about any convictions that deal with IMBRA. I had no problems with my application at all. The application say what it means, only the convictions they list on it do they care to know about up front. Too much info up front can sometimes be a bad thing. The rest they will see when they run you through the NCIC database.

K-1 Fiance(e) Visa Process & ProceduresLooking for an attorney

Hah, I guess that leaves out the attorney that was recommended for $1000! I asked her that if in lieu of a flat fee, she would consider simply addressing my concerns and charge me an hourly rate. She said she doesn't work that way. She then proceeded to tell me why a layman should not file the paperwork without an attorney.

I should also add that I went through the fiance visa process successfully 15 years ago and married a woman from the Philippines. (Our marriage lasted 10 years and we are now divorced.) I handled all the paperwork on my own (before visajourney was born and the internet was in its infancy! -- so it's not like I don't know the ropes, though I am very rusty. In the end, I had to hire an attorney for my wife to get her green card because we got a real winner at the INS who refused to believe our marriage was real. But that's another story. Thanks for reminding me what an attorney can and can't do. I needed a refresher. In any event, I will take the advice given and pursue this as far as I can on my own. Thank you again.

K-1 Fiance(e) Visa Process & ProceduresLeaving "Province" blank?

My fiance doesnt live in any Province or State, left it blank... what do you think? Now I am worried.

Don't worry I left it blank too, as we (Moldavians) really don't have province or Oblast. And I've never got RFE and was approved (K1 visa) in 72 days.

K-1 Fiance(e) Visa Process & ProceduresBeneficiary Change Of Address?

So my fiance is moving next week and I need to get his address changed with the USCIS. I called the service number the other day and was told I had to submit it in writing to the CSC where our case was at the time. However today I just found out we got our NOA2 (yay!). So..do I still send the change of address to the CSC or do I need to address it to the NVC? And is there anything I should know about sending out the paper? I was planning on putting his previous address and then his new address as well as our case number and then sign and date it.

My fiance moved too right before we got our noa2. I just called the embassy in Manila and told them about her new adress and it was fine. It's an $18 call though.

K-1 Fiance(e) Visa Process & Proceduresincome requirements

Initially when the I-134 is needed you are not required to supply the 2009 Tax transcripts or return. later you will for AOS. Look at I-134 instructions for what is needed in the K-1 interview.

http://manila.usemba...v/wwwh3219.html

Fiancé(e)s (K-1), spouses (K-3), returning residents (SB-1) and follow-to-join employment (E) applicants use the I-134 Affidavit of Support form. This form must be executed less than one year prior to the visa application. A copy of the sponsor’s most recent Federal income tax returns and evidence of current employment must accompany the I-134.

This is what I found from the Manila embassy website but I don't know if it's set in stone.

Does anyone know how far the embassy goes back in determining financial support. I now make $42,000 per year and I started this job Feb, 1st. Last year though I only made $9000. She has her interview in a month. What do you guys think?

Hello VJ friends,
Been following the forum for some time but just joined today. I met Ole in August 2007 and we got married on 10-09-08 in a Thai Buddhist ceremony. The BKK embassy was very fast in setting up our interview. We just returned the Packet 3 about the last week of June and the interview is already set for July 24, just after the last day of interviews that is posted on the embassy's website. We have used Star Visa in Chiang Mai to prepare our forms and everything has gone very smoothly.

Good luck to everyone

Bye for now

K-1 Fiance(e) Visa Process & ProceduresBeginner thinking about K1 for cuban fiancee, please help.
QUOTE (eeo @ Sep 19 2008, 07:52 PM) <{POST_SNAPBACK}>
Hello, I just joined this site today, as I was searching for more information on the best way to be with my partner from Cuba. Please help me understand all this a little better, as I am having a hard time sorting it all out just by reading posts. What I had planned to do at first was to go to Cuba, get married there, then file for him to come to the US as my spouse. But from searching today, I came across the K1, and now I am unsure about the best route to take with all this. Generally, it seems that the K1 process is quicker and even more successful than the K3 route, based on what others are saying. Is this true? For me, I am waiting to raise enough money to go there and get married, and then I had planned on filing for a k3 (I had no idea it was called a k3 before now). Now I am considering the K1 route, as it seems quicker. Also, I met him when I was in Cuba last year and have been back once more, but I was there "illegally", without a license or anything: Does this affect my eligibility to be approved for a K1? I am just not sure if this is what I should do, and I am definitely not sure about all the specifics. Can someone help me get a better idea, with regards to Cuba? Sorry if I am a nuisance, I'm just new to this and am very anxious to get answers, and it is hard to navigate all the information that is out there.
I would really appreciate your help. Thank you!

Check out the Latin American forum on this site, there are a few Cubans on here. Hopefully they can answer your questions. I think they were all illegally in Cuba too - you're not the only one.
The K1 seems to be pretty quick - assuming you have everything done right the first time and no convictions, etc.
I had a hard time being apart from my husband when he was my boyfriend and in Brazil, I didn't want to start out my marriage on different continents - so that's our main reason for choosing K1.

Good luck!

K-1 Fiance(e) Visa Process & ProceduresK1 correspondence
QUOTE (MMarc @ Nov 24 2009, 05:58 PM) <{POST_SNAPBACK}>
We have communicated through video SKYPE chat for the past 9 months (over an hour each night.) I made copies of our SKYPE chat history for the interview, a long with pictures, and a statement that I lived in China from August 2008 until March of 2009 in the same apartment complex as my fiancee. Since, I lived there, had over 130 pages of SKYPE history, and plenty of pictures, I thought this would be enough. We got a BLUE SLIP at the interview with the correspondence box marked. Here is what the box stated:

Provide as much evidence of correspondence that you can, that demonstrates the development of your relationship, from initial stages until the current date. Examples include letters, remittance slips, e-mail, and chat sessions.

So, my question is this, since we "communicated each night" through video SKYPE I did not send many emails. Has anyone had to explain this issue to the embassy?

What can I do to provide more evidence of our correspondence if SKYPE is our main source of contact?

Do you have anything like this? (This is what we showed):

Copy of Brazilian visas from passport
Copy of stamped entries into Brazil
Copy of teaching certificate from Brazil
Copy of both sides of Brazilian residency card with translation
Copy of Flight Coupons and the itinerary from last trip
Receipt from hotel and business card with translation
Pictures (6) from 2004 to 2006
Copies of credit card showing we bought on-line calling cards
Copy of one phone bill

....among others but I can't remember now innocent.gif

What can he put on his G-325a under fathers name? can he just put none?

Will this be a problem???

K-1 Fiance(e) Visa Process & ProceduresWhich name to use as a middle name G-325A
QUOTE (jj7000 @ Nov 29 2009, 01:20 PM) <{POST_SNAPBACK}>
Hi,

I need to know on the portion of first, last and middle name.

Because my fiance has a first name and 2 last names.

For example:

Mary Sanders Cruz ( Sanders 1st last name and then Cruz is the 2nd last name)

I am thinking to use the last name in the middle but I just want to be sure.

If "Sanders Cruz" are her surnames then list them both as such on the G-325A. My husband has no middle name and has 2 last names (as do most Latin Americans) so that is exactly how we listed it.
Later, when he was given the K1 visa, the U.S. consulate chose his first name as his middle name (which we use here in the U.S.), but that was their decision.

If we move back to Brazil he'll be using both names his surnames again.

Hi,

I have my artinerary, my hotel receipt in Manizales and pictures together. I have reciepts from restuarants but they do not say the name of the city. My strongest evidence outside of the pictures is my hotel reciept. It is in spanish but it shows the name of the hotel and my name and the name of the city . Does this need to be translated ( the hotel reciept)?

I some kind of way lost my little parts of my boarding pass. I have one boarding pass from houston to miami and then miami to bogota. But I don't have the boarding passes to bogota to manizales. My fiance lives in that city. I do have the luggage labels that shows my luggage went to Manizales. Do you think they will accept this?

Does it seem like I have enough evidence?

Do you all think I need to send ewvidence of an ongoing relationship?

You need to show as much proof as you can that you were in the same country (city) at the same time - the time you claim to be there. Do you have credit card bills showing you were in Manizales? ATM receipts?

I sent in a hotel receipt and it was in Portuguese, and although I speak the language, I asked a friend to translate it for us. We also sent in proof that I worked in Brazil, an itinerary, boarding passes, copies of my visas into the country, copies of passport stamps, pictures, one affadavit from a mutual friend, etc etc.

K-1 Fiance(e) Visa Process & Proceduresfiance letter as wife
QUOTE (reeses16 @ Dec 6 2009, 07:08 PM) <{POST_SNAPBACK}>
You should not submit any e-mail where you refer to each other as husband and wife (double and triple check anything you plan to submit).

Sure you can block it out, but I think any person who reads it could use context clues to figure out what you blocked out. Its up to you, but if you submit those e-mails you need to make sure you and you fiance can handle the potential consequences (denial of K1, many more months of separation, cost of traveling to her country and getting married there, reapplying for spousal visa). Or you could NOT submitt them and then you don't have to worry about those things.

Good point reeses, the OP could just NOT submit them. By the way, I remember talking to you months ago about our spouses working in the U.S. I hope yours has found a good job.

I also suggest NOT including that. You are allowed to block out certain parts of your e-mail so if you still want to use those as proof, do so, just use a marker to block them out.

You don't want the consulate to get any ideas, even if it's cultural to say "husband" and "wife" before marriage. I understand that because it's common in Brasil as well, but not a chance I'd take if I were in your shoes.

Good luck with your decision.

Bank of America gave me a hard time with this. So, I just brought the letter (including the amount) from when I opened my bank account. The consulate didn't even ask for it - or for my 2 years of W2s - but I think it's because I'm enough above the poverty level.

Hi again, sorry to open a new topic again on something that has already been there - sort of.

So I'm a certified Foreign language correspondent/bilingual secretary (+ in possession of LCCI Business English, TOEIC certs, etc.) and would like to translate all documents which I will have to bring to the embassy myself and maybe even sign them since I feel like .. well translating is what I've been doing for the pas three years.
For the I-129f I also translated everything but had it signed by one of our colleagues who is fluent in English and German. Can't I just do that myself this time around?

Thanks for all the help!

Many people have so I'd say why not? (You don't have to be a translator, just explain that you're fluent in both languages).
I asked a friend to translate for me since I wasn't sure that I could - and then I did the same for her and her husband's case.

Like Laura, I also had a certified translator translate my husband's BC while we were in Brazil. It was cheap and fast! I still have it and used it for AOS.

Good luck!

I'm an Egyptian and my fiance is American(my petitionairy) , he asked me for my middle name to fill in the I-129F form, we don't have middle names here, just about 4-5 names, should I use all names (except the very first and the very last) as my middle name then? Copy all names in my birth certificate?

I wonder if there are other Egyptians who dealt with that that can help me.

Thank you!

My husband too is egyptian and has multiple names. We put the exact names that are on his passport on all his documents so that way they will all match.
So that means on the applications, his first name, next name as middle, then the two next names as his last names. Once he comes here to the US then we can straighten out what names he will go by. First step is to make all the names match.
Good luck with your journey.
