K-1 Fiance(e) Visa Process & ProceduresNeed some advice
This actually shouldn't be a huge problem. If Scotland is anything like the US his school should have a record of vaccinations given as a child (since many are required to enter the public school system). If not, explain to his doctor the reason for needing the documentation to back it up he may simply ask for your fiance's public school records. Still if no luck with either of those your fiance may need to bite the bullet and pay to get the vaccines redone. If that is the case there is nothing that is on the list that he cannot get as an adult. MMR is fine to have twice in your life and for some people it is required (ie military and some hospitals) Tetanus will have to be done every 10 years anyways. When you go to the doctor ask them to do a titer on what they can (chicken pox, hepatitis, tetanus are just a few) and to just do injections for the rest. Just tell your fiance to take a deep breath and prepare to become a human pin cushion!! Best of luck!!!

K-1 Fiance(e) Visa Process & ProceduresI-134

Good morning,

I'm filling out my I-134 for my fiancee and have a couple questions:

1. It asks for my savings. If I don't have a savings account open, and I just dump all my money in my checking account, should I put the amount I have in my checking there or leave it at $0 because it's not officially a "savings account"?

2. For personal property, should I list my car even though I am still paying off loans for it?

3. For stock - I was given a few when I was born, but it's not worth much and I've never done anything but cash the $1 checks I periodically get from it. I wouldn't even know where to look to check what I have. Should I leave it blank as it's not worth noting?

4. For the date I submitted the visa application for my fiancee (question 10), do I list the date I sent it or the date they actually received it?

Thank you very much for your time! And I hope these answers help people as well!

1) depending on how much you have in your checking it may be smart to open a savings account and deposit the money in there to show that you are "planning ahead" (most banks allow you to open a free saving account when you have a checking account)
otherwise put $0 because like you said it is not technically a saving account (though it does look kinda bad)

2)personal property is property that you own. This could include your car even if you have a loan as long as long as you are not "upside down" on your loan and what your car is worth is more than what is owed on the loan.

3) you should be able to go to the bank that the stock is from and get a statement saying what the "cash value" is if you were to cash out on it today.

4)I put the date USCIS told me it was received by them

Also research thoroughly the requirements to make sure you qualify to fully support your Fiance. I had to have my parents fill one out and that is much better than to go through the whole process just to be rejected.

Good luck!!

Use the co-sponsor anyways it is always better to be safe. The last thing you want is to not do it and need it.

K-1 Fiance(e) Visa Process & ProceduresEmployment/co sponsor info?
The affidavit of support AKA I-134 isn't needed along with the I-129F if you are doing the K-1 fiance Visa. They will want to see that during the interview at the embassy which is a while down the road for you.

K-1 Fiance(e) Visa Process & ProceduresWhich form?

Generally the I-134 is for the K-1 interview, and the I-864 is used later for AOS after you are in the US and married. There a few exceptions, and some consulates ask for the I-864, but it does not appear to be that many. The Costa Rica Embassy site states that they require the I-134: http://costarica.use...v_onbehalf.html

Ask the embassy directly, or ask around VJ for those that have been through Costa Rica already if they allow joint sponsors. You and your mother will each fill out your own I-134 and provide supporting documents.

THANK YOU!!!

Thank ya'll so much for all the help!!!

K-1 Fiance(e) Visa Process & ProceduresBest way to file/Sign paperwork while seperated by long distance?
You need a physical signature and photos are always beneficial! My fiance simply printed off the forms filled them out signed them and sent them to me via mail (from Costa Rica he had to drive 2 hours to the capital because the mail system is so crappy and paid $46 for DHL to send them!). For the I-129F you also need passport style photos of the both of you so have her mail you those as well.
Good luck! You have a long hard process ahead of you but it is well worth it in the end!

I know everybody else said the same thing but be patient and enjoy the time planning your wedding. Trust me you think waiting now is hard... wait until you get your NOA2 and you are waiting on the embassy to call you... It is just torture!! But it gives your fiance and you time to pick up some overtime and start saving up for the wedding. It's a long hard process but totally worth it! Keep reading and researching and get the immunizations portion started. Good luck and welcome to the hurry up and wait club...

Surprisingly the people at the NVC are very very nice and are willing to continue to see if you have a case number yet. I would call them tomorrow and if you still don't hear anything call them the week after. Patience is key in this process but there is nothing wrong with being persistent.

K-1 Fiance(e) Visa Process & ProceduresPrevious Visa Tries
Well at that point in time his intent wasn't to immigrate it was to continue our relationship. We didn't want to jump the gun and assume that things were going to work out so we took it slow. We tried explaining to them that at that time we were just wanting him to have a visa to be able to come and visit me because I was looking at possibly going on deployment. We will continue to gather strong evidence to prove our relationship is legit.

K-1 Fiance(e) Visa Process & ProceduresPrevious Visa Tries
My fiance and I are currently trying for a K-1 visa. Prior to filing we had attempted twice to get a visitors visa for him to come visit me in the US and both were denied. For the first visitor visa I went with him and we were upfront and honest about our relationship. The second time his company was asking for him to come to the US for training but due to his previous interview with me and him confirming that we had an ongoing relationship it was denied again. Now as we are waiting for an interview date I am becoming more and more worried that these previous visa tries could affect the decision on the K-1 visa. Am I being silly for worrying?

K-1 Fiance(e) Visa Process & ProceduresAfter my fiance arrives to the US
Hello to everyone,

This is my first post on this forum. I?ve been reading posts here since the first day I decided to send out a petition for my fiancé for K 1 Visa.

Our NOA2 was approved on May 9 and we?re currently waiting on the answer either from NVC or the embassy.

My question pertains to the actions that we need to take once she comes to the U.S.

Here are the steps that I assume we need to take first after her arrival:
1. Apply for marriage license

a.I found out that we can apply for marriage license at the local circuit court. I live in Florida and on their website it says:

"Both parties must provide proof of the following: Age: both parties must be at least 18 years of age. Identification: in the form of a valid driver's license, state ID, military ID or passport. U.S. citizens must provide their Social Security Number. Non-citizens may provide a Social Security Number or an Alien Registration Number issued by the Immigration and Naturalization Service. An application form must be completed. If either party has been previously married, you must note on the application how and when the marriage ended. The nonrefundable fee for the marriage license is $93.50. This fee is reduced to $61.00 for Florida residents who have completed a premarital preparation course."

Since my fiancé won?t have the SSN ( I want to apply after we get married so we don?t have to do it again to change name) we can use her Alien Registration Number. On NOA2, above her name there is a number that starts with A##### I believe that would be her Alien registration number which will also be visible once she get the green card. I know these rules vary from state to state, but is there anyone who is from Florida and went through this process?

b. We want to get married by deputy clerk first and have religious wedding later on

2. Apply for SSN

3. Send AOE package ( I-485 to adjust status and I-765 for employment)

4. Now we wait for interview and then for Green Card (which will be valid for 2 years)

a.What do we need to do before the 2 years Green Card expires?

Are these steps correct?

Thank you for your help

Just wondering if anyone knows of an instance where an I-129F fiance visa petition has been denied by USCIS?

We're one of the unlucky ones waiting since December for an answer to our petition. Would be nice to hear something...

I've read one case where K-1 visa was denied during the interview. It was denied because of the age difference between the beneficiary and the petitioner which was 30 years.

K-1 Fiance(e) Visa Process & ProceduresPlease help, question about embassy and consualte

Sorry, my Polish is pretty basic, but I think I got it (and I can't really write in Polish). Many times, you will get contradictory information even from the Embassy/Consulate.
I believe you are correct and NVC will send it to Warszawa directly, the main reason I say this is because when I lookup my application, I had never seen anything sent to Kraków! (anything going to Kraków goes to Warszawa first).
The web site was pretty clear to me, that is why I noted that the interview will be in Warszawa. As for the DHL tracking number, NVC does not get you one; here is what you do (I didn't come up with this, other members did):

1. click on this link ---> http://track.dhl-usa...?nav=TrackByRef

2. Using the date provided from NVC of when your case left NVC, (in our case it was May 20 2011). Enter reference number as : EXP 20 MAY 2011A exactly as is with the spaces and uppercase
3. Put in a range of dates in the next field of information and click TRACK. In our case, I used From May 19 to May 23 (because it was a Friday). The key here is when the package was ready to be sent, because it is done the day before, so in fact our application actually was picked up on May 23, but was ready on the 20th

After that you will get a list of packages sent from the Department of State on that date. Look for the country where your interview will take place. In our case, I looked for Warsaw, and I found a package on page 2 of that list. You can then click on the red tracking number for more details of the package sent and it will tell you if it has been delivered or just arrived to the DHL facility in that country etc.
If you don't know the date (because NVC does not update things until the application has been sent), you can play with dates. IN case you see more than one going to Warszawa (which is not very likely), it is not possible to tell, but at least you will know when they arrived.

One more thing, you want to keep calling NVC until they tell you the application is sent, because they will be able to tell the new case number, that will be 'WRW' followed by numbers. That is the number you would need to use when dealing with the Embassy in Warszawa.

Good luck

Ok I think I see it !!

The NVC told me it was forwarded on June 3

I did a search by EXP 03 Jun 2011A

It shows there was a petition sent on June 6 to Warsaw. So I think it was ready on the 3 and send on June 6, like it was with your?

Thanks

So I'm entering EXP 03 MAY 2011A on the DHL website and I'm putting the date range from June 1 to June 7 and I'm getting a message that

Your petition will automatically be forwarded to the appropriate embassy, no worries at all. I had the same problem, I listed Bishkek, Kyrgyzstan as the embassy where my fiancee would interview not even realizing that all immigrant visas are processed in neighboring Kazakhstan. Ech... Jeszcze skubance zbieraja pienaidze za zwyklad informacje.

Jak NVC przesle do Polski petycje, to oni dadza mi jakis Tracking Number na DHL zebym mogl sprawdzac gdzie ona jest? Jeszcze raz dziekuje za pomoc. Pozdrawiam.

K-1 Fiance(e) Visa Process & ProceduresPlease help, question about embassy and consualte
My Fiance lives in south Poland and she was told by the consulate that she belongs to Krakow's consulate based on her location.

Consulate is in the south part, and embassy in the north part. In Poland K-1 interviews can only be held at the Warsaw embassy.

She also told me that they told her at the consulate that the petition gets first forwarded to Krakow's consulate from NVC and then they send it to Warsaw embassy because of where she lives. I assume that if she would be living in the north then the petition would go straight to Warsaw embassy.

I'm curious if this is true. Because when I called NVC they said that they always forward cases to embassies not consulates.

Now on the 1-129f, I put for the last question that my fiance will apply for visa at Krakow consulate and on my NOA2 notice it says that the case will be forwarded to the consulate in Krakow. Back then, I didn't know that k-1 interviews can only be done at the embassy in Warsaw.

So, now once the case will leave the NVC office, is it going to be send to the consulate first and then to the embassy, or is it going to go straight to the embassy from NVC (as NVC claims)? Who should she be calling to check if the petition was received the consulate or the embassy?

I know that rules are a little bit different for all countries, but has anyone had a similar situation in theirs?

Thanks for help

I met my Fiance in September of last year and we have about 7-10 pictures from the time we met.

I wasn't able to come and visit my fiance since then, because I don't get vacation from my job until September of this year.

Our interview will be somewhere in July.

Do you think this might be an issue that I've only visited her once? I know that the requirement is to prove that we have met within the last 2 years, but it doesn't specify how often.

What forms should be send back to the Consulate? Only checklist

(DS-230 is NOT required, this is a common misunderstanding, since the checklist is issued for both K1, K2, K3 and other visas. DS-230 is required for immigrant visas. K1 visa is not an immigrant visa)

K-1 Fiance(e) Visa Process & ProceduresI-134 instructions on Supporting Evidence

I think people are trying to submit more than is needed to feel safer. I followed the instructions for the form and I also checked with my embassy.

My embassy lists only letter from employer and bank statements and even they are listed as "optional but recommended". It says nothing about tax returns. I still made a copy of my last year W2 and 1040 "just" to stay on the safe side.

I'm sure if you make over the poverty guideline you will be fine in regards to the financial support.

I always recommend to check it with your embassy. Everything is listed on embassies websites.

Good luck.

K-1 Fiance(e) Visa Process & ProceduresW-2 from last year does not reflect well
Just received notice that I'll be getting the NOA2 in the mail (yaay!) two days ago and Sian and I are looking ahead trying to make the road as easy as possible coming up. I'm looking over the requirements for the I-134/I-864 (as I've been told to give as much info as the latter needs since I'll be doing that eventually, anyway) and I'm coming up with a problem concerning the poverty line.

Last year, I made less than the $18,387 required for two people and that is reflected on my W-2; however, shortly after the tax cycle last year, I received a raise that would put me OVER the aforementioned number. My boss is willing to back this up in his letter and it reflects on my last three paychecks, but I'm still asked to provide a W-2 that doesn't reflect this.

My question is: Will this be a problem moving forward? Should I get a co-sponsor? Or should it be ok since all additional information points to me making plenty of money?

Thank you for your help!

K-1 Fiance(e) Visa Process & ProceduresPassport Photo for Foreign Fiance

My fiancee just applied for and received her Colombian Passport today (same day processing). When she had her Colombian Passport photo taken yesterday, she followed the guidelines for Colombian Passport photos. Tomorrow she is getting two photos that we will use to attach to the duplicate Form DS-156, and those two photos will follow the strict guidelines as set out by the U.S. State Department (as in the link provided above Tyeger87).

Getting the photo for her Colombian Passport was a piece of cake; the photoshops are quite familiar with meeting their own country's requirements. Now, given my experience with other tasks that need to have some sort of precision or exactness, getting the one tomorrow for the Form DS-156 that meets the requirements of the U.S. State Department may be a major you-know-what!!!

To clarify, the photo being taken tomorrow will first be used to include with the I-129F application package, but I'm going to have her get several so we can have a couple extra on-hand when needed for the DS-156. I'm cautiously optimistic that we will be able to get a photo tomorrow that meets the requirements of the U.S. State Department (I've printed out the guidelines and sample page to take with us to the photoshop, lol).

K-1 Fiance(e) Visa Process & ProceduresK1 Qualifications
You can tell her that she's not applying for a tourist visa where they look to her economic resources and ties to Colombia to overcome the presumption that a person will stay in the U.S. and not return to their home country. Instead, you've petitioned the U.S. as a U.S. citizen to allow her entry into the U.S. for the sole intent of her getting married to you within 90 days. They mostly just want to make certain that your relationship and intent to get married is bonafide (and of course there are other things they look at such as you meeting the financial support requirements for your family size, criminal history for you both, her medicals, etc.)

Other than verbally telling her to reassure her, you could always suggest she read the K-1 Visa requirements for herself (I chuckle a little saying this because I've suggested such to my fiancee, but in the end she decided to just trust that I read them, lol).
