Sent of I-130, preparing for next steps....My wife has worked in Taiwan and before she left I had her get a police clearance for her Visa. We got married when she returned to the Philippines, but looks like she may be required to have clearance in her maiden and married name. Is this correct? If so, does anyone know the easiest way to get this now? From what I understand Taiwan is not the easiest to deal with.

Posted Imagehappened to me. the only difference is I did not renew my passport since it will expire on 2015 so I got my visa with my maiden name on it and I was told that my green card will have the same. My husband used both my maiden name and married name (first name, maiden name, married name) when he applied for my i130 Aug. last year. all my documents had the same name pattern on it except my passport so when I went to my medical they asked a copy of my marriage cert for my name to be changed to my married name on their record and because paranoia is my twinPosted Image ,a month before my interview I started bugging my husband about calling the embassy and asking them if I wouldn't have any prob with it. the only thing they told him for me to bring during the interview was another NBI clearance on my maiden name ( we submitted orig copy of my married nbi clearance prior to that). they didn't make a big deal out of it during my interview in fact no one bothered to ask about it Posted Image.

Would love to here from some more people regarding this matter. I have searched the advanced search and i'm finding lots of confusion. I simply want to know, if I filed the I-130 in married name and sent copy of passport in maiden name, will this carry us through to the end. We really don't care what name the visa or GC comes in, but we don't want to get caught at the end needing something. Can the NBI process be done without name change, if we need police clearance in both names?

I am very confused about the name change issue. My wife has a valid philippine passport valid until 2015 in her maiden name. We filed I-130 in married name with copies of maiden name passport. Does this passport have to be changed to married name at anytime before coming on CR1 visa? Will she need to have changed to get NBI for both names? We just want to leave it as maiden name though the process if possible, any thought?

Me and my wife were married in July in General Santos, Phillippines. We waited 2 months and got the NSO marriage certificate from Manila. She also was required to to the CFO before changing her passport. She just completed that yesterday and cost 400 peso. There is an office in Cebu. They will issue a certificate to use for passport change and when you get the visa you will need to return with passport and get the sticker attached for travel to US. I have hear mixed reviews on if the marriage certificate is required from NSO or you can use the LCR copy. Seems like they should except that until you receive the NSO and can so that at the interview.

Wondered about that too. If she can use the VWP, why do you two meet in Canada/ plan to get married there? Why not the USA? It's perfectly legal for her to come to the USA and get married here she just cannot stay longer than the 90 days given on the VWP.


The problem is you cannot legally enter the US on a tourist VISA with the intention of getting married. And saying anything other than "I am getting married" would be fraud. And just saying that is going to be an immediate denial. For those of us that are trying to do it legally, immigration really leaves us with no choice but to be separated from our loved ones until the process is complete. Unless you can afford to stay or work in her native country until everything is complete.

More tips on the interview below……

1. Speak slow, and answer questions in detail. Stick to the question and don’t veer off the subject. Respond clear, and descriptive. Should not be longer than one minute to answer, but be sure to explain yourself.

2. If you do not know the answer to a question, do not lie. Say, "I don't know the answer to that at this time." or "I don't remember."

3. The answer to many questions will be in the papers that were sent in the petitions. Questions like, "what are your wife's parent's names". They will expect you to know the information given in your petitions. Review everything in your paperwork with your husband before his interview, and do a mock interview to see how the information may be applied.

4. Avoid saying "I think . . .". Women do this a lot. The examiner will expect you to know not be unsure, of your answers. Alwife, avoid adding "umm", "you know" and "ahh" type fillers to your speech.

5. When applicable, don't just state, demonstrate. If the examiner asks a question that can be answered with a document or photograph(s), provide it along with your answer.

For example, if the examiner asks, "What does your family think of your wife?", give them a picture or two with your answer; "They like her very much. Here is a picture of her with my mother at my home."

Or, "How many attended your wedding?" Answer, "(give a number, then say) We have wifeme lovely wedding photos of our guests having fun. Here are a few that I can show you."

6. Give American answers for dates and times. 12/24/07, not 24/12/07.

7. Dress well, but not overdressed.

8. Try to appear calm, well organized, and friendly. Nervousness raises suspicions.

9. Remain focused. If the examiner makes jokes, smile and enjoy, but do not make jokes too.

10. Make proper eye contact when conversing with the examiner, and try to control your own facial expressions assure that your face remains pleasant and cordial.

11. Be audible (means speak up) your examiner doesn't have to ask you to repeat your answers.

12. Organize your papers in a way that will allow you to retrieve them easily and quickly. Examiners appreciate order and someone who doesn't waste their time.

13. When the interview is over, always ask for the results. "What should I now tell my wife about my visa status after our interview?" Before you leave, have them explain any papers they give to you and/or any procedures they will be taking to complete your case. Try to get the examiner's name for future reference, if needed. Write it down. Remember to verify the phone number so they can contact you to pick up the VISA.!@! hurray@@!!!

14. Arrive early to the consulate, but always be prepared to wait for a time past your scheduled interview appointment time. Be careful of thieves around the consulate if you have to carry cash. Bring ID; you cannot enter without it.

During the ceremony the person marrying us explained to us the different marriages that are legal in Nigeria. She stated that in the Nigerian traditional wedding, more than 1 spouse is allowed.

I have spent alot of time reading on this site and not posted but have found alot of useful information and very helpful people. I have also seen alot of judgemental people as well. I know that this post will attract that kind of input but please unless it pertains to my question let me decide what to do with my marriage.

Okay here goes. I met my husband a few years ago online. We talked for awhile I went to see him met family and friends. We were married had a few more visits and are NVC stage and waiting for his interview for him to come over. Everything has been going good and we have used alot of information from here to get where we are. However we have some red flags big one is age difference I am much older and the ablity to have children. I am sure like all of you know this is a difficult journey and we have had some issues off and on. We had one major issue a while ago and that was he had cheated on me after our marriage. He confess to it i would never have known if he didnt sense he lives there and I am in the states.

This was heartbreaking and I was sure that we would never make it thru this but we did. I recently went to see him to get the rest of the documents we needed for NVC and just spend some time together. We had a very good time together and it seemed that our relationship is stronger than ever. And then he shared the news with me that the girl he had the affair with was pregnant and she told him it was his child. I almost died with this news. After the shock wore off I talked with my husband and his mother. She was so great to have around. It seems the girl doesnt want to keep the child and my husband thought since we are not sure we could have one of our own we could raise this child together. Since his interview we hope will be soon and the child is not born yet his mother is going to take the child to live with her while we sort things out and decide what to do. My husband is planning on getting a DNA test to prove the child is his before his mother takes it. So this may prolong his travel but we are not going to stop the process since he has 6 months to travel once he recieves his visa.

Okay here is my question. On the forms we filled out we did not list any children for him because he didnt have any and we are not sure if this is his child or not. So should we bring anything up either by amending the forms or at the interview about the baby. If the interview is before the babies birth do we say he may have a child or should we say nothing at all until we know for sure. If the baby is born prior to the interview and he finds out for sure it is his will there be an issue if it is not on the form. Also if he gets his visa before he knows and then finds out the child is his if we file for the child to come to the states will there be a problem because we didnt put it on the form to follow him here. I am so confused on what to do and I dont know if anyone has been thru anything like this I sure hope not.... Anyway thanks for hearing me out and any help about how to proceed with the interview and paperwork will be greatly appreciated.


I feel bad that you have to go through all of this problem in your marriage. I will keep my opinion to myself about your relationship as that is not the question you asked. It is my opinion that if he were to mention any of this to the CO at the interview, he would be denied. I think that the CO will believe that your relationship is for immigration purposes, as your hubby was not faithful and his affair produced a child. You must also consider the red flags you have mentioned and the fact that Lagos is a tough embassy to go through. However, with that being said I do believe that if he finds out the baby is his and he gets approved for his visa, you could then file an I-130 for the child as his/her step-parent. The process will be the same as the process you went through with the hubby. Good Luck to you

Hi, as you all know my husband was denied at his interview. The Congressman notified us that our petition was returned on 11-21 and we are just waiting to hear from the USCIS. Any pointers on what to expect, from anyone who also went through a denial and a reaffirmation. The other question I had was, if my husband decides to move out of the country how would I go about changing his address, and would we be able to get our case transferred there for his second interview? My husband and I have had two interviews in Albania within a week. And we were asked a good 100 questions a piece,and still they didn't deny us or approve us. I was sure we would get our answer at the second interview. At first interview they said we had all documents they needed but needed time to look them over. ( letter of bonifide marriage,etc.)They called him next day and scheduled us to come back in following Monday. After hours of waiting and questions they say we are missing 2 documents... why couldn't they tell us this on the first interview? They said mail them in and when we get them we will call for further proceeding..... I am glad they didn't deny us on first interview but the suspense is driving me crazy.I never heard of interviews going this way. Has this happened to any else. Do you think we will be approved and How long are we waiting for them to call after they receive these missing documents. Can anyone put my mind at ease. They are sucking the life outta me.

Call NVC 1-2 weeks after you receive your Noa2, if you signed up for e-notification that would be better cause you'll know earlier rather than waiting for the hard copy. Their number is (603) 334-0700

Better to call them. Our case was closed for weeks before we got a e-notification or NOA2.

Federal income tax return for recent year would be fine. However you may send  tax return for three recent years if you think these will help you qualify. 

 

If you are self employed it is required to send a "Proof of Self Employment"- that could be a recently dated business letter executed by your company (on a business letter head), or a letter from your accountant or your business licence etc.

I think you have to use form i-864 only. Submit it along with other supporting docs. If you are showing any sort of assets, make sure you are providing proof of that assets, otherwise NVC will send you a checklist again to provide proof.

I "lived" with my then fiance for a month here and a month there, but how to define "lived" was very difficult, especially since she was working in 3 different states in 6 months. There line between "lived" and "visited" is very blurry. I just put the last address at which we both lived together for more than one month.

Hi everyone! My wife and I were married in Ottawa on 12-3-2011 and we are just starting down the visa road. I will probably have a lot of basic questions along the way and any help will be appreciated!

My question right now pertains to section 21 in the I-130. It asks for the last address that we lived together. We have not lived together other than visits I have made to Canada of less than 2 weeks duration. Can I fill in this section with the words "have not lived together" or is there a better solution?

My wife (Canadian) and I were married in Ottawa on December 3, 2011 and the officiant said that she was including a note with the marriage license asking that the certificate be expedited for immigration purposes. We received the marriage certificate about 2 weeks later. I used a copy of this with my I-130 application.

As a side note, the marriage certificate is a scaled-down copy of the marriage license printed on legal size paper and bearing the seal of Ontario.

i am sooooooooooooooooo frustrated..................i have been trying to call the visa specialist line all day. I have been on hold on 2 phones waiting to get thru.............as on right now on one phone i have been on hold for 1 hour and 9 mins and on the second phone i have been on hold for 2 hours and 41 mins...........


do agents actually answer the phone and is it just a loop? i have wasted half of my day with this......................

HI all............... I am new to this website ..........can someone PLEASE tell me generally how long it takes for the interview date to be set up once nvc completes case? My case was completed on Dec29 2008 and i still havent received anything. I know it may sound like im being impatient but I got married in jun 2007 and am still waiting for my husband to get here. Its a shame it takes this long for a US citizen to bring their spouse over.


Where can i can to get info about the interview date. I called the visa bulletin number on the NVC website but that is sooo hard to understand.

I called the nvc info line and all that says is "case was completed on 29dec2008 pls allow 8 weeks for further info"

Hey...im not sure what the issues are for South Africa... but I work for an International Airline and there are soooooooooooooooooooooo many fraud cases of people meeting their finance's in South Africa... they send them all kinds of money and cash and then they wait for them to show up at airport and no one shows up and they are out money with a broken heart and a broken wallet.......

we must get about 3-4 calls daily from US citizens sponsoring fiance's ....

I dont know ur situation BUT consider this a warning because its heartbreaking to tell all these customers that no one is listed under the manifest under the given name........... by law we cant give passenger manifest info...but with saying it directly and feeling bad for the receiving party........... i usually give them a hint that basically they been scammed...........

Who is the petioner? You or wife? If you are the petioner, provide documention that shows your are a USC, example: birth certificate, US passport, a copy of proof of naturalization etc.

You need to submit two G-325A forms, one for you with your signature, and the other with your wifes signature. You also have to submit two passport pics, one of you and the other your spouse.

:yes: When you file the I-130, you must complete and send the G-325A form with it.

Thanks for the info I, have called many times but we are still waiting for that letter to arrive and take it from there we have been at the embassy before and they are not nice I just want this to be over I am positive the stress that comes with this process have made me get worse I travel to see him every month since june 2011 but as time flies it gets difficult

Our case for my husbands immigrant visa was expedited due to medical reasons it is now at the Embassy when I called the Visa specialist (I first called the Embassy and paid the $7.00 and they couldn't find my case) the visa specialist told me that a letter was sent to my husband on the 24th of this month with an open interview letter i asked what was that she could not explain. Since she saw the case i gave the Embassy a couple of days for the case to appear in the system i called yesterday and they said that my case was not eligible for an interview date because of my priority date (1-23-2012) I explained that my case was approved for expidite and what the visa specialist told me he had no clue what he was saying or what i was talking about.He asked me if i was a U.S. citizen i said yes and he told me to call the embassy directly. I called and they just gave me an email address to send my concerns????? Does anyone know anything on the open appointment letter and what it is. I don't feel like spending $7.00 to get conflicting answers.

:help: If anyone has the answer pleae let me know. I was wondering if they allow the spouse to enter into the interview (even if I was to say nothing) or will my wife have to do it alone. Is it better to join the spouse during the interview. Her interview will be in CARACAS VENEZUELA and I just want to know if I could be there with her when she interviews. Also, If I was there will they interview me as well? Any information you have would be appreciated
