You most definitely need to send in the original military records, marriage certificate, birth certificate AND the english translations.We actually got a RFE because my husband sent in the certified engllish birth certificate and not the arabic one. So we had a month added on to the time at NVC because of that. He got all his original copies back at the interview.

NO, I dont have a problem of our petition, I was just interested in all the info I've seen of RFE listed here requested by USCIS. As for sharing, Im a straight, upfront person, If I have an issue of my petition, I would put it out there.
As for past cases since 2009, Ive just never seen so much on RFE's before posted on this site.
Just love how a person posts a innocent question, and its turned around of they have something to hide.

I know what you mean about the RFE's though. We even had one when we were at the NVC level. I had only seen just a few at the USCIS level specially since we all love to frontload our I-130 files.:blush:

Congratulations on your fiance possibly getting a scholarship to a school close to you. I do have to ask, has your fiance all ready applied for a student visa? Does he know if has received the scholarship yet? Only reason why I ask, is because if you have all ready petitioned him/her to come over on a K1 visa, this will flag him/her if they were to file for a student visa. Also if they were to come over on a student visa, the uscis ask them to file at least 120 days before the actual time required for the schooling. Just like the fiance and spousal visas, the student visa applicants has to go through background checks and make sure they qualify to receive the visa.

hello there VJ'ers...

i want to know if anyone who married anyone from egypt and there husband had a previous marriage and listed as revocable divorce, what stuff did you bring to prove for an NOIR that this divorce is legal and binding.

reason beings, they trying to say my husband divorce papers is something wrong and not for immigration purposes.

in egyptian/islamic law, a divorce is only revocable for the first 90 days when the divorce is filed. in which time to see if the woman is pregnanat or is called a cooling off period. if the man wants to take his wife back then he has to do it before the 90 days finish, that is what makes it revocable, before the 90 days waiting period.
if after the 90 days he does not take his wife back then they are divorce as of the day they filed for the divorce.
also keep in mind in egypt/islam the man can only marry the same woman 3 times. the listing as revocable is a count for how many they have between them.

now my husband divorced his ex-wife back in may 2008 and he let her go back to her parents...she was the one who asked for the divorce. 2 years later, him and i marry 2010.
they want proof that he did not divorce her for immigration benefits.

they want his divorce paper to say final or irrevocable.....cant do that because that means he has to remarry his ex-wife 2 more times and he has no intentions to do so....lol.
his divorce papers say "bill of divorce",,,so what is the difference from that and decree of divorce???

the proof he will bring...
a letter from 2 lawyers saying his divorce is a proper and legal divorce.
a timeline showing when he started with his ex and when they finished, it will also have our marriage in it and his daughter from ministry of justice and civil status department.
a letter signed by 9 of his close friends and neighbors vouching for him and me.
i have other papers here to send as well.

any help and ideas will be greatly appreciated.

i have until march 12 2013 to send it in by march 14 2013.


Once he got his divorce papers did he file it with the courts and get the official stamps on them? Then have them translated with the official stamps for the translations? I have a friend who actually married an egyptian man who was divorced islamically and had the papers but never got them recorded in the courts so when it was time for the embassy to ok the application they not only refuse to do that they also said their marriage at the ministry was unrecognized by the US because he wasn't properly "divorced" from his first wife. Even though the egyptian court recognized him as being single to marry his USC wife.

honestly it doesn't really matter when your case gets to Kingston because the NVC is the one who schedule's your interview and trust me your case will get there long before your interview date :thumbs: once you get case complete it takes 3-5 business days for them to forward your case to the embassy (sometimes longer :blush:)

Our experience was this.

The officer will ask some general questions but not embassy type of questions. Mostly your name, birthday, what town you are going to, husband/fiancee name etc. This is just to ensure you and your paperwork match. Mostly the officer will type info into the PC and look over your papers to be sure all is correct. If there is an error it can be corrected there and not cause you grief later on when you apply for your green card, ROC etc.

You have already gone through extensive screening/interviews before your POE by the embassy. I doubt you will have any issues.

My Mississippi B/C back is blank but a closer look (bottom back corner) revealed a certificate number same as the front. I almost missed that and sent copies of both sides. I doubt it would cause an RFE but you never know.............

I will complete my tax (in turbotax) as 'Married filing jointly' then select print and file (her SSN part will be empty). Get her to sign a W-7, get notarized copies (according to W7 instructions) of her passport (old and new). Then attach a cover letter explaining the situation and send it out to Austin, TX address (in W7 instructions).

As I have to go through this process (notarized copy or passport and other stuff) .... I am asking this (i hope it is not thread hijacking :D

1. Will IRS accept a notary from Malaysia (Hague convention country, listing here, but not a signatory of 1961 convention according to IRS) ? Or does my spouse needs to go to US Embassy and pay for notarization?

2. Same question for USCIS/NVC instead of IRS, if they will accept a Malaysia notary, for 'certified copies' of Marriage certificate, birth certificate etc, for RFE if that occurs.

On passport sized photo, there is only two, one for you and one for beneficiary.

Then as a proof of continual marriage, you can submit more photos taken together and other stuff ..... not passport sized.

no, you fill everything regardless of immigration or not.

Who is immigrating and who is not is determined by I-130, 325A is just a biographical information of all the applicants.

Filed for ITIN and 1040A at a IRS field office today.

I used turbotax online free edition since I donot have a state tax to file. Kept it blank (ssn field), review/alert caught it and reminded me I cannot e-file. Chose to print. emailed the PDF to her for sign.

Asked my wife for her passport to sent via fedex, copied it and notarized it here in US. Also included a signed W7 (line 2 as my address, line 3 hers) and a declaration signed by both of us mentioning she is choosing to be considered resident alien for entire 2011 tax year.

The IRS officer asked me a few questions about her status (if she was in US at any time of 2011, if she is eligible for a SSN, if she has any income). Then took the W7, passport copy, declaration, 1040A and W2. Said he will send it out, IRS austin office will contact me once ITIN is issued and if tax return is accepted.

1. Did you contact your congressmen (with all the release of information form and everything) ? If so, what ans did you get from them?
2. It is definitely out of appropriate time line for CSC IR1/CR1, what did the service request say? wait 180 days (which is 6 more months) ?
3. No RFE or anything?

Now this is getting me a little worried, since I am going through similar process -

I already filed for my wife as LPR F2A on Sept 06, 2011 (CSC), and I am on the naturalization process (interview on April 23, 2012) and planning to upgrade F2A to CR1.

I filed to save the I-130 processing time (as suggested in VJ before) - now in case I have to go through the whole I-130 initial processing again (that my PD gets the new day I naturalize and upgrade) - that will be a disaster - personally.

I guess I need to wait and see, and probably look at other/this thread for experiences of other filers.

You just need to include 1 year. But you need the "total income" number for the last 3 years.
 

 

Yeah - last time I sent the AOS to NVC, I included only once years. 3 years is optional - though certainly wont hurt. 

 

I am sending one year because I had the transcript.

Hi, a friend of mine asked me to to be a joint sponsor for his wife and 1 yr old child for IR-1. I understand I need to fill I-864 with Tax transcript. 

 

My question is, where do I send this I-864? Do I attach the barcode page on top and send it directly to NVC (just like I did for my wifes CR-1, I didnot need a joint/co sponsor)?

 

Or do I send this to my friend (which i find a little risky, I do not want him to have all my information - for privacy purposes) and then he send it to NVC?

I know this will not be the only question I have about this process but as we are just actually starting to seriously research it, me and my husband figure we would make a clear picture before we start filling out forms. My husband is Canadian and we are trying to get him into the country by early next year after he completes school. My biggest question right now is what do I do about the Support form if I am currently not working? At the moment I live with my family while I attend school. Is it possible to have someone else fill out the support form even though I myself is the one petitioning to get my husband here? My dad would be more than happy to say he will support my husband when he comes into the country while we get established but I was concerned I would have to have my father file ALL the paperwork if that makes any sense. Is it possible for me to be the sponsor but my father only be the support sponsor? Any help would be greatly appreciated,

He'll need to provide a copy of the payment arrangement and evidence he's actually making the payments. If he doesn't, they'll deduct the full amount of the lien from his current income. If he does, provide the evidence mentioned above, no worries.

Oh yeah theres a set up and everything with the IRS. Arrangements and what not set up through his accountant. So I'll just add the proof of that with his tax returns. I just didn't know if it would adversely affect anything. Thank you so much!
