This may be the case but it just makes it more frustrating for the people who have been waiting forever and no word on their petition. To me, it would be more comforting to know that they observe regular business hours than to know they work 24/7 but still there is such a disproportionate backlog.

Documents sent to the Dominican Republic can be in either English or Spanish WITHOUT needing to be translated. Any other langue must be translated into either English or Spanish.

 

They sent you back your Original Birth Certificate because they only need a "a copy" not the original.

 

It's probably something simple... Don't panic!  The good news is someone is actually working your case... :-D

Yes indeed DR man they are an intense embassy. I wonder why so much scrutiny. Ya'll aren't high fraud like my Nigeria. Hmmmm well now you get to prepare and learn alot . wink.png

 

 

Hey dwheels actually, DR is also considered High Fraud... even so much that if the Petitioner DOES NOT attend the Interview... it's often and automatic Denial... if the officer is kind or believes your honest/really in love... they will give a pass for an "Open Interview" and tell you to bring your Spouse/Partner back with you when you can... or it gets denied.

You asked for personal experiences...  So here's ours:

 

My Fiance is from the Dominican Republic (High Fraud). While waiting for our K-1 to be approved my Fiance applied for a Tourist Visa.

 

Like you he is not working, not in school full-time and does not have strong ties to his home country. He owns a vehicle but that's about it.

 

I wrote and signed a Notarized letter beautifully explaining that we understood it would be FRAUDULENT if he stayed or married, and would ruin our chances at his later legally immigrating on our K-1!

 

I sent along Pay Stubs, etc and promised that I would be responsible for his entering and leaving and all financial needs while here, that we just wanted to be able to plan our wedding like regular couples...  and he brought all his paperwork per the application.

 

 

The application fee was about $160 USD and the Consulate Officer at the window looked at EXACTLY NONE of the things he brought and rejected the visa in less than 2 minutes.  They were only interested in proof of compelling reasons for him to return.... Basically things that would cause financial loss if he did not return. Since he had none, they had no interest in considering anything else.

 

Several months later our visa petition was approved for our K-1 Visa though!! And we were approved at our interview 3 months after that... and now we are in AP and waiting for our Visa to be issued.

 

It sucks but here is the simplest way I can explain it is:

 

Tourist Visa = "I have NO INTENTION to stay in the US"

K-1, CR-1 Visa, etc. = "I have NO INTENTION TO LEAVE the US"

 

It's not impossible but in this case and cases like it, it is highly improbable.... you already told them you want to stay.

 

I sincerely wish you and your Wife, the best in your Journey but the best advice is as suggested by someone previously.. Find hobbies, find a temporary job or volunteer, find ways to cope with the absence and separation... Time and distance and expensive phone bills, etc aren't fun and pretty much everyone here DOES understand your pain... and we are ALL in a similar situation in respect to waiting and hoping and missing our chosen Loves, even if we see them more often, it still is gut-wrenching to leave them over and over, it never gets easier.... in fact I think it gets harder to voluntarily separate again... Somedays I laugh thinking that once he is here we will not ever be more than 10 feet apart!

The Expedite is only for USCIS to get it to the Consulate, after that it goes back to normal processing as far as I understand.

 

You'll see in my signature how long it took after my case was received at the Embassy.

Ahhhh Yes.. here is the "Important Note" I was thinking of...

 

Per the Visa Journey DCF Guide:

 

Important Note: A US Citizen living overseas that wishes to complete the I-864, Affidavit of Support, for their spouse (as part of the DCF process to get an Immigrant Visa) will be required to have U.S. domicile/intent to reestablish domicile to qualify as a Sponsor for the I-864.

 

In addition to having a US domicile/reestablishing domicile the US Citizen must either have employment that will continue (from the same source) when they move/return to the US, or, per the instructions on the I-864, the US Citizen and their spouse may use assets to qualify if the income requirement is not met.

 

In many cases however a couple may need to get a joint sponsor to successfully fulfill the requirements on the I-864.

Also you may want to look at the requirements for filing directly at the Consulate aka DCF (if possible at their US consulate) and what a USC needs to do to stay and live in Montenegro before jumping ship and heading to Montenegro.

 

Even with DCF filing my understanding is that a Citizen has to have a US Domicile to file for their spouse and several other requirements. Not to mention obtaining a Visa for long stays in the country and/or permission to work, etc. if that is a consideration for your situation.

 

Generally though count at least a year.. maybe longer.. if you get the Spouse Visa sooner that is an AWESOME GIFT!!! And you should treat it as such... :-D

Agree with the other posters...  if the petitioner is a woman they sometimes ask (checking for a sanky maybe.. :-p ) but it doesn';t show you have a "real or stronger relationship".. I think they ask for other reasons but I believe it's public records or gov't. accessible so YES .. be honest. It does not matter that you don't send it. 

 

I think many Dominican Men have too much "I'm tha Man" pride anyway to take money from their lady.. mine is anyway. :lol:

Yes just take copies, That';s all they want. If you don't have copy you can take the original and they will copy if for you.

 

For any USA Divorce Decrees it has to be the "Certified Copy"

 

For the Nacimiento del Beneficiary it MUST BE  the InExtensa version of Birth Certificate.. NOT the regular one. It says "IN-Extensa"  or "Inextensa" on the very top part of the page. Then it has to be certified.. (INSDO it's downstairs and around the back of the building)

Your best bet may be at this point to make a one or two sets of copies of all pages and send it back in as instructed requesting that they return it to you after cancellation. (It says here you can request to have it returned.)

  • Passports reported lost or stolen are invalidated and can no longer be used for travel.
  • If your passport is recovered after it has been reported lost or stolen, please submit it to the address listed on the back of Form DS-64. When you submit it, if requested - we will cancel it and return it to you. If not requested, it will be destroyed.
  • Once a passport is reported lost or stolen, it cannot be re-validated or used as evidence of U.S. citizenship.
