IR-1 / CR-1 Spouse Visa Process & Procedures2 Days Left

hi Shortie81,

I am from the philippines also and i expereinced my k-1 interview last december and it seems that i felt so nervous while my interview is fast approaching but my god, when i was inside manila embassy office already the consul, staff and security guards are very kind to me and to my pretty little girl. don't you worry, as long as your papers are complete nothing to be worried about. just relax and tell your wife to be more confident coz no one was denied in spousal visa as long as documents and relationship is genuine.

by the way....GOOD LUCK AND GOD SPEED!

I know she will be fine. She just got done with her Medical exam today and everything went fine. So she has tomorrow to rest and then Wednesday is show time. I just hope that we don't have to wait long to actually get the visa

Morning!! Sorry I overslept this morning.

Well Ali called at 12:21 last night and he didn't get his Visa.. the good news is that the interview went well. They said that they are waiting for his FBI name check and it can take 4 weeks to six months.

So we will just have to keep an eye out for his case number on their website. He said that all of the men there got the same thing, but the women got their visas.

He is going to email me what is on the piece of paper that he got. He said it was a blue paper that he has to take back when his name is on the list.

:) Thanks for staying up with me Rose and Kathryn :) Really helped me not go through the roof with my nerves!!

Now you would think that they would have completed that already but you know how fast everything moves. So So So slow, but on the bright side you are done with the interview and all the back and forwards , mailing of this and that. I hope everything speeds up and that you won't have to wait much longer than you have already.

3 hrs 58 mins until my wife's interview.....she is nervous..i am nervous...it is crazy

Man keep your son and send that flat foot biotch back to the craphole village in TacoLand where she's from

This kind of language really bothers me. It's insulting to so many people on so many levels.

I agree

Agree. That was completely uncalled for.

I agree....it may be acceptable around friends but that is not what this site is for. It is not for you to insult people with foul langauge. Of course some people use it but it is all about the context that you use it in. That was uncalled for. I understand what your trying to say but there are other ways of putting it...so that you don't offend others.

When i started reading this post...My eyes were big and I couldn't believe what it was that I was reading but then as I kept reading and I read about the problems that pittman described about his wife...as far as being happy one minute and yelling the next moment. I knew right then that it was true. My good friend is married to a Mexican and she is the exact same way....even when it comes to money she is the same was as pittman wife. I mean we went to the movies the other day to see X-men 3 and we all had a goodtime and on our way out of the movie theater...she just flipped out and got super pissed off at him...while both me and him was just standing there puzzled because we couldn't believe what just happened. It was something I had never seen before. I mean I have been to there house and just watched how they act around each other. Most of the time she complains that he doesn't want to do anything but when he has her to do something (anything) she doesn't...she just wants to stay in the other room and watch tv....all day long. But when she goes to Texas to visit her family and do her Air Force Reserves Time.....she is happy. Sometimes she doesn't come back when she says that she will...she just stays for weeks at a time without consulting her husband first and causes alot of stress in the marriage. I even sat them down with each other and made them talk about there problems and get alot off there chest and made them express to each other what was on there minds and in there hearts. Well it didn't take long for me to see that.....I know it couldn't be me....I don't have the patience to deal with it, even though the doctor said that it is a depression thing. I believe that at some point people have to take responsibility for there actions...i mean you don't make it to be an adult in life by only your parents....you have to do most of the work yourself. But I fully understand what pittman is going through and i simpathize because my friend goes through the samething........I am not sure about the whole offering $2000 to marry you though...that one is above my level

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion

When my wife arrives, what is the next steps? She is coming on CR-1 Visa

when she arrives at POE they will process her papers, & her Greencard & SSN will arrive soon after in the mail, then nothing todo until 90days before the 2nd anniversary of the date on her greencard you & she will have to apply to have conditions lifted, so enjoy this time with out having to do immigration stuff

So do you know when she can start to work? She is bugging me to find out...I guess she likes to work, which I have no problem with

i don't think you should worry as much about her overstay if it was less than 6 months as much as you should worry whether she had the two-year residency requirement with her J-1. check that directly on her visa. there should be stated whether the two-year rule applies or not.

the 2 year rule does not apply on her visa! (thank god it doesn't)

IR-1 / CR-1 Spouse Visa Process & Proceduresneed waiver or not?

Hey guys I have a question maybe someone can help me? My wife Natasha came to America on a J1 visa March 21, 2007 her visa expired Sept 12th 2007 we were married February 24, 2008, her grandmother passed away and she left to go back home to Russia February 25, 2208. We didn't know anything about Visa or K1, k2, k3 k4 CR1, so when she was ready to come back to America she was not allowed. I did alot of research and found this web site VISA JOURNEY (really great site) anyways she (overstayed) her visa but didn't stay in America more than 6 months and less than a yr. Do i need some sort a (WAIVER????)

I filed I-130 Sept 12, 2008 received (Noa1 Sept 16, 2008) and received (NOA2 April 3, 2009) and I have not received anything from USCIS or NVC about her being her in America past her VISA expiration Date!!!! Can any one tell if I will be having problems over this overstay issue, because our case has been forwarded to NVC and I have already pay some fees to them already and they have yet to say anything about her overstay.!

thanks for any one who can help

IR-1 / CR-1 Spouse Visa Process & ProceduresStill waiting for NOA1
hehe :D

After I post here this afternoon, I got home and there it was. My NOA1 was waiting in the mail. I couldn't be happier. I know the NOA1 is just a tiny little steps in this mountain of paperworks, but seeing that letter made my day. What are the chance that on the same day I post here, I got my answer. Thanks VJ! You made it happened, somehow??!! I should have posted here sooner.

Oh, I think the reason it took over a month because my i-130 got transferred to CSC. The NOA1 I got was from CSC.

Ok, so now I went online to USCIS website and register an account. Do I just add my receipt number as a case to my portfolio? What do I do from here?

Thanks all.

Thanks for all of the feedback. As I suspected, there is not a hard and fast answer....kind of depends....perhaps luck of the draw. Not sure what she'll do. She comes from an upper middle class family, so if she got turned around at immigration and had to go back home, it would not be a problem financially for her family....just a disappointment to her and her husband. Hopefully the process will go quickly and smoothly for them and she can just wait it out in Colombia. Guess it depends on whether she's willing to "push the envelop."

Thanks again,

Thanks for the feedback so far. It's obvious there's not an easy answer.

I should make one point a little more clear.....

My friend is now 21 or 22. She has been traveling to the U.S. for several years now to visit her family members in Texas and Florida (parents and brother still live in Colombia). She received her tourist visa well before she ever met her husband, let alone married him (both of which happened in the last year). So, the tourist visa had nothing to do with the spouse or the marriage. May or may not make a difference in the responses you provide, but I wanted to make sure that point is clear.

Thanks so much!

IR-1 / CR-1 Spouse Visa Process & ProceduresTravel to U.S. while IR-1/CR-1 in Process
Hello All:

Been a while. As you can tell, I've already been (successfully) through the K-3 process with my wife. Although I know quite a bit about the process and the result AOS, I have a question that I really don't know much about, because it did not apply to us.

I have a friend in Colombia (actually a girl who had a lot to do with my wife and I getting married) that needs some information. Here are the facts:

1) She is Colombian.
2) She married an American in July, 2008.
3) She remains in Colombia and he is back in the U.S.
4) They have filed for an IR-1/CR-1 visa.
5) She has a valid tourist visa for the U.S.
6) She has traveled to the U.S. many times (in fact, she met her husband while here). All 3 of her sisters lives in the U.S., two married to Americans and the other a student at a university.

She would like to use her tourist visa to return to the U.S. for a visit - to see her new husband and to visit her sister in Miami. However, she is worried that this MIGHT adversely impact (e.g., delay, etc.) her IR-1/CR-1 visa. She also understands that she will need to return to Colombia for the visa interview.

I've looked at many of the posts to the forum and tried to do a search, but most of the cases I've seen relates to folks who were visiting the U.S. on a tourist visa and married an American while he or she was here....and now wants a visa. I couldn't find a case that is similar to this one....but I swear I've seen something about this before on this board.

Can anyone give me some guidance on this? I'd really like to help my friend, since she did so much to help me and my wife.

Thanks so much,
Mike

THIS MAY BE THE WAIVER FOR THE 2 YEAR FOREIGN RESIDENCY REQUIREMENT. MANY PEOPLE WHO HAVE/HAD J1 VISAS HAVE THIS STIPULATION WHICH REQUIRES THAT YOU RETURN TO YOUR HOME COUNTRY FOR 2 YEARS BEFORE APPLYING FOR CERTAIN CLASSES OF VISAS OR PERMANENT RESIDENCY. WHETHER THIS APPLIES TO HER WILL BE INDICATED ON HER DS-2019 AND HER VISA. IT SHOULD SAY BEARER SUBJECT TO 212 (E). TWO YEAR RULE DOES APPLY. OF THIS IS THE CASE, SHE HAS TO APPLY FOR A WAIVER FROM THE DEPARTMENT OF STATE.

IR-1 / CR-1 Spouse Visa Process & ProceduresWaiting Part... Visa Process
I really understand how you all feel and I definitely sympathize. Right now, even though I am currently with my SO, possibly we will only be together until December. I tell myself that at least we will have had a year together and we will have the rest of our lives together-excluding that stolen by USCIS. I'm so surprised that this whole immigration process isn't better- its not like immigration is new to this country and considering all the technology available. Some people may say all this paperwork takes time to process, but I think just as how they can put all that effort into making sure work visas are processed speedily, they should try to do the same for families. I feel so sad sometimes when I look at people's timelines and see how long they have been waiting and how long it has been since they last saw their spouse/fiance. I've decided to just take it day by day for the sake of my sanity. And, I'm really glad for a place like this where we can all find support and good advice (which is immensely better than what USCIS offers on their website/customer service- which, btw, is little to none)...ok, I'm out of breath, sorry for the rant blush.gif

They have no families, no emotions and don't consider the fact that their jobs affect so many families and our petitions simply fall into a black hole.
