As long as her documents state that she isn't subject, you are in the clear. For information's sake, however, paying for everything does not exempt you from this rule. I paid for my internship from my own funds, went through a private company and received no government funds, however, due to the fact that the skill area I am interning in is one wwhich my country is experiencing a shortage of people, I am subject to the rule. Those are not the only factors considered (government funding, etc.), but also if one's area of study is on your country's skill), as stated in the information you have above.

Thats the thing I've noticed with the immigration process- the info is all over the place and theY make it so confusing. That's why sites like VisaJourney are so important- you get better and more accurate info here than from USCIS or even the DoS.

Lol, lucky you! I wish I was in your shoes right now. I'm in the U.S. until November and I cant apply for AOS without my waiver. I applied to my home country for a no objection statement in May- have yet to hear anything about that. It took them a month and a half just to cash the money order, so that should tell me something.

It can only be denied if she had the 2 yr requirement on her visa and it has not been waived or she has not spent 2 yrs in her home country after her program ended. Keep in mind that not everyone who has/had a J-1 visa is subject to this rule; you have to check her visa and DS-2019/IAP 66 for the nototaion on it.

Just as azer 2000 said- it still applies. As long as you have not done the 2 yrs. in your home country (not just outside of the U.S., because if you spend the two yrs. in a third country the requirement would still exist) or have received a waiver, you will not be able to apply to get a green card.

The DS-2019 (formerly known as the "IAP-66") would have a notation saying "subject to 212 (e)", which is the foreign residency requirement. If you are not able to locate that, your visa should also say "bearer is subject to 212 (e), two year rule does apply. If it does, you will have to have that requirement waived. If it doesn't say that, you are fine. See here for further information:

I would definitely list the employment even if just for a short time. If the embassy/USCIS finds out and you did not report the employment, it may cause some delay and further investigation. Do your best with the dates and move forward. just my opinion and good luck

don't worry, the mail sometimes takes a while. You sent the petiton on Feb 15, add 5-8 days for them to receive it and then for them to look at it and bla and then 5-8 days for the mail to get to you.

No reason to freak, it'll come.
If you need it to check your status online, they should have your receipt number on the back of the check.

Touched means that an Immigration Officer has looked at your paperwork.


Amd how to I know when someone has look at my paperwork???

it is either a change of status or simply the fact that they looked at it. Did the online status change? If not, your case was probably just looked at and found alright.

I sent my documents to the Phils thru LBC (a philippine courier with outlets in the U.S.). It takes about a week and costs $5. I would'nt trust my mail going through the Philippine Postal Corporation's hands, which receives the mail from USPS.



What is LBC and how do i get in contact with them?? Let me know...I am always looking to shave some time off of this SUPER LONG DRAWN OUT PROCESS. Let me know!!!!! I need the hook up

I would also suggest that your spouse go head and prepare all of her papers that she will need ahead of time. My wife has all of hers except the NBI and that was only because there was a minor problem with some incorrect information. I would also suggest that he/she process and get their passport.

:dance: If you want to take off a couple of days/weeks of processing time spend your payments & forms overnight express from both locations. It can be costly and i wouldn't recommend it if you have the time and patience to deal with the long drawn out process, but for those people who are like me i would suggest express mailing everything and fedex from international locations. I know that regualr mail travel to and from the Philippines is about 10-14 days and Fedex is only 3-4 days....time saved 7-10 days and regular priority mail here is 2-3 days and overnight is.....well the next day, so that is 1-2 days saved. With all the forms and payments the you have to send back and forth...you could save up to a month or two. But again i say that it can't be costly. :thumbs: :lol:

I have a situation that came up with me being deployed to Iraq this coming July. So i called down to the local congressmans office and explained my situation to him and asked if he could help me to speed the process up at the USCIS. To make a long story short....My case was approved the very same day I spoke with him, which as 2 1/2 months a head of time. As a matter a fact they still have not made it to my original processing date yet.

I don't know about www.noblecom.com but I do know that I have been using www.pinonsale.com for over 2 years now and I love it.....I mean i can have a phone card in less than 30 sec (information already programed). I tried the whole using Bellsouth and MCI and such and such......it cost me more than i would ever like to take credit for.
