IR-1 / CR-1 Spouse Visa Process & ProceduresAnyone get a NOA2 from CSC yet?
Hi,
I was just wondering if anyone has been lucky enough to get their NOA2 from CSC yet?..I havnt been touched since they recieved my RFE back on July 7th and was touched on the 8th..nothing since.
I posted about a week or so ago that my laywer expects approvals from CSC within 3 weeks time of recieving the RFE's back..so im hoping his comment has some merit.
Wishful thinking i guess..I do know they updated that they are working on petitions from March 3rd,and I know Vermont is already approving people who filed in May and June..thats what is so frusterating, why is CSC taking 3 times as long to process?..just isnt fair.
Ok fellow VJ'ers time to chime in.
Thanks,
Keith & Irish

IR-1 / CR-1 Spouse Visa Process & ProceduresStill waiting for NOA1
hi all,

This is my first post here. yippe! I'm filing paperworks so that I and my wife in Vietnam can be reunited. I'm a naturalized US citizen living in Florida.

Ok, I mailed the I-130 by ceritified mail to TSC on June 1, 2006. I received a Domestic Return Receipt from the Post Office on June 13, 2006. On it is a red stamp "Received from INS TSC Jun 06 2006".

So far I'm still waiting for the NOA1. I've read the CR-1/IR-1 Timeline Statistics on here. The average for TSC is around 16 days. As of today, it has been 34 days since I sent the I-130. Is it normal for the NOA1 to take that long? Plus I've checked the processing time for TSC but they don't list the I-130 for US citizen filing for a spouse. CSC and VSC does list them. Does anyone know if this is an oversight or something else.

Can I call TSC to check the status of my I-130?

Thanks everyone.

IR-1 / CR-1 Spouse Visa Process & ProceduresConfused about Packet 4 instructions
hi all,

We're filing CR-1. My wife received packet 4 with the interview appt. letter from the US Consulate General in Ho Chi Minh, Viet nam.

Now the instructions list documents to bring to the interview. It ask for the DS-230 part 1 and part 2. But we're already filed DS-230 part 1. Do we have to fill it again?

It also asked for I-864 which I already submitted to the NVC. I thought the Consulate should have these documents when the NVC send them our files.

The instructions also mention to do not bring photo albums, just bring loose photo. We have lots of photos in albums. It would be a pain to remove them and keep them in order. So has anyone heard of this loose photos requirement?

BTW, is there a packet 3 from the Consulate? My wife received the packet 4 so far.

Thanks,
Tung

QUOTE (Monica&Isha @ Apr 10 2009, 04:52 PM) <{POST_SNAPBACK}>
Hey guys! I'm here to let you know that my visa was approved yesterday at the Rio de Janeiro Embassy. During the interview they asked the basic things such as date of marriage and how we met. They also asked few things about my husband's info in the Affidavit of support and about his family like if he has brothers or sisters and if I know his brother. They asked to see our pictures and they asked what are our plans for the future.

I am the applicant and I was there by myself because my husband, the petitioner, couldn't take the days off to come to Brasil. sad.gif

But everything is fine now and they will send my passport with the visa to my house in a few days. (That's how they do in Brazil)
I'm sooooo happy and thankful to God because I know He was there with me all the time! kicking.gif biggrin.gif kicking.gif biggrin.gif

Also, big thanks to everybody in VJ who helped me in this process. Now I'm getting ready for POE!

Congratulations!!

We couldn't wait for the visa...so we returned to the embassy 2 days later.

IR-1 / CR-1 Spouse Visa Process & ProceduresAnother DS 230 questions!!

Following along with all the DS230 questions... [sorry if this is a stupid question]

Knowing that I need to provide original or certified copies of the marriage certificate and birth certificate, should I really write the case number in the upper right hand corner??? It says that not doing so would cause a delay, but these are the original documents and I'd prefer not to write all over them.

Any suggestions?

Thanks in advance.

Stephanie

Yes it is true that they want you to write the case number on the upper right hand corner of all papers submitted for the DS230. You can just write it in pencil thats what we did and then it can be erased off of your origionals.

I did contact my Congressman on April 9th.
This what I have in a 30 minutes:

Thank you for contacting my office. I have received your email and will be responding to your message soon.

Sincerely,
Rep. Ben Ray Lujan
United States House of Representatives

Nothing after that...

Didn't you get a 'touch' on your case after the congressman's enquiry? Normally when they do an inquiry, the date from when it was last looked at is updated online.

KIMCORENE, the other topic you posted has been very interesting to read. I would love to hear from more people who were lucky enough to get their immigrant visas before completing the 2 years. I have just started my second year in my country and the I-130 was just approved, we are now sending the DS-3032 form continuing with the process. It looks like I might get an interview before the 2 years are up, so I am just wondering if I should be calling the consulate to tell them that I am not finished with the 2 years and ask when to schedule the interview or I should just go to the interview and state that I have not yet completed the 2 years and hope for their mercy... After all, we do have a 3-year old child who is growing without his dad right now... Is it true that the worst that can happen is to be sent back and scheduled for a later interview date? I hope I will actually be issued a visa for later date, when the 2 years are supposed to be completed it. I guess if they cancel all other visas at the interview, they should be able to know when that date would be if I have no other ways of entering the country, right? I'd love to hear from other people in similar situation.

Thank you for the very informative thread!

BTW, I applied for a no-objection waiver and was denied... I had supporting documents from my work (I work for an NGO), our state's congressional delegation, and a no-objection letter and was still denied sad.gif.
The rule for the 2YHRR is to spend 730 days in your country and that has to be proved with passport stamps, credit card receipts, bills, etc.

If all else fails, I am prepared to do my time laughing.gif Considering how long this whole process takes, you'll more likely than not have completed your 2 yrs by the time you get an interview date. But, I guess if not, you can beg and plead laughing.gif I would wait to see what happens before calling the consulate. I'm sorry to hear your child is growing up without a dad right now, but everything will work out. We have to have faith, right. I've been hoping there were other people with this/similar situations, so we could commiserate- I posted in the thread for Jamaica, but no one responded- sadly. I'm just dying for this long, slow process to end and I get that waiver. If you don't mind- on what grounds was your waiver request denied? And I see you had a change of status to HB- I thought you couldn't get an HB if you had the 2 yr requirement?

As long as her documents state that she isn't subject, you are in the clear. For information's sake, however, paying for everything does not exempt you from this rule. I paid for my internship from my own funds, went through a private company and received no government funds, however, due to the fact that the skill area I am interning in is one wwhich my country is experiencing a shortage of people, I am subject to the rule. Those are not the only factors considered (government funding, etc.), but also if one's area of study is on your country's skill), as stated in the information you have above.
