Hi all again!

Has anyone lived in a foreign country where the police certificate was requested by the consulate? How long did it take? Was that nerve wrecking?
I lived in the Netherlands and I was told by the consulate that they will request the Police certificate to the Dutch Police on my behalf.

All inputs are welcome!

We almost had to go through that, but luckily my fiance had a relative in Pakistan get his for him. If the Consulate had requested it from Pakistan it would have taken 3 months. I am not sure about the Netherlands and if it is any faster for them to get it from there. All I know is, we had to find a different way of getting it from Pakistan or we would have been waiting forever.

Calm down :lol: We also had to send our origionals to the NVC and we kept copies. Once your at the interview just make sure you have all of your copies of anything and everything you have done along the way for backup. They will return your origionals to you at the interview.

Thanks to all of you who have provided advice. On your advice...and after reading more information about the adjustment of status process, etc., I have prepared the I-130 for my 9 year old step-daughter (I-130 and I-129F already filed for my wife).

After reading and re-reading the instructions, this is what I believe I need to submit:

*Completed I-130
*Fee
*Copy of marriage certificate (to my step-daugher's mother)
*Copy of my divorce decree
*Copy of my birth certificate

Compared to filing an I-130 for your spouse, it seems so easy....almost too easy. No G-325As. No passport photos. From what I read, I don't even have to provide my step-daugher's birth certificate...to prove that her 18th birthday had not passed as of the date of my marriage to her mother.

Am I right? Is it this simple? Or am I missing something? I'm getting a little paranoid! Even if my step-daughter's birth certificate is not required....do you think I should include it (to verify her age)?

NYSENESS's post caused me to go back to the I-485 instructions and read carefully (which still does not guarantee that I can understand the bureaucratical language used). Since I can't copy and paste from the PDF, this is the short of what it say on page 1 of the I-485 instructions.

If a "principal" is filing for AOS based on immigrant status, a "derivate" can file for AOS at the same time as the "principal" or any time after the "principal" is approved. This assumes that both the principal and the derivative are in the U.S. at the time.

Applying this to the K3/K4 visa holder....the principal is the alien parent (who filed both a I-130 and an I-129F) and the derivative is the child. Thus, the child can apply for the AOS at the same time as the alien parent (or after the alien parent is approved)....without ever having an I-130 filed on his/her behalf. This would be consistent with what NYSENESS was told.

Let's see if I've learned anything from all of this.

From what I have read (official government stuff and on this site), I gather that the K-3 (resulting from the I-129F) does cover the depenent child. However, if you want to option to switch to an IR-1/CR-1 (for the spouse and step-child) should the I-130 be processed faster, then you will have needed to file a separate I-130 for both the spouse and the step-child.

I hired some folks in Colombia to assist me with the paperwork and the required translations, etc. The idea of submitting a I-130 for the child never came up.

I am not doubting anyone, but would like to know why this is suggested. Is it because if the I-130 gets approved first, I can switch to the CR-1/AR-1 process? Or are there additional reasons.

Whilst a seperate I-130 is not required for the child that will be a derivative of the K-3 visa, the child must have their own I-130 in order to adjust status once in the US on a K-4. It has to be filed eventually so why wait. Having their own approved I-130 also allows a CR-2 to be sought for the child if things change and the CR-1 for the parent is sought instead of the K-3. If there is no K-3, there is no K-4......and if the child has no I-130 filed on their behalf then there is no visa for the child. CR-2 is not derivative of the CR-1.

I submitted the I-130 in mid-September. I submitted the I-129F last Friday (10-13). I could probably do an I-130 for my step-daughter, but I probably couldn't get it completed and mailed until early to mid-November. Does it make sense to still do it? If so, why? I just want to understand why I am doing certain things.

Further, if I file a I-130, I assume her mother actually fills out the paperwork (with me) and signs on behalf of the 9 year old child. Correct?

OK. Let's say that my I-130 gets approved before my I-129F. I understand I have the option to switch to seeking a CR-1 instead of the K-3. However, my wife has a 9 year old daughter who we intend to bring here at the same time as my wife. Can you bring a child over to the U.S. with her mother on a CR-1? Or is that only possible with a K-3?

Yes, that is all I did. So we'll see what happens. I am already anticipating having to deal with AOS for my wife and step-daughter...and am reviewing the materials for that right now. It kind of burns me that I have to submit an EAD for my 9 year old step-daughter (and pay $180) just to get her a social security card. But you do what you have to do. IF the I-130 actually ends up going to Bogota, I'll be sure to post that information.

Thanks, Yodrak. That's what I was afraid of...I have seen the post as well. On both I-130s, I did request a consular interview....but that may not matter any more. I guess we'll have to see what happens. If it turns out we can have a consular interview, then I'll deal with trying to get the interview done on the same day....at that time.

I filed the I-130 for my wife in late September (and the I-129F in October), but did not file the I-130 for my 9 year old step-daughter until mid-November. I just received my NOA2 for both the wife's I-129F and I-130. Barring a miracle, I fully expect the I-129F to beat the I130 to the embassy. Given that, the plan is for my wife to interview at the embassy so we can get her and my step-daughter to the U.S. ASAP (likely February).

Now, here's the issue. Luckily, I identified "Bogota Colombia" on line 22 of both I-130s. So, that means the I-130s should eventually be sent to NVC and then to the Bogota embassy. This will allow my wife and step-daugher to return to Colombia to interview for the I-130 (and thus avoid AOS in the U.S.). Obviously, however, the I-130s were submitted about 1 1/2 months apart (I only have the NOA2 on my wife's I-130 so far). Thus, I assume the interviews will eventually be scheduled about that far apart.

Is there a way to follow through on the I-130s with a Bogota interview without having to pay for two separate trips to Bogota? In other words, does anyone have any advice on how I might try to get their interviews scheduled for the same day in Bogota (so they can fly together, one time)? Has anyone had experience with this?

Any advice or experiences are much appreciated?
