The CR-1/IR-1 will result in permanent resident status. You will not file I-485. She will not need to adjust status as she will enter the U.S. with resident status.

If you will have been married less than 2 years at the time of her entry, you will need to file to lift conditions within 90 days of the expiration of her conditional permanent residence. If you will have been married for at least 2 years at the time of her entry, you will not have to file to lift conditions and will be done for 10 years.

Thanks for the advice so far. I read the instructions for what needs to be included in the I-130 package but don't really really know what to do with the stepdaughter since she must have a seperate package. Is it the same as my wife? Or is it just the marriage certificate? Do I need to include my divorce decree in that package also......seems kind of goofy to seperate the two packages. blink.gif

Customer Service personel are held to standards and the answer you recieved is not appropriate. You should have an ID number that they give you when you call. Use this number in your letter to the Ombudsman. If you did not receive a number call back ask the same question and ask for their ID number. hang in there. BG

Here is the answer.

Sent I-130 to TSC
As is the norm TSC sent to CSC
CSC is almost caught up and I watch as I know next week they will post some movement on I-130
Suprise CSC sent to Chicago Lock Box

I expect to recieve my original unopened package in my mailboox within the next 90 days.

Now if you're an employer and you need a worker hang on those babies fly through the process! Hmmm maybe I can hire my WIFE to be...hmmmm I don't know ??? a live in domestic partner.

Hello all

First of all congrats to those with cases that are starting to move!

I've searched through and cannot find anythng about questions they may ask children at the interveiw. I have a 14 year old step-daughter that of course is excited about moving to Florida, but as she is the typical teen she doesn't take much time to soak up much info about what goes on around her. Do they interveiw teens? Not sure what to tell her. Anyway thanks for your the help in advance!

I saw some couples posted the dates of which their case sent to the embassy and received by the embassy. Where can you find these information? Will NVC information telephone line provide this kinds of information as it happens?

Or you have to contact the embassy? If contacting the embassy is the way, when from the time of which the case is reported completed at NVC can we contact the embassy for such information? And which contacting method is beter? Email or Phone? Our embassy is Ho Chi Minh, VN.

Hi guys,

Does anyonw know what will be happening after additional documents is submitted per direction in the blue slip in HCM Consulate? Will my wife submit the additional doc, sit and wait for the answer from the review/CO in the SAME DAY? Or she will have to go home and wait endlessly for the decision in the mail after document submission?

Also, is my wife the only one who can submit the required doc or I, the petitioner, can walk in and submit the docs (if I can be in the country)?

Congrats on your recent marriage and thanks for your message. My wife and I have our I-130 approved already, so I was thinking that's why I was told 2-4 months. Most of the time lines I found for Thailand weren't recent (or they weren't doing a CR-1). It appears there have been some changes since the middle of last year, but it's hard to determine how and if things have changed in Thailand to make the process faster.

The attorney I spoke with in BKK is Brain Wright, he has a good reputation and only does US Visas. My wife goes back to BKK in about 2 weeks. I'll do my best to keep our time line updated and post about any snags we run into (hopefully none). Good luck with your Visa process and I hope you and your husband are able to get everything taken care of within 4 months. Keep us posted on how yours is going as well!

K3 route

Thanks for the response. I know what you mean about not trusting attorneys. I just want to get our original I-130 approval from the local attorney because he has no clue. Keeps telling me he wants to file the I-129F at the Bangkok Embassy and everything I read says this isn't possible, yet he's been carrying on about it for 3 weeks now. Then the attorneys in BKK are telling me two different things. Sheesh, I'll be glad when it's all finished.

If we can file for both CR-1 and K-3 that would be great, but I don't want to cause any confusion with them. I just want my wife back here soon and I have no problem waiting for AOS while she is here with me. I wish there were more time lines for Bangkok so I could get a better idea of the time for CR-1's in the past few months.

Yes, I'm a USC. The I-485 was denied because my wife entered the country on a C1/D (crewman) visa, so there is no reason for us to appeal it (our lawyer should have known better). She also has a B2, but the letter from USCIS gave her 45 days to leave or be subject to removal proceedings (they also took her I-94 at the interview). So we don't want to take any chances of her overstaying or getting barred from entering the US.

Hello everyone, I'm trying to make sure I understand this process properly. So I'll provide a quick background on my situation. My Wife and I were married in the US in April 2007. We filed an I-130 and I-485 through an attorney. The I-130 was approved and the I-485 was denied. As a result of the I-485 being denied, my wife is going back to Thailand next month to avoid overstaying.

Now, do we just simply wait until I receive NOA 2 on the I-130? Does anything else need to be filed in the meantime?

On line 19 of the I-130 it has her address in Thailand. Will the Bangkok Embassy use this address to contact her?

I want to get her back in the US as soon as possible. I've been told that it would be quicker to get a CR-1 Visa for her, instead of going the K-3 route (was told about 3-4 months for a CR-1, as opposed to 7-8 months for a K-3 plus the processing time for I-864). This conflicts with a lot of info I've read on this site, but recently I've seen where people stated the USCIS asked them to switch to a CR-1 from a K-3. So I'm hoping we'll be better off with the CR-1.

Any advice or info would be greatly appreciated.

Anyone doing the process in Cuba I have a tip on the how your spouse/significant other can get their superpacket.

We were waiting about 2 weeks after the NVC approval was wired to Havana and my husband hadn't heard anything. I was concerned because he works all day and no one is at his house if the interests section were to call him to tell him how to get the packet.

So I started calling the interests section last Thursday, I tried to call 3 days (all day long, hundreds of times!) and couldn't get through. The Interests Section posts close to 10 different numbers on their contact web page http://havana.usinte...ov/contact.html. but none of them worked, not even a dial tone most times.

So I saw cubanlovestory's post from months ago and faxed in a brief letter to 53-7-833-1084, just stating my case number, my husband's passport number and full name and that he needed an appointment to get his packet 3, they called him within 2 hours of sending the fax, que bueno!!! I finally got through by telephone an hour after he got the phone call (I hadn't talked yet so I didn't know that he made the arrangements yet) The number that finally worked was 53-7-834-4400.

Anyways, the girl was very helpful and told me that everything was taken care of and that my husband had made arrangements to pick up his packet 3 in a week.

So to anyone who is waiting to recieve superpacket instructions, start calling and faxing after about a week from NVC approval, it takes a while but it will work eventually, be patient and good luck!

Folks,

I called up NVC yesterday and they said that my case was sent to Chennai/Madras on Aug 23rd. I tried tracking the shipment using 'expedite iv section' as the tracking reference. I couldn't find anything. But i found one shipment ,to madras/chennai, when i used 'expedite niv section' as the tracking reference.

From what i read from the previous post, the tracking reference 'expedite iv section' should give you all the immigrant visas and 'expedite niv section' should give you all the non immigrant visas. Am i wrong?

Ours is a CR1 visa and since it's an immigrant visa, i was hoping to find it under 'expedite iv section'. Could it be that the shipment i saw under 'expedite niv section' is not actually ours? :huh: should i call up nvc ?

Any help would be greatly appreciated.

You could also try emailing the embassy if they have an email address, and ask them to let you know when they get the petition, that is what I did with mine , and they responded.
