Sending the last three tax years is an option on the I-864EZ. They ask for only one. Just call and ask if you think you need to send in three years as added insurance. They answer all of my questions and have helped me on 2 different occasions.

Great news for those August filers -- we filed our I-130 on August 14, received our NOA1 on December 21, and got APPROVED YESTERDAY. Hold on tight -- maybe Vermont is now moving.

We are in the same boat. I sent my I-130 to VSC on 10/16/07, but I haven't got NOA1 yet. I called the USCIS few days ago, and they told me that my petition was not in their system (even after 90 days; was told to wait for another month). Then, I called WesternUnion and found out thay they cashed my MoneyOrder on 1/15/07. I was glad to hear that but still... worrying about my NOA1 sad.gif



I wouldnt worry too much, I had 2, both checks cashed the same day but NOA's 2 weeks apart. ???? got me?

I just recieved RFE for this very information. Appearantly since the NVC collects all documents and make the appointment in some countries now it a requirement. However that said there is no way for yo to know ahead of time because it is not in the requested documents. After humiliating the idiot at the NVC I requested that he provide where he got his information from. All I heard was I don't know. I have a formal request into congressman Martinez to look into it. Won't help me but maybe some other unsuspecting soul.

I am totally LOST !!
My husband's interview was on 9th march in Bangladesh .We were prepared well and there wasn't any paper missing or incomplete.The Consular officer asked him bunch of common questions and he replied. She asked him to show some of our pictures but no emails, phone or any other evidences.
At the end of the Interview she gave him a BLUE SLIP stating the following :

Sorry to hear this. Blue slip under section 221 (g) means your case put on hold for further Administrative Processing, which means your petition, will return to USCIS for additional review and thereafter they will contact you. There is no time limits in this situation neither Consulate entertain your any query. So wait for Consulate notification.

Dont scare people like this. It may end up being returned to USCIS, but they are giving you the chance to rectify this issue. I just went through 221g LAST WEEK. I am sitting on the sofa with my wife now in the US.

I guess I'm an idiot. Where in any of those posts does it say which means your petition, will return to USCIS for additional review I got a 221g blue slip. My petition never left the consulate.

So really you have absolutely no idea what you are talking about.

Visa Denials under section 221 (g) at US Consulates
Even after USCIS approved a petition, the US consulate abroad can deny visa based on INA act section 221 (g) because the requirements for a petition-based visa did not met by an applicant. When it happens, they also request that the USCIS revoke the petition that approve earlier.

Just keep this fact that USCIS is primarily responsible to determine whether or not a person meets the requirements for particular visa under law. Immigration officer at US consulate abroad, under certain situation, reach a different verdict and request that the USCIS to reconsider its original approval of a petition.
So, USCIS concluded “Yes” before for a petition but consulate officer concluded “No” to the petition and under this circumstance, they send back the approved petition to the USCIS with “ADDITIONAL ADMINISTRATIVE PROCESSING”.

In July, 2001 Department of State classify the role of consulate officers with respect to adjudication of petition based visas and remind them that the revocation process should only be used “sparingly” and should not attempt to re-adjudicate petitions.

Interestingly, the guidance states that the petition SHOULD NOT be returned unless the consulate uncovers new information that was not available to the USCIS at the time of that petition's approval. This happen due to common mistakes during visa interview, whether it is just related to lack of paper works or bona fide relationship, etc.

Revocation Process: Consulate forward the petition to the Department of State, Kentucky Consular Center which then send to USCIS service center that originally approved the petition. The USCIS then re-evaluates the petition and either reaffirms and returns it to DOS or in many instances issues a notice of intent or revoke (NOIR) to the petitioner and gives 30 days to respond with additional evidence.

OK, I'll be happy to provide info...although none of it is particularly exciting!

1) I originally planned to travel with her, but I had to go back to work. So, I leve on Monday, January 22 (the day she picked up the visas) and my wife and step-daughter left on Friday, January 26. Actually, I was kind of releieved that I was NOT there. It was a zoo with all of the family at the airport crying and making a scene! :)
2) I can't recall the exact forms, but there are two. These are forms that all visitors on a visa complete (remember, at this point, the K-3 visa holder is not a permanent resident and is certainly not a citizen).
3) The point of entry was Miami
4) The line for visitors/non-residents. However, she was subsequently re-directed to an office to process her paperwork. There was only one official working in the office. It took about 2 hours....which made it about 3.5 hours from touchdown of the plane to them walking out of immigration and customs. I actually went to the immigration office to verify that she had arrived and was in processing.
5) The person in the office spoke to her in Spanish.
6) Passport (with visa inside, of course), envelope, immigration documents given out on the plane
7) N/A
8) The guy in the original immigration line asked casual questions....like a friend....such as "Is this your first visit to the U.S." and "Why are you here?" and "Is your daughter happy to be here?" The guy in the office asked her my name, home address, telephone number, my profession, where I work.
9) Friendy (note: as a gringo, I have always had good luck with the immigration folks in Miami)
10) See above, it was about two hours from the time she got "Scanned" by the first immigration officer to the time she was finished....but the whole process from time the plane landed until the time she came out of customs with her luggage was 3.5 hours.

My wife gives one piece of advice....try NOT to be nervous (or at least to show it). She said that the people who were nervous were asked many more questions....because they drew suspicion.

PS - keep in mind Jedi, that my wife and step-daughter came here on a K-3/K-4, not a CR-1. I posted this at your request, but there might be some slight differences in the process for a CR-1 visa holder.

Some questions that I have that I hope you will include answers to are:

1) Did your spouse travel alone or were they accompanied by the USC spouse?
2) Which form did your spouse fill out on the plane before landing?
3) Where was your spouse's Point of Entry (e.g. JFK, Miami, Atlanta etc)?
4) What line did your spouse get on when they got off the plane? Visitors, Resident?
5) Did the immigration agent speak in Spanish or attempt to speak in English to your spouse?
6) What documents did your spouse have ready to hand over? Passport,Visa, MBE(Mysterious Brown Envelope)
7) If traveling with the USC spouse, were you split up or was your USC spouse with you the whole time?
8) What kind of questions did they ask your spouse?
9) Were the immigration officers friendly, rude?
10) How long was the whole process?

Most insurance companies will not cover a spouse that does not live with you regardless of citizenship or immigrant status. If you overcome this portion you will be covered. I suppose you could say she has moved in with you. Not sure now what they will require since you have had issues already. I would work it from the point where she is living with you and traveling overseas when she is in Japan.

Getting married wont make it any faster. If you do not have a visa you can apply for the K1/3 type visa with the intent to marry once it is granted. I think its around 90 days after arrival.

If you marry you can apply for the CR1 route to get a Green Card. I would estimate the whole process to take about a year total. Normally people apply for the K3 at the same time so they can travel to the US.

You will not be able to work (legally) until you get final approval, and get the Green Card and SSN.

I am doing the IR1 route so I dont have all the answers. I am sure someone will chime in soon.

If your husband really wants to claim you and you feel that this will not hamper any process for your GC and eventual SSN you can apply under the section that indicates

-An alien spouse eligible to be claimed as an exemption on a U.S. tax return who is not eligible to obtain an SSN.

I have never done this because I have used the 2555 foreign tax exemption and never needed to claim also be wary of financial institutions they do not treat Tax IDs like SSNs.

Depending on how much you made as a couple the difference can be substantial. There are good 1040 tax calculators out there to see how much of a difference and if it is worth the hassle for you

Just look at the 1040. It states clearly "You MUST include SSN" If you do not have one you MUST file single. Its the same if you buy a house while you are married and your spouse does not have a Tax ID or SSN, you must be listed as unmarried, simply because you are a number first when it comes to Credit, Banks, and the IRS.

I have a better one. The first number is the number of divorces the ajudicator has and the second number is their weight in pounds. So mine would be 7 divorces and 250 pounds. Maybe the second number is the number of cigarette breaks they take in a week at the Service Center.

Actually I pulled that first stuff off of an information site. So I was no speculating, merely passing on what I saw. I like the speculation theories better though!!!

I figured it out.

Number used to identify an applicant or petitioner's place in the BCIS fee receipt and case tracking system. WAC is the acronymic artifact of the Western Adjudication Center, now known as the California Service Center. The alphanumeric identifier is ten digits in the format WAC-NN-NNN-NNNNN. The first two digits are the current fiscal year, the second three digits are the sequentially-numbered working day of the fiscal year (known as the "Julian date") on which the case was originally receipted, and the final five digits are a serial number (which always begins with "5"). There are three other BCIS Regional Service Centers, in Lincoln, NE (LIN); Irving, TX (SRC); and St. Albans, VT (EAC).

So my case starts with WAC-07-252

Susie K's case is 08 FY 2008 (Starts Oct 1st, 2007) 80th day of FY08, Dec 21st.

So that works for Susie's but mines a little off. Have to research it more.

I am sure he filed a foreign earned income tax credit on the 2555. I faced the same issue and had to come back to the US to start getting paid here in the US even though its from the same company. Most companies pay from a local legal entity even though they might be called Xxon, they really are not legally. Xxon S/A is not the same as Xxon Inc.

All my tax documents show 0 for 2000 thru 2006.

I just called using the RFE trick and a nice lady told me that the Received Date that they consider is the Notice Date. The Priority Date is the Received Date, whatever that means. Nevertheless, she said that they are processing I-130s from July 30th right now and I should expected something based off of my Notice Date of 28 August. I feel bad for those people that have 2 or 3 months between the dates. At least mine is only 30+ days.

So if all goes well I should have mine processed around the 2nd to 3rd week of February.

I guess we will have to do the Bahamas trick to extend the B1 visa for another 6 months as this looks like its going to drag on.

Do I have reason to worry, and if so, what can I do?

I would be worried about the Tax Returns. I would sit down and get at least back to 2004 done. Even if you were a student and overseas. You should try to file some thing. This could cause problems for you in the future regardless of your immigration process requiring it or not.

You are going to most likely need a co-sponsor. I would start looking around for someone (a US Citizen) who is willing and has the required means to be a co-sponsor. The 60K pounds should work out to about 110K USD, but that would have to be transfered and already in your account, which may not be what you want to do with it right now. I would shop around for a sponsor and get some kind of tax filing in for those past years just to cover yourself. If you were over seas working then file the 2555 with the 1040s.
