What I would do is wait for a RFE. If they will ever send you one. They might be smart enough and put one and one together...
But that is my opinion...
I wish you good luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresThis really pissed me off!!!
I didn't need prayers to complete my journey...
I just made sure I informed myself on everey possible aspect.

People on a J-1 are here legally, if they want to meet their possible future spouse at a party, so be it.
So what you want is a ban on parties for people that are not permanent residents but LEGALLY residing in the USA? You want them to stay at home and sit behind the window and be lonely? People need to socialize...

IR-1 / CR-1 Spouse Visa Process & ProceduresCR-1 V. DCF
Hello Everyone,

I'm so glad to have found all this information online and I don't feel alone in this journey now.

I would like to know the opinions you have of filing the CR-1 or taking the DCF route. I live in Egypt with my husband and I been here since January. I have made 2 trips back to the states and the 6 months they require to file DCF, will have to start now. I just came back from a visit last week.

I would like to file the quickest route possible as we would. smile.gif Would it be faster for me to wait the 6 months and file DCF in Egypt or get my things together and send it back to the states and file the CR-1? I don't plan anymore trips to the states until next year, so, I will have to have some papers sent to me as my father will be a co-sponsor.

If I was to send my request back to the states, would they allow my interview in Egypt or would I have to travel back to the states? I'd appreciate any advice you guys might have. What would you guys do if in my situation? Has anyone else had same situation as I do? I'd like to talk if you are willing to do so.

IR-1 / CR-1 Spouse Visa Process & ProceduresCR-1 V. DCF opinions plz...
No, i'm not a resident as I didn't know i'd need a resident visa. sad.gif I made a couple trips to the states and got new entry visa's when I returned and also in Feb. I got a tourist visa good for 6 months, but I lost that as they made a mistake on my name in my pasport and had to get a new one. So, they returned it w/o all the pages of my entires into Egypt and the 6 months tourist visa.

If I understand DCF in Egypt, I have to live here for 6 months and can not have left for any reason. We're trying to get married legally, but he's having a hard time getting his passport as he lost his. He's the only son and has to proof this with the army here before they give him the new passport. It's basically held up at his college where he attends, as the guy that must sign the paper he is a student there seems to never be in his office.. schools out over here. sad.gif

I have to be married before I can get a resident visa, so, i'm stuck until the man returns to school and signs the paper. I also don't know if I file CR-1 if I will have an interview myself and if so, will it be in the U.S.? I'm just kinda stuck here and so confused. sad.gif

IR-1 / CR-1 Spouse Visa Process & ProceduresCR-1 V. DCF opinions plz...
Hello Guys,

I have yet to file either way CR-1 or DCF and need your opinions on which would be the best and fastest for me to file. Let me explain a little about my situation first. smile.gif

Currently, i'm married using an Orfi marriage. I've been living in Egypt since Jan, but at the time I came over, we were told an American couldn't marry an Egyptian, due to our governments disagreement on the US allowing Americans to marry. So, we chose to use an Orfi marriage. Now things have changed and we can marry legally and we are in the process of this now.

After reading my options, I see I can file DCF or CR-1. I have been in Egypt since Jan, but I have a teen that lives with my parents and I must make trips frequently to visit. We were hoping my daughter could join us, but things aren't working out that way. So, staying here the required 6 months before filing DCF is going to be very hard for me, but I can do it if I must.

I think filing the CR-1 would be best for me since I do need to make trips back to the U.S., but which would be the fastest way to file? Are they both about the same or one seems faster and easier than the other? Also, since I basically do live in Egypt, would I also have an interview and if so, would that be in the states or is my husband the only one that gets an interview? Do they both cost about the same to file? I would appreciate your help and opinions.

IR-1 / CR-1 Spouse Visa Process & ProceduresHELP PLZ... Need Advice...
O.K. I currently live in Egypt with my husband and I have made frequent trips back to U.S. to visit family. To file DCF, I must be a resident of Egypt and have remained here for 6 months. I don't have a resident visa yet and I after I aquire it I must stay in Egypt for 6 months before I can file DCF.

Now, I want to make a choice and get the ball a rolling as I want to be back in the states as anyone does. smile.gif I live in Egypt with my hubby, but I make trips back to U.S. so, i'm thinking the CR-1 would be my best choice. Time wise, I don't know any advice about this? Anyway, can I live here in Egypt and still file CR-1? All I have here are my CC, but I have collected most everything I need on my last trip to the states to file. What else I need my mother would send me, accept of coarse a check to pay with. Can I fill out CR-1 online and send it n pay online or what? Will my living in Egypt pose a problem if I file the CR-1? Would I also have an interview and it be back in the states or only my SO?

Plz, if you can help me I would appreciate it so much. I just want to get the process started and not sure which is the fastest or would be my options. Ty for your help.

IR-1 / CR-1 Spouse Visa Process & ProceduresShould I go with my wife for her interview?
QUOTE (patriot05 @ Jun 24 2009, 02:56 PM) <{POST_SNAPBACK}>
My wife has her interview coming up soon and I am debating if I should with her for interview or not? The reason I say that is because I resigned from my job in the US and decided to spend sometime with my wife back home and didn't expect her interview call to come while being back home.

I want to go with her for moral support, but afraid that the interviewer might end asking my job status from me? If that happens my answer would obviously be that I am currently not working. This might lead them to have someone else provide affidavit of support.

Anyone with a similar experience?

I went to my husbands interview and I am glad i went. If you know each other there is no problem and it was a lot better for my husband that I was there.

IR-1 / CR-1 Spouse Visa Process & Procedures9 to 10 more months!!!!!!!!!
QUOTE (Jason&Dani @ Mar 25 2008, 02:32 PM) <{POST_SNAPBACK}>
I just got off the phone with USCIS and they said that it would be another 9-10 months due to the "backlog". That backlog in my opinion has been taken care of, if most people before July have been taken care of then in all logic there is no backlog that would cause 9-10 more months , granted some people are beyond the 6 month time limit but its not like there are millions of people that are beyond that. Their own website says Aug 19th so I dont understand. Oh and they said they are still on August 19th at vermont, I asked why they have been on Aug 19th after almost a month and a half and again "backlog". I only wanted to know about how far they were because as we all know spending $4,000.00 for a week to see our loved ones really does hurt the wallet and if they were some what near november filers i would have just waited to go visit my wife. It will be 6 months in June since i have seen my wife so I was planning a trip there. Knowing that i will have a ton of stuff to pay for once we are approved i really wanted to hold on to some of that money. Between phone bills , plane tickets, hotels , etc in 8 months I have spent near $16,000. I just cant keep doing it. I might be the only one here who has these types of problems but not being able to really plan or know what would be the best thing to do when trying to do plan your life is getting way beyond frustrating.

First thing that I found out is that the USCIS gives generic answers. They tell you the same thing every time. Count on your case getting looked at right around the 6 month mark. Thats May for you. The web page at USCIS gets updated fast so you will know within a day once its been worked on.

You can expect about 5 to 6 months after they approve the case. It will take about a month and a half once they approve it and send it to the NVC. Then everything else takes about 3 to 4 months to process. Its slow going. You might be able to get everything done in 6 weeks, but the wait from USCIS to NVC is guaranteed and the dates for interviews close out fast for the next month.

Dont know what you do for work, but you might want to swing an extended vacation and go visit, maybe stay with family if possible to cut expenses.

the first 6 to 8 months are the worst, after that you start getting use to it.

It sounds as though he doubted that you were a PhD. Truly strange.

CV is used almost everywhere else in the world except in the US where it is Resume. Sounds silly, but if he was doubtful about a claim in the documents then that must have been why he denied it. Maybe just your age and a bit of jealousy!

I do appologize if this question has posted, i have seen something before but cant find it.

Realistically speaking, how much faster was the CR 1 for you? Are you happy with the decision that you made?

I currently applied for 1130 and the 129 to make it faster, but everyone seems indifferent. I have my approval so let me know asap, and maybe how to cancel the 129 to go the CR 1 route.

Now im really confused.

So far i have the approval for the I 130 and the I129f(K3)

I have currently not sent anymore money or any more papers. The last thing i got in the mail was saying the K3 will be sent to her embassy in a week, in which i hope to abandon/ignore. I talked to someone from USCIS and they said i need to wait for a package?????

Yesterday I called to question the NVC why they havent sent me something stating that they are sending papers to her country like the K3. They responded they are working on the papers now.

Also i find it strange that we have a appointment and i have yet to recieve anything stating that appointment. Now my wife is going for something medical tomorrow, to a appointed doctor. Ive seen the papers , stating, "Resident" which i thought was the CR1 but later found out it was the K3.

I really want to do the CR1 but i am so lost.

Well, im doing the CR 1 but my wife says she called immigration and they said that the cr 1 can take another 6 months. I know this is not true. I think that they are thinking she is talking about the k1? No idea.

We got the interview for the K3 and its Aug 3, i was just going to ignore that but shes so worried that now the CR 1 is another 6 months. Can someone please tell her on here that its NOT 6 more months.

Her Embassy was the one that told her that.

IF the interview for the K 3 was Aug 3 then how long do you think it will take for the CR 1?

It is not a good idea to leave any question on the form unanswered. It is asking you if you want a SSN automaticaly issued to her after her arrival in the US.

You have two choices 1. say yes you want a SSN and once your wife his in the US it should arrive in the mail in about 4 weeks OR 2. say no you dont want a SSN issued. Then once your wife has arrived she will need to complete the SSA5 form and then go in person to your local SSA office and apply for a SSN that can take anything from 2 weeks to 2 months.

lol i am so tired of researching and paper work, you guys understand smile.gif so, to make it easiest sounds like the best idea is to say yes on the application. Just confirming your answer

IR-1 / CR-1 Spouse Visa Process & ProceduresUS Tax while I-130 pending
If you look on the instructions of the W7 it clearly states an "apostille" is needed if you do not have your documents notarized at a US embassy. This is only necessary if the spouse lives outside the US.

http://www.irs.gov/pub/irs-pdf/fw7.pdf

You can submit copies of original documents if you do any of the
following.
c Have the copies certified by the issuing agency or official
custodian of the original record.
c Have the copies notarized by a U.S. notary public legally
authorized within his or her local jurisdiction to certify that the
document is a true copy of the original. To do this, the notary must
see the valid, unaltered original document and verify that the copy
conforms to the original. U.S. notaries public are available at U.S.
embassies and certain consulates worldwide.
c Have the copies notarized by a foreign notary. However, foreign
notaries are only acceptable as outlined by the Hague Convention.
The Hague Convention provides for the simplified certification of
public (including notarized) documents to be used in countries that
have joined the Convention. A certification will be issued in the form
of an "apostille," which will be attached to the copy of the
document.
Note. The apostille must stay attached to the copy of the document
when it is sent to the IRS.

If you are a citizen of the UK, did you also include an "Apostille" with your W7 & certified copy of your passport? I sent in my tax return last year adding my husband as married filing jointly and attached his W7 and notarized copy of his passport and it was denied due to not having the apostille attached. They removed him as a deduction and sent me my check less $800. It's taken months for him to find out how to get an apostille in Englnad, but he finally did and he's sending it to me now. I can attach it to my 2007 return and get his ITIN as well as apply it to 2006 and get that $800 due us.

Good luck
