IR-1 / CR-1 Spouse Visa Process & ProceduresWays to bind together an I-130 petition
What are most people using to bind their I-130 documents together these days?? It seems ACCO fasteners are recommended but not too sure on this. Our overall document is pretty thick!

Thanks guys

IR-1 / CR-1 Spouse Visa Process & Proceduresquick question about G-325a photos
Sorry for my spree of random questions lately, I do try using the forum search :)

Is it necessary to put date of birth on the back of the G-325a photos? The I-130 instructions just say to print the persons name, but this guide >> http://www.visajourn..._live_in_the_US

..says to write date of birth on the back of each photo too.

Thanks!

well we are including my copies of boarding passes, and photos of us, copies of cards we've exchanged, copies of my US entry passport stamps etc,

Trying to include a variety of evidence, but not anything excessive :)

IR-1 / CR-1 Spouse Visa Process & ProceduresAffidavit from myself??

I think you can include anything that isnt 'dodgy' if you think it'll help you prove a bonafide ongoing marriage.

To be honest all we sent (not my decision) I think, was
2 wedding photos, marriage cert, divorce cert, bank statement, and the payment - which was payable by both of us.

Thanks matey

Also, we have used yahoo messenger as our main means of communication. As it stands right now, we would be sending about 40 pages worth of conversations transcripts. Is this too much to be including with the I-130?

After that poor dudes I-130 denial today, has made me think twice about all this.

IR-1 / CR-1 Spouse Visa Process & ProceduresAffidavit from myself??
Hi all,

Very close now to filing our I-130. I (the non USC) have written an affidavit to accompany our 2 affidavits written by family members. I have included exactly how we met and the events leading upto our marriage. I am just wondering, are we allowed to include this? Is it a good idea to include as our relationship certainly has not been the norm (Wife had leukemia etc etc) and it gives the full story of our relationship. (It is 5 pages but I couldn't really make it smaller)

Thanks :)

IR-1 / CR-1 Spouse Visa Process & ProceduresHow long does I-130 take?

You can get in trouble with the US government if you get married intentionally when the other person is here on a visitor's visa. And it is likely that a visitor's visa will not be granted by the US embassy to persons asking for one, for example, that are from Hispanic countries if they can't show intent/reasons to return to their native country or aren't upper-class (aka...richer).

You don't get in trouble for intentionally marrying on a visitor's visa. That is completely legal. You can get in trouble for intentionally marrying for the purpose of adjusting status.

I think that's what you meant.

IR-1 / CR-1 Spouse Visa Process & ProceduresK3 or IR-1/CR-1

Hi. I am from the UK too preparing to join my US wife :D

The K3 visa is pretty much obsolete. The only option really is the CR-1/IR-1 immigrant visa. This visa will allow you to find employment immediately after entering the US, you just need your social security number. This visa also eliminates the need of having to change status while in the US which the K3 required you to do.

The first form he must file for you is the I-130, along with all necessary evidence,

Actually, I would have thought you could go for DCF (Direct consular filing) with the US embassy in London, since you guys have been living together over 6 months in the UK. That's a whole different thing and I don't really have knowledge of that.

IR-1 / CR-1 Spouse Visa Process & ProceduresK3 or IR-1/CR-1

Hi, my husband and I are preparing to apply for me to move to the US and need advice on the best way to do it.

My husband is an American citzen and I am a British citizen, we were married last year in the UK and have been living here together since then. Due to circumstances, it is necessary that my husband return to the US and of course I need to go with him. It is most likely that he will return later this year and we will file early next year for my visa. In April we will have been married for two years, which I believe can make a difference as to whether or not I get a greencard on arrival to the US or have to file to have my status changed.

There are so many different forms to be filed and at different stages. Honestly, we just need a simple explaination as to how to apply. Whether to file the I-130 first and what follows after that? Whether we have to remain in different counties until the whole process is complete? On here it talks about K3 and IR-1 being an option but I'm not quite sure what the difference is? On the USCIS website I only see the otpion in regards to a K3 application.

Though I handled most of my husbands application to come to the UK, my journey to the US seems so much more complicated and I would really appreciate any assistance I can get.

Thank you in advance xx

If your FIL filed the taxes separately, last 3 years tax transcripts plus his current year income proof (employment letter, paystubs etc.) is good. Otherwise, I would suggest to include FIL's W2/1099 with his tax returns 1040 and its schedules for the last 3 years plus current year income proof.

Loto

thanks (F)

As my wife has not worked for several years due to illness and has therefore not filed for taxes, I'm assuming she just writes her income $0 and does not need to include any additional info in regards to tax returns?

I have a question too on this subject :)

My wife has not worked due to her illness. I'm assuming she completes the I-864 as usual?

We are using her father in the same household as a joint sponsor so I know that he must complete the I-864A form. I am unsure if he needs to include W2's and 1099's along with the IRS transcripts?. Does he still need to include these even if the transcripts are originals? How many years should he include?

There's what seems like conflicting info on the I-864 and I-864A instructions.

Thanks

IR-1 / CR-1 Spouse Visa Process & Proceduresheeeeeeeeeeeeeeeeeeelp

i had my interview yesterday in casablanca consulat in morocco for a cr1 visa.after the CO asked me about 20 questions most of it it was about my wife. im sure 100%i replyed at all of it and all the answers its write
but at last she give me back my passport and a paper that the section 221 g its marked. the CO told me that my application it will send back to USCIS
SECTION 221 (g) which prohibits the issuance of a visa to anyone whose application does not comply with the provisions of the immigration and national act or regulation issued pursuant there to.
i think they refuse to give me the visa because my wife it dont work and her ex hasbend is the co-sponsor
please told me what to do im lost again

I'm afraid I don;t know what to say, other than try to find an alternative co-sponsor. It seems very odd that you wife's ex-husband is sponsoring.

Also, you already started one thread on this already.

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion for Co-sponsor

Good day, I have a question for the first package for CR1 about a co-sponsor. Do we need to include my co-sponsor information on the first package, like a copy of birth certificate. Does the co-sponsor needs to fill up the form I-130 and G-325a and send it on the first package? thanks for the reply...

When filing the I-130 you are not required to include any info about your chosen co-sponsor. There will be no need to submit any information pertaining to this until your I-130 is approved and is transferred to the National Visa Center. They will then need you and your co-sponsor to fill out form I-864. But you don't need to worry about this for awhile yet :)

Hi, so Ive been in touch with London today and they've told me that they have sent out a packet to me. This is a packet requesting documents. Ive no idea whether it will require me to send documents / payment in prior to my interview or to take everything with me TO the interview.

Anyone shed any light what will be next?

On another note, wellingtonboot has his interview in London tomorrow for his CR1. Im sure you'll join me in wishing him well and all the luck in the world for a member of our 'community'

I can't shed any light on your case, but I wish both of you the best of luck!

This is what I'm concerned about. My wife has no income at present (mainly due to her illness the past few years), but her father is willing to be our co-sponsor and he earns more than enough. IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion regarding attempted expedite with USCIS

Technically YES, although Ive recently been told once its been expedited at NVC, as its the Consulate that approves it, theres no need to expedite at that level, however Im not 100% convinced and have written to expedite just in case, and will continue to push for the service until Im told I no longer need to.

nice one :)

So I'm assuming the I-864 packet and DS-230 packet eventually have to be sent to the embassy for processing... rather than the NVC..?
Paloma&AdamMaleUnited Kingdom2010-11-17 16:05:00
IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion regarding attempted expedite with USCIS

Getting professional notes isnt easy in my experience, so if you have the chance to get them to print out their requests for all 3 levels, just in case, to save time, that helps matters. AT the NVC level, as soon as you get your case number email the expedite request to the NVC. That will be then forwarded to London for adjudication, if approved, it goes straight to London virtually by-passing the NVC

So am I right in thinking that if USCIS approves an expedite, once transferred to the NVC we have to request for an expedite there too?

RichiJenny,

Two of my wifes doctors are writing letters on her behalf for our expedite request, however, her psychiatric doctor is chinese and says that she doesn't have enough grasp of the english language to write a letter. She suggested that my wife write the letter on her own behalf and then she would sign it for her. What do you think of this?? It seems abit dodgy to me....

If you go to an interview and are denied with chance of filing a waiver - file it immediately and insist that the CO takes the whoe packet that you have prepared, not just the i601 forms and HSL - for both spouses, as this is now required. Try to keep your whole package together.

I sent him a message early this afternoon, that was before I knew about his denial. I can't imagine how he must be feeling. My wife and I are expediting our case too as my wife's health isn't great right now either. To be separated from your loved one while they need you by their side is really painful. I can empathise with him. But things do have a way of working out, and I'm sure he'll be reunited with his wife in due course, sooner rather than later.

I've never been entirely sure on this.... are you supposed to leave no later than the date stamped on the visa waiver card, or is it the day before that you need to leave? My last visit, the date stamped to leave was September 8th. I left September 7th .... not sure if I stayed 89 days or 90 days... because if you count the day I arrived (June 10th) up till September 7th... it's 90 days in total... confusing
