Hmmm...I'm not sure but I think the three D.U.I's will not be too much of a problem but you should preload the information in your package because they will ask for it. If I understand you correctly and you have 3 DUI's...You will need : Ememplified Copies or Court Certifications showing the dispositions in those cases as well as everything that goes with it. You should get that from the court house and send it with the petittion. They will discuss this with your fiance as that is what the request is for is to share it with her. Tell her to be prepared if they ask "How do you feel about marrying a drunk ?" (You don't know what they will do during the interview...). If you have any substance abuse class completions, send that along as well. Someone else might comment on other supporting evidence that might support your case that you are a changed person.

Also, they are not going to communicate with you. All they are going to do is notify you that you got a NOA1 via letter, email, text. There is an optional form that you fill out that is part of the I-129F package to supply this information. The one concern I would have would be the letter of NOA1 which goes to your mail box. Any of the letters that come to you are important so if you are not home to receive it, make sure it is not getting wet in a leaky mail box and your mail is not returned because it was full.

My advice would be to search the board about DUI's and RFE's and see what prior people had to deal with. Good luck !

I am allergic to handcuffs... so I don't drink anywhere except home. Going to bars and having ONE DRINK is just a bad idea because it always turns into 2-3.

I was arrested for a second degree felony which was worse than assault. I had the step daughter from hell (I don't have enough space here to explain). Anyway while trying to keep her from running away, I chased after her with the car and parked. She ran by the park car and fell and scrapped her leg on the concrete. Another emotional woman shows up and the step daughter cries "he beat me up (she had no marks on her but a skinned leg from her fall.)." This is the same step daughter that I practically rescued from certain poverty. I bought her a car, I helped her get her grades from D's to A's. I took her to counceling.

I have 25 years working in corporations and a great career in technology so I am not going to hit someone with a car but that is what the cops charged me with because I just said "I want a lawer". I was shocked when I read that I was charged with Aggravated Battery with a deadly weapon (the car.) as the slammed the door shut and I spent 36 hours in jail.

The State Attorney reads the report and they probably pulled the step daughters mental and criminal history and they dropped the case against me within 45 days. This will never happen to me again but I was in fear I would get an RFE even though the case was dropped.

I didn't. I just got my I-797 (NOA2). So if you don't have a conviction, don't expect an RFE and answer "NO" to the questions. I guess I assumed I was guilty because people tend to think you are when you are arrested but in some cases innocent people are arrested and let out of jail everyday.

I just said to the lawyer, someone mentioned expungment and he responded that expungement is only related to if you have a conviction. What do you mean 500? I didnt pay anybody anything? Im confused, lol. He didnt mention USCIS but he basically just wrote it off with his response anyway.


Your lawyer is wrong on this based on my knowledge :whistle: . You can get ONE record expunged in Florida. Even if it just an arrest. Check with a bettter $$$ Lawyer.

Let it go but be wiser. One guy I spoke with sent $ 20,000 to a woman (so he told me) and is still sending her money and I think she is a scammer. Just be smart in the future. There are a lot of corrupt people in this world and you shouldn't trust anybody. That's how you'll find a good woman like I did.

If you have a NOA1, then you'll get a notice soon. It's not time to call the USCIS yet. As long as you have the NOA1, I wouldn't worry too much. They have just picked back up and mine was processed and sent to me yesterday. No email, no text, just recieved it in my American mailbox like a Passalubong.

You should search this site and read. Someone is giving you wrong information. You can also read how they process the files if you search for it.

Regarding the medical in Manila, anybody have any trouble booking a room and paying for it in advance by using a credit card from the USA so your Fiance can just show her I.D. and they will give her the room ? I know this can cause some troubles. Do you have any experiences in this ? Which hotel ? What procedures ?

Does she have to have a copy of my credit card with her ? Did you use Agoda.com or call directly. Help me ?

I had to go round and round with Marriot Manila to get approval for her to arrive before I do with just her I.D.

We had a similar experience!! I am a US citizen applying for my male Nigerian fiance to come here. Ola had his interview on Nov. 21st, and was denied. We used a lawyer, we had every piece of evidence required, we had clean health record, clean police record, we had record of the wedding plans, and a building reserved for the wedding, chats, phone record, etc, EVERY THING!! The interviewer spent 10 minutes questioning Ola about MY ex-husbands race ( which happens to be native american indian) then the interviewer tried to find Bishop Weber (the man who was contracted to perform the wedding) online, then he denied the visa. HE LOOKED AT NONE OF THE EVIDENCE WE HAD. We are hurt, humiliated, shocked, and MAD!!

This system is a farce. Do the american people really think this is a way to keep a terrorist out??? I have contacted senators, congressmen, NVC, USCIS, and tried to contact the embassy in Nigeria. ( i can not get anyone to answer the phone at the embassy, or even an answering service.) We are at a loss. We dont know how to proceed. I cant believe that they expect us to totally reapply. We have been working on this for almost 2 years. Not to mention, we have spent every penny we had. If anyone has advice, please share!! I feel so so bad for all those who just want to be together, and are told that they cant be. Who are they to tell people that they cant be together??


What is your income ? I have this personal belief that if you have a lot of history making good money in America that they tend to believe in your relationship more. I have seen people who get denied also say we were above the poverty line. The poverty line in America is one step above living in the slums in third world countries and I just have this hunch that they turn away many people who are marginal income. Someone correct me if I am wrong.

Huh?? Where in the 6th ammendment (that you quoted) of the Bill of Rights does it state that "murder" is exempt.

Regardless, since this was apparently a state offense, the 14th Ammendment (Due Process) would apply in state law. The due process in the 14th is derived from the 6th Ammendment, so they are closely related..


Okay, I concede that it looks like murder is not exempt to the speedy trial. What did I hear once about murder being exempt from something...time frames ? Was it civil ? Maybe it was during the Casey Anthony fiasco I heard something... I don't know but I think it is a good law so it should apply to all.

I'm no lawyer and my advice is free so take it for what it is worth :whistle:

IMBRA doesn't apply to me or anyone else that is a petitioner that hasn't been convicted of a crime that falls under IMBRA. The law is written to share the background of the petitioner with the beneficiary mainly. If the crime falls under AWA (Adam Walsh Act) then the petition will be denied most all cases but not all from what I read whereas one guy was approved. In this OP case, he is the beneficiary I think of which I'm confused as to how an arrest but a non-conviction will effect him. I just don't know but since it is still an open case and he is the beneficiary, he needs to be prepared to defend himself and state why he did not commit a crime. (I am repeating myself here)

In the US, we have a law written in our constitution which applies to everything except murder. The law is that "every accussed will be afforded a speedy trial and be allowed to confront their accusers." In Florida once you are arrested, the State Attorney has 180 days to officially file charges or drop the case. I learned late in life what a wonderful piece of work our constitution is and too bad you are not afforded the same law because it sounds like you can be followed and accused for life.

As a beneficiary, if it ask for arrest, you would be very wise to disclose it. It sounds like an open case so if it is, they will want an arrest report and all supporting documents. From there, it is not my guess but I would tell the truth and if you intend to convince them your opening line should be "No crime was committed." and then explain why.

I'd also find a way to get your officials to Sheet or get off the Pot. An American term for put up or shut up.

GringoD... oh.. I see you sent your I-129F off in July ? Well, I sent mine off August 25th. I got no text, no email, I wasn't on the web site. I had a hunch so I checked my mailbox everyday. I just received my NOA2 on January 3rd that was processed on 12-28-2011.

Don't count on a notification but wait at least 5 months before you start to concern yourself if you have a NOA1.

It could be in your mailbox now.

Very interesting thoughts. I can't offer any comments about your sistuation but citizenship for your stepdaughter she be thought through carefully as you don't want to deny her something that you might regret later.

I too have been thinking of my future in the U.S. and although I doubt I will leave soon, it is an option. People here are chasing stuff mostly. They hop in their cars and drive back and forth for 500 hours a year just to get to work. That transportation bill alone with maintenance, insurance and monthly payment means they work for a month or two just for that. Let alone every other bill housing food. I grew up on three acres but there is no way I could afford that lifestyle for my children in the city by todays dollars.

If you can't make considerably more money here then why stay in the U.S. ? My fiancee is from the Philippines. Maybe one day, we might move to Panama or Costa Rica but there are lots of places to move to have a better quality of life than here. Thanks for posting this thought as it seems to be something I have been thinking about more and more myself.

I provided medical care for my finacee as well but it was a lot of dental that she had to have done. The medical prices there were probably 20% of what it would cost in the US.

I have been told the NOA1 is worthless now and the NOA2 document is so valuable that it is difficult if not impossible to replace and must be

I would highly recommend you not spend anytime away from this web site for about 3 months. Just live on it and see what other people go through. That will educate you.
For example, you put in the Texas Service Center. Is there one ? You might have sent it to Texas but your application likely got forwarded to California or Vermont. I know
so much now but 4 months ago, I knew nothing... I spent about 10 hours a week on this site and I saw some errors other people went through that might help me be more prepared.
I just packed up everything to handdeliver to my fiancee next week for her interview. Be aware that all Embassies are slightly different. Read the Bulgarian US Embassy reviews.
That will help you a lot too.

Chat with your fiancee and start to organize your evidence over time for proof of a relationship. You have probably about 4 months until you are
approved for NOA2 unless you get an RFE but there is no guarantees on this time line, I am just telling you from my own experience because I just got mine. Congratulations

Let me ask you some tough questions.

Are you really helping them out or are you being cheap and spending all your money that you are making and just living better than you normally would once you do have
to move out. If I was the CO doing the interview, I would scrutinize your relationship and make sure it was bonified.
Many people DO attempt to bring a spouse over while their real motive is for them to take care of the aging family members.

I have no facts.

I don't know how they can estimate whether you can support her or not in a subsidized living arrangment because your situation will not last. You need to figure your ability to support her based on current rental prices and not the deal that your parents are giving you. That is just my thoughts.

That sweet deal you have is going to end one day and it could end based on tensions in the house. Good luck

Once we received our embassy confirmation email with MNL #, we printed that email and my fiancee
(now wife!) used that for entrance to St. Lukes. No problems.

My wife did eventually get her embassy packet with letter.............2 weeks after her interview!

She landed October 13th in Chicago, IL airport. We are planning to marry on Nov 19 and are having issues getting her social since she was not given back an I-94. From what I am reading on the internet, we have a problem. Was she suppose to get an I-94 back when she landed in the states, cause she says they never gave her anything? Please help, I don't know how to go bout getting her a SSN. What other way she can see her SSN then???

The I-94 was given to her on the plane maybe 2-3 hours before landing in the USA. It was about 4" wide by 10". She filled it in and along with her brown envelope and passport gave it to an ICE person behind the immigration counter at the airport. The ICE person would have stamped then ripped the bottom portion off the I-94 and stapled this INSIDE her passport.

My point is the I-94 is not a traditional sized 8.5x11" form, it is actually just a bit bigger than a business card. Before panic mode sets in, look inside her passport for a page with this little card stapled inside.

If by chance a mistake was made somewhere, you will need to get a new card. Go here for directions.

Once again I'd like to thank everyone SOSO much for the fast replies, it really means alot to us to have a community like VJ around us :) My fiancee is currently on the phone and is ordering the transcripts free of charge.. This seems to be the best option as we dont have a fax machine. If someone could just clarify for us this is ok? And will the transcripts be acceptable scanned over to me? As there isnt going to be time for me to recieve them via mail.

Transcripts are 100% acceptable, I used nothing but transcripts on all of our K1/AOS and now removal of conditions. Copies are also ok so I see no issues with scanned then printed transcripts.

Preparing documents for the interview right now but kind of hit a road block and a big panic situation as we can not find my fiancee's tax returns from 2009-2010.. We have 2008 but not the past 2 years!

Is there a way we can get them fast? Please any info on this would be a great help


Just call the IRS hotline at 1-800-908-9946 (or online at http://www.irs.gov/i...=232168,00.html) and order your transcripts for the missing years. Takes a few days by mail, online may be quicker.
