I REALLY appreciate you answering me and giving me some good "inside information." It has been nearly impossible to get an answer to my question as to exactly how they count the 2 years spent back in Russia. Hearing from a Russian citizen who has been through this really helps. We know they won't count the 3 months she spent here in the US last year, but we hope they will overlook the week or 10 days she has spent in Italy or France every 3 months for the past 2 years. Since May of 2008 she has met me in Montenegro, Paris and Vienna for a total of about 30 days. She has also spent about the same amount of time in Milan and Paris with her Mother conducting business for their family owned fashion business. I am hoping they will overlook some of this at the interview. However, like you said, it may take until November anyway for her to get an interview date. We are sending in the I-130 application this week, so I figure it will be June for that approval, then another 4-5 months to send in the next chuck of paperwork and get an interview in Moscow. I mainly wanted to make sure we could go ahead and file for the I-130 while she still had time left on her 2 year HRR. If we had to wait until the 2 year HRR was up to start ANYTHING, it would take FOREVER to get her here.

Thanks canadianwife and milimelo. I hope you are right about them not counting her days out of Russia towards the 2 year HRR. It doesn't make sense that she could never leave her country for 2 years, but the rule seems to state that she must be physically present in her home country for an aggregate of 2 years. Does anyone know when they determine this? Do they look at the stamps in her passport when I submit a copy for the I-130 application, and determine then when her 2 years is up? Or would it not be until her interview in Russia? If so, she could go to the interview and they could decide she still hasn't fulfilled the 2 years, and reject the whole thing.

Sorry for all the questions, but I have been unable to get answers anywhere else!

Hi everyone

I am new to this forum and I am hoping someone has some experience with this issue and can give me some help.

I am a US citizen and live in Florida. My wife is a Russian citizen who visited my city on a US State Department funded J-1 visa back in December 2007. She is a Russian attorney and came here to study our legislature. She returned to Russia in May of 2008, and her J-1 visa has a 2 year home residency requirement back in Russia. If she had never left Russia since returning, her 2 years would be up this May. However, she spent April thru June of 2009 in Florida with me at which time we got married. She came here then on a 2 year, multi-entry B2 visa. Rather than try to stay in the US after we got married and look like we were trying to commit fraud, she returned to Russia on July 3, 2009. In addition to the 3 months she spent here last year, she has been out of Russia for a total of about 3 months on business (family owned clothing retail business), traveling to France and Italy, and also a couple of trips to Europe where she and I vacationed.

I am about ready to file the I-130 paperwork but have the following important questions:

* Does ALL the time she has spent out of Russia not count towards the 2 year HRR? If not, then her 2 years won't be satisfied until around November 2010, if you add 6 months to May. I keep getting different answers to this question. Some people say only the time she spent back here in the US counts against her, others say the law is enforced strictly and ANY day she was physically out of Russia won't count towards the 2 year HRR. This seems rather harsh, as you could then never leave your home country for a vacation out of your country.

* Can I file for the I-130 while she is still waiting to fulfill the 2 year HRR? I know she can't be issued a CR-1 or IR-1 while she is waiting out the 2 year HRR, but it takes such a long time anyway that I would like to use up some of the next several months letting the I-130 get processed. If it takes about 7 months to get a IR-1 (including 3-5 months for the I-130 approval), then does that mean she could get her I-130 approved in 5 months, maybe still have 1-4 months to wait out the 2 year HRR, but then after that is up have just 2 months left to get the visa? Am I making any sense? I guess I am asking, do I have to wait out the whole 7 month process starting when her 2 years is up, or can I go ahead and get the I-130 out of the way now? If so, WHEN would they determine when her time is up? At the interview by looking at stamps in her passport? By reviewing our paperwork? I just don't want to screw this up and have them tell me I committed fraud by applying for a I-130 while she was still fulfilling her J-1 2 year HRR.

* Is the CR-1/IR-1 the best way to go? We were initially going to do the K-3. but if this takes about the same time or slightly longer, isn't it better to just go ahead and get the immigrant visa? Does it really take about 7 months from the time you apply for the I-130, or is it much longer than that?

No, you don't have to have known each other for two years, you simply need to have met in person in the last two years. That is what it means.

My fiance found a site (https://www.immigrat...fiance_visa.htm) that states "Strict qualification apply to the K-1 Fiancé Visa. Both parties must be single, over the legal age, and have an intend to get married. The couple must be together for over two years. " Is this accurate??? I'm not even sure the site is government, since it ends in .org. I only have a few minutes here. No one has asked us yet, but we've been a couple for a year and a half, or so.

I know there are other threads on this, and I just don't get it. I signed up to receive automatic updates on my case at https://egov.immigra.../jsps/index.jsp. According to that site (https://egov.immigra...iceCenter=Texas), TSC is NOT processing I129-F's, and I don't see a date of 2/15/06 anywhere. CSC (https://egov.immigra...nter=California) is showing they are on 11/03/05, but it hasn't been updated since 02/08/06.

I can't get the page you all were using to show 02/15/06 for TCS to open properly, and I don't know whay two sites would have differing information. The site I am using is THE SITE TO USE, isn't it?

Does that mean they will contact us only through email afterwards ?



Hello Samoray!
This is what will happen...Approximately 10 days after you get your NOA2 from the USCIS, call the NVC and give them your receipt number from the NOA2 and they will give you your case number. Plus suppying them with your and your SO email address will make it capable for them to contact you through email. You will NOT receive things in the mail unless you specify, but really it is way much quicker via email!:thumbs:

Congrats on getting your case number! Yes, call them and give them both yours and your SO email address. That way you can submit your ds-3032 (choice of agent) and get the ball rolling! If you are not using a lawyer to help you through, you should select your US citizen as the spouse. That way you can pay the fees online and you will get all your notices via email. It'll speed things up quite a bit!

The RFE will come by email. Once you provide your email addresses to the NVC that pretty much does away with any snail mail activities. I realized that I was getting a RFE because after sending my paperwork 10 days went by and I still didn't get SIF.

If you were exempt from the military you definitely need to send in the exemption form and also the translation.
Better be safe than sorry because it may cause you to get a RFE.
As for the 2X2 photos, you can go to the website and follow the instructions for printing out the photographs they ask for. My husband went to where ever they do the passport size photographs and specifically asked for the 2X2 that the US requests and got about 20 of them! So we had plenty to send in.

Hey everyone, my husband and I arrived at Chicago yesterday. What do I do now in regards to his whole visa process?? He came here on an cr1 visa. How do we get a SSN? Congratulations on getting your husband to the US with you!
First of all, it depends on how quickly the POE takes to send in your information to Homeland Security to how quickly your hubby will get his greencard OR the SS office to get the application for his SS number.
My husband came through JFK for his POE and it took a couple of weeks for them to send the paperwork in for his stuff. We ended up waiting 2 weeks and going to the SS office ourselves and making an application for his SS number. Now the tricky part with that, is that the name on the social security card has to match EXACTLY what homeland security puts on his greencard.
We had trouble because the SS office tried to say that my husband's full name wouldn't fit on the card and when he got the green card, it had his FULL name on it so we had to resubmit another application to correct his name on the social security card. *BTW his whole name DID fit on the card!*
I was able to get my husband on my insurance at work and pretty much everything to do with that, BUT you do have to wait for the social security card to get state DL and etc.....
Keep in mind the expiration date on his conditional green card because you will have to apply for ROC no more than 90 days before the expiration of the CGC.
I have heard from some people that they got a reminder letter telling them to apply for ROC and then I have heard from others saying they didn't.

How can I get statements from my husband's family members notarized in Egypt? I have already looked up and called a list of Egyptian lawyers who have supposedly passed the American Bar. None of them have spoken English. On the American Embassy website it says the following: The American Citizen Services Unit of the Consular Section performs notarial services Sunday through Thursday between the hours of 8:00 and 11:00, with the exception of the last Tuesday of every month. Services include taking of oaths, acknowledgment of signatures on documents for use in the United States, certification of true copies for Social Security and Internal Revenue Services purposes, and authentication of Government of Egypt officials' signatures. Notarial services are performed for any person regardless of nationality if the document will be used in the United States.

The document(s) I want to have notarized will be required "Requests For Evidence" the USCIS has requested.

I am not currently in Egypt. My husband is there and we are processing his I-130 visa application. When he called to the US embassy on their ridiculous 900 #, they told him they do not provide any services for non-Americans. Who can help me? Also according to the fee schedule. Notaries charge $50.00 PER SIGNATURE???!!! What is up with that? Are there any other resources available? I'm tired of getting the run around. Please help me.

I hope you found the informaton you were looking for. When I apply for the I-130 for my husband, I included notarized letters from people here in the US. Like one from my adult daughter, my boss, a couple of close friends who knows my husband and myself. They are just wanting evidence that this is a real relationship. If you want to submit letters from his family, you can do that, but if you have evidence of you and your husband with his family via pictures, would work even more better.
This first stage of your VJ is to show just cause for the application of the I-130. I wouldn't worry about getting letter notarized from his family in Egypt only because the USCIS would have a hard time following through that it is the solild truth.

I just wanted to take your advice about which date to mention in the I-130 and in the interview about our marriage, as we had a private marriage contract in a date XX and another date YY for registration of the marriage in the court.

When you are saying a private marriage contract, is that the one drawn up at the lawyer's office? If so, then it is not counted as a legal document in the eyes of the counsulate. They want the dated/fingerprinted 5 copies you had to sign contract that has to be translated into english then authenticated and notarized at the Cairo Consulate.

It sounds like you are waiting for the I-130 NOA2. If that is so then you are going for the CR1 visa (spousal visa). Once you get the NOA2, your "packet" with application will go to the NVC. You can follow the NVC guidelines and get majoritiy of your paperwork and your SO papers together to mail them in when they ask for them.
I know what you mean about the mail being horrible there. My husband would get my mail but ended up paying way too much for the little stuff I sent to him.

There are some great information you can find here about the NVC and getting ready for the next step in your journey. Just google James' shortcuts or Lingche's shortcuts.

I have been scouring the threads and topics and cannot find any useful information for this.

How soon after should my husband get his conditional green card, social security card and welcome to the US letter?
I see in people's timeline when they had gotten theirs, but still there is hardly any information on what to expect once they arrive.

We went to our local SS office last Friday to see if he was in the system yet, and according to the lady we spoke to there he has not been put into the system. She recommended for us to come back 4 weeks after POE and if he still isn't in the system to fill out a new application.
So that takes care of the ss # but still don't know anything about the CGC.

Any info and/or past experiences will be appreciated!!!!

I was looking at the requirements for the I-864 and it states that you need 6 months of pay stubs and/or employment letter if you believe any of these items will help.
I have a stable job with government and copies of pay stubs. My issue is with the employment letter. Being a government agency our HR department is less than cooperative in most manners.

My question is, do I really need this letter?


You just need to have your immediate supervisor sign the letter. Leave HR out of the picture if at all possible (they will just screw things up). The letter just needs to be 4-5 sentences long on letterhead with the basics, start date, salary, job title etc. I am Federal govt. and my boss had no problems with signing.

My opinion is the letter is important.

My husband already have a tax refund from 06,07,08 the 09 have not filed yet.. and he has a w2 from 06,07,08,09.. He dont have a transcript that came from IRS. So on monday he is going to call the IRS to request a transcript from 06,07,08 and 09.. But it takes a week to get it.. We made a mistake. we didnt get it earlier..

My question is Can we send the package of AOS now even though we dont have the IRS transcript ,but my husband already have a W2 and tax refund that his company gave , employment cert and pay stub?

do you think that the NVC will send RFE to us bec we dont send a IRS transcript?

Please help us...


Did you keep a copy of the actual tax form (1040, 1040a etc) from those years? I was in the same situation for 2008 tax year and forgot to get a transcript for that year. I just printed out my 1040 for 2008, signed it and sent it in with 06 and 07 transcripts. No RFE!

I personally would wait the 1 week for the transcripts to arrive then mail in the package. If you get an RFE for lack of proper documents, you will lose more than 1 week in the delay for the USCIS to resume your petition once you send in the tax forms.

As one post suggests, a faxed copy is also a solution. I was not aware the IRS did that.

Here are the questions they asked my fiancee (now wife!).

1. How I and my fiancee met (yahoo).
2. How many times we met (3), where we stayed (hotel names) and the EXACT dates.
3. What I do for work.
4. Where I live (complete address).
5. My birthday and what state I was born. They Did not ask the city(?)
6. General questions about my family like how many brothers, sisters, mother's first name etc

Her interview was 6-8 minutes and DONE and APPROVED.

Hello, I am applying for my mother to come live in the US, she currently lives in Medellin. Around Dec 15, 2010 I learned that the case and paperwork had been sent from the NVC to the Bogota Embassy so the next step is the interview. They stated that when an interview slot becomes available and an interview date has been scheduled, the designated representative of this case (applicant, petitioner, or attorney) will be notified. However I was wondering if anyone has any idea how long the wait will be. Is it weeks, months, years? I am totally lost here. She wasn't scheduled for Jan 2011 and was wondering if it is going to take a while?

I'm not sure if filing for an IR-5 interview is different from a K-1, but it took us 2 months. I would think that her interview should be in February...no later than March.

I think he was living with his wife in Indonesia and was going to stay permanetly, but then decided not to and to bring her to the US with CR-1.
He wants to stay in Indonesia and wait until his wife gets approved and then go to the US together.

I too didn't know anything about the process until I decided to file for my fiance. I spent many hours on this website reseaching and eventually I learned all the terms and more.

I don't know about all the forms you are using because I went the K-1 route. I think it will be hard to stay with her and do all the paperwork from her country.

If the I-186(I think it is) is like the I-134 then you will need a co-sponsor because you are not currently working. However they will want your past tax returns anyway, and it shows you weren't unemployed for long periods and things like that. You could have your mom be a co-sponsor if she makes 125% over the poverty level for a house of atleast 3.(you, your wife, and mother) Your mother could use her house as assests which could help.

It is very sad to read those type of post. I tell myself I have done everything I can and will hope for the best, but know that anything is possible and try to prepare myself in my mind for several different situations. I ask myself what would I do if Natoy left me without a word? What if I fall in love with someone else? What if he's secretly gay? I also picture us having a good and happy life so I don't let my fears sabatoge a relationship that I presently enjoy. That seems to help me. Remeber we all take a chance of being hurt when we open our hearts up. I hope none of us get hurt. One also has to remeber that the people with success stories don't post on here much because they have no problems like that. :) I wish they would though...Just an update on how good things are going. :)

My Wife is about to file the I-130 for me. I visited her in the US several times, on a couple of occasions for the full 90 days allowed. At present, we havn't actually lived together as a working couple, only visits. Do we need to put an address here at all??

When should I start calling NVC for Case #... what do I do after that?

some are of the opinion that it can make the wait longer. if its genuine and you have strong evidence i cant see it being denied, but im only comparing it to cases i know of. i personally doubt it adds to the wait but nobody knows for sure i dont think. i mean if your wife had toothache and needed a filling, even a dentist letter probably wouldnt swing it. but in your case its somewhat more serious than that, so if i were in your shoes, its worth a shot as loto said.

My expedite request denied and approved normally in 70 days time! To me, it looked like a virtual expedite!

ours took a month from the service request which was a week after filing. as there was a ####### up with a so called specialist filing for us, he garnered us with an rfe which added id say about twelve days onto the decision.

any correspondonce you have with the uscis add your service request number and case receipt number into the subject line. its a tough wait, not really knowing if you qualify, we were given maybes and confirmations of expedite process for a few days, however we didnt know for sure what was happening til friday.

of course you can always inform your senators immigration liasison dept and ask them to trail it for you too. although ours was as much use as a chocolate fire guard!

but it doesnt hurt to have them on board.

i believe if you send the exp req in with the i130 you mark the envelope with a red dot, too. not a hundred per cent on that though. on the uscis site just search expedite. itll show you. i think they give you 3 optiona you can choose from the list too if need be. well, we got 3.

also remember the uscis will tell the beneficiary nothing on the phone. its all the petitioner which is frustrating.

ring the uscis and place an expedite service request. your wife will do this. and then she will receive an email shortly after confirming the request and also an expedite referral number.

your wife will have to briefly explain on the phone the reasons why you are requesting it.

then after a few days you will get a letter requesting medical proof in laymans terms. im sure the drs can help you out there. your wife will also have to write a letter explaining the reasons for the request and why she needs you home. you'll be given a fax number to send the docs to, also it doesnt hurt to fed ex the originals too for peace of mind. then just sit tight for a week or so and every so often a call or email to the uscis - always speaking to a tier 2 just to keep on top of it.

when i had a consultation with steven heller who was great, he said that in the quote topsy turvy world of immigration the more serious things are for the petitioner the better it is unquote.

id consider your reasons for an expedite valid. probably more so than ours in a way. i know its a tough situation. im not sure if you want to go into specifics in the public arena, but its worth a try as loto said. weigh up thee options - does your wife have bad days, how is she coping, is she just about coping, is she in remission and finally and i believe most importantly do you have a good honest relationship with the medical professionals who would provide the evidence for your. if they are willing to do it, and agree with your position, you have a very goood chance in my humble opinion. iif shes totslly cured and thered no chance of it returning, the chances are slim.

My Wife is a high risk case, She's relapsed twice, and had a bone marrow transplant just over a year ago. Right now, she is in college in remission, but she does struggle somewhat, she is dependant on a host of medications to prevent rejection by her body of the new bone marrow. Psychologically, she is on anti-depressants and anti anxiety meds and misses me a huge deal. There is always a risk she could relapse again.

I'm sure we could get her docs to help out. How would we go about requesting an expedite after filing our I-130??

Paloma&Adam, Normally USCIS considers the current serious condition for the expedite. However, it is not a bad idea to try for a medical emergency as expedited criteria. Who knows? At the end, if they approve your expedite, you are the gainer. If not, you have nothing to lose as well.

Congratulations mate!


I am just wondering if my wife and I have any hope of an expedite. Early on in our relationship, she was battling with leukemia, I'd have to return home, knowing she was extremely ill and needed my support. That said, she's been fine for the past year and is leading a normal lifestyle..

Just wondering, considering what we've been through, if we would be likely to get an expedite with our I-130?

What are most people using to bind their I-130 documents together these days?? It seems ACCO fasteners are recommended but not too sure on this. Our overall document is pretty thick!
