Question 36 is ...has anyone ever filled an immigrant visa petition on your behalf, yes or no.....My question is, my fiance and I applied for a k1 visa back in 2003, but our application dissapeared somewhere in Texas (long story). Anyways, does it mean I have to answer question 36 with a yes?

Your right I need to stay positive. They only ask for the most recent year, but you are the second person i heard to get blue slipped for not having even further year's returns. I'm going to scan and e-mail him the papers he needs so he will have them before interview. After I finished freaaking out we found a solution. Thankfully Nattoy's neighbor just bought a printer. I think you may have saved us a blue slip becuase I have a feeling they will ask us for 07 08 as well because we are using a co-sponsor. Sorry you got blue-slipped. Once you give them what they need it shouldn't be a problem. :)

IR-1 / CR-1 Spouse Visa Process & ProceduresAre we going to be expedited by NVC or not?
Some do take about 30 minutes, but you don't really know how much of your paperwork they'll scrupulously review before sending you on your way. I see you're gonna POE at Newark, doesn't seem so bad there. I'll be going through Atlanta and I bet that'll be slower being the worlds busiest airport.

Couple of hours!! OH NO! Where did you hear that mate? Ive heard anything from ten mins to half an hour, I really hope it doesnt take 2 hours, that'll finish me off!

Thanks mate, I do hope it goes smoothly though.

Yes, Im on a CR1, and only have a couple or months ago before i'll have to start more paperwork!!

Why do you need to start more paperwork so soon mate?

Yes, I read through the various POE reviews, and tried to identify those who have gone through on immigrant visas. Alot of them took quite sometime. You get taken aside into a separate immigration area apparently. Seems most take about an hour on average but some have taken 2 hours or more. With your I-601 paperwork, it could take longer than you anticipate mate. Things may be quicker more recently, but I've read several reviews that recommend allowing plenty of time between any connecting flights. Sorry to get you worried! You'll probably end up being fine, but I know I'll be allowing a good couple of hours between my connecting flight when I go.

Thanks for the heads up mate.

I'll be having the medical exam soon, can't wait! :D

Good luck with your flight on tuesday. You can relax now and hopefully enjoy the flight. I'm sure everything at POE should go smoothly. I was quite surprised to learn that it can take a good couple of hours to be processed at POE. Do you have CR-1 or IR-1 status? I will be arriving on a CR-1 so 90 days before the 2 year POE anniversary is certainly a date i'm gonna have to remember. Might even consider sticking abit of paper with the all important date on the ceiling above the bed when I get there so it gets ingrained into my memory lol

I never did any sign in stuff at nvc. Did they process anything there for you?

Great news I'd say next week maybe the end of you should be assigned an interview date. Drop them a line and ring to see if they've received the master file next week. If my timelines anything to go by - 2 or 3 weeks and you're on your way home mate.
I'm really pleased for you.

Thanks mate, couldn't have done it without your advice :)

We never sent any documents to the NVC , besides the DS-3032. The wife just needs to send all her documents across the Atlantic to me now..

Do you have a confirmed flight yet? Looking forwards to the day next week when you tell us you're reunited with your wife mate. I hope she's doing well.

If you havent done already Adam, drop the NVC an email, same format in the subject line asking for the expedite again, and also give the rip off line in London a ring to see if they have any record of your case, ask for the CIU number while you're at it. I did email/call the NVC a fair bit during the expedite period.

I think that may be a good idea mate. The embassy should of had our request for 7 working days now since reopening on 5th of January. Maybe everybody came back to work all slow and lazy after the holidays, I don't know. I think I may call the embassy today to start chasing it up there, it's already taken longer waiting for this approval than it did with USCIS!

Have you got a flight booked for this weekend mate?

Any news on your expedite yet mate? If not, should be any day now, fingers crossed.

hi mate, nice of you to ask. I had to attend a funeral today so sorry for late response.

I called NVC this evening and they said they forwarded our expedite request to London embassy on 3rd of Jan as well as another on 10th of Jan. They still have not heard anything from London.

My wife has just been diagnosed with another serious condition, so we're getting very desperate now. If it's much longer, we're just going to have to send the rest of the documents for processing with the NVC.
Paloma&AdamMaleUnited Kingdom2011-01-13 20:25:00
IR-1 / CR-1 Spouse Visa Process & ProceduresAre we going to be expedited by NVC or not?

No mate, its not needed for the medical. All you need is your case number and any proof of vaccinations you have had.
I'd get the medical booked in if I was in your position as you have your case no. And its not going to be too much longer before you get to the embassy and you're bumbling arounf London at stupid o clock in the morning waiting for the embassy to open so you can start queuing up outside!

I'm almost positive your expedite will go thru - in comparison to our reasons, yours are more urgent. And as a layman so to speak yours reuquires a quick process. Have to say I've not seen an email like you had, but perhaps its a generic one for the holidays. The embassy has hardly been open since xmas eve so it really shouldn't be too much longer. Take it as a positive sign that you were approved in under 40 days mate. Their crieria is pretty much the same all the way through. You've got the uscis over with, now its just the nvc. Realistically tomorrow is the first proper working day back for them. Its a hard life working at the consulate in grosvenor square!!

Thanks for that mate.

My wife and I are both anxious about things. Just want those blokes at the embassy to give us a nice clean, quick, problem free interview. I guess I'll book my £200 ball molesting medical exam tomorrow lol

I'm on my phone mate so can't see your details but I've just realised, the embassy opens tomorrow again after only opening for a day or two since xmas. As its the consulate that makes the decision I shouldny worry too much.
I sent my passport off xmas eve. They received it the following wednesday and shut again! They have more time off than a lottery winning pensioner! I'd say tomorrow is their first real day back, so chase it up thurs fri. That's my opinion for what its worth mate. I don't think they'll decline your request, its just you hit a bad time for holidays that's all.

you are always so informative mate. Thanks for that info. Really hope you get your passport back soon.

Another question, is it true you have to bring a police certificate to the medical?? I'm still waiting on mine so don't know wether to go ahead and get the medical booked.

So after our I-130 was approved and expedited recently by USCIS, we also put in a expedite request with NVC too on January 1st by email to Supervisor Sue along with supportive evidence. I received an email back from them yesterday saying that our request for expedite is currently under review.

Today, I receive what looks like a standard email from NVC with no mention of our expedite request and has the choice of agent form attached.

Dear Sir/Madam,

The attached correspondence relates to an immigrant visa referenced on the subject line. This case is being processed by the National Visa Center. Please read the information carefully and follow the instructions.

This message contains confidential information and is intended only for the individual named. So does this mean our expedite request failed?! Or have they just sent this email out anyway while our expedite request is being reviewed?!

I suppose I should just call them but the line is always busy lately.

it says on the uscis website that you can have that form expidited due to financial loss and other things of that nature. when my husband left i lost my apartment and now live with my sister im barely making ends meet as it is. and after i pay each fee im pinching pennies to pay the next one. without him i cannot work pay daycare and rent a place to live. i am a constant burden on my family....what do i do? i need him home....

An I-601 is only needed for illegal overstays of more than 6 months or more. A 6 month overstay results in a 3 year reentry bar. A 12 month overstay results in a 10 year bar.

As long as he departed voluntarily before 6 months of overstay accrued, then there is no need to file the I-601.

IR-1 / CR-1 Spouse Visa Process & ProceduresExpedite Info

Well, within one week i received a notice that our petition to expedite was denied. The reason given, was that we did not qualify within the guidelines. I never received the form to fill out to state my case. I just talked to a representative on the phone and explained briefly my circumstances. After we talked, he told me i would receive a letter within a week with the answer. When i asked about the form to fill out, he stated that he had written down everything i said and would pass it on. He never asked me any questions or asked me to clarify anything i said. In my opinion i doubt seriously that he was able to type everything that i said as fast as he did. For anyone wanting to expedite, make sure you get a form to fill out. It was doubtful that we would have been approved anyway, but i think if i could have shown our reasons "on paper", there might have been a better chance for approval. Good luck to everyone else.

The reasons usually have to be severe in order to be granted an expedite.

My wife and I had our I-130 petition expedited. After she called to place the service request, she received an email requesting medical proof (doctors letters) be faxed to a specific officer.

I'm not sure what criteria you were attempting to expedite under, but sounds like you should have been given more of a chance.

IR-1 / CR-1 Spouse Visa Process & Proceduresneed advice / dont trust my husband anymore
There's not really an easy way to deal with this. First and foremost, maybe you should try to have a good talk with your husband about your suspicions and concerns.

Once you sign and file an I-864, there is a contract between you and your husband for you to support him at 125% above the federal poverty level regardless if you get divorced.

I would perhaps seek the professional advice of a reputable attorney . I really do hope there is nothing funny going on with your husband, that would be awful, but I will agree it does sound suspicious if he's doing things behind your back. On the other hand, you might just be a little paranoid and everything could be fine.

I really wish you luck.

Great thanks! I guess anything well organized with paperclips or acco fasteners is great and will get us approved. No worry in the conflicting government information online.
Thanks!

We used the acco fasteners for ours. Looks nice and neat and makes it very easy for USCIS to browse through. I think it may be their most preferred method of keeping the file together, however you can still use clips just fine.

IR-1 / CR-1 Spouse Visa Process & ProceduresGetting approval in 2 to 3 months? Is it real?

USCIS website still shows 5 months, hopefully that gets reduced to 2 or 3 months. hope so. that would be a miracle. just a stupid question, can't they hire more people at these processing centers? and NVC? why can't a I130 have a premium processing option like H1B visa?

Because, it's unfair on those who can't afford premium processing. We should some loved ones be brought together sooner just because they're financially better off?

IR-1 / CR-1 Spouse Visa Process & ProceduresPremium Processing Option for I130's (CR and IR)? Vote!

isn't this a great time to introduce new option for premium processing (faster track) option for I130 (CR and IR only) processing?

Charge more fees = more USCIS/NVC workforce = faster approvals? and bridge the current applicants who want to have premium processing by asking to pay the difference in fees?

I gave my opinion on this to you earlier. I believe this decision would be unethical. We are all desperate to be reunited with our loved ones. Why should some of us have to suffer longer and be apart longer than those who could afford the extra cash for premium processing? It just doesn't seem right to me. The filing fee has already recently increased and it certainly doesn't need to be any higher;

USCIS and NVC can't just increase their levels of staff. They are government run departments and there isn't some big pot of money to finance a larger workforce.

Felo & Wayne and Claudia--thank you both very much!

Yes, the courier fee shouldn't be a big deal. I've heard rumors, though, that it can only be paid via credit card (not cash, not debit card). Anyone know if this is true?

I had my interview for the CR-1 last Friday. You have NOTHING to worry about. They were very friendly and they're not out to try and deny you. If all your paperwork is in order you have no reason to worry I assure you.

Anyways, I paid the courier by debit card and it was £14.80 :)

I had to pay a $400 visa fee on the day but that's because we did not process our documents with the NVC so that won't apply to you.

GOOD LUCK!

IR-1 / CR-1 Spouse Visa Process & Proceduresis it a good idea?
Hi, candle- your husband is moroccan, but if he has a USC passport, he will be let inside. In addition, in casablanca, there is
no room you enter or sit down for the interview, you stand in front of a plexiglass window , there is a phone on the left hand side if the CO does not hear you from the protective glass. You stand for the interview right in front of the other ppl waiting
for their interview. Everyone hears your answers and nothing is private. Your husband can sit in the waiting room which is right
in front of the CO glass window in which you will be standing when called.

He does have to show his passport at the window outstide the consulate!

The check point to enter the consulate is across the street, once the police check your belonging across the street from the
consulate, you will cross to make the line outside , and give the interview letter to the person at the window outside the
consulate.

Great idea for him to be there if needed to be asked some questions!

IR-1 / CR-1 Spouse Visa Process & ProceduresNeed advice on I-130 and J-1 2 year Home Residency Requirement
Thanks for the additional replies everybody. I went ahead and filed the I-130 4 days ago. Looking at the timelines on here, the average time from filing an I-130 petition to getting an interview for the CR-1 is 10 months. If they count all of my wife's time out of Russia on vacations against her 2 year HRR, then her 2 years won't be up until November, so getting a visa interview in late November or December would be perfect timing. We will just have to be sure we don't send in the packet to NVC TOO quickly and get too early an interview, if that is even possible. I would rather err on the side of caution and make sure the 2 year HRR isn't an issue when she goes for her interview. Saving a month or two, at this point, isn't worth the risk of getting rejected at the interview and delaying things even more.

IR-1 / CR-1 Spouse Visa Process & ProceduresNeed advice on I-130 and J-1 2 year Home Residency Requirement
Hi Aspasia

??????? ???????!

I REALLY appreciate you answering me and giving me some good "inside information." It has been nearly impossible to get an answer to my question as to exactly how they count the 2 years spent back in Russia. Hearing from a Russian citizen who has been through this really helps. We know they won't count the 3 months she spent here in the US last year, but we hope they will overlook the week or 10 days she has spent in Italy or France every 3 months for the past 2 years. Since May of 2008 she has met me in Montenegro, Paris and Vienna for a total of about 30 days. She has also spent about the same amount of time in Milan and Paris with her Mother conducting business for their family owned fashion business. I am hoping they will overlook some of this at the interview. However, like you said, it may take until November anyway for her to get an interview date. We are sending in the I-130 application this week, so I figure it will be June for that approval, then another 4-5 months to send in the next chuck of paperwork and get an interview in Moscow. I mainly wanted to make sure we could go ahead and file for the I-130 while she still had time left on her 2 year HRR. If we had to wait until the 2 year HRR was up to start ANYTHING, it would take FOREVER to get her here.

Thanks again and best of luck to you!
