I agree, you don't want to run the risk of visa fraud by coming to the states with the intent to marry and then trying to adjust....that is a big risk

K-1 Fiance(e) Visa Process & ProceduresWhere oh where is the NOA2????

I just got home from working 14 hours and this was the first post on my nightly check of VJ. I'm so glad to see that I'm not the only one going "batty" or having stupic small fights about nothing. Today, I decided that we should not talk to each other for one week, to see if it would help me look forward to hearing his voice instead of checking my status on the USCIS website every day. But then 5 mintues after hanging up I realized that was a stupid idea. But since he agreed and acted like it was a good idea, I don't want to look insane and call him tonight. So I guess I'm going to have a seriously bad night. My first night since becoming serious not talking to my baby. I guess I will learn not to come up with dumb ideas to try to end my frustration with USCIS. I have stoped hoping for my NOA2 and keep hoping for a "touch". Then I feel guilty for not being able to wait, because people have been waiting longer then we have, then the cycle starts all over. Anyway I wish we could all be approved and out of this crazy process.

Try not to let this process get in the way of your relationship, that is the most important thing right now. I know how very hard it is though. My finace and I are feeling the stress of it too, we don't really get to talk on the phone that much during the week because of the big time difference between the states and South Korea, but we IM each other every day, and have dates every Saturday and Sunday. It never fails on the weekends we get into some kind of tiff lately too, because of the stress of all of this, it is very understandable. I know what you are going through. You just have to be there for one another and try to understand each other and try to get through the little fights, but don't push each other away during this process, you need each other more than ever right now.

If I'm not mistaken your fiance can cross the border and stay up to 180 days without paperwork. But must return or get a visitors visa if he plans on staying longer than the 180 days. Anyone else????

K-1 Fiance(e) Visa Process & ProceduresDS-156

Hey, if you don't have a current job then the obvious answer is none!

Hence the....maybe this is a bit of a stupid question part ;)

Maybe a bit of a stupid question, but.....Question 21 asks for your present occupation. Right now I unfortunatly don't have job, so should I just write done none in that box?

K-1 Fiance(e) Visa Process & ProceduresPackage 3 questions
Thanks you guys. Duh@myself for not looking at that information myself first. I guess I was right by asuming I have to send in the ds-230 and the 2 ds-156 forms first.

Anyone????? :(
Em&EdFemaleNetherlands2006-03-15 13:33:00
K-1 Fiance(e) Visa Process & ProceduresPackage 3 questions
This is what the visa instructions are that I got form the consulate

.....First: Complete and return immediatly by mail, to this office the enclosed Form DS-230 I, Biographic Data and fill out, in duplicate, sign, the enclosed forms DS-156, Nonimmmigrant visa application, together with a single copy of the DS 156 K, do not sign fiancee visa application. All questions on form ds-156 must be answered. I your children will apply with you, two copies of form ds-156 for each child must be completed in full. So please send in DS-230 i, 2 x DS-156. This office cannot process your case untill these forms are received.....

Now, I filled out all the forms, so that's not te problem. I'm just a bit confused what to send in first now. Am I correct when I think I have to send in the DS -230 I form and the 2 DS-156 forms first and hang on to the ds 156-k form for now?

Also is it a good thing to send in the above forms first and then later on (no more later than a week form now)the checklist?

Gosh, I really feel like I am about to freak out

K-1 Fiance(e) Visa Process & ProceduresI-134
Maybe this question has been asked before and if so, sorry, but.....are tax returns really necesary for the I-134? I've been reading some topics here where some people say they are and others say they aren's so it's a bit confusing in terms of what to do. Sofar we are getting together letters form bank and employer, bank statements and pay stubs.
Em&EdFemaleNetherlands2006-03-19 15:38:00
K-1 Fiance(e) Visa Process & ProceduresSmall mistake on notarized I134
Well, we're just getting a new I-134 notarized, this time with the correct age on it. Luckily fiance can get it notarized for free at work. I'll be sending the checklist back to the consulate this week and hopefully they will give me an interview date soon.
Em&EdFemaleNetherlands2006-04-17 17:59:00
K-1 Fiance(e) Visa Process & ProceduresSmall mistake on notarized I134
So I got the notarized I134 back, but argh, I spotted a small mistake on it. Although small, lol, fiance put down the wrong age! (dumb dumb dumb) Instead of 32 he put down 33. Now is this going to be a problem and should we just fill out a new I134 or should I take this one to the interview? Fiance says he cannot imagine this being such a problem that it will lead to a visa denial, but me, being stressed out by the whole process as it is is totally not sure about that. So, I just basically would like to know what anyone else would do.....

K-1 Fiance(e) Visa Process & ProceduresJust another question
Maybe this is a bit of a stupid question, but originals of what exactly. My fiancee is on here more than I am, but she is currently on holiday and probably knows exactly what you're talking about, but I would just like to know for myself so I can get the stuff to her in the mail this week.
Em&EdFemaleNetherlands2006-04-18 17:06:00
K-1 Fiance(e) Visa Process & ProceduresJust another question
We're in the final stage of the whole K1 process, my fiancee is currently waiting for an interview date. I was just wondering about something that someone else brought to my attention. We never made copies of our K1 petition. To be honest we, or let's say I never thought of it (I know, not very smart). Now, someone said to me they might ask my fiancee for copies of our petition at her interview? Why, if at all, would they do that if they have the originals right there? I told my fiancee not to be worried about this because I can't possibly imagine me not having made copies would lead to a visa denial, so can anyone tell me if I am right or that my fiancee is indeed right to be stressed out about this?

K-1 Fiance(e) Visa Process & ProceduresU.S. Military member deploying, please help
Keith.

I am Air Force and I am also deploying to Iraq in July. As soon as i got news of the deployment (because it was at the USICS) I called the local congressmans office and spoke with an idividual there and he made some calls and the same day that I spoke with him....My papers was approved within hours. It has been almost 2 months ago and they still haven't made it to my processing date there. Now I am at the NVC, I sent a Expedite Request Letter, A Deployement Verfication Letter from my Unit Deployment Manager, and A copy of my Deployment tasking order from my Command Level. I just got word on friday that my expedite request was approved at the NVC. Of course once it goes to the Embassy, I will need to do the same process again...but it is moving and that is what matters. If you have any questions please just shoot me a message and I can help you out

K-1 Fiance(e) Visa Process & ProceduresChild Support

If you are setup w/garnishments from your paycheck for child support, it's possible that you have a court order thru support enforcement in your state. All u have to do is speak to someone at your local support enforcement office and get a copy of your court order. The person to speak to would be your caseworker. That document would be your proof.

thanks Sweetee I will try this. I appreciate the suggestion. Mike ... I wish you guys the best of luck!

K-1 Fiance(e) Visa Process & ProceduresChild Support
My fiance had her interview today in Rio and everything seemed to go fine except for one thing. They told her we needed a document showing proof that I am paying my child support from a previous marriage. I am not sure what documentation to provide. I have my support set up so that it is automatically deducted from my pay, and it shows this on the pay stub. Does anyone out there know if this would be acceptible proof?

We appreciate anyones comments or suggestions.

Thanks

K-1 Fiance(e) Visa Process & ProceduresChild Support Arrears
My fiance is a citizen of Brazil and she just had her interview at the consulate in Rio. The CO asked for documentation relating to my child support. I am concerned because 6 years ago I was involved in a work related accident and was out of work for 3 years. During this time I accrued arrears in my child support. Aside from this period of time I have never missed a payment prior to the accident or in the 2.5 years I have been working after the accident when I was finally able to obtain work again. I currently am paying back the arrears that has built up and likewise have not missed a payment. I am concerned about any possible problems this arrear may cause. Would this be grounds for denial of the K1 VISA? Thanks,

K-1 Fiance(e) Visa Process & ProceduresWhat address to use?

You were asked for a "statement". You need no address on the statement; simply your words attesting to your intent to marry is adequate but if you must make it a letter of correspondence then "to whom it may concern" is adequate.

I agree. I should have said if they want to address them theyt should be to who they are writing to, the USCIS, and if they do updated letters of intent for the Embassy they should be addressed to the Embassy should they want to address the letters.

The only reason I was including an address is that I was following the FAQ example off here. I think I'll do what you suggest and use multiple copies with the appropriate address on each.

K-1 Fiance(e) Visa Process & ProceduresWhat address to use?
[Chris on Crystal's login]

Thanks for your suggestions! Seems like there's a little confusion as to what's required here though. Looks like even if we write a joint letter we should have two letters of intent, or one if we don't address it at all.

Could this be cleared up in the FAQ section for the future?

Chris.

K-1 Fiance(e) Visa Process & ProceduresTo mention the internet or not to mention?
My fiance and I are filling out our I-129F. Under the box where it ask us to describe the circumstances under which we met, we're having a debate.

Long story short(er): I'd been on an internet forum for a tv show for a few years, he'd joined, we had mutual friends, but hadn't really conversed until one of my friends pointed us toward each other, knowing we'd both be attending a New Year's Party later that year (2002). We talked on the phone once, and chatted online, exchanged PM's a few time before we physically met at said New Year's Party.

I think we should mention meeting online, as I wouldn't want to appear to be hiding something on the first form, but it coming up later in the process. My wording is "We met at a New Year's Party in Edinburgh after having been introduced online and have been travelling to see each other since." He thinks that we shouldn't mention it now, as it might appear we were introduced for the purpose of getting him into this country. His wording is "We met at a New Year's Party in Edinburgh, UK (2002-2003) and have been travelling to see each other regularly ever since."

Any advice on what information is better to give or not give at this stage?

K-1 Fiance(e) Visa Process & Proceduresvisiting girlfriend, problems with customs
My now-fiance came over for the last three months of last year, then we travelled together to the UK for the holidays. When we returned, he was on another three month ticket and got held back in immigration for about an hour.

What was explained to us was basically that the VWP is intended to be used for visiting, not de facto living in the US (as that was what a prolonged period of entry appeared to be). They want you to be out of the US more than you're in it, essentially. They let him in, but said that he would need to be in the UK for a longer period before coming back.

IR-1 / CR-1 Spouse Visa Process & ProceduresApply for a visa while waiting for his visa

We've been waiting for over three months for my husbands immigration visa, we were wondering if we can apply for a visitor/tourist visa so we can see each other while we wait. Does any one know if this is possible and if it is how would we go about doing this considering the U.S. embassy in Cairo has his passport?

thanx for any help :)

Sorry to say because he is trying to get an immigration visa, he doesn't qualify for any other kind of visas at this time.
Perhaps you can go to Egypt to visit with him?
Good luck and I hope you hear something soon!
